which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Administrator of the Environmental Protection Agency to establish a voluntary sustainable apparel labeling program, and for other purposes.</official-title></form><legis-body id="HE717F331EFC64F9EA8044E2986A5D8BE" style="OLC"><section id="HC299B8F4CD784611B578A4D721D0905F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Voluntary Sustainable Apparel Labeling Act</short-title></quote>.</text></section><section id="H22A35183F8E64690AE20DA99C6CC0E28"><enum>2.</enum><header>Voluntary sustainable apparel labeling program</header><subsection id="HBBF8A15273AF4DE9B794C9BA0F36ADCB"><enum>(a)</enum><header>In general</header><paragraph id="H7CD5DFD2013645FA9EC0A92AEBA11B0B"><enum>(1)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Administrator of the Environmental Protection Agency (in this section referred to as the <quote>Administrator</quote>) shall carry out a voluntary sustainable apparel labeling program (in this section referred to as the <quote>labeling program</quote>).</text></paragraph><paragraph id="HE421CBDA917544738293C4F1D2CFDA3A"><enum>(2)</enum><header>Consultation</header><text display-inline="yes-display-inline">The Administrator shall establish and operate the labeling program in consultation with the Secretary of Agriculture and the Federal Trade Commission.</text></paragraph><paragraph id="H89B23BE855714DFEBBD15260994B3056"><enum>(3)</enum><header>Regulations</header><text>Not later than 2 years after the date of enactment of this section, the Administrator shall finalize regulations to carry out the labeling program.</text></paragraph></subsection><subsection id="HD57D3D97A4614740B8D9F2C409B80FA1"><enum>(b)</enum><header>Requirements</header><text>Under the labeling program—</text><paragraph id="H3A61A8DFAD6742A8885390EF7268AB50"><enum>(1)</enum><text display-inline="yes-display-inline">any person that sells an article of apparel may submit an application to the Administrator to enter the article of apparel into the labeling program;</text></paragraph><paragraph id="HC59D120F2B5441D0947F536DFA170263"><enum>(2)</enum><text>the Administrator shall specify the information to be included in an application under paragraph (1);</text></paragraph><paragraph id="HAA52A5BE95FA4EA19FD46733F5759E0D"><enum>(3)</enum><text display-inline="yes-display-inline">the Administrator shall review any application submitted under paragraph (1) and make a determination regarding whether to include the article of apparel in the labeling program—</text><subparagraph id="HC75FAB31DC5348518F362206C3655DCE"><enum>(A)</enum><text>on the basis of whether the Administrator believes the person submitting the application will adhere to the requirements of the labeling program; and</text></subparagraph><subparagraph id="H937653B4D8CA4D5CAC1FEDFF3F4E4DA0"><enum>(B)</enum><text display-inline="yes-display-inline">not on the basis of an assessment of the benefits to the environment associated with the article of apparel;</text></subparagraph></paragraph><paragraph id="H01C6C34A64CA473F9F723716A5FC2D68"><enum>(4)</enum><text>a person (referred to in this section as a <quote>participant</quote>) that sells an article of apparel that the Administrator has determined to include in the labeling program (referred to in this section as the <quote>participating article of apparel</quote>) may attach a label (referred to in this section as the <quote>apparel sustainability label</quote>) to—</text><subparagraph id="HF1952DCA7248478DA97CC2CA3FB93E2A"><enum>(A)</enum><text>the participating article of apparel; or</text></subparagraph><subparagraph id="H02F045095A74457A9813640C85597221"><enum>(B)</enum><text>packaging used for the sole purpose of containing the participating article of apparel;</text></subparagraph></paragraph><paragraph id="H1F846A86181E4A2AB051C28E25364BEE"><enum>(5)</enum><text display-inline="yes-display-inline">the Administrator shall establish requirements for the visual form of the apparel sustainability label that shall—</text><subparagraph id="H22A5DB8EFDB44FE09015BCE6109E8987"><enum>(A)</enum><text>convey the information described in paragraph (6) to the consumer in a manner that is determined by the Administrator to be most useful to the consumer at the point of sale in making apparel purchasing decisions;</text></subparagraph><subparagraph id="H552E7136974A4CBBA315FFD53D8530C6"><enum>(B)</enum><text display-inline="yes-display-inline">not convey that any given article of apparel is acceptable or unacceptable, but instead provide the consumer a numerical quantification of the information described in paragraph (6);</text></subparagraph><subparagraph id="H8F26D16C6B454F57B2EE89DC4616ECBC"><enum>(C)</enum><text>employ words, numbers, and imagery, as specified by the