<section id="H5AA96E8894E14E37A6850198331664B7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Political Accountability and Transparency Act</short-title></quote>.</text></section> <section id="H0B9428C0E3984C64929CBD3ABA164C34"><enum>2.</enum><header>Applying personal use restrictions to leadership PACs and other political committees</header> <subsection id="H4E1C31D09369425B9C847F9C3E6B7DB0"><enum>(a)</enum><header>Applying restrictions</header><text display-inline="yes-display-inline">Section 313(b) of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/52/30114">52 U.S.C. 30114(b)</external-xref>) is amended—</text> 
<paragraph id="H9701AA7EBF63498D9FD63972CDD4A49E"><enum>(1)</enum><text>in paragraph (1), by inserting <quote>or a receipt of any other political committee</quote> after <quote>subsection (a)</quote>;</text></paragraph> <paragraph id="H5E761CB0B1B34B4C9D6745140894CB87"><enum>(2)</enum><text>in paragraph (2), by striking <quote>contribution or donation</quote> and inserting <quote>contribution, donation, or receipt</quote>; and</text></paragraph> 
<paragraph id="H05E576CD8D8848D9AC735EB76391EFAD"><enum>(3)</enum><text>in paragraph (2), by striking <quote>campaign or individual’s duties as a holder of Federal office</quote> and inserting <quote>campaign, the individual’s duties as a holder of Federal office, or the political committee’s political activities.</quote>.</text></paragraph></subsection> <subsection id="H23018240B0524F0786457AEE038D2632"><enum>(b)</enum><header>Effective date</header><text>The amendments made by this section shall apply with respect to contributions and donations received on or after the date of the enactment of this Act.</text></subsection></section> 
<section id="H5956609FB43A459783F24AB30CA8CE82"><enum>3.</enum><header>Clarification of treatment of coordinated expenditures as contributions</header> 
<subsection id="H5DAD5D512A414409A9C131F94F6C796A"><enum>(a)</enum><header>Treatment as contribution</header><text display-inline="yes-display-inline">Section 301(8)(A) of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/52/30101">52 U.S.C. 30101(8)(A)</external-xref>) is amended—</text> <paragraph id="H08E332708659464F88295E93D3DA03E5"><enum>(1)</enum><text>by striking <quote>or</quote> at the end of clause (i);</text></paragraph> 
<paragraph id="HE47D496D298B4F059A43CB2A70BFD7FF"><enum>(2)</enum><text>by striking the period at the end of clause (ii) and inserting <quote>; or</quote>; and</text></paragraph> <paragraph id="HBD7DFF20AA83417B883C24B79EC9A298"><enum>(3)</enum><text>by adding at the end the following new clause:</text>

<clause id="H90FC170AA537494B89DE007F22D44277" indent="up1"><enum>(iii)</enum><text>any payment made by any person for a coordinated expenditure (as such term is defined in section 324) which is not otherwise treated as a contribution under clause (i) or clause (ii).</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H6F2D485177414284947980F9DAC4270C"><enum>(b)</enum><header>Definitions</header><text>Section 324 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/52/30126">52 U.S.C. 30126</external-xref>) is amended to read as follows:</text>

<section id="H10554A620A2A47CA9634E504D6ABE50D"><enum>324.</enum><header>Payments for coordinated expenditures</header> 
<subsection id="H2A04F78B0EA04797AE1CDD3470C91A33"><enum>(a)</enum><header>Coordinated expenditures</header> 
<paragraph id="HAB91118096B44D5B82EAEC8FDA5B7A6E"><enum>(1)</enum><header>In general</header><text>For purposes of section 301(8)(A)(iii), the term <term>coordinated expenditure</term> means, with respect to a candidate, authorized committee, or political party—</text> <subparagraph id="HBEF74DB039F84503A357886856BADB38"><enum>(A)</enum><text display-inline="yes-display-inline">any payment for any communication which republishes, disseminates, or distributes, in whole or in substantial part, any video, audio, written, graphic, or other form of campaign material created or prepared by the candidate, an authorized committee of a candidate, or a committee of a political party, but does not include—</text> 
<clause id="H7D1DC36FC9094232829729A563910DE4"><enum>(i)</enum><text>any payment made by the candidate, the authorized committee, or the political party which created or prepared the material involved; or</text></clause> <clause id="HCEDDBD1172F340A6B27A0A088321FF3F"><enum>(ii)</enum><text>any payment for the republication, dissemination, or distribution of the material involved for purposes of opposing the candidate, authorized committee, or political party which created or prepared the material involved; or</text></clause></subparagraph> 
<subparagraph id="HDF7EE13073864DA09E1F81FC35538118"><enum>(B)</enum><text>any payment for a covered expenditure described in subsection (c) which is made in cooperation, consultation, or concert with, or at the request or suggestion of, a candidate, an authorized committee of a candidate, or a political committee of a political party, as defined in subsection (b).</text></subparagraph></paragraph> <paragraph id="H509451A9DA764213B0445A16BCFF16B3"><enum>(2)</enum><header>Clarification of individuals treated as candidates</header><text>For purposes of this section, an individual shall be treated as a candidate if the individual is a candidate at the time of a coordinated expenditure, without regard to whether the individual was a candidate at the time the coordination occurred, as described in subsection (b).</text></paragraph> 
