which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Public Health Service Act to expand trauma-informed training for law enforcement personnel related to sexual assault cases, and for other purposes.</official-title></form><legis-body id="H50BEC99DBFCB4145A00A1286938FEC14" style="OLC"><section id="H696446573F2445A7A26040624B674B4E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Compassionate Assault Response and Empathy Act of 2024</short-title></quote>.</text></section><section id="HD83191A5072E46E993041639AE274ACF"><enum>2.</enum><header>Expanding trauma-informed training for law enforcement personnel related to sexual assault cases</header><text display-inline="no-display-inline">Part D of title V of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290dd">42 U.S.C. 290dd et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H86FEEFF971A042C6B1BB88EC344AC284" display-inline="no-display-inline"><section id="H8462423D946D4520BEE65AA55EB62E6E"><enum>553.</enum><header>Expanding trauma-informed training for law enforcement personnel related to sexual assault cases</header><subsection id="HC4A131AE08DB4F87A4CE683F1FC909F9"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary may award grants to State, Tribal, and local law enforcement agencies to establish and expand training for law enforcement personnel—</text><paragraph id="H3D83BE8A14EF4ABC98C7E376CD717A77"><enum>(1)</enum><text>to increase understanding and awareness of the impact of trauma in sexual assault cases; and</text></paragraph><paragraph id="H990884C761644324A263A6EABE694F10"><enum>(2)</enum><text>to develop and implement strategies for trauma-informed responses and policies in such cases.</text></paragraph></subsection><subsection id="H06CC61FECC7C422180105F03D92D453C"><enum>(b)</enum><header>Period of grants</header><text>The period of a grant under this section shall be 1 year.</text></subsection><subsection id="H64D787C775D54D699D2A4FB453C6805E"><enum>(c)</enum><header>Training described</header><text>The training funded pursuant to subsection (a) shall—</text><paragraph id="HF6F3FDB7A73F4463B010C87279FE57F6"><enum>(1)</enum><text>be trauma-informed, evidence-based, and victim-centered;</text></paragraph><paragraph id="HF623FA5D63F8456BADCEDBD48A283B1D"><enum>(2)</enum><text>focus on the circumstances of individuals who—</text><subparagraph id="H5AC0CFF5D40C4B2AA2FB4622FEF869AA"><enum>(A)</enum><text>have experienced sexual assault or other sexual violence; and</text></subparagraph><subparagraph id="HD51E5EBB1A30423FA733B70D2EB0FCBC"><enum>(B)</enum><text>dealt with related trauma in interacting with law enforcement; and</text></subparagraph></paragraph><paragraph id="H92E817E22C2E44DEA06C0C7513538059"><enum>(3)</enum><text>include training on—</text><subparagraph id="H7D019AD5F8244F6998F78D82D1DE29F6"><enum>(A)</enum><text>how contact with law enforcement can cause or lead to retraumatization of sexual assault victims; and</text></subparagraph><subparagraph id="H34E0EB986D9443FD801199ADD5F24F81"><enum>(B)</enum><text>how law enforcement personnel can best support victims of sexual assault or other sexual violence during their interactions with law enforcement.</text></subparagraph></paragraph></subsection><subsection id="HB88F2F8227D948B59959DE07FA246806"><enum>(d)</enum><header>Trainer listing</header><text>The Secretary shall maintain and make available online—</text><paragraph id="HB0A0BAA6487D41D683AEB86C92BC34CD"><enum>(1)</enum><text>a listing of trainers who provide training described in subsection (c); and</text></paragraph><paragraph id="HC8420D1A3C9E4581A93AE18C4C1971A0"><enum>(2)</enum><text>make such listing searchable according to the trainer’s—</text><subparagraph id="HEB8FD56CB52A4695A7AF5206ADC55843"><enum>(A)</enum><text>geographic area; and</text></subparagraph><subparagraph id="H49F9DA33AAE348F29BAB10ECDAA2BC7E"><enum>(B)</enum><text>professional background.</text></subparagraph></paragraph></subsection><subsection id="H90D73DFE033F439DB7868F3A944A404D"><enum>(e)</enum><header>Diversity among trainers</header><text display-inline="yes-display-inline">As a condition on receipt of a grant under this section, a State, Tribal, or local law enforcement agency shall strive to provide the training funded through the grant by trainers with—</text><paragraph id="HFADAC9C8BA4E47669B77453BF5EFB811"><enum>(1)</enum><text>diverse professional backgrounds; and</text></paragraph><paragraph id="HE87C653F96AB43B5A7182451FA6475B2"><enum>(2)</enum><text>inclusive racial, ethnic, and gender representation.</text></paragraph></subsection><subsection id="HB3863044E8284945B7858667D78F2920"><enum>(f)</enum><header>Required number of training hours</header><text display-inline="yes-display-inline">As a condition on receipt of a grant under this section, a State, Tribal, or local law enforcement agency shall agree to require—</text><paragraph id="H917046B163A148E8896378050BC48C2C"><enum>(1)</enum><text>individuals enrolled in a law enforcement academy (or other initial training for law enforcement personnel) of such agency to receive training described in subsection (c) for at least eight hours; and</text></paragraph><paragraph id="H5E68860B30D94075BC4B6EB5E93CB3EE"><enum>(2)</enum><text>all other law enforcement personnel of such agency to receive training described in subsection (c) for at least four hours annually.</text></paragraph></subsection><subsection id="H364DE26A123B4B0A958D27EA36872C7A"><enum>(g)</enum><header>Reports to Congress</header><text>The Secretary shall collect data and submit annual reports to the Congress on the grant program under this section. Each such report shall include—</text><paragraph id="H234EC896844E439DA65A50FA50EB36B1"><enum>(1)</enum><text display-inline="yes-display-inline">the number of State, Tribal, and local law enforcement agencies receiving grants under this section; and</text></paragraph><paragraph id="H5687576C9243417798135FC050135869"><enum>(2)</enum><text>an evaluation of the effectiveness of such grants in improving trauma-informed training for law enforcement personnel for sexual assault cases.</text></paragraph></subsection><subsection id="H8BBA182EEC194D78B36C5DBF523C5358"><enum>(h)</enum><header>Definition</header><text>In this section, the term <term>trauma-informed</term> means based on the knowledge and understanding of trauma and its far-reaching implications.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