Administrator;</text></subparagraph><subparagraph id="HBFE7B71CBA2D47FEB2EAA7D8F9C471E4"><enum>(D)</enum><text>convey the fact that the information on the apparel sustainability label has been verified under requirements established by the Environmental Protection Agency; and</text></subparagraph><subparagraph id="H12B1E97B8CE84A9C8AB734AAE4077870"><enum>(E)</enum><text>include a logo to help the consumer identify the label as being associated with the labeling program;</text></subparagraph></paragraph><paragraph id="HFCA2A4AA70174E6CB0E1FEA169A89441"><enum>(6)</enum><text>the information included on the apparel sustainability label shall—</text><subparagraph id="HDCB3C17901F1420CA3D90C69CFD6BB03"><enum>(A)</enum><text>convey a numerical summary of the best available information regarding the total greenhouse gas emissions released throughout the full life cycle of the participating article of apparel and its input materials, including in association with—</text><clause id="H28CB202D2CCE46D6BAE21FAA78EA7955"><enum>(i)</enum><text>growing of plant fibers and other agricultural inputs;</text></clause><clause id="H6BB24D13FB2F4B80A1699CA67CD0D88C"><enum>(ii)</enum><text>manufacture of the nonagricultural input materials;</text></clause><clause id="HD0D75407BB3443B383D9D739B9384B1F"><enum>(iii)</enum><text>manufacture of the participating article of apparel;</text></clause><clause id="HF45E88255955445D9B3A570B684B5AD6"><enum>(iv)</enum><text>packaging;</text></clause><clause id="H5FC902A0441043B1AD14F384FF100D5E"><enum>(v)</enum><text display-inline="yes-display-inline">transportation of the input materials and the participating article of apparel;</text></clause><clause id="H815C99FDB2D94BB3A48DC41B0819C8F9"><enum>(vi)</enum><text>storage;</text></clause><clause id="H2A21199B201344628B6479AFCD5D1E37"><enum>(vii)</enum><text>presentation in a retail apparel establishment;</text></clause><clause id="H715A687D0516470BAD1E593828577B97"><enum>(viii)</enum><text>consumer use, including the energy used to—</text><subclause id="H6444145686994FF39FD885C9AA8508DA"><enum>(I)</enum><text>wash the participating article of apparel; and</text></subclause><subclause id="HA98B8765ADD2435191AC147413857DEA"><enum>(II)</enum><text display-inline="yes-display-inline">prepare the participating article of apparel for use, including by ironing or pressing;</text></subclause></clause><clause id="HB7D0F196D9054C22ACF5E11932192EA7"><enum>(ix)</enum><text>end-of-life reuse, recycling, treatment, and disposal of the participating article of apparel and its packaging; and</text></clause><clause id="H2B068D6C50174A4194DBB3B6208FDAD8"><enum>(x)</enum><text>any other aspect of the full life cycle of the participating article of apparel associated with greenhouse gas emissions;</text></clause></subparagraph><subparagraph id="HA66E236518EA4B4C877746CFF87DC194"><enum>(B)</enum><text display-inline="yes-display-inline">convey a summary of the voluntary commitment made regarding the participating article of apparel, as reported under subsection (c)(1); and</text></subparagraph><subparagraph id="HE95FFA38EE4A4432B8023B8DCA0EDF80"><enum>(C)</enum><text display-inline="yes-display-inline">provide electronic access immediately available to the consumer at the point of sale through a quick response (QR) code or similar mechanism to additional information relevant to the consumer, which shall include—</text><clause id="HA0BCD2FD38454C24B547487AA26851F2"><enum>(i)</enum><text>the complete information described in subparagraph (A) regarding the participating article of apparel;</text></clause><clause id="H552FAFF9CE2B48EE8C7F8C178FA3E692"><enum>(ii)</enum><text>the complete information provided under subsection (c)(1) regarding the participating article of apparel; </text></clause><clause id="HA1CC3B6707F04CCCB7D71AB9B4987458"><enum>(iii)</enum><text display-inline="yes-display-inline">the database established under subsection (d); and</text></clause><clause id="HA320C03E18714E8E80CE0A5FD8AC92A2"><enum>(iv)</enum><text display-inline="yes-display-inline">such other information as the Administrator determines to be relevant to the consumer;</text></clause></subparagraph></paragraph><paragraph id="H7A5082C265B548C0B2AC75255DA63FCE"><enum>(7)</enum><text display-inline="yes-display-inline">if the participant is the manufacturer of the participating article of apparel, and not the retail establishment selling the participating article of apparel to the end consumer, this fact shall be made clear on the apparel sustainability label;</text></paragraph><paragraph id="H5F8297FDCD794DC5B5AA913D5770A2E5"><enum>(8)</enum><text display-inline="yes-display-inline">if requested by a participant, the information pertaining to the participating article of apparel that is conveyed under paragraph (6)(A) shall