R. 9565</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20240912">September 12, 2024</action-date><action-desc><sponsor name-id="J000301">Mr. Johnson of South Dakota</sponsor> (for himself, <cosponsor name-id="M001194">Mr. Moolenaar</cosponsor>, <cosponsor name-id="G000559">Mr. Garamendi</cosponsor>, and <cosponsor name-id="S001196">Ms. Stefanik</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit the Secretary of Transportation from entering into, extending, or renewing a contract with or awarding a grant to an entity that uses or procures light detection and ranging technology from certain foreign entities, and for other purposes.</official-title></form><legis-body id="H5274C4F337DC410E8276DD0F7BE144AC" style="OLC"><section id="H16D192BD2F734268A862A037637EC980" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Securing Infrastructure from Adversaries Act</short-title></quote>.</text></section><section id="H91148CF06A674BD78E1A316DF13A1801" section-type="subsequent-section"><enum>2.</enum><header>Prohibition on operation, procurement, and contracting related to foreign-made LiDAR technology</header><subsection id="H80F902F37B1645E7AE0CC14CFFD09DCC"><enum>(a)</enum><header>Prohibition on agency operation or procurement</header><paragraph id="H0A472ADC89534147BC6AA8AC8042093C"><enum>(1)</enum><header>In general</header><text>The Secretary of Transportation may not—</text><subparagraph id="H2AF7331D60B244F3B8039B372A316FE7"><enum>(A)</enum><text>procure or obtain any LiDAR produced or provided by a covered LiDAR company; or</text></subparagraph><subparagraph id="H72F0C05966034A1EBBD37DA99935A3E0"><enum>(B)</enum><text>enter into a contract or extend or renew a contract with any entity unless such entity certifies to the Secretary that no LiDAR produced or provided by a covered LiDAR company will be used in performance of the contract with the Department of Transportation.</text></subparagraph></paragraph><paragraph id="HBF803C1E5F7140D6881FCAC7D736999D" commented="no"><enum>(2)</enum><header>Waiver</header><text>The Secretary may waive the restriction under paragraph (1) on a case-by-case basis by certifying in writing to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee of Commerce, Science, and Transportation of the Senate not later than 15 days before an activity is carried out for which such a restriction applies that such activity is required in the national interest of the United States.</text></paragraph></subsection><subsection id="H900B18480311483BAE5C65308E068D96"><enum>(b)</enum><header>Prohibition on use of loans or grant funds</header><text display-inline="yes-display-inline">In entering into an agreement with an entity with respect to which the Secretary provides loan or grant funds to such entity, the Secretary shall ensure that no such funds may be obligated or expended to procure, obtain, or use LiDAR produced or provided by a covered LiDAR company.</text></subsection><subsection id="H0B3C0ECA98F64CF1A79CFD6AF83F9168"><enum>(c)</enum><header>Applicability</header><text>This section shall apply to any obligation or expenditure of funds, or contract entered into, on or after June 30, 2026.</text></subsection><subsection id="H9472AF8FEDA84260B02A2DC2A469C902"><enum>(d)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H2BADB6D6068B4EAAABF337A6C87A161A"><enum>(1)</enum><header>Covered foreign country</header><text>The term <term>covered foreign country</term> means the People’s Republic of China, Iran, North Korea, and Russia.</text></paragraph><paragraph id="HA1843E3EAC3B4D1BA76114D5B89F8893"><enum>(2)</enum><header>Covered LiDAR company</header><text display-inline="yes-display-inline">The term <term>covered LiDAR company</term> means any entity, or any subsidiary, affiliate, or licensee of said entity, that produces or provides LiDAR and is included—</text><subparagraph id="H288A0EEAD0484ABD88248F3643911F7C"><enum>(A)</enum><text>on the Consolidated Screening List maintained by the International Trade Administration of the Department of Commerce; or</text></subparagraph><subparagraph id="H3DAA616FFA9048418794A00FEDDCD6A1"><enum>(B)</enum><text>as a Chinese military company pursuant to section 1260h of the William M. (Mac) Thornberry National Defense Authorization Act for Fiscal Year 2021 (<external-xref legal-doc="usc" parsable-cite="usc/10/113">10 U.S.C. 113</external-xref> note).</text></subparagraph></paragraph><paragraph id="H1D36FAC1826748D5B9F75F396B285303"><enum>(3)</enum><header>LiDAR</header><text>The term <term>LiDAR</term> mean a sensor that—</text><subparagraph id="H181976BD47764053A4BA81E397C13CC3"><enum>(A)</enum><text>emits light, including in the form of a pulsed or modulated laser; and</text></subparagraph><subparagraph id="HE623B6B4558243E9923E729C3039912C"><enum>(B)</enum><text>scans or flashes the environment to detect and measure the range of the surroundings of such sensor.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
