which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require an evaluation of the nuclear supply chain of the United States to further reduce regulatory barriers and associated costs for nuclear supply chain manufacturers, and for other purposes.</official-title></form><legis-body id="HA1DA4898A3DD4EA3A1702A9A5572BB1F" style="OLC"><section id="HE248A38B70854BB892C1681CDAB1C404" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Atomic Supply Chain Solutions Act</short-title></quote>. </text></section><section id="H3CA40FFECB1F4554B69B793109F5CD9B" commented="no"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="HC80570BD501647239CA69F2804C8DA4B" commented="no"><enum>(1)</enum><text>The United States remains an esteemed global leader in the area of nuclear safety.</text></paragraph><paragraph id="H3FBF850270174B00B88DF911C44FE6D5" commented="no"><enum>(2)</enum><text>The strength of the nuclear supply chain of the United States is directly tied to the growth of the nuclear energy sector.</text></paragraph></section><section id="H723F22F1312D41178FFE5E7A015CB868" commented="no"><enum>3.</enum><header>Nuclear supply chain evaluation</header><subsection id="HF82452F9B50E4300B044B6DE41E1731D" commented="no"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 270 days after the date of enactment of this Act, the Secretary of Energy shall develop and submit to the appropriate congressional committees an evaluation of the nuclear supply chain of the United States.</text></subsection><subsection id="HE0DF742126DD4E0EB5592C9F14283F73" commented="no"><enum>(b)</enum><header>Contents</header><paragraph id="H9DC7782A603E49C6B7EDCEE339A19051" commented="no"><enum>(1)</enum><header>Building up at the right time</header><text display-inline="yes-display-inline">The evaluation developed and submitted under subsection (a) shall include a general description of—</text><subparagraph id="HFB9D0B574F1E49E391424439AF05E861" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">past efforts within the nuclear supply chain of the United States to meet increased demand;</text></subparagraph><subparagraph id="HB65AA004303E4B6DA80D17B0B97337A7" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">the importance of proactively bolstering the nuclear supply chain of the United States in order to meet future demand for nuclear energy; and</text></subparagraph><subparagraph id="HD4ECCF04171B49879B88AEED8A334711" commented="no"><enum>(C)</enum><text>lessons learned from the construction of Vogtle 3 and 4 in Georgia, including an analysis of how the nuclear supply chain of the United States operated during such construction and any improvements that could be made to assist with future nuclear construction projects, including workforce and supply chain considerations.</text></subparagraph></paragraph><paragraph id="HC793C76D95AF4B078BD46A99F43B8392" commented="no"><enum>(2)</enum><header>Component regulatory challenges</header><text display-inline="yes-display-inline">The evaluation developed and submitted under subsection (a) shall include—</text><subparagraph id="H2B38A4859658466A83822B007819FD3A" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">an analysis of whether the requirement for an N–stamp is appropriate and necessary, as determined through the use of probabilistic methodology or other similar methods, for certain nuclear components and materials (selected by the Secretary of Energy) that currently require an N–stamp;</text></subparagraph><subparagraph id="HE1DC40F87CA945BEA62C37292534161B" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">a general analysis of the costs associated with regulatory requirements relating to—</text><clause id="HE21BB51CE2AF4A7DAD5E45ABB182214C" commented="no"><enum>(i)</enum><text>safety-related nuclear components and materials that receive appropriate ASME certification;</text></clause><clause id="H81BFCDC59A4D4C1287568B681EC0AEFB" commented="no"><enum>(ii)</enum><text>safety-related nuclear components and materials that do not receive appropriate ASME certification but instead receive acceptance by the Nuclear Regulatory Commission through commercial grade dedication; and</text></clause><clause id="HC9E05965677C48E18757FC7DB2A398DC" commented="no"><enum>(iii)</enum><text>nonsafety-related nuclear components and materials that do not have to obtain a relevant quality assurance requirement;</text></clause></subparagraph><subparagraph id="HBE07BF4B03564456BFB2C5449221AE06" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">identification of potential ways to streamline the acquisition and maintenance of N–stamps and other similar certifications for entities that already have obtained such N–stamps or other similar certifications; and</text></subparagraph><subparagraph id="HFDED74F0BDEF4D12BB91F116772ADF07" commented="no"><enum>(D)</enum><text display-inline="yes-display-inline">an analysis of N–stamps being effective for a total of a period of 3 years, whether such period could be increased, and what impact such an increase would have on safety and the cost associated with obtaining an N–stamp.