which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committees on <committee-name committee-id="HWM00">Ways and Means</committee-name>, and <committee-name committee-id="HBU00">the Budget</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title XVIII of the Social Security Act to establish a designation for territorial safety net hospitals, and for other purposes.</official-title></form><legis-body id="H7FB637D5E5514AC09D5C17B962A97DF3" style="OLC"><section id="H79CA3AA519F043B7B8322E5B7ACDFADE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Supporting Territorial Safety Net Hospitals Act</short-title></quote>.</text></section><section id="HB44BF4379EA0484B8C8BFB9CBC0F41FF"><enum>2.</enum><header>Designation for territorial safety net hospitals</header><subsection id="HE91680DC803D4DF294A11A5C251B2017"><enum>(a)</enum><header>Territorial safety net hospital defined</header><text>Section 1861 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block style="OLC" id="HCFEBF79DA9FA418FB6A872D3C2FECB32" display-inline="no-display-inline"><subsection id="H4D9836F1D4784FF9B26C4FE427ADE763"><enum>(nnn)</enum><header>Territorial safety net hospital</header><paragraph id="H3FF73818B53B4F5AB3E8589F903B23DE"><enum>(1)</enum><text>The term <quote>territorial safety net hospital</quote> means a hospital (as defined in subsection (e)) that is located in the Northern Mariana Islands, American Samoa, Guam, or the Virgin Islands.</text></paragraph><paragraph id="H29640B2CB79D4C2496F3B728CA17D6EB"><enum>(2)</enum><text>The term <quote>inpatient territorial safety net hospital services</quote> means items and services, furnished to an inpatient of a territorial safety net hospital by such facility, that would be inpatient hospital services if furnished to an inpatient of a hospital by a hospital.</text></paragraph><paragraph id="HEC7F69A1BA934959A40BDBE4D45A67D5"><enum>(3)</enum><text>The term <quote>outpatient territorial safety net hospital services</quote> means medical and other health services furnished by a territorial safety net hospital on an outpatient basis.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HE89417C36CFE46778AE6CBEA4EB18FBD"><enum>(b)</enum><header>Payment for inpatient territorial safety net hospital services</header><paragraph id="H6AD178FB03E8404D9A533C47AAFEAFDC"><enum>(1)</enum><header>In general</header><text>Section 1814 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395f">42 U.S.C. 1395f</external-xref>) is amended—</text><subparagraph id="H3016B7260762465C9760E2621FD3B2F2"><enum>(A)</enum><text>in subsection (b), by inserting <quote>other than a territorial safety net hospital providing inpatient territorial safety net hospital services,</quote> after <quote>critical access hospital providing inpatient critical access hospital services,</quote>; and</text></subparagraph><subparagraph id="H1692B86B795149EBAB86A4715FE3638D"><enum>(B)</enum><text>by adding at the end the following new subsection:</text><quoted-block style="OLC" id="H0FC54B60DE6D4B21864381061C9F9DFD" display-inline="no-display-inline"><subsection id="H7FEB046B8D36426B9BF0BB3195939501" commented="no"><enum>(m)</enum><header>Payment for inpatient territorial safety net hospital services</header><text display-inline="yes-display-inline">The amount of payment under this part for inpatient territorial safety net hospital services is equal to 101 percent of the reasonable costs of the territorial safety net hospital in providing such services.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HDFD9734C75DB4105A18E219A6A0EA9F4"><enum>(2)</enum><header>Scope of benefits</header><text>Section 1812(a)(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395d">42 U.S.C. 1395d(a)(1)</external-xref>) is amended by striking <quote>or inpatient critical access hospital services</quote> and inserting <quote>, inpatient critical access hospital services, or inpatient territorial safety net hospital services</quote>.