R. 9326</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20240809">August 9, 2024</action-date><action-desc><sponsor name-id="H001077">Mr. Higgins of Louisiana</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HAS00">Committee on Armed Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require United States shipyards to repay Federal financial assistance if they are sold to foreign persons, to prohibit the use of Federal funds for capital improvements at foreign-owned shipyards, and for other purposes.</official-title></form><legis-body id="H3B98601DEF3F487FBE74CBBB5FAD8D7B" style="OLC"><section id="H67BA413394DF4D69A5D25FE90E604643" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting American Investment in Shipbuilding Act of 2024</short-title></quote>.</text></section><section id="HFA5366F2A8374D42BC244C4568CC3AAA"><enum>2.</enum><header>Repayment of Federal financial assistance by shipyards purchased by foreign persons</header><subsection id="HAEB85601AD7F469982872C0F7B440E65"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">With respect to a United States shipyard that has received Federal financial assistance, if the shipyard becomes majority-owned or controlled by foreign persons or entities, the shipyard shall immediately pay to the Secretary of the Treasury, for deposit in the general fund, an amount equal to all Federal financial assistance previously received by the shipyard.</text></subsection><subsection id="H8E80F0901F154E76B13FD361B55493F5"><enum>(b)</enum><header>Rulemaking</header><text display-inline="yes-display-inline">The Secretary of the Treasury shall issue such rules as may be necessary to carry out this section.</text></subsection><subsection id="HFD1AE6BE80A24F869C3A2E8CAC0D9BE8"><enum>(c)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H5B115D93FBFA4F808F7D194B60148FD2"><enum>(1)</enum><header>Federal financial assistance</header><text display-inline="yes-display-inline">The term <quote>Federal financial assistance</quote> means any type of financial assistance (including grants, financing, tax credits, or otherwise) provided under any Federal program, including—</text><subparagraph id="HD6B3EEFEB5134564A3CBAFECEF3A283D"><enum>(A)</enum><text>title III of the Defense Production Act of 1950; or</text></subparagraph><subparagraph id="H352F8291AB0F4D56884D4D40E5234A5B"><enum>(B)</enum><text>the CARES Act or any amendment made by the CARES Act.</text></subparagraph></paragraph><paragraph id="H31607DC58A854BDAA83F4AB062B19CC3"><enum>(2)</enum><header>United States shipyard</header><text>The term <quote>United States shipyard</quote> means a shipyard that is majority-owned by United States persons.</text></paragraph></subsection></section><section id="H914EDDC25F1343BBB121F0696D19F7DA"><enum>3.</enum><header>Prohibition on using Federal funds for capital improvements for shipyards not wholly-owned by United States persons</header><text display-inline="no-display-inline">Notwithstanding any other provision of law, a shipyard that is not wholly-owned by United States persons may not use Federal funds for capital improvements.</text></section></legis-body></bill>