<paragraph id="H9900B57E8C4A41D2AD54C4A690E281D7"><enum>(3)</enum><header>Treatment of employees, independent contractors, and agents</header><text>For purposes of this section, any reference to a candidate, committee, officeholder, or political party includes—</text> <subparagraph id="HF4DFE8CD91F94D2A978B32033F74CF15"><enum>(A)</enum><text display-inline="yes-display-inline">an employee or independent contractor of the candidate, committee, officeholder, or party, if such employee or contractor has executive or managerial authority (or acts under the direction or control of an employee or contractor who has such executive or managerial authority) for the candidate, committee, officeholder, or political party at any time during the election cycle in which the expenditure is made (in the case of a candidate or committee for an election for the office of President) or during the 2-year period ending on the date the expenditure is made (in the case of a candidate or committee for an election for any other Federal office or any political party); or</text></subparagraph> 
<subparagraph id="H00BC9B60BD2242489B4D41603A0F852B"><enum>(B)</enum><text display-inline="yes-display-inline">an agent (including an authorized fundraiser), whether paid or unpaid, of the candidate, committee, officeholder, or party at any time during the election cycle in which the expenditure is made (in the case of a candidate or committee for an election for the office of President) or during the 2-year period ending on the date the expenditure is made (in the case of a candidate or committee for an election for any other Federal office or any political party), without regard to whether the individual was such an agent at the time any of the coordination described in subsection (b) occurred.</text></subparagraph></paragraph> <paragraph id="H7B262B27072447A88F9160810BF4E0C3"><enum>(4)</enum><header>Exceptions</header><text>A payment shall not be treated as a coordinated expenditure under this section if—</text> 
<subparagraph id="H6358D63CBE0D4536AF9042F1AA95EFAF"><enum>(A)</enum><text>the payment is for a communication which appears in a news story, commentary, or editorial distributed through the facilities of any broadcasting station, newspaper, magazine, or other periodical publication, unless such facilities are owned or controlled by any political party, political committee, or candidate; or</text></subparagraph> <subparagraph id="H7DF9C87CBD804C79ACF8A651D9DFDC9D"><enum>(B)</enum><text>the payment is for a candidate debate or forum conducted pursuant to regulations adopted by the Commission pursuant to section 304(f)(3)(B)(iii), or is for a communication which solely promotes such a debate or forum and is made by or on behalf of the person sponsoring the debate or forum.</text></subparagraph></paragraph></subsection> 
<subsection id="H349A7720FE9D4CC4B4EC2F18A685B93D"><enum>(b)</enum><header>Coordination described</header><text display-inline="yes-display-inline">For purposes of this section, a covered expenditure is made <quote>in cooperation, consultation, or concert with, or at the request or suggestion of,</quote> a candidate, an authorized committee of a candidate, or a political committee of a political party if any of the following apply:</text> <paragraph id="H1DF3915B8E5344C498129C05FF4D8F78"><enum>(1)</enum><text display-inline="yes-display-inline">The covered expenditure is not made totally independently of the candidate, committee, or political party. For purposes of the previous sentence, a covered expenditure not made totally independently of the candidate or committee includes any expenditure made pursuant to any express or implied agreement with, or any general or particular understanding with, or pursuant to any request by or communication with, the candidate, committee, or political party about the expenditure.</text></paragraph> 
<paragraph id="HC39CF75E877341BCB4ADE19D697F3902"><enum>(2)</enum><text display-inline="yes-display-inline">During the 2-year period ending on the date the covered expenditure is made (in the case of a candidate or committee for an election for any other Federal office or any political party) or during the election cycle in which the covered expenditure is made (in the case of a candidate or committee for an election for the office of President), the person making the covered expenditure was directly or indirectly established, maintained, controlled, or principally funded by the candidate, an immediate family member of the candidate, the committee, or party. For purposes of the previous sentence, an <quote>immediate family member</quote> means, with respect to a candidate, a father, mother, son, daughter, brother, sister, spouse, domestic partner, father-in-law, or mother-in-law.