</text></paragraph><paragraph id="H2C7A60639FED4BD3812F5C2C728CF049"><enum>(3)</enum><header>Deductibles and coinsurance</header><text>Section 1813 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395e">42 U.S.C. 1395e</external-xref>) is amended—</text><subparagraph id="HE15DB3B6B47045E18E887AC282B0E74F"><enum>(A)</enum><text>in subsection (a)(1), by striking <quote>or inpatient critical access hospital services</quote> each place it appears and inserting <quote>, inpatient critical access hospital services, or inpatient territorial safety net hospital services</quote>; and</text></subparagraph><subparagraph id="HB5A0B3441E534836ABF3743502D88F33"><enum>(B)</enum><text>in subsection (b)(3)—</text><clause id="HEFD111B05A314333818A248CA01A1A48"><enum>(i)</enum><text>in subparagraph (A), by striking <quote>or inpatient critical access hospital services</quote> and inserting <quote>, inpatient critical access hospital services, or inpatient territorial safety net hospital services</quote>; and</text></clause><clause id="H22F8DC10FBBA48059EC8B50D709162B9"><enum>(ii)</enum><text>in subparagraph (B), by inserting <quote>, inpatient territorial safety net hospital services,</quote> after <quote>inpatient critical access hospital services</quote>.</text></clause></subparagraph></paragraph><paragraph id="H44AF654EEF234EF58DEB0976D6871869"><enum>(4)</enum><header>Payment to providers of services</header><text>Section 1815(e)(2) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395g">42 U.S.C. 1395g(e)(2)</external-xref>) is amended—</text><subparagraph id="HC96539EC72CC4E5C8136E017D1CCA7C8"><enum>(A)</enum><text>in subparagraph (D), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="HF549045E2B0043FB87CA3C3F2D3EB64E"><enum>(B)</enum><text>in subparagraph (E), by inserting <quote>and</quote> after the semicolon at the end; and</text></subparagraph><subparagraph id="H3DABA77ED53B4099912FB45A441A61F1"><enum>(C)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block style="OLC" id="H60B99F2B1E3643E188170BB35DA59906" display-inline="no-display-inline"><subparagraph id="H96FC8B2A85434480A8A2764370CFE9F1"><enum>(F)</enum><text display-inline="yes-display-inline">inpatient territorial safety net hospital services;</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H3B9D7C1D21DF451EBE8CA81529A0AF40"><enum>(5)</enum><header>Administration of part A</header><text>Section 1816(c)(2)(C) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395h">42 U.S.C. 1395h(c)(2)(C)</external-xref>) is amended by inserting <quote>territorial safety net hospital,</quote> after <quote>critical access hospital,</quote>. </text></paragraph></subsection><subsection id="H7BFFE9447EF241D880A8F2879271F978"><enum>(c)</enum><header>Payment for outpatient territorial safety net hospital services</header><paragraph id="H3F1BBF089A2540B5A4F076290783AC86"><enum>(1)</enum><header>In general</header><text>Section 1834 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block style="OLC" id="HAB474D07B1234C61A7B4F8CD92B9C316" display-inline="no-display-inline"><subsection id="H862D599E431F464BA0C4A037C515CE1D"><enum>(aa)</enum><header>Payment for outpatient territorial safety net hospital services</header><paragraph id="HA780D9919C934F498654BCA278FDB4F5"><enum>(1)</enum><header>In general</header><text>The amount of payment for outpatient territorial safety net hospital services of a territorial safety net hospital is equal to 101 percent of the reasonable costs of the hospital in providing such services, unless the hospital makes the election under paragraph (2).</text></paragraph><paragraph id="HE2986671F7BE4E9E8CA453D9856FC35A"><enum>(2)</enum><header>Election of cost-based hospital outpatient service payment plus fee schedule for professional services</header><text>A territorial safety net hospital may elect to be paid for outpatient territorial safety net hospital services amounts equal to the sum of the following, less the amount that such hospital may charge as described in section 1866(a)(2)(A):</text><subparagraph id="H1CA1D6227A994802AE016242523E49B6"><enum>(A)</enum><header>Facility fee</header><text>With respect to facility services, not including any services for which payment may be made under subparagraph (B), 101 percent of the reasonable costs of the territorial safety net hospital in providing such services.