compensation</header><text display-inline="no-display-inline">Section 908 of title 37, United States Code, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="HDE7DB89DE83847E093C3798313696A86"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)—</text><subparagraph commented="no" display-inline="no-display-inline" id="HD76AEA338CDC46FCB79BC93F2EDA4825"><enum>(A)</enum><text>by redesignating paragraphs (1), (2), and (3) as subparagraphs (A), (B), and (C), respectively, and by moving such subparagraphs, as so redesignated, 2 ems to the right;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HEFC4D712DD004451B17907CCAEF3407D"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>Subject to</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HCBE96AAD18CB403F92F5EDFE374805F1"><paragraph commented="no" display-inline="no-display-inline" id="HBFB3DA179D35477B81B8367EC6B8A1E8"><enum>(1)</enum><header>In general</header><text>Subject to</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="H5412F4F5447C40488242DA9EB59AAC17"><enum>(C)</enum><text>in subparagraph (C), as redesignated, by striking <quote>Commissioned Reserve Corps</quote> and inserting <quote>Ready Reserve Corps</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HD51B00D2945C4158BC1967D8783CEB1D"><enum>(D)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H3D9B2775A9FA4541A00CE4C76A7E0601"><paragraph commented="no" display-inline="no-display-inline" id="HB7F78185289347D8ABD396098717B74D"><enum>(2)</enum><header>Application to private entities</header><text>The acceptance by a person described in paragraph (1) of employment (and compensation related to that employment) or payments or awards indirectly from a foreign government through a private entity shall be subject to the provisions of this section to the same extent and in the same manner as such provisions apply to employment (and compensation related to that employment) and payments and awards described in paragraph (1).</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB7A1D89B7C5641268D34DB9F3579B022"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (b)—</text><subparagraph commented="no" display-inline="no-display-inline" id="H7339924E4CB4486DB38B034636BAC7C1"><enum>(A)</enum><text display-inline="yes-display-inline">by inserting <quote>(1)</quote> before <quote>A person</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H12E10B9593F04F929CA7576F59565711"><enum>(B)</enum><text display-inline="yes-display-inline">by adding at the end the following new paragraph: </text><quoted-block style="OLC" display-inline="no-display-inline" id="H1A730F005C2947DAAAE7A935715CDA4C"><paragraph commented="no" display-inline="no-display-inline" id="HD18D664D020C4E53A3C091DCDDBF7AEC" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Before approving under paragraph (1) the employment of a person described in subsection (a), the Secretary concerned and the Secretary of State shall—</text><subparagraph id="H3003CCFC47B5447C8445FCD54496F1DE"><enum>(A)</enum><text>review the offer of employment, including the full text of the contract or other agreement and any annexes or statements of work; and</text></subparagraph><subparagraph id="H94116C03724840DF8BE79F65112E6394"><enum>(B)</enum><text>determine that the employment will not harm the national security of the United States, including with respect to complying with requirements under the International Traffic in Arms Regulations under subchapter M of chapter I of title 22, Code of Federal Regulations.</text></subparagraph></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H0D95528B787D421A8947196C3001E4F0" commented="no"><enum>(3)</enum><text>by redesignating subsections (d) and (e) as subsections (k) and (m), respectively; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H35F91B35903F4EE7A2B093C2818EA189"><enum>(4)</enum><text display-inline="yes-display-inline">by inserting after subsection (c) the following new subsection (d):</text><quoted-block style="OLC" display-inline="no-display-inline" id="HC292C633652146CB9C5ACE25DD39CAAA"><subsection id="H070323B687084C9CB6FAEE1A1902AB61"><enum>(d)</enum><header>Terms of approval</header><text>An approval provided to a person described in subsection (a) for employment or compensation under subsection (b) or for a payment or award under subsection (c) shall cease to be effective if the person—</text><paragraph id="HE0321587C1A948E4A14EB69F0794049D"><enum>(1)</enum><text>fails to notify the Secretary concerned in writing of any material change in the nature of the employment or payment or award not later than 30 days after the change is made; or</text></paragraph><paragraph id="HA5D10568AEF94F06B97480150A920AB7"><enum>(2)</enum><text>provides inaccurate or incomplete information in a written notification submitted under paragraph (1).