<section id="H81D149AE2CB54AC79C7FAB5C3462678E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Marine Energy Technologies Acceleration Act</short-title></quote>.</text></section> <section id="HD37BCB258D664DFF876507637E6AD1DE"><enum>2.</enum><header>Marine energy acceleration</header> <subsection id="H545D0C7F7F284731AED125F203D773DA"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H19E186DEA7C3436B9B3CA564E21EE1C0"><enum>(1)</enum><header>Fund</header><text>The term <term>Fund</term> means the Marine Energy Acceleration Fund established under subsection (b).</text></paragraph> <paragraph id="H68B1FEA5B2DE4C5EA97A1AE9716CD2E7"><enum>(2)</enum><header>Marine energy</header><text display-inline="yes-display-inline">The term <term>marine energy</term> has the meaning given that term in section 632 of the Energy Independence and Security Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/42/17211">42 U.S.C. 17211</external-xref>).</text></paragraph> 
<paragraph id="HA5C08CC488494161B16691DE0E74A80D"><enum>(3)</enum><header>National Marine Energy Centers</header><text display-inline="yes-display-inline">The term <term>National Marine Energy Centers</term> means the National Marine Energy Centers referred to in, or established under, section 636 of the Energy Independence and Security Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/42/17215">42 U.S.C. 17215</external-xref>). </text> </paragraph> <paragraph id="HAF0A5A9FBEF947FC884D833CD8AFA8F9"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Energy.</text></paragraph></subsection> 
<subsection id="HAAB0B1FD427D4D95B161B4991E05E969"><enum>(b)</enum><header>Marine energy technologies acceleration fund</header> 
<paragraph id="HDADA11E5037F42B899FB0AFA56B5A1E9"><enum>(1)</enum><header>Establishment</header><text>The Secretary shall establish a fund, to be known as the <quote>Marine Energy Technologies Acceleration Fund</quote>.</text></paragraph> <paragraph id="HA96EF47BDF434353B8288D10EE9BF9FC"><enum>(2)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Fund $1,000,000,000, to remain available until expended.</text></paragraph></subsection> 
<subsection id="HD3BADF5430364F818ADA6D164CE622E4"><enum>(c)</enum><header>Marine energy demonstration projects</header> 
<paragraph id="H9D6FACBEF21B462D9C4F318CADDF8A62"><enum>(1)</enum><header>In general</header><text>The Secretary shall conduct competitive solicitations for not fewer than twenty marine energy technology demonstration projects that export power to microgrids, community grids, or utility-scale grids.</text></paragraph> <paragraph id="HCA46AEE4D2DE473891FD0ABFF365BEC3"><enum>(2)</enum><header>Coordination</header><text>In carrying out this subsection, the Secretary may coordinate with the National Marine Energy Centers, non-profits that promote the growth and development of the blue economy, universities with relevant facilities and access to marine energy resources, and other entities with proven technical expertise to support marine energy demonstration projects.</text></paragraph> 
<paragraph id="H3284B3B937E64C1C8EE3349C5F2D3B57"><enum>(3)</enum><header>Priority</header><text>In carrying out this subsection, the Secretary shall prioritize—</text> <subparagraph id="H63E06FA1D4824E8DB49F2BF66BB49F7E"><enum>(A)</enum><text display-inline="yes-display-inline">projects that integrate marine energy technologies with existing onshore and offshore transmission infrastructure, nearshore marine structures, or projects with all necessary local, State, and Federal licenses or permits in place;</text></subparagraph> 
<subparagraph id="H898A19E698C84140AD6CD74A30D77BAB"><enum>(B)</enum><text display-inline="yes-display-inline">open water prototype testing for more mature and advanced microgrid, community grid, or utility-scale grid marine energy technologies nearing market adoption;</text></subparagraph> <subparagraph id="H0945A06E25B148EC8CE0598C3DF0B8ED"><enum>(C)</enum><text>projects that support energy resilience and economic sustainability for rural and remote disadvantaged communities, Tribal communities, and communities of color; and</text></subparagraph> 