</text></paragraph> <paragraph id="H81CFDBF7A45443BE9AC47707D9A588DC"><enum>(3)</enum><text display-inline="yes-display-inline">During the 2-year period ending on the date the covered expenditure is made (in the case of a candidate or committee for an election for any other Federal office or any political party) or during the election cycle in which the covered expenditure is made (in the case of a candidate or committee for an election for the office of President), the candidate, the committee, or political party solicited funds for, provided nonpublic fundraising information or strategy to, appeared as a speaker or featured guest at a fundraiser for, or gave permission to be featured in fundraising efforts for, the person making the covered expenditure. The previous sentence does not apply if the person making the covered expenditure is an organization described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986 and exempt from taxation under section 501(a) of such Code.</text></paragraph> 
<paragraph id="HFDAF16E9643740629AA8C394D2FFFE78"><enum>(4)</enum><text display-inline="yes-display-inline">The covered expenditure is made on the basis of non-public information about the candidate’s, committee’s, or political party’s campaign needs or plans that the candidate, committee, or political party provided directly or indirectly to the person making the covered expenditure, including information about campaign messaging, strategy, fundraising, planned expenditures, or polling data. The previous sentence does not apply to communications between the person making the covered expenditure and the candidate, committee, or political party solely for the purpose of either engaging in discussions regarding the person’s position on a policy matter or regarding whether the person will endorse the candidate or party, so long as such communications do not include any nonpublic information about the candidate’s, committee’s, or party’s campaign needs or plans.</text></paragraph> <paragraph id="H9341776D881E4EE88C021B8C5F49FDE5"><enum>(5)</enum> <subparagraph commented="no" display-inline="yes-display-inline" id="HDF1D20CD88884CA382B5DABC24A82EE9"><enum>(A)</enum><text display-inline="yes-display-inline">During the 2-year period ending on the date the covered expenditure is made (in the case of a candidate or committee for an election for any other Federal office or any political party) or during the election cycle in which the covered expenditure is made (in the case of a candidate or committee for an election for the office of President), the person making the covered expenditure employed or otherwise retained the services (other than accounting or legal services) of a person who, at any point during that cycle or two-year period—</text> 
<clause id="HA017002915A94000971A0D102942B270" indent="up1"><enum>(i)</enum><text display-inline="yes-display-inline">had executive or managerial authority for the candidate, committee, or party, whether paid or unpaid;</text></clause> <clause id="HCFC59E74C29A4259BAEE066AD0EBF863" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">was authorized to raise or expend funds for the candidate, committee, or party and had nonpublic information from the candidate, committee, or party about the candidate’s, committee’s or party’s campaign’s needs or plans; or</text></clause> 
<clause id="H178C62F347FE48EBB3A6247ED1E4D68F" indent="up1"><enum>(iii)</enum><text display-inline="yes-display-inline">provided the candidate, committee, or party with professional services (other than accounting or legal services) related to campaign or fundraising strategy.</text></clause></subparagraph> <subparagraph id="H6937C4D55B3040B3BEFB19536C6D6505" indent="up1"><enum>(B)</enum><text>Subparagraph (A) does not apply with respect to a person employed or otherwise retained by a person making a covered expenditure if, at the time the person who was so employed or retained exercised the authority or provided the services described in clauses (i) through (iii) of such subparagraph, the person making the covered expenditure had in effect a firewall policy which meets the requirements of subsection (d).</text></subparagraph></paragraph></subsection> 
<subsection id="H75FDF3E532FD460F93BFDFA620438D61"><enum>(c)</enum><header>Covered expenditures</header> 
<paragraph id="HB0D406754E8D4B3B8C51B90986DD8914"><enum>(1)</enum><header>Candidates and authorized committees</header><text display-inline="yes-display-inline">For purposes of this section, the term <term>covered expenditure</term> means, with respect to a candidate or an authorized committee of a candidate, any of the following:</text> <subparagraph id="H292FFA1DF0B3466F9036CCCE64038011"><enum>(A)</enum><text>An expenditure for a public communication (as defined in section 301(22)) which—</text> 
<clause id="H22A155A3DA3F4BBD901108D8D06242B5"><enum>(i)</enum><text>expressly advocates for the nomination or election of the candidate or for the defeat of an opponent of the candidate (or contains the functional equivalent of express advocacy);</text></clause> <clause id="H67AECD9D7F3948718D840A772768FB80"><enum>(ii)</enum><text>promotes or supports the candidate, or attacks or opposes an opponent of the candidate (regardless of whether the communication expressly advocates the election or defeat of a candidate or contains the functional equivalent of express advocacy); or</text></clause> 