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H119492C8273D4D38943863B39A52A7CB"><enum>3.</enum><header>Prohibition on members of the Armed Forces negotiating employment with foreign governments while on active duty</header><text display-inline="no-display-inline">Section 908 of title 37, United States Code, as amended by section 2, is further amended by inserting after subsection (d) the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HAFE80C8F1647459D8E7FC6A5CE847797"><subsection id="HEB2478B338EF4C2A8FB2E29018D0A83B"><enum>(e)</enum><header>Prohibition on negotiation of employment by foreign governments while on active duty</header><text>A member of the armed forces is prohibited from negotiating or having in effect an agreement for future employment or compensation, or payment or award, described in subsection (a) while serving on active duty.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H63F912B75DC04308A5F5DB3AC2D16CFE"><enum>4.</enum><header>30-month prohibition on retired members of the Armed Forces eligible for access to classified information seeking approval for employment by foreign governments</header><text display-inline="no-display-inline">Section 908 of title 37, United States Code, as amended by section 3, is further amended by inserting after subsection (e) the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HAE1A58B8F83C4B669ECE4D13704473AC"><subsection id="H7070307B55E045E9AF2459DB7D2ADB76"><enum>(f)</enum><header>Prohibition for retired members of armed forces eligible for access to classified information</header><paragraph commented="no" display-inline="no-display-inline" id="HACBDF7A29D4740ADB86EEC9B975A7A98"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided by paragraph (2), a retired member of the armed forces who is eligible for access to classified information is prohibited from seeking approval under subsection (b) for employment or compensation described in subsection (a) during the 30-month period beginning on the date on which the person retires from the armed forces.</text></paragraph><paragraph id="H9E493FB9C51C41C593BDC0587F351E56"><enum>(2)</enum><header>Exception for allied governments</header><text>A person described in paragraph (1) may accept employment or compensation from the government of the United Kingdom, Canada, Australia, or New Zealand if the Secretary concerned and Secretary of State approve the employment as provided by subsection (b).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HB3DFD56B67B64EF69937AD37DC7742E5"><enum>5.</enum><header>Notification of obligations</header><text display-inline="no-display-inline">Section 908 of title 37, United States Code, as amended by section 4, is further amended by inserting after subsection (f) the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H99ED6DC9828C4FF5B7807F34CA7ECF23"><subsection id="HCB1317C747504D25B5C8CF8EA5EC83E7"><enum>(g)</enum><header>Notification of obligations</header><text>The Secretary concerned shall ensure that each person described in subsection (a)—</text><paragraph id="H5F1D55765C354A44BB4CA72E681B1DAF"><enum>(1)</enum><text>is notified of the obligations of the person under this section; and</text></paragraph><paragraph id="H2A84814BD6634D72B4BC45994D1AAA01"><enum>(2)</enum><text>certifies to the Secretary that the person understands such obligations.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H800BB0B1C8C542539D11B6DDD7CB0479"><enum>6.