<subparagraph id="H0EE9BE9E810448A79C506ECD2234F386"><enum>(D)</enum><text>projects that power ocean-based scientific research and education, and support workforce development, national security, and commercial activities limited by the availability of existing energy resources.</text></subparagraph></paragraph> <paragraph id="HAC084D270B6E4815BA21C24C033B727F"><enum>(4)</enum><header>Funds</header><text>Of the amounts in the Fund, $600,000,000 shall be available to the Secretary to carry out this subsection.</text></paragraph></subsection> 
<subsection id="HCABB2D2D85944EDEAE0533F0F9393F3D"><enum>(d)</enum><header>Advancement of marine energy technologies</header> 
<paragraph id="H0C71FF65E46C4A9BB7A69A7989C3E1A1"><enum>(1)</enum><header>In general</header><text>The Secretary shall conduct competitive solicitations for—</text> <subparagraph id="HF7746AE52C934AF6A22CE866DC1E0FE8"><enum>(A)</enum><text>research and development projects to advance marine energy technologies; and</text></subparagraph> 
<subparagraph id="H1744B005DEF049289D8CBE149151A714"><enum>(B)</enum><text display-inline="yes-display-inline">upgrades to research and development facilities that advance marine energy technologies.</text></subparagraph></paragraph> <paragraph id="HBF3EBAC817334366B771A22D05BCF07F"><enum>(2)</enum><header>Coordination</header><text display-inline="yes-display-inline">In carrying out this subsection, the Secretary may coordinate with the National Marine Energy Centers, non-profits that promote the growth and development of the blue economy, universities with relevant facilities and access to marine energy resources, entities with all necessary local, State, and Federal licenses or permits in place, National Laboratories, Federal agencies involved in the development of marine energy technology, other existing marine energy research and development programs, and other entities with proven technical expertise to support marine energy research, development, and commercialization.</text></paragraph> 
<paragraph id="HDD4704A1D9404270A341C87C8193DC38"><enum>(3)</enum><header>Priority</header><text>In carrying out this subsection, the Secretary shall prioritize research and development projects that—</text> <subparagraph id="H163B98FC7A434521936D2B85EBEB25E1"><enum>(A)</enum><text>rapidly design, fabricate, and test marine energy systems, subsystems, components, controls, domestic manufacturing, and materials in order to advance efficiency, reduce costs, reduce environmental impacts, increase power production, and improve reliability at a variety of technology readiness levels;</text></subparagraph> 
<subparagraph id="HA5FB8CC93BE4472CAE77C8098FAA49B7"><enum>(B)</enum><text>can be used to educate the public, policymakers, investors, educators, and other stakeholders about the potential for deployment of marine energy technologies, and identify the needs and concerns of local communities where projects may be placed; and</text></subparagraph> <subparagraph id="H36F1EEB5315D4AAFBE947C99FE9BE18B"><enum>(C)</enum><text>support the development of technologies to monitor and mitigate impacts to marine and coastal ecosystems and communities.</text></subparagraph></paragraph> 
<paragraph id="H9B5EFB83CBC846318652960DFA93E5B7"><enum>(4)</enum><header>Funds</header><text>Of the amounts in the Fund—</text> <subparagraph id="HA25A490FFFA14B2687F64DE5998ECAC0"><enum>(A)</enum><text>$230,000,000 shall be available to the Secretary for technology research and development activities under this subsection; and</text></subparagraph> 