<clause id="H241559773CC944AD93001E16491CB278"><enum>(iii)</enum><text>refers to the candidate or an opponent of the candidate but is not described in clause (i) or clause (ii), but only if, during the period which begins 120 days before the date of the primary election for the office involved and ends on the date of the general election for such office (or, if necessary, the date of a runoff election following such general election), the communication is disseminated in the jurisdiction of the office the candidate is seeking.</text></clause></subparagraph> <subparagraph id="HCA49313F2579469D84462AF990B267B0"><enum>(B)</enum><text display-inline="yes-display-inline">An expenditure to pay for partisan voter activity (such as partisan voter registration, get-out-the-vote activity, phone banking, or generic campaign activity) in the jurisdiction of the office the candidate is seeking.</text></subparagraph> 
<subparagraph id="H3D091E22AE0941F9895E3476D65EC01A"><enum>(C)</enum><text display-inline="yes-display-inline">An expenditure to pay for research, design or production costs, polling expenses, data analytics, creating or purchasing mailing or social media lists, or other activities related to the expenditures described in subparagraphs (A) or (B).</text></subparagraph></paragraph> <paragraph id="HCD6DC25560384CB1BE2A7DE797A64EEF"><enum>(2)</enum><header>Political parties</header><text display-inline="yes-display-inline">For purposes of this section, the term <term>covered expenditure</term> means, with respect to a political party, any of the following:</text> 
<subparagraph id="H3C92AA3833A940518465B902EBB22AE6"><enum>(A)</enum><text>An expenditure for a public communication (as defined in section 301(22)) which—</text> <clause id="H7CE5441DD10A422DBFC28F97F40B40AE"><enum>(i)</enum><text>expressly advocates for the nomination or election of a candidate of the party or for the defeat of an opponent of a candidate of the party, including a communication which expressly advocates generically for the election of candidates of the party or for the defeat of opponents of candidates of the party (or contains the functional equivalent of express advocacy);</text></clause> 
<clause id="H70F1DE1395E146B38A38F22E9709B93C"><enum>(ii)</enum><text>promotes or supports a candidate of the party, or attacks or opposes an opponent of a candidate of the party (regardless of whether the communication expressly advocates the election or defeat of a candidate or contains the functional equivalent of express advocacy); or</text></clause> <clause id="HDD2ED64319B345028B13FB32B50A298A"><enum>(iii)</enum><text display-inline="yes-display-inline">refers to a candidate of the party or an opponent of a candidate of the party but is not described in clause (i) or clause (ii), but only if, during the period which begins 120 days before the date of the primary election for the office involved and ends on the date of the general election for such office (or, if necessary, the date of a runoff election following such general election), the communication is disseminated in the jurisdiction of the office the candidate is seeking.</text></clause></subparagraph> 
<subparagraph id="H60353CC4BFE14C8F996868D3A99393BF"><enum>(B)</enum><text display-inline="yes-display-inline">An expenditure to pay for partisan voter activity (such as partisan voter registration, get-out-the-vote activity, phone banking, or generic campaign activity) in the jurisdiction of the office a candidate of the party is seeking.</text></subparagraph> <subparagraph id="H7F23C8DC786D43E9B1753D314C9B4DBB"><enum>(C)</enum><text display-inline="yes-display-inline">An expenditure to pay for research, design or production costs, polling expenses, data analytics, creating or purchasing mailing or social media lists, or other activities related to the expenditures described in subparagraphs (A) or (B).</text></subparagraph></paragraph></subsection> 
<subsection id="H2F0DDA8A03AB4EEBADC86EB1518D2ED2"><enum>(d)</enum><header>Firewall policy requirements</header><text>For purposes of paragraph (5) of subsection (b), a firewall policy of a person making a covered expenditure meets the requirements of this subsection if all of the following apply:</text> <paragraph id="HC06A07FF160F455B9E8960FB5ADA8D41"><enum>(1)</enum><text display-inline="yes-display-inline">The policy separates the specific staff of such person who provide services related to the making of the covered expenditure from the distinct, specific staff who have engaged or will engage in any of the authorities or services described in clauses (i) through (iii) of subparagraph (B) of paragraph (5) of subsection (b) with the candidate, authorized committee, or political party supported by the covered expenditure.</text></paragraph> 