</enum><header>Post-retirement employment reporting</header><text display-inline="no-display-inline">Section 908 of title 37, United States Code, as amended by section 5, is further amended by inserting after subsection (g) the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H0868644E1CE54B7D8AD263D5D3D64EC6"><subsection id="H461CE71DE8B440418D33AD35CE88C341"><enum>(h)</enum><header>Post-Retirement employment reporting</header><paragraph id="H540B8E48F0FC48C8845CB79337511686"><enum>(1)</enum><header>In general</header><text>During the 5-year period beginning on the date on which a member of the armed forces retires, that member shall—</text><subparagraph id="H28CF1C93E49D43428854D20A2F05CF4D"><enum>(A)</enum><text>report employment described in subsection (a) to the Secretary concerned upon accepting such employment; and</text></subparagraph><subparagraph id="H2FFBDE055E394470ABD0CB93D4F8241F"><enum>(B)</enum><text>annually (or more frequently if the Secretary concerned considers it appropriate) report such employment to the Secretary concerned.</text></subparagraph></paragraph><paragraph id="H32A3109298DA44169E6F75CFC2382B4E"><enum>(2)</enum><header>Regulations</header><text>The Under Secretary of Defense for Personnel and Readiness, in consultation with the Department of Defense Standards of Conduct Office and the Secretaries of the military departments, shall issue regulations requiring, as a condition of service, each member of the armed forces to sign a written agreement requiring the regular reporting of employment described in subsection (a) to the Secretary concerned under paragraph (1).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H76AAF730EE004E26A035906E04963E2A"><enum>7.</enum><header>Penalties</header><text display-inline="no-display-inline">Section 908 of title 37, United States Code, as amended by section 6, is further amended by inserting after subsection (h) the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H362BC3ECDCC74138B681619404EEB4F6"><subsection id="H0BB9B41583644B038E33F2629C8390A3"><enum>(i)</enum><header>Civil penalties</header><paragraph id="HAE8CAFB5C77645448289B90604F071D6"><enum>(1)</enum><header>In general</header><text>A person who violates subsection (b), (c), (e), (f), or (h) shall be liable to the United States for a civil penalty in an amount that is not more than the greater of—</text><subparagraph id="H3AAF6BC20A594DC9B79E88DBCE9BEA08"><enum>(A)</enum><text>$100,000; or</text></subparagraph><subparagraph id="H4972F03B64C548EDA1EFF333EB69011E"><enum>(B)</enum><text>the amount of compensation that the person received or was offered for the conduct in violation of subsection (b), (c), (e), or (f), or the employment described in subsection (h), as the case may be.</text></subparagraph></paragraph><paragraph id="H8D0E6B0E5DE441699C9BC1A35541B5A0"><enum>(2)</enum><header>Additional penalties</header><text>In addition to the penalty provided for under paragraph (1), a person who violates subsection (b), (c), (e), or (f) shall, for a period of not longer than five years—</text><subparagraph id="H6F1A74F6E87747A58E296593A1579612"><enum>(A)</enum><text>be prohibited from accepting employment or compensation or a payment or award from any foreign government;</text></subparagraph><subparagraph id="H8D8D73AB23E0413585B22F24EE15C333"><enum>(B)</enum><text>be prohibited from—</text><clause id="HF4074A4EBB5947DEBBF838B80E7F1DE5"><enum>(i)</enum><text>accepting employment with the Federal Government;</text></clause><clause id="H1AB1847B30594EF2A567543F26F08C90"><enum>(ii)</enum><text>providing services under a contract awarded by the Federal Government; or</text></clause><clause id="HD4B1F946E527481CA903CBE1B971B469"><enum>(iii)</enum><text>serving on a Federal advisory committee or in any other advisory capacity to the Federal Government; and</text></clause></subparagraph><subparagraph id="H730FD8A0C4C3467BA395B3A463D78832"><enum>(C)</enum><text>not be eligible for access to classified information.</text></subparagraph></paragraph><paragraph id="H13BFA870691447D8AB1A091CCACC88DD"><enum>(3)</enum><header>Appeal</header><subparagraph id="H87B0B921D44F49F0ABB82482E5202365"><enum>(A)</enum><header>In general</header><text>A person assessed a penalty under paragraph (1) for a violation of subsection (b), (c), (e), (f), or (h) may appeal the penalty to the President.</text></subparagraph><subparagraph id="HBD5636B98B08415284C729E026FF9064"><enum>(B)</enum><header>Determinations on appeal</header><text>A determination by the President to rescind or waive part or all of a penalty for a violation of subsection (b), (c), (e), (f), or (h) shall be made in writing, submitted to Congress, and made publicly available by the President through publication in the Federal Register.