Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit consideration of pregnancy status when filing for divorce.</official-title></form><legis-body id="H877B052B67414C2EB3421EACB45C58DB" style="OLC"><section id="HD91818207FAC4A4A95BD7FF0E15F4ED7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Pregnancy Empowerment Act of 2024</short-title></quote>.</text></section><section id="HA3257BD0949C4625AD0F967F04026ED7"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds as follows:</text><paragraph id="HC596B55F8BFB469E84EB38C8DC82D83E"><enum>(1)</enum><text display-inline="yes-display-inline">Throughout calendar year 2024, national news media reported that several States, in practice, will not finalize a divorce for pregnant people.</text></paragraph><paragraph id="H2F0B7F7E7D1046C9874FCCB19C3EFBBE"><enum>(2)</enum><text>Many States, in practice, delay, prohibit, or limit divorce until the baby’s delivery, allowing the court to determine paternity status and parental rights.</text></paragraph><paragraph id="H33166B0ADE1A4E3D9B1106DB242DCE9E"><enum>(3)</enum><text>Non-Invasive Prenatal Paternity (NIPP) tests can now determine paternal status with blood samples from the mother and alleged father and achieve an accuracy rate of 99.9 percent.</text></paragraph><paragraph id="H275D439D99694DBFBECB3943D3423D18"><enum>(4)</enum><text display-inline="yes-display-inline">Pregnant people are at an increased risk of experiencing intimate partner violence.</text></paragraph><paragraph id="HCFAE57BF93964E46A63CE368ED742E60"><enum>(5)</enum><text display-inline="yes-display-inline">Women of color are disproportionately impacted by domestic violence and are more likely to die at the hands of an abuser.</text></paragraph><paragraph id="H4A2A88A0311246A1A3B43BFA6D4411FA"><enum>(6)</enum><text>Black women are murdered by men at three times the rate of their white counterparts.</text></paragraph><paragraph id="HE92A1743527341A99831DB73CD1CD666"><enum>(7)</enum><text>Black women living with a partner are six times more likely to experience domestic violence. </text></paragraph><paragraph id="HCC4A1094BE71462AAFE576A1789BD4EF"><enum>(8)</enum><text>An estimated 324,000 pregnant people experience intimate partner violence in the United States per year.</text></paragraph><paragraph id="HED850244DEF5490199C99ECC74CE10F7"><enum>(9)</enum><text>When reported and detected, prevalence of intimate partner violence during pregnancy can range as high as 35 percent.</text></paragraph><paragraph id="HA0773037EACE424EB7B1D7659F809377"><enum>(10)</enum><text>Reproductive coercion can prevent women in abusive marriages from finalizing a divorce, keeping women in abusive relationships.</text></paragraph><paragraph id="HE5070188E4C34C5DBD4179EDE1229762"><enum>(11)</enum><text>One in 6 abused women were first abused during pregnancy.</text></paragraph><paragraph id="HB2E19D4E615F401F9CD14707FBC40228"><enum>(12)</enum><text display-inline="yes-display-inline">Homicide is the second leading cause of traumatic death for pregnant and recently pregnant people, accounting for 31 percent of maternal injury deaths. </text></paragraph><paragraph id="H28DCFCED58B2402590515B86058EBC2E"><enum>(13)</enum><text>Women living in poverty are twice as likely to experience intimate partner violence.</text></paragraph><paragraph id="H8B568B70D9784FB2ADAC7265CB7F9024"><enum>(14)</enum><text display-inline="yes-display-inline">People experiencing intimate partner violence often rely on the emergency room due to financial concerns and coercion and control from their abusers.</text></paragraph><paragraph id="HB9499BC7711049BCB99A921C71F15A53"><enum>(15)</enum><text>Divorce has a profound economic impact, often implicating interstate commerce and assets.</text></paragraph><paragraph id="H6625C9D5810D4ECC98A0CFB20F6B24FD"><enum>(16)</enum><text>The median American divorce costs $7,000 and the average American divorce costs $15,000.</text></paragraph><paragraph id="HF46FC23CF44740A3ABE0816E7B1DCB64"><enum>(17)</enum><text>Contested divorces involving child custody debate can cost over $100,000.</text></paragraph><paragraph id="HC19B69558C16465E97308441E526883C"><enum>(18)</enum><text display-inline="yes-display-inline">Of the $27.4 billion reported by the FY 2022 Office of Child Support Services Preliminary Data Report, $1.4 billion came from interstate cases.</text></paragraph><paragraph id="H6719DC3653E4480890A79781CA757499"><enum>(19)</enum><text>Divorces dissolve many financial assets, many of which may cross State lines, including—</text><subparagraph id="HF2FD1E489F254031B5042575DDD6D46A"><enum>(A)</enum><text>real estate;</text></subparagraph><subparagraph id="H577C9791A54749D08488DE0F2D28F6A4"><enum>(B)</enum><text>outstanding debts;</text></subparagraph><subparagraph id="H9D329F0D2EB64FD3B427DCFA4482D1CE"><enum>(C)</enum><text>investments;</text></subparagraph><subparagraph id="H58000C9160934E17B8E91EB3A1907681"><enum>(D)</enum><text>retirement savings;</text></subparagraph><subparagraph id="H7FC0221C97AB49E2931A5D72486BD08B"><enum>(E)</enum><text>property; and</text></subparagraph><subparagraph id="H8B94701E1B5E4AD29C37ADCBDAAB9A0F"><enum>(F)</enum><text>business interests.</text></subparagraph></paragraph><paragraph id="H63A52400E2924D54B8713447456C627D"><enum>(20)</enum><text>Article 1, Section 8, Clause 3 of the U.S. Constitution provides Congress the power to regulate interstate commerce.</text></paragraph></section><section id="HD39002F064554F9885995D1BE62AEF2B"><enum>3.</enum><header>Prohibition against consideration of pregnancy status when filing for divorce</header><text display-inline="no-display-inline">No State may take pregnancy status into consideration when considering the filing of a petition for divorce.</text></section></legis-body></bill>
