which was referred to the <committee-name committee-id="HVR00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of Veterans Affairs to carry out a pilot program to provide grants to outpatient mental health facilities for the provision of culturally competent, evidence-based mental health care for veterans, and for other purposes.</official-title></form><legis-body id="HFCA601F5AF0F4B32B851E5EA89684872" style="OLC"><section id="H8EE2F80531814F98933C775FD709CD16" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Veterans’ Mental Health Access Act</short-title></quote>. </text></section><section id="HEAF0BFB900174D56B7E35EAA44A62D50"><enum>2.</enum><header>Department of Veterans Affairs pilot program to provide grants to medical facilities for the provision of culturally competent, evidence-based mental health care for veterans</header><subsection id="H43A4C464F1194056A7B23CB5CDE6310C"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary of Veterans Affairs shall carry out a three-year pilot program under which the Secretary shall make grants to eligible mental health care providers for the provision of culturally competent, evidence-based mental health care for veterans.</text></subsection><subsection id="H2B4AD8C10E844EB695D4FFE6183B42DC"><enum>(b)</enum><header>Eligibility</header><text>To be eligible to receive a grant under the pilot program, a mental health care provider shall—</text><paragraph id="H8D7D5B03B04C4E8783D10797FB341E4A"><enum>(1)</enum><text display-inline="yes-display-inline">be a non-profit organization;</text></paragraph><paragraph id="H1FE3BC4C9D8B49EDB2470C020001A5F5"><enum>(2)</enum><text display-inline="yes-display-inline">have operated at least one outpatient mental health facility in the United States for a continuous period of at least three years; and</text></paragraph><paragraph id="H3FB32E9DCB5D41978BC037983445AA6B"><enum>(3)</enum><text>submit to the Secretary an application that includes such information and assurances as the Secretary may require, including—</text><subparagraph id="HB4D570CFB6A84776AF0D013569E72B92"><enum>(A)</enum><text>an identification of the outpatient facility or facilities where the provider will provide mental health care to veterans using the grant funds;</text></subparagraph><subparagraph id="H9742773154904314BD85FC5C8DF53440"><enum>(B)</enum><text>a plan under which at least one clinician employed by the provider at each facility for which a grant is made is trained to provide culturally competent veterans mental health care pursuant to the requirements established by the Secretary under subsection (f); and</text></subparagraph><subparagraph id="HF49B7AFFAB5C47AA8B70D6649A061FBB"><enum>(C)</enum><text display-inline="yes-display-inline">an identification of the percentage of the operating budget for each such facility that was provided through Federal grants during the fiscal year preceding the year during which the application is submitted.</text></subparagraph></paragraph></subsection><subsection id="H8958DD8F46B54208ABE19A4CA216879D"><enum>(c)</enum><header>Use of funds</header><paragraph id="H8F9CF9F65F6C4746B5F3D322005C3DE2"><enum>(1)</enum><header>In general</header><text>The recipient of a grant under the pilot program shall use the grant—</text><subparagraph id="H331A8D07980A4BD095999AA916081FDD"><enum>(A)</enum><text>to provide culturally competent, evidence-based mental health care for veterans;</text></subparagraph><subparagraph id="H0388EA776F364CEC97C7207A9A841BBF"><enum>(B)</enum><text display-inline="yes-display-inline">to operate an existing outpatient mental health facility or establish a new outpatient mental health facility for the purpose of providing such care; and</text></subparagraph><subparagraph id="H88F054B541FD42FBB9F56FA557F7C165"><enum>(C)</enum><text>to encourage veterans who are eligible for enrollment in the patient enrollment system under section 1705 of title 38, United States Code, to enroll in such system and to receive medical services furnished by the Department of Veterans Affairs.</text></subparagraph></paragraph><paragraph id="H11BD5C9CF1F445EE92645AD494A2D3CC"><enum>(2)</enum><header>Limitations</header><text display-inline="yes-display-inline">The recipient of a grant under the pilot program may not—</text><subparagraph id="HB7CDC22FEAAE49CE87ECEA44F651761E"><enum>(A)</enum><text>charge any veteran a fee associated with the receipt of mental health care; or</text></subparagraph><subparagraph id="HB82E64588DAD444F9FFF9CA2A7911717"><enum>(B)</enum><text>refuse to provide mental health care to any veteran on the basis that the veteran is not eligible for reimbursement for such care under a health plan contract or any Federal, State, or local government program.</text></subparagraph></paragraph><paragraph id="H66197B0727574EC4B3B06F87775C0887"><enum>(3)</enum><header>Reimbursement</header><text display-inline="yes-display-inline">Nothing in this subsection shall prevent the recipient of a grant under the pilot program from seeking or receiving reimbursement for all, or a portion, of the mental health care provided to a veteran, including reimbursement under a health plan contract, the Community Care Program of the Department under section 1703 of title 38, United States Care, or any other Federal, State, or local government program.