<paragraph id="HA09D629D3CC9482E882F42C740A12D2D"><enum>(2)</enum><text display-inline="yes-display-inline">The policy forbids owners of such person and executives, managers, and supervisors within such person’s organization, to simultaneously oversee the work of staff being separated by a firewall.</text></paragraph> <paragraph id="HBEBB9FC14C374DB8889CA41DEB6D1576"><enum>(3)</enum><text display-inline="yes-display-inline">The policy imposes a prohibition on the flow of strategic nonpublic information, including by imposing physical and technological separations, between such person and the candidate, committee, or party supported by the covered expenditure, and between the specific staff who are being separated by the firewall.</text></paragraph> 
<paragraph id="HD23D3CF9FA13430AA510A87132164D39"><enum>(4)</enum><text display-inline="yes-display-inline">The policy is memorialized in writing and distributed to all relevant staff (including consultants) before such staff provide any services relating to the making of the covered expenditure, and the written policy described both the general firewall policy and any specific firewall created pursuant to such policy, and the person making the covered expenditure provides such written policy upon request to the Commission.</text></paragraph></subsection> <subsection id="HEFAE09B8B3B04F09AEAE2DF3BB0C962E"><enum>(e)</enum><header>No limitation on application of other coordination rules</header><text>Nothing in this section may be construed to limit the application of section 315(a)(7) to any contribution, expenditure, disbursement, or person.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HC33045D158E34CA699EE35C023BEDA8A"><enum>(c)</enum><header>Effective date; effect on existing regulations</header> 
<paragraph id="H575AD2B41D07470292796815F1D73E1E"><enum>(1)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section shall apply with respect to payments made on or after the expiration of the 60-day period which begins on the date of the enactment of this Act, without regard to whether or not the Federal Election Commission has promulgated regulations in accordance with paragraph (2)(B) as of the expiration of such period.</text></paragraph> <paragraph id="HD212C193C9274FD2B6C2ED84D43FE21E"><enum>(2)</enum><header>Repeal of existing regulations on coordination</header><text display-inline="yes-display-inline">Effective upon the expiration of the 60-day period which begins on the date of the enactment of this Act—</text> 
<subparagraph id="HAC062ED510F34842A4E86154FF7500D7"><enum>(A)</enum><text>the regulations on coordinated communications adopted by the Federal Election Commission which are in effect on the date of the enactment of this Act (as set forth in 11 CFR Part 109, Subpart C, under the heading <quote>Coordination</quote>) are repealed; and</text></subparagraph> <subparagraph id="H080C6576C43A4C87A86FF3E5C38F3D2A"><enum>(B)</enum><text>the Federal Election Commission shall promulgate new regulations on coordinated communications which reflect the amendments made by this Act.</text></subparagraph></paragraph> 
<paragraph id="H4B33E8255C334706A4EBE3B1F7B4EF21"><enum>(3)</enum><header>Termination of validity of advisory opinions</header><text>To the extent that any advisory opinion issued by the Federal Election Commission prior to expiration of the period described in paragraph (2) was based on the regulations referred to in subparagraph (A) of paragraph (2), the validity of the opinion is hereby terminated, and no person may rely upon the opinion with respect to conduct occurring after the expiration of such period.</text></paragraph></subsection></section> <section id="H10603D785D2A46FEB7A361A2C748503C"><enum>4.</enum><header>Expansion of definition of public communication</header> <subsection id="HD0A423D58FEC4392B3BA936535CEADC0"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Paragraph (22) of section 301 of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/52/30101">52 U.S.C. 30101(22)</external-xref>) is amended by striking <quote>or satellite communication</quote> and inserting <quote>satellite, paid Internet, or paid digital communication</quote>.</text></subsection> 
<subsection id="HE1616344D4BF4064B9B012EB260050A0"><enum>(b)</enum><header>Treatment of contributions and expenditures</header><text>Section 301 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/52/30101">52 U.S.C. 30101</external-xref>) is amended—</text> <paragraph id="H89B4D30FBE554CCE82BA3C8FC745FBF3"><enum>(1)</enum><text>in paragraph (8)(B)—</text> 
<subparagraph id="H1591615D703447D4BE62AC80F0D4CB64"><enum>(A)</enum><text>by striking <quote>on broadcasting stations, or in newspapers, magazines, or similar types of general public political advertising</quote> in clause (v) and inserting <quote>in any public communication</quote>;</text></subparagraph> <subparagraph id="H87C04E5B1B1B4C47A4C3F98F57E6851B"><enum>(B)</enum><text>by striking <quote>broadcasting, newspaper, magazine, billboard, direct mail, or similar type of general public communication or political advertising</quote> in clause (ix)(1) and inserting <quote>public communication</quote>; and</text></subparagraph> 