</text></subparagraph></paragraph><paragraph id="H70DF65021B9F4A379C57DDAA85345AE8"><enum>(4)</enum><header>Savings provision</header><text>The imposition of a penalty under this subsection does not preclude the application of any other criminal or civil statutory, common law, or administrative remedy that is available by law to the United States or any other person.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H93FB01A8DE524AEE99D2BF23FB0FD55A"><enum>8.</enum><header>Guidance</header><text display-inline="no-display-inline">Section 908 of title 37, United States Code, as amended by section 7, is further amended by inserting after subsection (i) the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H0DF1ECEAF6CC4F0DA80640F826A55994"><subsection id="HC892A9EDE9294F6EACE15F54438F1D61"><enum>(j)</enum><header>Guidance</header><text>Not later than 120 days after the enactment of the <short-title>Retired Officers Conflict of Interest Act of 2024</short-title>, the Secretary of Defense and the Secretary of State shall issue and make available to the public guidance with respect to complying with this section.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HE4FB0954EEFA4508B4AF70C1DB316675" commented="no"><enum>9.</enum><header>Public reporting</header><text display-inline="no-display-inline">Subsection (k) of section 908 of title 37, United States Code, as redesignated by section 2(2), is further amended—</text><paragraph commented="no" display-inline="no-display-inline" id="H650CC152B156461E9A8195D7C0A9780A"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (2), by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HAD6326BCFBA04A7EB951007A242A771D"><subparagraph id="H3DC8C26746B14D79B0CAF2441FC0DE31" commented="no" indent="up1"><enum>(D)</enum><text>The value of any travel, meals, lodging, or registration fees provided by the foreign government in connection with the employment or compensation or payment or award.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="HFEE5B5847E5A488385BA80A6FF364BB7" commented="no"><enum>(2)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HFF5ED54F499A4FE38A6480041BBC580C"><paragraph commented="no" display-inline="no-display-inline" id="HC97D98BDAE0143EBA8CDC571A9D07672" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">Each report required by paragraph (1), and all of the contents of the report, without redaction, shall be made available by the Secretary of Defense on a publicly accessible internet website not later than 60 days after the report is submitted under paragraph (1).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H15618FBB2AFE4C239C4EDA591FAF9F38"><enum>10.</enum><header>Database of employment approvals</header><text display-inline="no-display-inline">Section 908 of title 37, United States Code, is amended by inserting after subsection (k), as redesignated by section 2(2), the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H81CD85B132B7434AAB79EF81B567DCE7"><subsection id="H9E5496C766664D07BFF9843C7253A1EF"><enum>(l)</enum><header>Database of employment approvals</header><paragraph id="H85AE62D0AF6F4AF387E1B2E8C3C8BEEE"><enum>(1)</enum><header>Establishment</header><text>Not later than 1 year after the date of the enactment of the <short-title>Retired Officers Conflict of Interest Act of 2024</short-title>, the Secretary of Defense shall establish and maintain an online portal accessible by the public that allows a member of the public, at no cost to the member, to search, sort, and download information on approvals of employment provided under subsection (b).</text></paragraph><paragraph id="H9D399D74C2D3419787D2278A0EAF3CA1"><enum>(2)</enum><header>Elements</header><text>The portal required by paragraph (1) shall be designed to provide a member of the public with the ability to retrieve information on an approval of employment provided under subsection (b) to a person described in subsection (a) through searches based on each, and any combination, of the following:</text><subparagraph id="H17F09FD8769C42CC9CB758C752C02275"><enum>(A)</enum><text>The name of the person.</text></subparagraph><subparagraph id="HDD5CF782FACE4727A70E0E5FA4E66C8D"><enum>(B)</enum><text>The armed force of the person.</text></subparagraph><subparagraph id="H022BD9425A394055A0FD89E04405BD3E"><enum>(C)</enum><text>The position the person held or holds in the armed forces, including rank, and in any other former employing Federal office.