<section id="H796F800C2C454EBDB99FBA7DDE1A0338" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No Amnesty for Hamas Sympathizers Act</short-title></quote>.</text> </section> <section id="H11C973FB12AC433D98873143F1A2A52F"><enum>2.</enum><header>Nullifying deferred enforced departure for certain palestinians</header> <subsection id="HD84B9B955CAC4E029EB6EE4BCBBA49FC"><enum>(a)</enum><header>In general</header><text>The memorandum issued by the President on February 14, 2024, entitled <quote>Deferred Enforced Departure for Certain Palestinians</quote> (89 Fed. Reg. 12743) and the notice issued by the Secretary of Homeland Security on April, 15, 2024, entitled <quote>Implementation of Employment Authorization for Individuals Covered by Deferred Enforced Departure for Certain Palestinians</quote> (89 Fed. Reg. 26167), shall have no force or effect.</text></subsection> 
<subsection id="H0B109BCC44FA44BF84C1F446CC390773"><enum>(b)</enum><header>Prohibition</header><text display-inline="yes-display-inline">None of the funds made available by any Act may be made available to provide deferred enforced departure to an alien who habitually resided in the Palestinian-administered territory within Judea and Samaria or Gaza, or who holds a passport or other travel document issued by the Palestinian Authority.</text></subsection></section> <section id="H99DA5A5BA2924112A7F75A37A52626C1"><enum>3.</enum><header>Prohibition on temporary protected status for individuals who habitually resided in palestinian-administered territories</header><text display-inline="no-display-inline">Section 244(c)(2)(B) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1254">8 U.S.C. 1254(c)(2)(B)</external-xref>) is amended—</text> 
<paragraph id="HF262305480AE4069B8F97C34765A09C5"><enum>(1)</enum><text>in clause (i), by striking <quote>or</quote> at the end;</text></paragraph> <paragraph id="H27C2F5FC13B34D3BA8375B0F142D8CC9"><enum>(2)</enum><text>in clause (ii), by striking the period at the end and inserting <quote>, or</quote>; and </text></paragraph> 
<paragraph id="HEA782831738344D5BBFB71DB17A77116"><enum>(3)</enum><text>by adding at the end the following:</text> <quoted-block id="H7E001A7DE7274A42BFF73762A6C4522F" style="OLC"> <clause id="H03F1651113E2442EB9FE5DFD576AC6C3"><enum>(iii)</enum><text>the alien—</text> 
<subclause id="H5B5F500C5BFB4688B27368F72340501C"><enum>(I)</enum><text display-inline="yes-display-inline">habitually resided in the Palestinian-administered territory within Judea and Samaria or Gaza; or</text></subclause> <subclause id="H2B418B4588AA4F36909A804781C9718A"><enum>(II)</enum><text>holds a passport or other travel document issued by the Palestinian Authority.</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="HDE0174D46214441CAD447164447351C2"><enum>4.</enum><header>Inadmissibility and deportability of individuals who habitually resided in palestinian-administered territories</header> 
<subsection id="HE7BEFCBD1D2A42D2A9E8B91C31D93739"><enum>(a)</enum><header>Inadmissibility</header><text>Section 212(a)(3) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(3)</external-xref>) is amended by adding at the end the following:</text> <quoted-block id="HBCFF735CABD74F588688D947BBD6C39B" style="OLC"> <subparagraph id="H15208286A8D54849A8E507B6AC780748"><enum>(H)</enum><header>Palestinian-administered territory</header><text display-inline="yes-display-inline">Any alien who habitually resided in the Palestinian-administered territory within Judea and Samaria or Gaza, or who holds a passport or other travel document issued by the Palestinian Authority, is inadmissible.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HD3D8D782679B4AEAA6997A11C3852FAD"><enum>(b)</enum><header>Deportability</header><text>Section 237(a)(4) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1227">8 U.S.C. 1227(a)(4)</external-xref>) is amended by adding at the end the following:</text> <quoted-block id="HA70ADE5B03DF49349DCC39B057F3F61A" style="OLC"> <subparagraph id="H390C6DD7257B481E88973FE81AA51A91"><enum>(G)</enum><header>Palestinian-administered territory</header><text display-inline="yes-display-inline">Any alien who habitually resided in the Palestinian-administered territory within Judea and Samaria or Gaza, or who holds a passport or other travel document issued by the Palestinian Authority, is deportable.