which was referred to the <committee-name committee-id="HHA00">Committee on House Administration</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Federal Election Campaign Act of 1971 to require the disclosure of the card verification value as a condition of the acceptance of online contributions made through the use of credit or debit cards in elections for Federal office and to prohibit the acceptance of contributions made through the use of gift cards and prepaid credit cards in such elections, and for other purposes.</official-title></form><legis-body id="H44B3F76B1E304253991898CC9D353DB1" style="OLC"><section id="H6D215D28B2F1429F9286D9C9D92B37F8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Secure Handling of Internet Electronic Donations Act</short-title></quote> or the <quote><short-title>SHIELD Act</short-title></quote>. </text></section><section id="HF5426F632327440CB7F247C3E28FC132" section-type="subsequent-section"><enum>2.</enum><header>Requiring disclosure of card verification value as condition of acceptance of online contributions made using credit or debit cards in Federal elections</header><subsection id="H2D02D15F319648B1A30E633B762912FB"><enum>(a)</enum><header>Requirement</header><text display-inline="yes-display-inline">Section 302 of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/52/30102">52 U.S.C. 30102</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H5A18B52A762B49ABB66854D30F9AD6B2" style="OLC"><subsection id="H5619DCEEF2D5444796563F3C7B0FD935"><enum>(j)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HB39503A250B545F2819D178052CFFEB3"><enum>(1)</enum><text>No political committee shall accept any Internet credit or debit card contribution unless—</text><subparagraph id="HB0AE3FF8F92546CEBAC00BD0AA49747E" indent="up1"><enum>(A)</enum><text>the individual or entity making such contribution is required, at the time such individual makes such contribution, to disclose the card verification value of such credit or debit card<italic></italic>; and</text></subparagraph><subparagraph id="HFC99ADC7DEA74908A22265D65DC1E345" indent="up1"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="HA473618FAB454A21999FB32E43DB9B16"><enum>(i)</enum><text>the billing address associated with such credit or debit card is located in the United States; or</text></clause><clause id="HB6D70901E3D04875B1E78B1C3B3E0F52" indent="up1"><enum>(ii)</enum><text>in the case of a contribution made by an individual who is a United States national or lawful permanent resident living outside of the United States, the individual provides the committee with—</text><subclause id="H0F64C711EEB144329D2D5D338093C854"><enum>(I)</enum><text>the United States mailing address the individual uses for voter registration purposes;</text></subclause><subclause id="H1AFA1685EEE94FF8973E625D7F88F6A0"><enum>(II)</enum><text display-inline="yes-display-inline">a copy of the individual’s United States passport;</text></subclause><subclause id="H70B6262920A64C02BEFD4CC156B99B74"><enum>(III)</enum><text display-inline="yes-display-inline">a copy of the individual’s permanent resident card; or</text></subclause><subclause id="H11299DCD5A994A66A57F44E19282A2D2"><enum>(IV)</enum><text display-inline="yes-display-inline">a copy of a comparable acceptable identification document, or the unique identifying number from such a document, for the individual.</text></subclause></clause></subparagraph></paragraph><paragraph id="H4E8FDE481B8B468BB919E32D87807265" indent="up1"><enum>(2)</enum><text>Notwithstanding subsection (b) or (c), in the case of an Internet credit or debit card contribution—</text><subparagraph id="HED6D8F4ECE9B4E7AAA4960AA49D663AB"><enum>(A)</enum><text display-inline="yes-display-inline"><italic></italic>no later than 10 days after receiving the contribution, the person who receives the contribution shall forward to the treasurer such contribution, the name and address of the person making the contribution, and the date of receipt; and</text></subparagraph><subparagraph id="H6FCD8A8CD9DB44D9ADC0331BF850EDD0"><enum>(B)</enum><text display-inline="yes-display-inline">the treasurer of a political committee shall keep an account of the name and address of any person making any such contribution, together with the date and amount of such contribution by any person.</text></subparagraph></paragraph><paragraph id="H3C1126EA657C4088B90545811E958A19" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">In this subsection, the term <term>Internet credit or debit card contribution</term> means a contribution that—</text><subparagraph id="H2544D77A93BD474BA722241F77998918"><enum>(A)</enum><text>is made using a credit or debit card; and</text></subparagraph><subparagraph id="HB3CCCE1952EB4F519977B2BC84E95B3E"><enum>(B)</enum><text>is received through an Internet website.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H1533FF8D22A54644809F1654B5FBBEAD"><enum>(b)</enum><header>Regulations</header><paragraph id="HDAF2779887E54849A9F4C730FE8B232A"><enum>(1)</enum><header>Deadline</header><text>Not later than 10 days after the date of the enactment of this Act, the Federal Election Commission shall promulgate regulations to carry out the amendments made by subsection (a).</text></paragraph><paragraph id="HF8A33C0EECDD452DA7685B02D55ADF35"><enum>(2)</enum><header>Consultation with credit card payment networks</header><text display-inline="yes-display-inline">In promulgating regulations under paragraph (1), the Commission shall consult with representatives of payment card networks, as defined under section 921(c) of the Electronic Fund Transfer Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1693o-2">15 U.S.C. 1693o–2(c)</external-xref>).</text></paragraph></subsection><subsection id="H8B4D729DAD1E443A8CE452691B4B681C"><enum>(c)</enum><header>Effective Date</header><text>The amendment made by subsection (a) shall apply with respect to contributions made after the expiration of the 180-day period which begins on the date of the enactment of this Act.</text></subsection></section><section id="H2CC459EBE41D4F20B56C7BF6F6709858"><enum>3.</enum><header>Prohibiting acceptance of contributions made using gift cards and prepaid credit cards in Federal elections</header><subsection id="HBEC699332605405B8CDFB5F02A9D7212"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">Section 302 of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/52/30102">52 U.S.C. 30102</external-xref>), as amended by section 2(a), is amended by adding at the end the following:</text><quoted-block style="traditional" id="H06617B2E36FF4F05B4BA0F4218718E35" display-inline="no-display-inline"><subsection id="HEB28EC4B4A8345DA92B620E987FDBFFD"><enum>(k)</enum><text display-inline="yes-display-inline">No political committee shall accept a contribution made through the use of a general-use prepaid card, gift certificate, or store gift card, as such terms are defined, respectively, under section 915(a) of the Electronic Fund Transfer Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1693l-1">15 U.S.C. 1693l–1(a)</external-xref>).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H4F1A9FE5116848A7B12A111B77353306"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendment made by subsection (a) shall apply with respect to contributions made after the expiration of the 180-day period which begins on the date of the enactment of this Act.</text></subsection></section><section id="H0BD18AFFFAF74B5088E110A90C637D61" display-inline="no-display-inline" section-type="subsequent-section"><enum>4.</enum><header>Prohibiting aiding or abetting making of contribution in the name of another</header><text display-inline="no-display-inline">Section 320 of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/52/30122">52 U.S.C. 30122</external-xref>) is amended by adding at the end the following new sentence: <quote>No person shall knowingly direct, help, or assist any person in making a contribution in the name of another person.</quote>.</text></section></legis-body></bill>