<subparagraph id="HF53D15A4759F4BBD8A8AAC9C0020E12B"><enum>(B)</enum><text>$20,000,000 shall be available to the Secretary for providing marine energy and education activities under this subsection through the National Marine Energy Centers.</text></subparagraph></paragraph></subsection> <subsection id="H09AB215647D54FEDA50159222A15CD1D"><enum>(e)</enum><header>Assessment of technical resource potential</header> <paragraph id="H6757C6849D2542A29E6992A4BAD9BB1D"><enum>(1)</enum><header>In general</header><text>The Secretary, in coordination with the National Oceanic and Atmospheric Administration, the Bureau of Ocean Energy Management, and other agencies, as appropriate, shall assess the technical resource potential of marine energy at not fewer than 50 sites that previous agency assessments and modeling have determined to have significant marine energy potential.</text></paragraph> 
<paragraph id="H43F71BC537354E9AA33A81E03598AD87" commented="no"><enum>(2)</enum><header>Requirements</header><text>In carrying out this subsection, the Secretary shall—</text> <subparagraph id="H3BE9E250325F49179CE7BA64B9273B92" commented="no"><enum>(A)</enum><text>develop in-depth marine energy resource and conditions characterizations for each site;</text></subparagraph> 
<subparagraph id="HBE37A23048E34B168F7DCECB493A999A" commented="no"><enum>(B)</enum><text>deploy environmental monitoring technologies, tools, and data collection to understand and mitigate potential environmental risks, characterize potential conflicts with other users of the local marine resources, optimize marine energy devices and arrays, and reduce costs; </text> </subparagraph> <subparagraph id="H26C1589B24B74A4E90D69B09788E4AE1" commented="no"><enum>(C)</enum><text>ensure, to the maximum extent practicable, that the sites are geographically distributed to assess marine energy resources and technologies in different regions of the United States;</text></subparagraph> 
<subparagraph id="H9B8932A507C44E7B85D2E0851EA55F13" commented="no"><enum>(D)</enum><text display-inline="yes-display-inline">where applicable, carry out technical resource assessments in coordination with Regional Ocean Partnerships of the National Oceanic and Atmospheric Administration Office for Coastal Management; and</text></subparagraph> <subparagraph id="H70F747D6903142B39A84192F57E5DA6A" commented="no"><enum>(E)</enum><text display-inline="yes-display-inline">use such technical resource assessments to inform the location of the marine energy technology demonstration projects under subsection (c).</text></subparagraph></paragraph> 
<paragraph id="HAF88D4F7F248470C8ECA999F20885E0D"><enum>(3)</enum><header>Data sharing</header><text>Data collected under this subsection shall be shared with public data repositories for use among regional ocean data portals and partnerships.</text></paragraph> <paragraph id="H4D99850F181D494DBE1B587C4744B6C6"><enum>(4)</enum><header>Funds</header><text>Of the amounts in the Fund, $50,000,000 shall be available to the Secretary to carry out this subsection.</text></paragraph></subsection> 
<subsection id="H060EABDF4B01451D8BC51A6F994970B1"><enum>(f)</enum><header>Improvement of permitting</header> 
<paragraph id="HE57672D6546F4952BB2A6D5C3FA10B42"><enum>(1)</enum><header>In general</header><text>The Secretary, in coordination with the Federal Energy Regulatory Commission, the Bureau of Ocean Energy Management, the National Oceanic and Atmospheric Administration, the Corps of Engineers, and other agencies as needed, shall convene a task force with the appropriate Federal and State agencies to prepare a report that—</text> <subparagraph id="H9A208B14475647B399BA9D35EB5D5420"><enum>(A)</enum><text>describes any barriers under the jurisdiction of such agencies to the development of marine energy technology projects; and</text></subparagraph> 