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="H1086DAC5D5964B0A970CA2399F1B90CB"><enum>5.</enum><header>Limitation on parole for individuals who habitually resided in palestinian-administered territories</header><text display-inline="no-display-inline">Section 212(d)(5) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(d)(5)</external-xref>) is amended by—</text> <paragraph id="H3B698E13AD1E4283A3BAE0D662AAC93A"><enum>(1)</enum><text>striking <quote>subparagraph (B)</quote> and inserting <quote>subparagraphs (B) or (C)</quote>; and</text></paragraph> 
<paragraph id="H3686864653DE4C949241B59D59B8C669"><enum>(2)</enum><text>inserting the following new subparagraph:</text> <quoted-block id="H59DAEAF978AA40EDAFD1CEDBD2C7B38F" style="OLC"> <subparagraph id="H85E849C3B3B74D669FF587D3FB20F9C3"><enum>(C)</enum><text display-inline="yes-display-inline">The Secretary of Homeland Security may not parole into the United States an alien who habitually resided in the Palestinian-administered territory within Judea and Samaria or Gaza, or who holds a passport or other travel document issued by the Palestinian Authority.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H863D88B593904D4DB8A666E991CF299A"><enum>6.</enum><header>Prohibition on asylum status for individuals who habitually resided in palestinian-administered territories</header><text display-inline="no-display-inline">Section 208(b)(2)(A) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1158">8 U.S.C. 1158(b)(2)(A)</external-xref>) is amended by—</text> <paragraph id="HD8213182ED144486998E85831E570D36"><enum>(1)</enum><text>in clause (v), by striking <quote>or</quote> at the end;</text></paragraph> 
<paragraph id="H05654E01CD814F318328815962D91545"><enum>(2)</enum><text>in clause (vi), by striking the period at the end and insert <quote>; or</quote>; and </text></paragraph> <paragraph id="H6A4091F46365425387999D7A2626819D"><enum>(3)</enum><text>inserting the following new clause:</text>

<clause id="H1867046D24AD4A2BB75CD56561886B03"><enum>(vii)</enum><text display-inline="yes-display-inline">the alien habitually resided in the Palestinian-administered territory within Judea and Samaria or Gaza, or who holds a passport or other travel document issued by the Palestinian Authority.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> <section id="H896384BF90214231BD2D79B32AD6704C"><enum>7.</enum><header>Prohibition on refugee status for individuals who habitually resided in palestinian-administered territories</header> <text display-inline="no-display-inline">Section 207 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1157">8 U.S.C. 1157</external-xref>) is amended by adding at the end the following:</text>

<subsection id="H4326DBC620BF45C299462D8FF5814722"><enum>(g)</enum> 
<paragraph id="HFE3D10FB00F841B9AA23FCADF4E0ED6C" display-inline="yes-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">An alien who habitually resided in the Palestinian-administered territory within Judea and Samaria or Gaza, or who holds a passport or other travel document issued by the Palestinian Authority, shall be ineligible for admission as a refugee and shall be ordered removed.</text></paragraph> <paragraph id="HB45E9132EAA44F7989AADC1703BEA4DA" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">In the case of an alien, who habitually resided in the Palestinian-administered territory within Judea and Samaria or Gaza, or who holds a passport or other travel document issued by the Palestinian Authority whose status is adjusted to that of an alien lawfully admitted for permanent residence and who commits a crime of violence (as such term is defined in section 16(a) of title 18, United States Code), such status shall be rescinded.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section>
