which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To make publicly available information on sustainable aviation fuel production and imports, and for other purposes.</official-title></form><legis-body id="HA9E21E9B4D3C4DCE9FFB27BA80CBE93C" style="OLC"><section id="H72A0812ED1984E52A2DE58DB8F7A94F4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Sustainable Aviation Fuel Information Act</short-title></quote>.</text></section><section id="H33758FBE898E4BB8B92C33AA668F434E"><enum>2.</enum><header>Reported data</header><subsection id="HE0FA4C4FB8CA4717A0A3FD4AB4C3E85D"><enum>(a)</enum><header>Reported data</header><text display-inline="yes-display-inline">As soon as practicable after the date of enactment of this Act, the Secretary of Energy, acting through the Administrator of the Energy Information Administration, shall include in each report titled <quote>Petroleum Supply Monthly</quote> of the Energy Information Administration, each report titled <quote>Weekly Petroleum Status Report</quote> of the Energy Information Administration, and any other relevant report of the Energy Information Administration, as determined by the Administrator of the Energy Information Administration, data on sustainable aviation fuel, including—</text><paragraph id="H39AE5A2CCE87412E872E4CF40A26157A"><enum>(1)</enum><text>the type, origin, and volume of feedstock used in the production of sustainable aviation fuel—</text><subparagraph id="H24C5FF9EBF324939A096567B6F4F9106"><enum>(A)</enum><text>in each State or, if appropriate, Petroleum Administration for Defense District, as applicable;</text></subparagraph><subparagraph id="H7131319D874B47C5B364F0D9D243144B"><enum>(B)</enum><text>in the United States; and</text></subparagraph><subparagraph id="H611B4D58A57A4F8B9139E03671D819D0"><enum>(C)</enum><text>to the maximum extent practicable, in each foreign country, as applicable; and</text></subparagraph></paragraph><paragraph id="H0A36922B8E6A4934909486F25F4A4A1A"><enum>(2)</enum><text>the total amount of sustainable aviation fuel—</text><subparagraph id="HC98FED37F27F4BE5BBF0F3E3BDE69A9F"><enum>(A)</enum><text>produced—</text><clause id="H30A2135DFA2F492DA4EEE1C4FD192466"><enum>(i)</enum><text>in each State, as applicable; and</text></clause><clause id="H5842A5965BE44E44BC8B657E36E2BDC1"><enum>(ii)</enum><text>in the United States; and</text></clause></subparagraph><subparagraph id="H8A4E3F92B93A4CC28FA0B8F5205719AD"><enum>(B)</enum><text>imported from—</text><clause id="H8CE68ADEA14A433A8A58E052173CAD9B"><enum>(i)</enum><text>each foreign country, as applicable; and</text></clause><clause id="HB821002AC8DA4FDB9494CC8438725D60"><enum>(ii)</enum><text>all foreign countries, as applicable.</text></clause></subparagraph></paragraph></subsection><subsection id="HEE22C22F4C614593B11750FE2B05987C" commented="no"><enum>(b)</enum><header>Reporting requirements</header><text>Data published pursuant to this section shall be obtained using an accounting methodology that—</text><paragraph id="H62F8360F12D5428EA52E9914D70A856A" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text>is consistent with reliable statistical sampling techniques; and</text></paragraph><paragraph id="HAE9986E8304A4EBD953DE99F68E758E1" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">ensures no double counting of feedstock or fuel.</text></paragraph></subsection><subsection id="H88EA6CEE06AD47E19D80BF046D656BE0" commented="no"><enum>(c)</enum><header>Rule of construction</header><text>Nothing in this section affects the applicability of section 205 of the Department of Energy Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7135">42 U.S.C. 7135</external-xref>).</text></subsection></section><section id="H9DF7C5C090BB4530AADBCBB3F78BFD9D"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H399C6C178CC2435C976446AC6282E71D"><enum>(1)</enum><header>Applicable material</header><text>The term <term>applicable material</term> means—</text><subparagraph id="HA4FA41F43C3B43D882A4931180291FF0"><enum>(A)</enum><text>monoglycerides, diglycerides, and triglycerides;</text></subparagraph><subparagraph id="HAA718393946442B185D655628B238B64"><enum>(B)</enum><text>free fatty acids; and</text></subparagraph><subparagraph id="HDF3B7BD18F4C41FAA9D2476668BAF423"><enum>(C)</enum><text>fatty acid esters.</text></subparagraph></paragraph><paragraph id="H5D11576557D44593996B2A2DE21D8CC6"><enum>(2)</enum><header>Biomass</header><text>The term <term>biomass</term> has the meaning given such term in <external-xref legal-doc="usc" parsable-cite="usc/26/45K">section 45K(c)(3)</external-xref> of the Internal Revenue Code of 1986.</text></paragraph><paragraph id="H9FE3B1F38C36483E84F61FB8D94C20FD"><enum>(3)</enum><header>Lifecycle greenhouse gas emissions reduction percentage</header><text>The term <term>lifecycle greenhouse gas emissions reduction percentage</term> means, with respect to any sustainable aviation fuel, the percentage reduction in lifecycle greenhouse gas emissions achieved by such fuel as compared with petroleum-based jet fuel, as determined in accordance with—</text><subparagraph id="HA979CC3AE83F486CB66ED73B439AC8E0"><enum>(A)</enum><text>the most recent determinations under the Greenhouse gases, Regulated Emissions, and Energy use in Technologies (GREET) model developed by Argonne National Laboratory or any successor model developed by Argonne National Laboratory; or</text></subparagraph><subparagraph id="H4D53ECD4D6D64EB7B95560D3499C0AAA"><enum>(B)</enum><text>the most recent Carbon Offsetting and Reduction Scheme for International Aviation which has been adopted by the International Civil Aviation Organization with the agreement of the United States.</text></subparagraph></paragraph><paragraph id="HC5AFAE32ADFA4EA090657F5DC227A085"><enum>(4)</enum><header>Sustainable aviation fuel</header><text>The term <term>sustainable aviation fuel</term> means liquid fuel, the portion of which is not kerosene, which—</text><subparagraph id="H4237F2CBFF0D400E9D8AD45C8F41399A"><enum>(A)</enum><text>meets the requirements of—</text><clause id="H3E8FC72A49434EB98A644124553A9348"><enum>(i)</enum><text>ASTM International Standard D7566; or</text></clause><clause id="HEF73BFD793ED4BD08EFDCEED2BB34F40"><enum>(ii)</enum><text>the Fischer Tropsch provisions of ASTM International Standard D1655, Annex A1;</text></clause></subparagraph><subparagraph id="HF40D597D0CB644C69D73BC43D6742356"><enum>(B)</enum><text>is not derived from coprocessing an applicable material (or materials derived from an applicable material) with a feedstock which is not biomass;</text></subparagraph><subparagraph id="H704ACBF857AA42ED81C5739EC44E42F6"><enum>(C)</enum><text>is not derived from palm fatty acid distillates or petroleum; and</text></subparagraph><subparagraph id="H79710EEE732744FA9BBE31CC5B4F1429" commented="no"><enum>(D)</enum><text>has been certified as having a lifecycle greenhouse gas emissions reduction percentage of at least 50 percent.</text></subparagraph></paragraph></section></legis-body></bill>