</text></subparagraph></paragraph><paragraph id="H0DD3CBC71881412F99A7FAAB4E0CDD4F" commented="no"><enum>(3)</enum><header>Advanced manufacturing and innovative technologies</header><subparagraph id="H640EC0392339407AA780ECCAB55B05EE" commented="no"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The evaluation developed and submitted under subsection (a) may include an analysis of potential uses and benefits that advanced manufacturing and innovative technologies, such as 3D printing, advanced modeling and simulation, augmented reality training, artificial intelligence, robotics, and drones, can provide to the nuclear supply chain of the United States, if the Secretary determines such analysis to be pertinent.</text></subparagraph><subparagraph id="HB351BEC2697E4D21A347EBD18C2B40AC" commented="no"><enum>(B)</enum><header>Inclusions</header><text>The analysis under subparagraph (A) may include a general description of—</text><clause id="H7854E2048E774919B5EAF6F1C8F02F8A" commented="no"><enum>(i)</enum><text>the current status of innovative technologies described in such subparagraph with respect to the use of such technologies within the nuclear supply chain of the United States;</text></clause><clause id="H59BDC9F0FC4541588F1B1D87D69A2669" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">potential uses for such technologies within the nuclear supply chain of the United States, including use for—</text><subclause id="H15FA065C55E640448D05A9CC45F10E22" commented="no"><enum>(I)</enum><text>reducing cybersecurity vulnerabilities;</text></subclause><subclause id="H4A80F58A5A1E475A8061B2A7DDE79AFF" commented="no"><enum>(II)</enum><text>maximizing the efficiency and effectiveness of transporting nuclear components and materials;</text></subclause><subclause id="H4D2A5798B9544A639FA9EEDAB23130DD" commented="no"><enum>(III)</enum><text>examining the technology readiness of individual components, including structural and thermal analysis;</text></subclause><subclause id="HA9BEFF2E031C42708D73AB33EF4B204E" commented="no"><enum>(IV)</enum><text>predicting maintenance schedules and subsequent costs;</text></subclause><subclause id="H30D5205FD1D84FB280706375B4DB217D" commented="no"><enum>(V)</enum><text>training nuclear supply chain workforce participants;</text></subclause><subclause id="H0E79D1B0BBD64EB8AAC200126BF9C65B" commented="no"><enum>(VI)</enum><text>identifying counterfeit nuclear components and materials; and</text></subclause><subclause id="H2912863849B24FA8AE2E9FD26C5418D7" commented="no"><enum>(VII)</enum><text display-inline="yes-display-inline">any other use that may be relevant;</text></subclause></clause><clause id="H0E0FF01F28A04CAF99583CB781FC42A9" commented="no"><enum>(iii)</enum><text>economic considerations associated with such technologies; and</text></clause><clause id="HD1A2B825177F4E78B3A9DF9F570ABB12" commented="no"><enum>(iv)</enum><text display-inline="yes-display-inline">potential challenges associated with such technologies, including potential regulatory challenges with respect to the use of such technologies within the nuclear supply chain of the United States.</text></clause></subparagraph></paragraph><paragraph id="HFD0CA3390D154982A118604532B33D0E" commented="no"><enum>(4)</enum><header>Allied cooperation</header><text display-inline="yes-display-inline">The evaluation developed and submitted under subsection (a) shall include a general description of—</text><subparagraph id="H35357CED7449472CAD06E3D1183954FD" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">the relationship between the United States and Canada with respect to nuclear components and materials, including recommendations on bolstering nuclear-related collaboration with Canada to extend North American civil nuclear energy leadership around the world; and</text></subparagraph><subparagraph id="HE7606D254A4D407194247B1835AA0D5B" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">whether certain nuclear components and materials that are manufactured in the United States, as selected by the Secretary of Energy, are cost competitive with similar nuclear components and materials that are manufactured internationally.</text></subparagraph></paragraph><paragraph id="HDA5B769AD8B14EC4B3EC95A04C74A134" commented="no"><enum>(5)</enum><header>Advanced nuclear demand</header><text display-inline="yes-display-inline">The evaluation developed and submitted under subsection (a) shall include a description of how advanced nuclear technology, including the anticipated increased demand for advanced nuclear technology, will impact the existing nuclear supply chain of the United States, and recommendations for increasing the resiliency of the nuclear supply chain of the United States to prepare for such increased demand.