</text></subparagraph><subparagraph id="HC4F5CEC26125414995C53B67070FA4FE"><enum>(D)</enum><text>The foreign government involved.</text></subparagraph><subparagraph id="HA339EC2405DD4D35AAC971736120330F"><enum>(E)</enum><text>The amount of compensation expected or provided for the employment.</text></subparagraph><subparagraph id="H06461B919D874FE0A98AD80D59F652E0"><enum>(F)</enum><text>The details of the person’s application for approval of the employment.</text></subparagraph><subparagraph id="H2367C4A5426C440EA5DB4DF4AAAC0BCD"><enum>(G)</enum><text>In the case of a retired member of the armed forces, the nature of the activities of the member since retirement.</text></subparagraph><subparagraph id="H1CCD58E62BD3483DB54728BA9E77A3E6"><enum>(H)</enum><text>Other information relating to the employment.</text></subparagraph><subparagraph id="H9D878297AE0845ECAFAE1BB5563C2D7F"><enum>(I)</enum><text>Except as provided by paragraph (3), any other information the Director considers relevant.</text></subparagraph></paragraph><paragraph id="HCF20337574CA485D800D8CCD47D8A31D"><enum>(3)</enum><header>Information prohibited from disclosure</header><text>The portal required by paragraph (1) may not include an individual’s date of birth, social security number, home address, phone number, or any other personal identifier other than those specifically required to be included under paragraph (2).</text></paragraph><paragraph id="H4BB94B84FDA54994A5ACB525FBECD476"><enum>(4)</enum><header>Availability of information</header><text>The Director shall design the portal required by paragraph (1) so that the contents of the portal may be downloaded in bulk and retrieved by an application programming interface.</text></paragraph><paragraph approval of employment provided under subsection (b) for not less than 10 years after the expiration or other termination of the approval.</text></paragraph><paragraph id="H7CB2F61EC5F84F4D9C8900A6B7BA135B"><enum>(6)</enum><header>Updates required</header><text>The portal required by paragraph (1) and the application programming interface referred to in paragraph (4) shall be enhanced and updated as necessary to carry out the purposes of this section.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H8A099BE33447469085717F9540FB2936"><enum>11.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 908 of title 37, United States Code, is amended by inserting after subsection (m), as redesignated by section 2(2), the following new subsection:</text><quoted-block id="HBA3AB47011034DA5B195BDC785E0B8BA" display-inline="no-display-inline" style="OLC"><subsection id="H084CC258643744E99ABD2070DFDF6E4F"><enum>(n)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HE874F78608B34251BDB117D88109676B"><enum>(1)</enum><header>Classified information</header><text>The term <term>classified information</term> means any information or material that has been determined by the United States Government pursuant to an Executive order, statute, or regulation, to require protection against unauthorized disclosure for reasons of national security.</text></paragraph><paragraph id="HA196D44CFAAB4010B4A2BCAA744D9F28"><enum>(2)</enum><header>Eligible for access to classified information</header><text>The term <term>eligible for access to classified information</term> has the meaning given that term in the procedures established pursuant to section 801(a) of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3161">50 U.S.C. 3161</external-xref>).</text></paragraph><paragraph id="HC10DD3E8CA0C40C1A1206A4BBAACABAE" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header>Foreign government</header><text>The term <term>foreign government</term> has the meaning given that term in section 7342(a)(2) of title 5.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H408CE64279BA46EB935179C629C45F95"><enum>12.</enum><header>Comptroller General of the United States review</header><subsection id="HAB8F20EDC93B4CBB82320310FCCCDBA9"><enum>(a)</enum><header>Report required</header><text>Not later than 2 years after the date of the enactment of this Act, the Comptroller General of the United States shall submit to the Committees on Armed Services of the Senate and the House of Representatives a report on the employment by foreign governments of former officers of the Armed Forces covered by section 908 of title 37, United States Code.