<subparagraph id="H694D8753EE424253A88B0F9DD8F2DCBF"><enum>(B)</enum><text>provides recommendations on reducing such barriers, including identification and determination of opportunities to improve the regulatory process associated with the authorities required to deploy and license marine energy technology projects, consistent with the National Environmental Policy Act.</text></subparagraph></paragraph> <paragraph id="H870CF01E4ED64BAFAC8359FB3DEE0902"><enum>(2)</enum><header>Requirements</header><text>The task force convened under paragraph (1) shall—</text> 
<subparagraph id="HE88DD5711FC5490FA2B850FA5F42F4D6"><enum>(A)</enum><text>develop recommendations for efficient permitting processes that reduce the time, cost, and uncertainty for marine energy projects, consistent with the National Environmental Policy Act;</text></subparagraph> <subparagraph id="HFD6D206EB51647D19208ECC3584CF79C"><enum>(B)</enum><text>determine whether additional staff are required to be hired and trained at the appropriate Federal agencies to process permits and conduct environmental reviews in a timely and efficient manner;</text></subparagraph> 
<subparagraph id="H0E92C09BABFD498E8242C6154DE94BA4"><enum>(C)</enum><text>conduct outreach to stakeholders;</text></subparagraph> <subparagraph id="H55DC73AB9E3B434F86AE7F5DF9884F3C"><enum>(D)</enum><text>facilitate Federal coordination with State permitting processes for marine energy projects, including by providing staff training for State and territory permitting agencies; and</text></subparagraph> 
<subparagraph id="H2494A8DD5F674273841079D57CF9C124" commented="no"><enum>(E)</enum><text>not later than 1 year after the date of enactment of this Act, submit to Congress the report prepared under paragraph (1).</text></subparagraph></paragraph> <paragraph id="HBD69808A66614D01BA219B873C2F3F5F"><enum>(3)</enum><header>Funds</header><text>Of the amounts in the Fund, to carry out this subsection—</text> 
<subparagraph id="HB7D78B717BF740C6B62428DE9F4E948E"><enum>(A)</enum><text>$5,000,000 shall be available to the Department of Energy;</text></subparagraph> <subparagraph id="H7732B4A71DB9448DAFA0C0E264F21A56"><enum>(B)</enum><text>$5,000,000 shall be available to the Federal Energy Regulatory Commission; and</text></subparagraph> 
<subparagraph id="H46CFB6F4600D43C0ABF385694A66186A"><enum>(C)</enum><text>$5,000,000 shall be available to the Bureau of Ocean Energy Management.</text></subparagraph></paragraph></subsection> <subsection id="H135D02FB0C974AA9A6ECF0D2E23BFBDE"><enum>(g)</enum><header>Workforce</header> <paragraph id="HDD730D29A42143A2996F78D058104C57"><enum>(1)</enum><header>Assessment</header><text>Not later than 2 years after the date of enactment of this Act, the Secretary shall conduct a national assessment of—</text> 
<subparagraph id="H8D20F3311EE64F8D9FA3A36598BA6948"><enum>(A)</enum><text>the prospective marine energy workforce and hiring needs; and</text></subparagraph> <subparagraph id="H31DD1C8BA9D547E8B4CE9F3FE39B43CB"><enum>(B)</enum><text>the educational pathways and programs that would address those needs.</text></subparagraph></paragraph> 
<paragraph id="H2CA52E5DF3F147EABD5897A1C6FDA004"><enum>(2)</enum><header>Development programs</header><text>The Secretary shall launch workforce development programs based on the assessment conducted under paragraph (1), in partnership with the National Marine Energy Centers, the marine energy industry, institutions of higher education, labor unions, non-profits, and career and technical education programs.</text> </paragraph> <paragraph id="HDBFCC5712B59430BA876653E531E1D6E"><enum>(3)</enum><header>Priority</header><text display-inline="yes-display-inline">In carrying out this subsection, the Secretary shall prioritize workforce development programs in communities near the location of the marine energy technology demonstration projects under subsection (c).</text></paragraph> 
<paragraph id="H3EAC35DCEA30462488BA71D334BB1DC3"><enum>(4)</enum><header>Funds</header><text>Of the amounts in the Fund, $85,000,000 shall be available to the Secretary to carry out this subsection.</text></paragraph></subsection></section> </legis-body></bill>
