<section id="HCD9F5150ECC94662BFED6DA1C27590DE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Private Smither Act of 2024</short-title></quote>.</text></section> <section commented="no" display-inline="no-display-inline" id="HCCBF3B058E16452A9BE0D92C5E3C2BCE"><enum>2.</enum><header>Identification in patient medical records of affiliation of certain non-Department of Defense health care providers</header><text display-inline="no-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/55">Chapter 55</external-xref> of title 10, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/10/1091">section 1091</external-xref> the following new section:</text>

<section commented="no" display-inline="no-display-inline" id="H20031FCB51F64E579DD1336AF756C737"><enum>1091a.</enum><header>Identification in patient medical records of affiliation of certain non-Department of Defense health care providers</header> 
<subsection id="H06958F44FF924B8FA8CC414CB4986302"><enum>(a)</enum><header>In general</header><text>The Secretary of Defense shall ensure that medical records of the Department of Defense include the organizational affiliation of any covered health care provider identified in such medical records.</text></subsection> <subsection id="HD5A5E7D1C85345A6AD3899D6C089ABE5"><enum>(b)</enum><header>Covered health care provider defined</header><text>In this section, the term <term>covered health care provider</term> means a health care provider who is not—</text> 
<paragraph id="H00C564FFBD334A5DB019BE359911CB95"><enum>(1)</enum><text>a member of the uniformed services;</text></paragraph> <paragraph id="H27D8D6C00A0C4255903403BA152FC6B4"><enum>(2)</enum><text>an employee of the Department of Defense;</text></paragraph> 
<paragraph id="H7547164995CE41B299FB41B9A126570C"><enum>(3)</enum><text>an employee of another agency of the Federal Government detailed to the Department of Defense;</text></paragraph> <paragraph id="H55E4E9D7DB7B45BA815A48ECB6BB99C3"><enum>(4)</enum><text>a personal services contractor under section 1091 of this title; or</text></paragraph> 
<paragraph id="HA55A62596FCC4078A5301D525BD71E8D"><enum>(5)</enum><text>a volunteer under section 1588 of this title.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> </legis-body></bill>