</text></subsection><subsection id="HA9B47F38DD3E40C1A52310E1590157C2"><enum>(b)</enum><header>Elements</header><text>The report required by subsection (a) shall include an assessment of—</text><paragraph id="H17FB72626B664ABA887C26015C6291FC"><enum>(1)</enum><text>the processes in place at the Department of State and the Department of Defense—</text><subparagraph id="HDB130F17DC0A4475B04B44E77A2C5115"><enum>(A)</enum><text>to identify—</text><clause id="HA63543FF57A34056A668879DF2AE1F79"><enum>(i)</enum><text>the extent to which former officers described in subsection (a) were provided compensation directly or indirectly by foreign governments during the 5-year period preceding submission of the report; and</text></clause><clause id="HF8EBF8C0DEF34D9190FBC4148DD609E0"><enum>(ii)</enum><text>the extent to which such former officers who receive compensation from foreign governments work on contracts or programs of the Department of Defense, the Department of State, or the Department of Health and Human Services—</text><subclause id="HDDBFFA149A4444FBBD18B02F6636BF44"><enum>(I)</enum><text>for which such former officials personally had program oversight responsibility or decision-making authority when they served in the Armed Forces; or</text></subclause><subclause id="H836C2354AF8C4365A9651C10BBE99DEB"><enum>(II)</enum><text>that are the responsibility of the agency, office, or command in which such former officers served; and</text></subclause></clause></subparagraph><subparagraph id="HC3CD852AF9DC4F1D83A023E221B1D313"><enum>(B)</enum><text>to review and approve employment by foreign governments of such former officers in accordance with section 908 of title 37, United States Code, as amended by this Act; and</text></subparagraph></paragraph><paragraph id="HFAADD1F4E66A4CA590BC7BE610A6E553"><enum>(2)</enum><text>what is known about the effectiveness of existing statutes and regulations governing the employment of former officers of the Armed Forces, including—</text><subparagraph id="H776AC77ACD984F41A094E25B3D17C63B"><enum>(A)</enum><text>section 207 of title 18, United States Code;</text></subparagraph><subparagraph id="H91DF3348F2BB4E85822A4E0961B9E4C1" commented="no"><enum>(B)</enum><text>section 908 of title 37, United States Code, as in effect on the day before the date of the enactment of this Act; and</text></subparagraph><subparagraph id="HB673E5679A2946D4B364E5C0C2535E27"><enum>(C)</enum><text>the Foreign Agents Registration Act of 1938, as amended (<external-xref legal-doc="usc" parsable-cite="usc/22/611">22 U.S.C. 611 et seq.</external-xref>).</text></subparagraph></paragraph></subsection><subsection id="H75F2E4D99CD9402FB19DBABFA6E85B02"><enum>(c)</enum><header>Access to information</header><text>In accordance with the contract clause required pursuant to section 3841(d) of title 10, United States Code, and section 4706(d) of title 41, United States Code, contractors shall provide the Comptroller General with access to information requested by the Comptroller General for the purpose of preparing the report required by subsection (a).</text></subsection></section><section id="HEFC1FFCCEBBF4957ACBBE79DE7B6A294"><enum>13.</enum><header>Effective date; applicability</header><text display-inline="no-display-inline">The amendments made by this Act—</text><paragraph id="H3884BD1FB87B44AB87F59DAB5F4E0FA7"><enum>(1)</enum><text>take effect on the date of the enactment of this Act; and</text></paragraph><paragraph id="HF09C71D6CFBD40F4900E1F78FAD46526"><enum>(2)</enum><text>apply with respect to—</text><subparagraph id="H8BAB00529C87421C92327281F61CC507"><enum>(A)</enum><text>offers of employment or compensation described in subsection (a) of section 908 of title 37, United States Code, as amended by this Act, made on or after the date that is 120 days after such date of enactment;</text></subparagraph><subparagraph id="H0D65F08C2E5A4DCB9400A9C0FF5FAF93"><enum>(B)</enum><text>the provision of any payment, item, or award described in that subsection on or after that date;</text></subparagraph><subparagraph id="H87E3201C4D384F5F83ED88AB3D3AD0A0"><enum>(C)</enum><text>negotiations for employment described in subsection (e) of that section on or after that date; and</text></subparagraph><subparagraph id="H64E5C15C48704A4BA1483B2B6FFD6C3E"><enum>(D)</enum><text>agreements described in that subsection in effect on or after that date.</text></subparagraph></paragraph></section></legis-body></bill>
