which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Federal Energy Regulatory Commission to improve interregional electricity transfer capability between immediately adjacent transmission planning regions, and for other purposes.</official-title></form><legis-body id="HDA14A10A804541B7A11E5754684AFD80" style="OLC"><section id="H8EC12432E1604E4BA845F9EAAE43591A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Reinforcing the Grid Against Extreme Weather Act of 2024</short-title></quote>. </text></section><section id="H7135C09EC8474BC69E65C71ED071A267"><enum>2.</enum><header>Improving interregional electricity transfer capability</header><text display-inline="no-display-inline">Part II of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824">16 U.S.C. 824 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H1012393C49ED4991A7C0FC333C771E3D" display-inline="no-display-inline"><section id="H33EA75DE4DEF4B019DA5E0D41EC44740"><enum>224.</enum><header>Improving interregional electricity transfer capability</header><subsection id="HD2251F9B33234D3FA445AE1BFBF26EEB"><enum>(a)</enum><header>Rulemaking</header><text display-inline="yes-display-inline">Not later than 24 months after the date of enactment of this section, the Commission shall issue regulations to establish a process for—</text><paragraph id="HD549E4A5EC97498181FB3B4DFFAF1560"><enum>(1)</enum><text display-inline="yes-display-inline">calculating existing transfer capability between each transmission planning region and its immediately adjacent transmission planning region, such that—</text><subparagraph id="H6433D62584664200BF6B638E54456C1F"><enum>(A)</enum><text display-inline="yes-display-inline">each transmission planning entity for a given transmission planning region and the transmission planning entities for any immediately adjacent transmission planning region shall use the same method to calculate the transfer capability between them; and</text></subparagraph><subparagraph id="H5197D3A6339C42469F55B6952BFCD74E"><enum>(B)</enum><text display-inline="yes-display-inline">each shared method of calculation shall comply with requirements established by the Commission;</text></subparagraph></paragraph><paragraph id="H368F050BD338475FBB2D38B1AB6ECB6F"><enum>(2)</enum><text display-inline="yes-display-inline">determining a minimum transfer capability between each transmission planning region and its immediately adjacent transmission planning region in order to—</text><subparagraph id="H606955CC7B6343D3936495E99EF2DDE6"><enum>(A)</enum><text display-inline="yes-display-inline">ensure that each transmission planning region has sufficient electric transfer capability with immediately adjacent transmission planning regions to ensure reliability during impacts associated with weather events, physical events, or cyberattacks to the transmission planning region; and</text></subparagraph><subparagraph id="H57842485A066416D80AB634CDBEF61C3"><enum>(B)</enum><text display-inline="yes-display-inline">optimize achievement of the transmission benefits;</text></subparagraph></paragraph><paragraph id="H5087E04AB38F42A98A9FE180F4C1DA2D"><enum>(3)</enum><text display-inline="yes-display-inline">identifying, selecting, and allocating costs for individual interregional transmission projects needed to achieve each minimum transfer capability identified pursuant to paragraph (2); and</text></paragraph><paragraph id="H222BE96C3C334D5CA33911E3B6410A8E"><enum>(4)</enum><text display-inline="yes-display-inline">preventing the disclosure of information pertaining to cyberattacks that may compromise the security of the electricity system.