<subparagraph id="H555FA135588A448096841DFC709C4418"><enum>(C)</enum><text>by striking <quote>but not including the use of broadcasting, newspapers, magazines, billboards, direct mail, or similar types of general public communication or political advertising</quote> in clause (x) and inserting <quote>but not including use in any public communication</quote>; and</text></subparagraph></paragraph> <paragraph id="H8E4951EF662F4E318A7D976EC8DE567A"><enum>(2)</enum><text>in paragraph (9)(B)—</text> 
<subparagraph id="H07FD5BE3F344488091C8332D629A4B26"><enum>(A)</enum><text>by striking clause (i) and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="H28D3A8F4B446486185279D04734DDDF3" style="OLC"> <clause id="H48232C0025AB49E8B931878AAB07BF2D"><enum>(i)</enum><text>any news story, commentary, or editorial distributed through the facilities of any broadcasting station or any print, online, or digital newspaper, magazine, blog, publication, or periodical, unless such broadcasting, print, online, or digital facilities are owned or controlled by any political party, political committee, or candidate;</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="H8B448034ED3C41E1A880CB3A10BC3441"><enum>(B)</enum><text>by striking <quote>on broadcasting stations, or in newspapers, magazines, or similar types of general public political advertising</quote> in clause (iv) and inserting <quote>in any public communication</quote>.</text></subparagraph></paragraph></subsection> <subsection id="H48E398D4B58F49B1A8FCDC1467FFA450"><enum>(c)</enum><header>Disclosure and disclaimer statements</header><text>Subsection (a) of section 318 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/52/30120">52 U.S.C. 30120</external-xref>) is amended—</text> 
<paragraph id="H216B2F9148974FBEAC7D36777618BE77"><enum>(1)</enum><text>by striking <quote>financing any communication through any broadcasting station, newspaper, magazine, outdoor advertising facility, mailing, or any other type of general public political advertising</quote> and inserting <quote>financing any public communication</quote>; and</text></paragraph> <paragraph id="H4131F3538B954FBD9D2651A21C91C0B9"><enum>(2)</enum><text>by striking <quote>solicits any contribution through any broadcasting station, newspaper, magazine, outdoor advertising facility, mailing, or any other type of general public political advertising</quote> and inserting <quote>solicits any contribution through any public communication</quote>.</text></paragraph></subsection> 
<subsection id="HE92A7FAC83724FD4B8DE114486767434" commented="no"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall apply with respect to communications disseminated on or after January 1, 2025.</text></subsection></section> <section id="H959C752CE02C4CE7865CDC30E2930B6A"><enum>5.</enum><header>Expansion of definition of electioneering communication</header> <subsection id="H27EB8F6EBDAB4F2EB628D81BE7CFE220"><enum>(a)</enum><header>Expansion to online communications</header> <paragraph id="H97E5BB0EAF46425B866EBB84C7CE3C4E"><enum>(1)</enum><header>Application to qualified Internet and digital communications</header> <subparagraph id="HAEC4D9BAD66547D09353FFEBF7A4152B"><enum>(A)</enum><header>In general</header><text>Subparagraph (A) of section 304(f)(3) of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/52/30104">52 U.S.C. 30104(f)(3)(A)</external-xref>) is amended by striking <quote>or satellite communication</quote> each place it appears in clauses (i) and (ii) and inserting <quote>satellite, or qualified Internet or digital communication</quote>.</text></subparagraph> 
<subparagraph id="HC6C706EC366D4CB199A94F0062312AAD"><enum>(B)</enum><header>Qualified Internet or digital communication</header><text>Paragraph (3) of section 304(f) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/52/30104">52 U.S.C. 30104(f)</external-xref>) is amended by adding at the end the following new subparagraph:</text> <quoted-block display-inline="no-display-inline" id="HCFD47DA06BC7441992E54962FBA524EA" style="OLC"> <subparagraph id="HD30D8ED3212D47E5B6C84D70448B3A64"><enum>(D)</enum><header>Qualified Internet or digital communication</header><text display-inline="yes-display-inline">The term <term>qualified Internet or digital communication</term> means any communication which is placed or promoted for a fee on any public-facing website, Web application, or digital application (including a social network, ad network, or search engine).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph commented="no" id="H6712D8203E114A42BBCAFD768AA4DC5F"><enum>(2)</enum><header>Nonapplication of relevant electorate to online communications</header><text>Section 304(f)(3)(A)(i)(III) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/52/30104">52 U.S.C. 30104(f)(3)(A)(i)(III)</external-xref>) is amended by inserting <quote>any broadcast, cable, or satellite</quote> before <quote>communication</quote>.</text></paragraph> <paragraph commented="no" id="H6EDA8E10A4794D178613756560666772"><enum>(3)</enum><header>News exemption</header><text>Section 304(f)(3)(B)(i) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/52/30104">52 U.S.C. 30104(f)(3)(B)(i)</external-xref>) is amended to read as follows:</text>