</text></paragraph></subsection></section><section id="HB36E6765DA45452FB6C3FA48427C14FD" commented="no"><enum>4.</enum><header>Statement of policy on HALEU</header><text display-inline="no-display-inline">It is the policy of the United States to prioritize establishing a robust, diversified domestic high-assay, low enriched uranium (HALEU) market that will ultimately strengthen the energy independence and national security of the United States while reducing procurement and national security risks associated with HALEU, especially with the anticipated increased demand for advanced nuclear technology.</text></section><section id="H3BBACF07020546189308F3513ABC97BE" commented="no"><enum>5.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H71D8BE09CFC942539A541F4136D1A006" commented="no"><enum>(1)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means—</text><subparagraph id="H41A06EAE7B5141A1879452AE587CB4D1" commented="no"><enum>(A)</enum><text>the Committee on Energy and Commerce of the House of Representatives; and</text></subparagraph><subparagraph id="H89563842535F412AB64AA15D7D0DFC94" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">the Committee on Environment and Public Works and the Committee on Energy and Natural Resources of the Senate.</text></subparagraph></paragraph><paragraph id="HA1CC8389C6F445E490B4E2C69BA4DC96" commented="no"><enum>(2)</enum><header>Artificial intelligence</header><text>The term <term>artificial intelligence</term> has the meaning given such term in section 5002 of the National Artificial Intelligence Initiative Act of 2020 (<external-xref legal-doc="usc" parsable-cite="usc/15/9401">15 U.S.C. 9401</external-xref>).</text></paragraph><paragraph id="HA9F54342704F48CC8D9806AF4CDEA9A7"><enum>(3)</enum><header>ASME</header><text display-inline="yes-display-inline">The term <term>ASME</term> means the American Society for Mechanical Engineers.</text></paragraph><paragraph id="H0B2990D3011747C59FACCB1107DDD96B"><enum>(4)</enum><header>N–stamp</header><text display-inline="yes-display-inline">The term <term>N–stamp</term> means the ASME Nuclear Certification.</text></paragraph><paragraph id="H363C528F9586489FBDBDB23F32A98508"><enum>(5)</enum><header>Nuclear components and materials</header><text>The term <term>nuclear components and materials</term> includes—</text><subparagraph id="H03B3C63EEB884D648E7DFCC2797EAF69" commented="no"><enum>(A)</enum><text>reactor pressure vessels;</text></subparagraph><subparagraph id="H0FBAF79F734D4A29AE75C5B806CA53E5" commented="no"><enum>(B)</enum><text>thermocouples;</text></subparagraph><subparagraph id="HE626EFDB58324261BA837E9BC6B55EC1" commented="no"><enum>(C)</enum><text>heat exchangers;</text></subparagraph><subparagraph id="H3481B337DFA94213BC8A182CF09F0B1D" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text>pumps;</text></subparagraph><subparagraph id="H301956CE4C3A4BAE80A1AA733416603A" commented="no"><enum>(E)</enum><text>sensors;</text></subparagraph><subparagraph id="H0F7045548E264CA391D40A60CE3E88DB" commented="no"><enum>(F)</enum><text>piping;</text></subparagraph><subparagraph id="H5121E1D4668D498CAE00CA50073F276B" commented="no"><enum>(G)</enum><text>castings;</text></subparagraph><subparagraph id="HD9637BC62A9C4FF98583B59AE7DA5620" commented="no"><enum>(H)</enum><text>structural steel;</text></subparagraph><subparagraph id="H5AA61AEBEB774DCFA7793AC55BBFCF92" commented="no"><enum>(I)</enum><text>concrete;</text></subparagraph><subparagraph id="HFFBEF6D3691E4936B11E8DC620073915" commented="no"><enum>(J)</enum><text>cabling;</text></subparagraph><subparagraph id="HB482F1D9148A48CA8484E769CA497624" commented="no"><enum>(K)</enum><text>nuclear grade graphite;</text></subparagraph><subparagraph id="H9EFDEDF7C31A4CDC870769685A9B5239" commented="no" display-inline="no-display-inline"><enum>(L)</enum><text>helium;</text></subparagraph><subparagraph id="H9E53D084541B44F0A9FBD848BCD7178D" commented="no"><enum>(M)</enum><text>sodium;</text></subparagraph><subparagraph id="HA8CD53FF4E1A487D8248725039CBC583" commented="no"><enum>(N)</enum><text>molten salts;</text></subparagraph><subparagraph id="H4C365A263BB14E59AD05CD71DCDE6602" commented="no"><enum>(O)</enum><text>beryllium; and</text></subparagraph><subparagraph id="H5933CF6172884F519E445153C7D4DD0E" commented="no"><enum>(P)</enum><text display-inline="yes-display-inline">any other component or material determined appropriate by the Secretary of Energy.</text></subparagraph></paragraph></section></legis-body></bill>