</text></paragraph></subsection><subsection id="H826B6E99E54646038486A959F51FD334"><enum>(b)</enum><header>Filing a plan</header><paragraph id="H18FE166A512246D89D7E04CE0C898FF8"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 3 years after the date of enactment of this section, and at least every 5 years thereafter, the transmission planning entities for each pair of immediately adjacent transmission planning regions shall file with the Commission, and receive approval for, a plan that, in accordance with the regulations issued under subsection (a)—</text><subparagraph id="H6052139498F04207B5A39705EABF3D69"><enum>(A)</enum><text>evaluates and selects interregional transmission projects based on consideration of the transmission benefits; and</text></subparagraph><subparagraph id="HDC5FEBF6FD8D411284729EC0AED8CBAC"><enum>(B)</enum><text>achieves minimum interregional transfer capability.</text></subparagraph></paragraph><paragraph id="HB7A72B660DCC422C82C7A17C8E758473"><enum>(2)</enum><header>Duty of Commission</header><text>The Commission shall approve or deny a plan filed pursuant to paragraph (1) in consideration of the factors described in subsection (a)(2).</text></paragraph></subsection><subsection id="H70C11E90AFBF41F2A42118AB8BDFEC59"><enum>(c)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 48 months after the date on which the regulations are issued pursuant to subsection (a), and annually thereafter, the Commission shall publish in the Federal Register a report on the results of implementing this section.</text></subsection><subsection id="H123AF8F5EF12458789A328FD9E0B33A2"><enum>(d)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H20C59ADC692144D490CD4C5DFD522ADC"><enum>(1)</enum><header>Greenhouse gas</header><text>The term <term>greenhouse gas</term> includes each of the following:</text><subparagraph id="H0B9A7AEC25AA468F969196EF68C27D64"><enum>(A)</enum><text display-inline="yes-display-inline">Carbon dioxide.</text></subparagraph><subparagraph id="HDF49476FEA83463799A3E92462E21EF6"><enum>(B)</enum><text>Methane.</text></subparagraph><subparagraph id="H7562152660E24B6892BA12F433D95224"><enum>(C)</enum><text>Nitrous oxide.</text></subparagraph><subparagraph id="H656499CCA960490D8290495C6AA38502"><enum>(D)</enum><text>Sulfur hexafluoride.</text></subparagraph><subparagraph id="H9C1BF1F5833843FFBEAA288EAE10E743"><enum>(E)</enum><text>Any hydrofluorocarbon.</text></subparagraph><subparagraph id="H3594CD1C295B4FE1B5E9F7700B4454AE"><enum>(F)</enum><text>Any perfluorocarbon.</text></subparagraph><subparagraph id="H19FECAA003614955960EFB4F6D75133F"><enum>(G)</enum><text>Nitrogen trifluoride.</text></subparagraph><subparagraph id="HAF03DA2D0EA941FFB64AE5972F706945"><enum>(H)</enum><text>Any fully fluorinated linear, branched, or cyclic—</text><clause id="H2624AB52ED6545518ECFF66AE01A79A8"><enum>(i)</enum><text>alkane;</text></clause><clause id="HA1AD3CE2A67D42D6AB60F6CF31E8378E"><enum>(ii)</enum><text>ether;</text></clause><clause id="H0BE4BA1570E845FF914790F0918810BA"><enum>(iii)</enum><text>tertiary amine; or</text></clause><clause id="H7140EABD529B41448EE5905DA5D85AEF"><enum>(iv)</enum><text>amino ether.</text></clause></subparagraph><subparagraph id="H832FD6B07A754EC4885632129EFD491B"><enum>(I)</enum><text>Any perfluoropolyether.</text></subparagraph><subparagraph id="H09EF71034B8E4FA091CCBAF5DF9DE8E1"><enum>(J)</enum><text>Any hydrofluoropolyether.</text></subparagraph><subparagraph id="H005BB3C51AE649A794FF94332B8087EF"><enum>(K)</enum><text>Any other fluorocarbon, except for a fluorocarbon with a vapor pressure of less than 1 mm of Hg absolute at 25 degrees Celsius.