R. 9464</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20240906">September 6, 2024</action-date><action-desc><sponsor name-id="A000148">Mr. Auchincloss</sponsor> (for himself, <cosponsor name-id="M001221">Mr. Molinaro</cosponsor>, <cosponsor name-id="B000574">Mr. Blumenauer</cosponsor>, and <cosponsor name-id="M000312">Mr. McGovern</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Internal Revenue Code of 1986 to allow employers to deduct certain transportation fringe benefits.</official-title></form><legis-body id="H3967590846B1490E8A5C2C411957A3BE" style="OLC"><section id="H38A0DBD55F8D4725A85864E82D8F6A1B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Supporting Transit Commutes Act</short-title></quote>. </text></section><section id="H360F20664E5245E7BB0A9A8596D312CE"><enum>2.</enum><header>Deduction allowed for certain transportation fringe benefits provided by employers</header><subsection id="H5F83E18A6DB84A0BAF37AFCAFE7CC52D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/274">Section 274(l)</external-xref> of the Internal Revenue Code of 1986 is amended by redesignating paragraph (2) as paragraph (3) and inserting after paragraph (1) the following new paragraph:</text><quoted-block style="OLC" id="H28810BFB3E034DEF971E42F6E6E5F998" display-inline="no-display-inline"><paragraph id="H63277175C5BD43789AD84CB5B86B2358"><enum>(2)</enum><header>Exception for certain transportation fringe benefits</header><subparagraph id="HACDFC63100B34D7D9D634096C03DB5E6"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Paragraph (1) shall not apply to so much of any qualified transportation fringe described in subparagraph (A) or (B) of section 132(f)(1) as does not exceed the limitation described in section 132(f)(2)(A).</text></subparagraph><subparagraph id="H8121F98780DB4FA6B8994E326A0ABB2B"><enum>(B)</enum><header>Reduced deduction in case of benefits provided under salary reduction agreements</header><text>In the case of any qualified transportation fringe with respect to which the employee may elect between receiving such fringe and receiving an amount directly in cash, subparagraph (A) shall be applied by substituting <quote>50 percent of so much</quote> for <quote>so much</quote>. </text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H88B6E9BD8AF647F692F43EA47B321D25"><enum>(b)</enum><header>Conforming amendment</header><text>Section 274(l)(3) of such Code, as redesignated by subsection (a), is amended—</text><paragraph id="H0013284532C44C92B38AD750450899CD"><enum>(1)</enum><text>by striking <quote>this subsection</quote> and inserting <quote>paragraph (1)</quote>, and</text></paragraph><paragraph id="H1A896E72B1674090935C0B02C0ACE7C9"><enum>(2)</enum><text>by inserting <quote><header-in-text level="paragraph" style="OLC">for qualified bicycle commuting reimbursement</header-in-text></quote> after <quote><header-in-text level="paragraph" style="OLC">Exception</header-in-text></quote> in the heading thereof.</text></paragraph></subsection><subsection id="HD474DC989A984443A3374C13324F3F47"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to amounts paid or incurred after the date of the enactment of this Act, in taxable years ending after such date.</text></subsection></section></legis-body></bill>
