which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 18, United States Code, to provide for transportation and subsistence for criminal justice defendants, and for other purposes.</official-title></form><legis-body id="H2E334E67C8974F8C98010897007BFC21" style="OLC"><section section-type="section-one" id="H165D4361B60F415B8212BDCD36987A72"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Criminal Judicial Administration Act of 2024</short-title></quote>.</text></section><section id="H9B3DEB26EEF24316B70482A71FFF8743"><enum>2.</enum><header>Transportation and subsistence for criminal justice act defendants</header><text display-inline="no-display-inline">Section 4285 of title 18, United States Code, is amended in the first sentence—</text><paragraph id="H133F1C02D0A344E2A43DAE8622345DFD"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>when the interests of justice would be served thereby and the United States judge or magistrate judge is satisfied, after appropriate inquiry, that the defendant is financially unable to provide the necessary transportation to appear before the required court on his own</quote> and inserting <quote>when the United States judge or magistrate judge is satisfied that the defendant is indigent based on appointment of counsel pursuant to section 3006A, or, after appropriate inquiry, that the defendant is financially unable to provide necessary transportation</quote>;</text></paragraph><paragraph id="H3EEA4256A7444CAFAE2A628D7DDF9A94"><enum>(2)</enum><text display-inline="yes-display-inline">by striking <quote>to the place where his appearance is required,</quote> and inserting <quote>to the place where each appearance is required and back to the place of the person’s arrest or bona fide residence,</quote>; and</text></paragraph><paragraph id="H143D6E427D184159BD6E91A4E7D7E5C4"><enum>(3)</enum><text display-inline="yes-display-inline">by striking <quote>to his destination</quote> and inserting <quote>, which includes money for both lodging and food, during travel to the person’s destination and during any proceeding at which the person’s appearance is required</quote>.</text></paragraph></section><section id="H4109325F84BE4701AE73D3A93918371C"><enum>3.</enum><header>Effective use of magistrate judges to decide postjudgment motions</header><text display-inline="no-display-inline">Section 3401 of title 18, United States Code, is amended—</text><paragraph id="H3112C4ED181F4BF987ADC797C019CFEA"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph id="H2B944876A3684C5EA6BB8140CD4B7ABE"><enum>(A)</enum><text>in the second sentence—</text><clause commented="no" display-inline="no-display-inline" id="H634F1B55FA4244039961FACB964F74ED"><enum>(i)</enum><text display-inline="yes-display-inline">by striking <quote>and</quote> after <quote>trial, judgment,</quote>; and</text></clause><clause id="H987B21D7C20A4ED2AC53DD4708856752"><enum>(ii)</enum><text>by inserting <quote>, and rulings on all post-judgment motions</quote> after <quote>sentencing</quote>; and</text></clause></subparagraph><subparagraph id="H67ECEDCD18F74EE99C18C7E1DA17E21B"><enum>(B)</enum><text>in the third sentence—</text><clause commented="no" display-inline="no-display-inline" id="H9CC99CCEBC484F3E8AC0D6709D7F3D4F"><enum>(i)</enum><text display-inline="yes-display-inline">by striking <quote>and</quote> after <quote>trial, judgment,</quote>; and</text></clause><clause id="HA9A8666702AE4E72A057B898547712C6"><enum>(ii)</enum><text>by inserting <quote>, and rulings on all post-judgment motions</quote> after <quote>sentencing</quote>;</text></clause></subparagraph></paragraph><paragraph id="H5FFD9ADF967544CFA240EC91EAEE79AC"><enum>(2)</enum><text>in subsection (c), by striking <quote>, with the approval of a judge of the district court,</quote>; and</text></paragraph><paragraph id="H67FE949E66B645B2A3C394C8AA4D96B2"><enum>(3)</enum><text>by inserting after subsection (i) the following:</text><quoted-block style="OLC" id="H094591F08DAB481E9F9ABD7485FCA5FE"><subsection id="HD85545BC0FB74607AB1BDA02D295CC48"><enum>(j)</enum><text>A magistrate judge who exercises trial jurisdiction under this section, in either a petty offense case or a misdemeanor case in which the defendant has consented to a magistrate judge, may also rule on all post-judgment motions in that case, including petitions for writs of habeas corpus, petitions for writs of coram nobis, motions to vacate a sentence under section 2255 of title 28, and motions related to mental competency under chapter 313 of this title.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