<clause id="HE761E2653CAE4524BD657F904D754530"><enum>(i)</enum><text>a communication appearing in a news story, commentary, or editorial distributed through the facilities of any broadcasting station or any online or digital newspaper, magazine, blog, publication, or periodical, unless such broadcasting, online, or digital facilities are owned or controlled by any political party, political committee, or candidate;</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection commented="no" id="HECFF15075B294E06B52C061916AFA85A"><enum>(b)</enum><header>Effective date</header><text>The amendments made by this section shall apply with respect to communications made on or after the date of the enactment of this Act.</text></subsection></section> 
<section id="HC95A703C5E464A68AC5CC5A06CDB54E0"><enum>6.</enum><header>Disclosure of true identity of source of funding of campaign advertisements</header> 
<subsection id="H7396CEDE34B54E3AB0609D27959DA82D"><enum>(a)</enum><header>Requiring best efforts To determine true source of funds used To pay for campaign advertisements</header><text>Section 318 of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/52/30120">52 U.S.C. 30120</external-xref>) is amended by adding at the end the following new subsection:</text> <quoted-block display-inline="no-display-inline" id="HC9AF10D01AE14CFA96E6E008C8CE829E" style="traditional"> <subsection id="H1B24DB3D80BD420EB0E4B79C0515253F"><enum>(e)</enum><header>Requiring best efforts To determine true source of funds used To pay for certain advertisements</header> <paragraph id="HBDC0674C4A6E4A2483847D21E1B6A016"><enum>(1)</enum><header>Best efforts required</header><text>The person making a disbursement of funds for a communication described in paragraph (3) of subsection (a) shall make best efforts to determine the true source of the funds used for the disbursement to ensure that the names of the persons included in the statement required under such paragraph are the names of the persons who served as the true source of such funds. For purposes of this paragraph, such best efforts shall include the making of multiple requests (if necessary) to contributors to determine whether the funds provided by the contributors were transferred (either directly or indirectly) by other persons.</text></paragraph> 
<paragraph id="H0BB297DF9A5D47E4A677F6211DC23B96"><enum>(2)</enum><header>Treatment of political committees</header><text>For purposes of this subsection, a political committee shall not be considered a source of funds used for a disbursement for a communication described in paragraph (3) of subsection (a), other than an account of a political committee established for the purpose of accepting donations or contributions that do not comply with the contribution limits or source prohibitions under this Act.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="HD307FB88B2A04149A25A7D8A4F05D9B8"><enum>(b)</enum><header>Inclusion in advertisements of identification of Top Three Funders</header><text>Section 318 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/52/30120">52 U.S.C. 30120</external-xref>), as amended by subsection (a), is further amended by adding at the end the following new subsection:</text>

<subsection id="H7648EB4C8C854E4CA0944AD816822F69"><enum>(f)</enum><header>Disclosure of Top Three Funders</header> 
<paragraph id="H38A23BF624C246EEBCD0C1F6FF23C7C7"><enum>(1)</enum><header>Requiring disclosure in certain advertisements</header> 
<subparagraph id="H6BC89F09BA34400EAC07AB45D423D42C"><enum>(A)</enum><header>Requirement</header><text>Any communication described in paragraph (3) of subsection (a), shall, in addition to including the information required under such paragraph and under paragraph (2) of subsection (d), include the Top Three Funders list (if applicable).</text></subparagraph> <subparagraph id="HF0499154DA7E49D8977DC0A20FCAAFDE"><enum>(B)</enum><header>Exclusion of communications paid for by political parties</header><text display-inline="yes-display-inline">This subsection does not apply with respect to a communication paid for exclusively by a political committee of a political party.</text></subparagraph></paragraph> 
<paragraph id="HC38AE3FFF9DB48D5AFF3D08B4D9AC1FE"><enum>(2)</enum><header>Method of conveyance of statement through video format</header><text display-inline="yes-display-inline">In the case of a communication to which this subsection applies which is transmitted through a video format (including through television or through the Internet or similar digital format if the transmission includes a video component), the information required under paragraph (1) shall appear in writing at the end of the communication in a clearly readable manner, with a reasonable degree of color contrast between the background and the printed statement, for a period of at least 4 seconds.</text></paragraph> <paragraph id="H5F94650A2BFE4E92B76EF933DAC5E930"><enum>(3)</enum><header>Method of conveyance of statement through audio format</header><text display-inline="yes-display-inline">In the case of a communication to which this subsection applies which is transmitted in audio format (including through radio or through the Internet or similar digital format if the transmission includes an audio component), the information required under paragraph (1) shall include, in a clearly spoken manner, the following audio statement: <quote>Top funders include _______</quote>, with the blank filled in with the names of the persons on the Top Three Funders list.</text></paragraph> 