</text></subparagraph><subparagraph id="HC841D28A3E484AD3A64A705703FB9159"><enum>(B)</enum><header>Fee schedule for professional services</header><text>With respect to professional services otherwise included within outpatient territorial safety net hospital services, 115 percent of such amounts as would otherwise be paid under this part if such services were not included in outpatient territorial safety net hospital services. Subsections (x) and (y) of section 1833 shall not be taken into account in determining the amounts that would otherwise be paid pursuant to the preceding sentence.</text></subparagraph><continuation-text continuation-text-level="paragraph">The Secretary may not require, as a condition for applying subparagraph (B) with respect to a territorial safety net hospital, that each physician or other practitioner providing professional services in the hospital must assign billing rights with respect to such services, except that such subparagraph shall not apply to those physicians and practitioners who have not assigned such billing rights.</continuation-text></paragraph><paragraph id="HBA524BA21E6143E2B9CCC367BAD53FFE"><enum>(3)</enum><header>Disregarding charges</header><text>The payment amounts under this subsection shall be determined without regard to the amount of the customary or other charge.</text></paragraph><paragraph id="H93717226269046A0A096E771ED084D31"><enum>(4)</enum><header>Treatment of clinical diagnostic laboratory services</header><text>No coinsurance, deductible, copayment, or other cost-sharing otherwise applicable under this part shall apply with respect to clinical diagnostic laboratory services furnished as an outpatient territorial safety net hospital service. Nothing in this title shall be construed as providing for payment for clinical diagnostic laboratory services furnished as part of outpatient territorial safety net hospital services, other than on the basis described in this subsection. For purposes of the preceding sentence and section 1861(nnn)(3), clinical diagnostic laboratory services furnished by a territorial safety net hospital shall be treated as being furnished as part of outpatient critical access services without regard to whether the individual with respect to whom such services are furnished is physically present in the territorial safety net hospital, or in a skilled nursing facility or a clinic (including a rural health clinic) that is operated by a territorial safety net hospital, at the time the specimen is collected.</text></paragraph><paragraph id="HBB9655DF246A4FF9A41AF7DC689716F5"><enum>(5)</enum><header>Coverage of costs for certain on-call emergency room providers</header><text>In determining the reasonable costs of outpatient territorial safety net hospital services under paragraphs (1) and (2)(A), the Secretary shall recognize as allowable costs, amounts (as defined by the Secretary) for reasonable compensation and related costs for physicians, physician assistants, nurse practitioners, and clinical nurse specialists who are on-call (as defined by the Secretary) to provide emergency services but who are not present on the premises of the territorial safety net hospital involved, and are not otherwise furnishing services covered under this title and are not on-call at any other provider or facility.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HB289EBD38AD04C7EAE557CEC61CE9535"><enum>(2)</enum><header>Scope of benefits</header><text display-inline="yes-display-inline">Section 1832(a)(2) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395k">42 U.S.C. 1395k(a)(2)</external-xref>) is amended—</text><subparagraph id="H09BEF795645E473FA2B682C1A839BD99"><enum>(A)</enum><text>in subparagraph (I), by striking <quote>; and</quote> and inserting a semicolon;</text></subparagraph><subparagraph id="HFE30FADE0B504B70817123B63C8ED956"><enum>(B)</enum><text>in subparagraph (J), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="HF9D267C6E490439F8BA85432DBF4158E"><enum>(C)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block style="OLC" id="HC10B4690D7374948A6038FA1BA492C89" display-inline="no-display-inline"><subparagraph id="H6799C3D223A140DDB90364D73E48FAE8"><enum>(K)</enum><text display-inline="yes-display-inline">outpatient territorial safety net hospital services (as defined in section 1861(nnn)(3)).