R. 9536</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20240911">September 11, 2024</action-date><action-desc><sponsor name-id="C001125">Mr. Carter of Louisiana</sponsor> (for himself and <cosponsor name-id="Y000067">Mr. Yakym</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 23, United States Code, and the Infrastructure Investment and Jobs Act with respect to vehicle roadside accidents, and for other purposes.</official-title></form><legis-body id="H9D3D12AB7B9747E9A76C2EFC64DA2D0B" style="OLC"><section id="H02DB86ACB53B4DB1958DF5BC92F7B2E4" section-type="section-one"><enum>1.</enum><header>Vehicle roadside accidents</header><subsection id="H56F0D71850F34A458FB13260A9F5F956"><enum>(a)</enum><header>Highway safety improvement program</header><text display-inline="yes-display-inline">Section 148(c)(2) of title 23, United States Code, is amended—</text><paragraph id="H9BAC27BCB9BA448F943A0F131B558E5C"><enum>(1)</enum><text>in subparagraph (A)(vi) by striking <quote>and pedestrians,</quote> and inserting <quote>pedestrians, and occupants and pedestrians associated with disabled vehicles</quote>; </text></paragraph><paragraph id="H850E001DB8EB4B44B89349C04653CF65"><enum> (2)</enum><text>in subparagraph (B)(i) by inserting <quote>, and occupants and pedestrians associated with disabled vehicles</quote> after <quote>pedestrians</quote>; and</text></paragraph><paragraph id="HF8ADA9B9007B4D2E830A29F37A8C33EB"><enum>(3)</enum><text display-inline="yes-display-inline">in subparagraph (D)(vi) by striking <quote>and pedestrians</quote> and inserting <quote>pedestrians, and occupants and pedestrians associated with disabled vehicles</quote>. </text></paragraph></subsection><subsection id="H1260535B0A45421EBA730478EC3148BB"><enum>(b)</enum><header>National priority safety programs</header><text>Section 405 of title 23, United States Code, is amended by adding at the end the following: </text><quoted-block style="USC" id="HF3C3381D938E49AB8E9934DA8FC92B05" display-inline="no-display-inline"><subsection id="H1D00A66167C34BCF9CDA47A3AC6929AF"><enum>(i)</enum><header>Collection of data</header><paragraph id="HB8304F1ACFB4451EBBBD8DC158493AAB"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Transportation, in conjunction with the Occupational Safety and Health Administration and other relevant agencies, shall convene a working group of industry and nongovernment entities, including representatives of high-risk diverse communities, such as groups advocating for historically marginalized groups, high traffic risk professions, such as truckers and first responders, and other relevant stakeholders, including state and local highway safety experts, insurers, medical and public health experts, law enforcement and other first responders, and technology and automobile manufacturers.”</text></paragraph><paragraph id="H78FA9A6EC6584478BB86FE7F4821BA30"><enum>(2)</enum><header>Duties</header><text>The working group convened under paragraph (1) shall collect, analyze, compile, and publish accurate, detailed data on Disabled Roadside Vehicle Crashes, along with strategic plan to identify and implement solutions to the fatal and non-fatal injury crashes, adoption of better data sharing with the National Highway Traffic Safety Administration, including local adoption of the Model Minimum Uniform Crash Criteria, and annual updates on awareness and intervention activities and results.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H99B625722B594C3DB3CEE4540C9DE228"><enum>(c)</enum><header>Injury health data</header><text>Section 24108(c)(2) of the Infrastructure Investment and Jobs Act (<external-xref legal-doc="public-law" parsable-cite="pl/117/58">Public Law 117–58</external-xref>) is amended by inserting <quote>, including roadside deaths,</quote> after <quote>fatalities</quote>. </text></subsection><subsection id="H64490C6A68B1424FB3150EF50C818F78"><enum>(d)</enum><header>Review of move over or slow down law public awareness</header><text display-inline="yes-display-inline">Section 24109(a) of the Infrastructure Investment and Jobs Act (<external-xref legal-doc="public-law" parsable-cite="pl/117/58">Public Law 117–58</external-xref>) is amended by inserting <quote>or motorist or disabled vehicle</quote> after <quote>authorized emergency vehicle</quote>.</text></subsection></section></legis-body></bill>
