R. 8985</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20240710">July 10, 2024</action-date><action-desc><sponsor name-id="O000175">Mr. Ogles</sponsor> (for himself, <cosponsor name-id="G000565">Mr. Gosar</cosponsor>, <cosponsor name-id="P000615">Mr. Pence</cosponsor>, <cosponsor name-id="S001224">Mr. Self</cosponsor>, <cosponsor name-id="B001302">Mr. Biggs</cosponsor>, <cosponsor name-id="M001211">Mrs. Miller of Illinois</cosponsor>, <cosponsor name-id="P000609">Mr. Palmer</cosponsor>, <cosponsor name-id="D000615">Mr. Duncan</cosponsor>, <cosponsor name-id="L000564">Mr. Lamborn</cosponsor>, <cosponsor name-id="S001214">Mr. Steube</cosponsor>, <cosponsor name-id="M001212">Mr. Moore of Alabama</cosponsor>, <cosponsor name-id="M001195">Mr. Mooney</cosponsor>, and <cosponsor name-id="B000825">Ms. Boebert</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide for certain conditions on the enforcement of surrogacy contracts.</official-title></form><legis-body id="H9421F108AC484BA69DA77C0E4363C322" style="OLC"><section id="HE1E6DD04918E4303B283F4733F19DE6F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Preventing Forced Abortions Act of 2024</short-title></quote>.</text></section><section id="H9580765B640F4E8693DE39455230E771"><enum>2.</enum><header>In general</header><text display-inline="no-display-inline">A Federal court—</text><paragraph id="H6AC28EE8F7C34E308EC8332B1D13049A"><enum>(1)</enum><text display-inline="yes-display-inline">may not enforce any provision in a surrogacy contract that requires the surrogate mother to have an abortion at the request of any intended parent, party to a surrogacy contract, or agent of any party to a surrogacy contract; and</text></paragraph><paragraph id="H7C63641737764F408333DCBAAAD5ED19"><enum>(2)</enum><text display-inline="yes-display-inline">shall enforce any clause requiring the payment of a surrogate mother of any compensation agreed to in a surrogacy contract, notwithstanding any provision that requires the surrogate mother to have an abortion at the request of any intended parent, party to a surrogacy contract, or agent of any party to a surrogacy contract, including any provision providing for—</text><subparagraph id="HD0D0ACD04C2D42BBA77CE152E955AEE3"><enum>(A)</enum><text>liquidated damages based on a refusal to get an abortion;</text></subparagraph><subparagraph id="H8FA00350F90B4FA1BF65C6A6ECD46BD9"><enum>(B)</enum><text>reduction of payment based on a refusal to get an abortion; or</text></subparagraph><subparagraph id="H5D90DB92DA074BB68A9D08BFD6A65B1A"><enum>(C)</enum><text>otherwise requiring the surrogate mother to have an abortion at the request of any party or agent of any party to a surrogacy contract.</text></subparagraph></paragraph></section><section id="HE7722D9BAE784794B32A9E2391DC0DA5"><enum>3.</enum><header>Jurisdiction of the courts</header><subsection id="H64D7D5D8C81040EC933FE284190EC811"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/85">Chapter 85</external-xref> of title 28, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="HBC560BAA740942E5BC75AE716B25F780" display-inline="no-display-inline"><section id="H6BA54DF8459A4DC2B5B507F41BD5B94B"><enum>1370.</enum><header>Surrogacy contracts</header><text display-inline="no-display-inline">The district courts shall have original jurisdiction of all civil actions where the matter in controversy is a surrogacy contract (as such term is defined in section 4 of the Preventing Forced Abortions Act of 2024) in or affecting interstate or foreign commerce.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H0C7AD60D137243B58DD4BD0145FDF09D"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections for such chapter is amended by adding at the end the following: </text><quoted-block style="USC" id="H91990C128F8E405CB1F4CC57FBCD7E51" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">1370. Surrogacy contracts. </toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="HA1E0FD97291E422C87AAF6E7554135C6"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H72EAB1F00B5347A5A72602761EE18A4B"><enum>(1)</enum><text>The term <term>intended parent</term> means any individual who is a party to a surrogacy contract and who is the party who will take permanent custody of a child born pursuant to such contract.</text></paragraph><paragraph id="H103A306BDA3445AA990A325F57850249"><enum>(2)</enum><text>The term <term>surrogacy contract</term> means an agreement setting forth the terms and conditions for the conception and birth of a child to a female with the intent of all parties being that such child shall immediately thereafter enter into the permanent custody of another individual.</text></paragraph><paragraph id="HE4FC86E4E80345159004BB6CE862E1A6"><enum>(3)</enum><text display-inline="yes-display-inline">The term <term>surrogate mother</term> means a female who is a party to a surrogacy contract and who is the party who will bear the child pursuant to such contract.</text></paragraph><paragraph id="H5C8E977A604C44A7B80F7466A4250D3E"><enum>(4)</enum><text>The term <term>female</term> means an individual who has, had, will have, or would have, but for a developmental or genetic anomaly or historical accident, a reproductive system that at some point produces, transports, and utilizes eggs for fertilization.</text></paragraph><paragraph id="HE07B41C7C2424335AECC6A36AAE47DDF"><enum>(5)</enum><text display-inline="yes-display-inline">The term <term>abortion</term> means the use or prescription of any instrument, medicine, drug, or any other substance or device—</text><subparagraph id="H292E1B9AC72C4F75A8846AD3140F9DAA"><enum>(A)</enum><text>to intentionally kill the unborn child of a woman known to be pregnant; or</text></subparagraph><subparagraph id="H9CBFC787565D4ECE84DF19E44CF6CE3C"><enum>(B)</enum><text>to intentionally terminate the pregnancy of a woman known to be pregnant, with an intention other than—</text><clause id="H36392B0A290D43C8AFF25877CB6E3EAF"><enum>(i)</enum><text>after viability to produce a live birth and preserve the life and health of the child born alive; or</text></clause><clause id="HD64667A402E3474B92FB72B81A4D8A6C"><enum>(ii)</enum><text>to remove a dead unborn child.</text></clause></subparagraph></paragraph></section></legis-body></bill>