</text></paragraph></subsection><subsection id="H7E5D95822A7143149DF19A7E2FEC5979"><enum>(d)</enum><header>Selection of facilities</header><text display-inline="yes-display-inline">In selecting outpatient mental health facilities for the receipt of grants under the pilot program, the Secretary—</text><paragraph id="H4C0CC4407C044CEC83607966ABE861D8"><enum>(1)</enum><text display-inline="yes-display-inline">shall ensure that grants are distributed evenly among outpatient mental health facilities located in rural and urban areas;</text></paragraph><paragraph id="H600C2CF5FA5C48FC86393EB0E9CEF82F"><enum>(2)</enum><text display-inline="yes-display-inline">may consider the proportion of veterans historically served by the outpatient mental health facilities; and</text></paragraph><paragraph id="H8DC3433A397246CAAB73F041A99CB040"><enum>(3)</enum><text display-inline="yes-display-inline">may prioritize outpatient mental health facilities located in areas that the Secretary determines—</text><subparagraph id="H87800492A2494BCBBB777D05756586AE"><enum>(A)</enum><text>are medically underserved;</text></subparagraph><subparagraph id="H97D797A5BE124E338B3B9A5180BB865C"><enum>(B)</enum><text>have large veteran populations;</text></subparagraph><subparagraph id="HB22994DE9C30434FB6C80C0A418897A8"><enum>(C)</enum><text>are located near military installations; or</text></subparagraph><subparagraph id="H7CEBC2D08A1A4B918F87A36BCCF25D9F"><enum>(D)</enum><text>have large numbers of veterans at high risk of suicide.</text></subparagraph></paragraph></subsection><subsection id="H70074EE93EF1496DA0ECE5C4FDF64542"><enum>(e)</enum><header>Amount of grant</header><paragraph id="H6E3FD6748A3144989E6B3DE36E2A3036"><enum>(1)</enum><header>In general</header><subparagraph id="H0247914374F54A359E8762B71F949180"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), no grant under the pilot program for a facility for any fiscal year may exceed $1,500,000.</text></subparagraph><subparagraph id="HF251C206FCE646A0836030EFDD85ABA0"><enum>(B)</enum><header>Limitation</header><text display-inline="yes-display-inline">In the case of an outpatient mental health facility for which at least 50 percent of the operating budget of the facility for the preceding fiscal year was provided through Federal grants, no grant under the pilot program for the facility for any fiscal year may exceed the lesser of—</text><clause id="H11794F037E4A4A85BE3ECDCBA929757F"><enum>(i)</enum><text>50 percent of the operating budget of the facility; or</text></clause><clause id="H623C3F1B856A48A68E5C768008322B4E"><enum>(ii)</enum><text>$1,500,000.</text></clause></subparagraph></paragraph><paragraph id="H7F592564B4DE4523BEE2AF7BA0343128"><enum>(2)</enum><header>Multiple grants</header><text>The recipient of a grant under the pilot program—</text><subparagraph id="HCB09156057B04099A07A3FABC6C1B1F3"><enum>(A)</enum><text>may apply for, and receive, grants for more than one facility of the recipient for any fiscal year; and</text></subparagraph><subparagraph id="H6A9B06619965459A858E4446A2CCF411"><enum>(B)</enum><text>may apply for, and receive, a grant for a facility that has already received a grant under the pilot program.</text></subparagraph></paragraph></subsection><subsection id="HB88D901686D141DF9173BD6B145E0514"><enum>(f)</enum><header>Training requirement</header><text>The Secretary shall establish the requirements for the training referred to in subsection (b)(2)(A).</text></subsection><subsection id="HC5DB17BC161142B68DDB037BC6773027"><enum>(g)</enum><header>Regulations</header><text display-inline="yes-display-inline">The Secretary shall prescribe regulations to carry out this section, which shall include a requirement that each recipient of a grant under the pilot program shall—</text><paragraph id="H0E7B6E7F94E2468E92298C8EDBE390EA"><enum>(1)</enum><text>demonstrate the capacity to provide accountability;</text></paragraph><paragraph id="H953395F92EE1478280D5534A7E9788DA"><enum>(2)</enum><text>demonstrate clinical outcomes; and</text></paragraph><paragraph id="HF8F204CC47B740D9A99AD661968B4EAB"><enum>(3)</enum><text>justify the effective use of any private investment funds or Federal grant funds through data collection and reporting metrics.</text></paragraph></subsection><subsection id="HA501EB0C144549759BCA8EFF05ECBFC6"><enum>(h)</enum><header>Report</header><text>Not later than 180 days after the completion of the pilot program under this section, the Secretary shall submit to Congress a report on the pilot program that includes the following:</text><paragraph id="H64035CD9C70C4C509F7D3737E04031E1"><enum>(1)</enum><text display-inline="yes-display-inline">The number of veterans who received mental health care under the program.</text></paragraph><paragraph id="H6D5ED718479F4ED194095E621D7307BC"><enum>(2)</enum><text>The demographics of the veterans served.</text></paragraph><paragraph id="H2EE2CDEB8B5F4E57A147F131CAA7A58D"><enum>(3)</enum><text>An identification of the types of mental health care provided and the time period for which such care was provided.</text></paragraph><paragraph id="HC0ED9720A2CA4CA8A397E6427D24CBC8"><enum>(4)</enum><text>An identification of program outcomes.</text></paragraph><paragraph id="H928E926689414C08BC01524018FDD68D"><enum>(5)</enum><text>The number of veterans who received mental health care under the program and subsequently enrolled in the patient enrollment system under section 1705 of title 38, United States Code.</text></paragraph><paragraph id="H959DDFDB29114793923016F4EDAAA48A"><enum>(6)</enum><text>An identification of any obstacles faced by grant recipients in providing mental health care under the program.</text></paragraph></subsection><subsection id="HF94A67DA105F42EFAEA2976285F41EA6"><enum>(i)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary to carry out the pilot program under this section $20,000,000 for each of fiscal years 2025 through 2027.</text></subsection></section></legis-body></bill>
