R. 9249</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20240802">August 2, 2024</action-date><action-desc><sponsor name-id="E000246">Mr. Edwards</sponsor> (for himself and <cosponsor name-id="P000048">Mr. Pfluger</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 5, United States Code, to require the publication of scientific data, incident data, or other pertinent data relied on by an agency to justify a rule.</official-title></form><legis-body id="H34977CFA80994CE7A0B7235CB55AB252" style="OLC"><section id="H073029418FCE4418B495B0CD1FFD6A66" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Show Me the Science Act</short-title></quote>.</text></section><section id="H53CCF2345C7D47B38C01879D8FA4B4D3"><enum>2.</enum><header>Rulemaking requirements</header><text display-inline="no-display-inline">Section 553 of title 5, United States Code, is amended by adding at the end the following: </text><quoted-block style="USC" id="H4E2E0DF2D03846AC9DEA7384240F8173" display-inline="no-display-inline"><subsection id="H771CC541DFCB4EE7A7ECD3D1EA78850E"><enum>(f)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HE849B707878D4A1E94EE83E550C5688E"><enum>(1)</enum><text display-inline="yes-display-inline">The publication of a rule under subsection (d) shall include the scientific data, incident data, or other pertinent data relied on by the agency to justify the rule, except in the case that the head of the agency—</text><subparagraph id="H1EA07704DC7F4B7DAB356B8CD790B0CB"><enum>(A)</enum><text>determines, on a nondelegable basis, that publication of such data would impede public safety or security;</text></subparagraph><subparagraph id="H7EFCFF18C18B4DDA947F8EB09B2DD8C8"><enum>(B)</enum><text display-inline="yes-display-inline">submits to the Administrator of the Office of Information and Regulatory Affairs (referred to in this subsection as the <quote>Administrator</quote>) a notification disclosing the reasons for the determination under subparagraph (A); and</text></subparagraph><subparagraph id="H57F56EA25393487FB493D4A0EF90608D"><enum>(C)</enum><text>publishes such notification, consistent with public safety, security, and privacy interests, in the Federal Register.</text></subparagraph></paragraph><paragraph id="H13C780EBF81B4B1CB87A92DB4A074755" indent="up1"><enum>(2)</enum><text>The Administrator shall issue guidance for agencies on compliance with this section and shall monitor such compliance.</text></paragraph><paragraph id="H807E6FA3CE6F464D9EEC3AE102D94834" indent="up1"><enum>(3)</enum><text>In this subsection, the term <term>scientific data</term> means recorded factual material that is commonly accepted in the scientific community and is of sufficient quality to validate and replicate research findings.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