</text></subparagraph></paragraph><paragraph id="H72835FA48AFA499C9E09F575D01CF707"><enum>(2)</enum><header>Transmission benefit</header><text>The term <term>transmission benefit</term> means a broad range of economic, operational, safety, security, resilience, public policy, environmental, and other reasonably anticipated benefit of constructing, modifying, or operating a transmission facility, including any benefit realized when real-time energy prices and operational conditions differ from those anticipated in the 48-hour ahead or day-ahead time frame. Such benefits include—</text><subparagraph id="H5C75A58252004BB89875B6132E37F6A7"><enum>(A)</enum><text>improved reliability;</text></subparagraph><subparagraph id="H1180CC79A9ED40858F788D3D8BA013B6"><enum>(B)</enum><text display-inline="yes-display-inline">improved resilience;</text></subparagraph><subparagraph id="H6047E344227C433FA10ABCC70C7C7D9F"><enum>(C)</enum><text>improved safety;</text></subparagraph><subparagraph id="H977C2FBD29594202A92A0FDC08000001"><enum>(D)</enum><text>reduced congestion;</text></subparagraph><subparagraph id="H83320B970F294DA6ABA31EAC4F387D81"><enum>(E)</enum><text>reduced power losses;</text></subparagraph><subparagraph id="H3DC79EB264DE45A8A36C6E075C855E50"><enum>(F)</enum><text>greater carrying capacity;</text></subparagraph><subparagraph id="H1C60BA87F3FB42EF9450CACC1E2BA699"><enum>(G)</enum><text>reduced operating reserve requirements;</text></subparagraph><subparagraph id="H52970282BDA84E1891E98FA70DCFFC5E"><enum>(H)</enum><text>improved access to lower-cost electricity generation;</text></subparagraph><subparagraph id="H5C582A7BE780412896F717E7C320B394"><enum>(I)</enum><text>improved access to electricity generating facilities with no direct emissions of greenhouse gases;</text></subparagraph><subparagraph id="HECF942305CCF41918229927868F2C188"><enum>(J)</enum><text>improved public health from the closure of electricity generation facilities that emit harmful pollution;</text></subparagraph><subparagraph id="HCC35C132325D45188FE3F3EABA57D32E"><enum>(K)</enum><text>increased competition and market liquidity in electricity markets;</text></subparagraph><subparagraph id="H57378960E8EF40DC820BA162ACA7F041"><enum>(L)</enum><text>improved energy resilience and reliability of Department of Defense installations;</text></subparagraph><subparagraph id="HEF8B83E91BCD42169D21C7873EF807DC"><enum>(M)</enum><text>optimizing use of existing transmission assets, including any existing rights of way;</text></subparagraph><subparagraph id="HDC5DACEAE8B74ADC8DA15F2DEC95FFE2"><enum>(N)</enum><text>other transmission costs avoided by the proposed transmission solution; and</text></subparagraph><subparagraph id="HF3EAD53F43CB485D9923E9DB5C2ECC2A"><enum>(O)</enum><text>other potential benefits of increasing the interconnectedness of the electric grid.</text></subparagraph></paragraph><paragraph id="H403EFF98231449E0B8C5DC3450C186C0"><enum>(3)</enum><header>Transmission planning entity</header><text>The term <term>transmission planning entity</term> means an entity responsible for planning for the deployment of electric transmission for a given transmission planning region.</text></paragraph><paragraph id="H7813FA9EA82D46B1B37C77F157FA15A4"><enum>(4)</enum><header>Transmission planning region</header><text display-inline="yes-display-inline">The term <term>transmission planning region</term> means a geographic area that the Commission finds sufficient to satisfy its requirements for the scope of regional transmission planning, as established in or in compliance with the following orders issued by the Commission:</text><subparagraph id="H1B0C40A52BC44991955E8DCA9ED8BAE6"><enum>(A)</enum><text><quote>Transmission Planning and Cost Allocation by Transmission Owning and Operating Public Utilities</quote> published in the Federal Register on October 12, 2012 (77 Fed. Reg. 64890); and</text></subparagraph><subparagraph id="H9F6B83DA3E194262B12139789A5B2541"><enum>(B)</enum><text display-inline="yes-display-inline"><quote>Building for the Future Through Electric Regional Transmission Planning and Cost Allocation</quote> published in the Federal Register on October 24, 2012 (77 Fed. Reg. 64890).</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
