R. 9127</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20240724">July 24, 2024</action-date><action-desc><sponsor name-id="S001177">Mr. Sablan</sponsor> (for himself and <cosponsor name-id="M001219">Mr. Moylan</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title III of the Public Health Service Act to include territorial disproportionate share hospitals as covered entities under the 340B drug discount program.</official-title></form><legis-body id="H4BB5F4AB6C3344E994EF93B13A040752" style="OLC"><section id="H342EDE6407814423BC31C5452DA7D7AE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Equitable Access to 340B Act</short-title></quote>.</text></section><section id="H2EB1A88200034EAE8023FFBB8306314A"><enum>2.</enum><header>Including territorial disproportionate share hospitals as covered entities under the 340B drug discount program</header><text display-inline="no-display-inline">Section 340B of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/256b">42 U.S.C. 256b</external-xref>) is amended—</text><paragraph id="H84784804DC114951BAEDF3DC89C9D210"><enum>(1)</enum><text>in subsection (a)(4), by adding at the end the following new subparagraph:</text><quoted-block style="OLC" id="H037EBC578F5C49CFB37DF3F98ACBCA21" display-inline="no-display-inline"><subparagraph id="H48753E1B38964A50AFD98401418D9B1A"><enum>(P)</enum><text display-inline="yes-display-inline">An entity that is a territorial disproportionate share hospital (as defined in subsection (b)(3)) and meets the requirements of clauses (i) and (ii) of subparagraph (L).</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H8D7E628427424662A1FAF4F52D2D82D7"><enum>(2)</enum><text>in subsection (b), by adding at the end the following new paragraph:</text><quoted-block style="OLC" id="HEF39BCE33D4D48629A8F208BFB622C87" display-inline="no-display-inline"><paragraph id="H5EF889BCCCBA442B9BD17AC3FF48AE7E"><enum>(3)</enum><header>Territorial disproportionate share hospital</header><text display-inline="yes-display-inline">The term <quote>territorial disproportionate share hospital</quote> means a hospital that meets the requirements of a Medicaid deemed disproportionate share hospital (as described in section 1923(b)(1) of the Social Security Act) and is located in the Northern Mariana Islands, Guam, American Samoa, or the Virgin Islands.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