<paragraph id="H8D66964047CC456B995128E6B9F03245"><enum>(4)</enum><header>Method of conveyance of statement through text and images</header><text display-inline="yes-display-inline">In the case of a communication to which this subsection applies which is a printed communication or which is transmitted through the Internet or similar digital manner and is not described in paragraphs (2) or paragraph (3), the information required under paragraph (1) shall appear in a clearly readable manner, with a reasonable degree of color contrast between the background and the printed statement.</text></paragraph> <paragraph id="HF9AD88125555477EB8663718C809DCD3"><enum>(5)</enum><header>Top Three Funders list defined</header> <subparagraph id="H1B0D0C5EBD1F454DA6655195DE2C1EE6"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>Top Three Funders list</term> means, with respect to a communication, a list of the three persons who, during the 12-month period ending on the date of the transmission of the communication or the date on which funds were disbursed for the communication (whichever is earlier), provided the largest payments of any type in an aggregate amount exceeding the applicable threshold to the person who is paying for the communication and the amount of the payments each such person provided. If two or more people provided the third largest of such payments, the person who provided the most recent of such payments shall be included on the Top Three Funders list.</text></subparagraph> 
<subparagraph id="H42B450D2215F46E9B5FDC86F418975F6"><enum>(B)</enum><header>Exclusion of certain payments</header><text display-inline="yes-display-inline">For purposes of subparagraph (A), in determining the amount of payments made by a person to a person paying for a communication, there shall be excluded the following:</text> <clause id="HD6FA776BF1C94DB78F562DEFA086D61E"><enum>(i)</enum><text display-inline="yes-display-inline">Any amounts provided in the ordinary course of any trade or business conducted by the person paying for the communication or in the form of investments in the person paying for the communication.</text></clause> 
<clause id="H12B1C7EB455B4E98BE6A5BFF1F26BF12"><enum>(ii)</enum><text display-inline="yes-display-inline">Any payment which the person prohibited, in writing, from being used for communications under this section, but only if the person paying for the communication agreed to follow the prohibition and deposited the payment in an account which is segregated from any account used to make payments for such communications.</text></clause></subparagraph></paragraph> <paragraph id="H7DDCDF4121C54EEB86C0C7449643C72D"><enum>(6)</enum><header>Applicable threshold defined</header> <subparagraph id="H9B69001ADC1B43E4AA2E3155F5734E57"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">For purposes of subparagraph (A), the <quote>applicable threshold</quote> with respect to a communication is—</text> 
<clause id="H789F06F7D52A4EA4A3C541655555AE88"><enum>(i)</enum><text>$10,000, if the funds used to pay for the costs of the communication were derived exclusively from a separate, segregated account which meets the requirements of subparagraph (B); or</text></clause> <clause id="HE4511763EF9D4237AABC7C2A4F3A0856"><enum>(ii)</enum><text>$50,000, if the funds used to pay for the costs of the communication were not derived exclusively from such an account.</text></clause></subparagraph> 
<subparagraph id="HAAF6FE9441A2445EB0429EA03EDA950F"><enum>(B)</enum><header>Requirements for accounts</header><text>An account meets the requirements of this subparagraph if—</text> <clause id="HAF949CFD78CE483193E7ACB4192B927F"><enum>(i)</enum><text>the account is separate and segregated from the general fund of the person paying for the costs of communications which are subject to the requirements of this subsection; and</text></clause> 
<clause id="H05BCB46E76F9465397D84A859BF4C8EC"><enum>(ii)</enum><text display-inline="yes-display-inline">the account does not include any funds transferred from the general treasury of the person paying for the costs of such communications unless the funds were transferred during the 12-month period ending on the date of the transmission of the communication or the date on which funds were disbursed for the communication (whichever is earlier) and the person who provided the funds to the general treasury gave written permission for the funds to be transferred to the account.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H1E0C08CB6E604CAA9CFC295322447C4C" commented="no"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply with respect to communications made on or after January 1, 2025.</text></subsection></section>
