<section id="H496D2C00AAD44FC0A745A4E76D1C5BEA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Prevention of Election Interference Act of 2024</short-title></quote>. </text></section> <section id="H13519D9A75F14BE9A590D2F5B4BEB957"><enum>2.</enum><header>Prohibition on imposition of sentence for State criminal offense by a major party candidate</header> <subsection id="H2514862EBD8A4DEBB8C11017E57D2CD7"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">No State, or any officer or instrumentality thereof, may impose or carry out a sentence for a State criminal offense committed by a major party candidate during the covered time period. </text></subsection>
<subsection id="H2F3F8AE65A104C40A0AA1225E1D90794"><enum>(b)</enum><header>Interference with campaign activities</header>
<paragraph id="H854009DB84E64730AAC2E74771B8AFCC"><enum>(1)</enum><header>Application</header><text display-inline="yes-display-inline">During the covered time period, a major party candidate may submit an application to a State or Federal court of jurisdiction demonstrating that such sentence described under subsection (a) may interfere with the campaign activities of the major party candidate.</text></paragraph> <paragraph id="H8D58B6784BD24F8A94FF842430582602"><enum>(2)</enum><header>Remedy</header><text>Upon receipt of an application under subsection (a), the State or Federal court of jurisdiction shall amend a sentence relating to the major party candidate, including by staying the sentence for the duration of the covered period or vacating such sentence.</text></paragraph></subsection>
<subsection id="H5208190743FC42BDBE0291C6CDA9559A"><enum>(c)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H08873C5DBCA247E59B9CE10488E13EE9"><enum>(1)</enum><header>Covered time period</header><text>The term <quote>covered time period</quote> means the time period that is—</text>
<subparagraph id="H00A8D9AF0DBE4C53B9C022535E259FE6"><enum>(A)</enum><text>120 days prior to a general Presidential election; and</text></subparagraph> <subparagraph id="H12990854A81B459BA93AD0E85B52B648"><enum>(B)</enum><text>60 days after a general Presidential election.</text></subparagraph></paragraph>
<paragraph id="H3AB27CFB8EE44D23B54C98C4CCA85DFC"><enum>(2)</enum><header>Major party candidate</header><text display-inline="yes-display-inline">The term <quote>major party candidate</quote> shall have the meaning given the term <quote>major Presidential and Vice Presidential candidates</quote> in section 3056(a)(7) of title 18, United States Code. </text></paragraph></subsection></section> </legis-body> </bill>