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HE04D41AC462144C790B33CC3F428D81F"><enum>(3)</enum><header>Payment of benefits</header><text>Section 1833 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395l">42 U.S.C. 1395l</external-xref>) is amended—</text><subparagraph id="H1F2AB92F52E945AC972C07D4B727E300"><enum>(A)</enum><text>in subsection (a)—</text><clause id="H9035A692B3684597A2828DB1FF537BC5"><enum>(i)</enum><text>in paragraph (9), by striking <quote>; and</quote> and inserting a semicolon;</text></clause><clause id="HE813E2A2123F409B88B3886AE3F95A7C"><enum>(ii)</enum><text>in paragraph (10), by striking the period at the end and inserting <quote>; and</quote>; and</text></clause><clause id="H85B4AA80F7494FBD8D102E65C1EA3639"><enum>(iii)</enum><text>by inserting after paragraph (10) the following new paragraph:</text><quoted-block style="OLC" id="HC9C0F35410CD4D0F81EE5C1CEA93BEE3" display-inline="no-display-inline"><paragraph id="H6BC310E7DD754D43A05996C88D50080E"><enum>(11)</enum><text display-inline="yes-display-inline">in the case of outpatient territorial safety net hospital services, the amounts described in section 1834(aa).</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="HA89A991AFD434541AA925C3E8F842765"><enum>(B)</enum><text>in subsection (h)(5)(A)(iii), by inserting <quote>territorial safety net hospital,</quote> after <quote>critical access hospital,</quote>;</text></subparagraph><subparagraph id="HF970F7B74F334ED68D5B33C3089B6C7B"><enum>(C)</enum><text>in subsection (i)(1)(A), by inserting <quote>territorial safety net hospital,</quote> after <quote>critical access hospital,</quote>;</text></subparagraph><subparagraph id="HF3C831B8A68D494C9C7032C900BED4BE"><enum>(D)</enum><text>in subsection (l)(5)—</text><clause id="H9DD03C9EBFE0426E8B198D5E4C29E0C1"><enum>(i)</enum><text>in subparagraph (A), by inserting <quote>territorial safety net hospital,</quote> after <quote>critical access hospital,</quote> in each place it appears; and</text></clause></subparagraph><subparagraph id="HC0697D0DA96C4BD2867EA862D08D04D1"><enum>(F)</enum><text>in subsection (cc)(2), by adding at the end the following new subparagraph:</text><quoted-block style="OLC" id="H9980649883E44B30B7C7BD1FCB9B337A" display-inline="no-display-inline"><subparagraph id="H1549B545095A4A26955E1E758389C116"><enum>(F)</enum><text display-inline="yes-display-inline">Section 1834(aa), with respect to an outpatient territorial safety net hospital service.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H9AE5BE4736B341CC97E55C84304EE2D4"><enum>(4)</enum><header>Payment for ambulance services furnished by a territorial safety net hospital</header><text>Section 1834(l)(8) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(l)(8)</external-xref>) is amended—</text><subparagraph id="H707C1E944EA542E28D9B6516E9836EAA"><enum>(A)</enum><text>in the heading, by inserting <quote><header-in-text level="paragraph" style="OLC">and territorial safety net hospitals</header-in-text></quote> after <quote><header-in-text level="paragraph" style="OLC">critical access hospitals</header-in-text></quote>;</text></subparagraph><subparagraph id="HB8B90BBB3FA84130BC90CAB261AFC0CA"><enum>(B)</enum><text>in subparagraph (A), by inserting <quote>or a territorial safety net hospital (as defined in section 1861(nnn))</quote> after <quote>(as defined in section 1861(mm)(1))</quote>;</text></subparagraph><subparagraph id="H4915292FFC9A45189B7B3C04D099B4DF"><enum>(C)</enum><text>in subparagraph (B), by inserting <quote>or a territorial safety net hospital</quote> after <quote>critical access hospital</quote>;
