R. 9248</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20240802">August 2, 2024</action-date><action-desc><sponsor name-id="D000626">Mr. Davidson</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 49, United States Code, to provide States the authority to limit blocking highway-rail grade crossings, and for other purposes.</official-title></form><legis-body id="H8C2E1646815D4633802C1CD49E48CE20" style="OLC"><section id="H94045725938B444F91A41B173F6AE0D5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Railroad Responsibility Act of 2024</short-title></quote>.</text></section><section id="H46B5A4E04341467FA1D868C63B1B5583"><enum>2.</enum><header>State authority to limit blocking highway-Rail grade crossings</header><subsection id="H3005C98F6FBB45C4A03EBD9F8F46E8DA"><enum>(a)</enum><header>General jurisdiction of Surface Transportation Board</header><text display-inline="yes-display-inline">Section 10501(c)(3) of title 49, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="HA421E2C040424A9FA12813237D7C41F9" display-inline="no-display-inline"><subparagraph id="H8E86ED01F9F84953AA6228E5ED5F7EF2" indent="up2"><enum>(C)</enum><header>State authority To limit blocking highway-Rail grade crossings</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, this title does not preempt a State from the adoption or enactment of any law, regulation, order, or other requirement related to limiting the duration that a railroad carrier may block a highway-rail grade crossing. </text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H66A2D40134B744D6A3F4936B8DC02280"><enum>(b)</enum><header>Preemption</header><text display-inline="yes-display-inline">Section 20106(a) of title 49, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="H78AC24456CA04237AB444E7B3459678F" display-inline="no-display-inline"><paragraph id="HCF42F19B39AB4BF2A189886FADBA6032" indent="up1"><enum>(3)</enum><header>State authority To limit blocking highway-Rail grade crossings</header><subparagraph id="H7D4047E88358482382C03A6091D3EC7D"><enum>(A)</enum><header>In general</header><text>Notwithstanding any other provision of law, this title does not preempt a State from the adoption or enactment of any law, regulation, order, or other requirement related to limiting the duration that a railroad carrier may block a highway-rail grade crossing.</text></subparagraph><subparagraph id="H29490E034C634DF1A26C22A17EFC66AC"><enum>(B)</enum><header>State defined</header><text display-inline="yes-display-inline">In this paragraph, the term <term>State</term> means a State of the United States and the District of Columbia.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