be divided into—</text><subparagraph id="HBCAE7568A86241969D9FBA9702ABC612"><enum>(A)</enum><text display-inline="yes-display-inline">information identified under clauses (i) through (v) of paragraph (6)(A), for which the participant shall be responsible for reporting; and</text></subparagraph><subparagraph id="H6F4C6479945F4FD1B3A646299008DB54"><enum>(B)</enum><text>information identified under clauses (vi) through (ix) of paragraph (6)(A), for which the Administrator shall be responsible for estimating on the basis of the typical use of the participating article of apparel;</text></subparagraph></paragraph><paragraph id="HD831A99F3C514A53BD8E6F6DC56BB33D"><enum>(9)</enum><text>the distinction between the sources of information referred to in subparagraphs (A) and (B) of paragraph (8) shall be made clear on the apparel sustainability label;</text></paragraph><paragraph id="H6625A2B123DA47CEB29C2F97FC72D361"><enum>(10)</enum><text display-inline="yes-display-inline">no information or imagery shall be included on the apparel sustainability label that has not been specified by the Administrator pursuant to paragraphs (5) and (6);</text></paragraph><paragraph id="H62E6E8E0B7DB4AE28A3245E579728503"><enum>(11)</enum><text display-inline="yes-display-inline">the Administrator shall establish the method by which the information included on the apparel sustainability label shall be verified, which verification shall—</text><subparagraph id="H9E0F41C2E8EC4C87A03C2AEDFCDB8FC9"><enum>(A)</enum><text display-inline="yes-display-inline">be conducted in accordance with uniform standards for the collection and analysis of the information for all participating articles of apparel;</text></subparagraph><subparagraph id="H2D7C30BF229A4344AEDD3AC32F4D1DBB"><enum>(B)</enum><text>require the use of the best available scientific information;</text></subparagraph><subparagraph id="HC2F9337F1864487483D9D928A73EFC08"><enum>(C)</enum><text>specify the requirements for entities to be authorized to measure, monitor, verify, and report the information; </text></subparagraph><subparagraph id="HAE2EFD36BB9C4B8A9A5E621A0FAD0326"><enum>(D)</enum><text>be informed by the established international standards for carbon accounting for product life cycle assessment, including—</text><clause id="HD3CFF279ED644416ADDE20E9C0851945"><enum>(i)</enum><text>the ISO 14040 and ISO 14044 standards of the International Organization for Standardization; and</text></clause><clause id="HB537987238B64A9DAC76EACC6C327E99"><enum>(ii)</enum><text>protocols established under the Greenhouse Gas (GHG) Protocol program of the World Business Council for Sustainable Development and the World Resources Institute, including—</text><subclause id="HE448822BBF4D4A8980535466344B864D"><enum>(I)</enum><text>the GHG Protocol for Product Accounting and Reporting; and</text></subclause><subclause id="HB2086590271E4A06BAED619C2B107DFA"><enum>(II)</enum><text>Publicly Available Specification 2050; and</text></subclause></clause></subparagraph><subparagraph id="H7A0322E023D74D8A823599D90EAA6BC4"><enum>(E)</enum><text display-inline="yes-display-inline">be informed by and generally align with the current best practices for validating such information in the apparel industry;</text></subparagraph></paragraph><paragraph id="H382E4D89C1684161A3A1963521F15E46"><enum>(12)</enum><text>in establishing the requirements described in paragraphs (5), (6), and (10), the Administrator—</text><subparagraph id="H6E050F9D6C5C4F52A351FFF4D55EB63F"><enum>(A)</enum><text display-inline="yes-display-inline">shall consult with an expert advisory panel composed of apparel industry stakeholders; and</text></subparagraph><subparagraph id="H85CC45AB4DA74C3CA19C0B3E13C9B4D8"><enum>(B)</enum><text>may consult with such panel either—</text><clause id="H8CBF0FA227464F8798E587341F6C64CD"><enum>(i)</enum><text>by establishing a Federal advisory committee under chapter 10 of part I of title 5, United States Code (commonly referred to as the <quote>Federal Advisory Committee Act</quote>); or</text></clause><clause id="H918EBBE08B37411A8E1627FF83BF1921"><enum>(ii)</enum><text>through a negotiated rulemaking under subchapter III of part I of title 5, United States Code (commonly referred to as the <quote>Negotiated Rulemaking Act</quote>);</text></clause></subparagraph></paragraph><paragraph id="H96DA82308811444ABC6DF320303F9D65"><enum>(13)</enum><text>the Administrator shall establish a program by which entities shall be certified to perform the activities under paragraph (11)(C);</text></paragraph><paragraph id="H66AA69CD59DA476DBBBFF369FA0D26E1"><enum>(14)</enum><text>beginning 7 years after the date of enactment of this Act, and every 5 years thereafter, the Administrator shall—</text><subparagraph id="H2C7C979DB1BA4D2AA297A5BBC2D7EF3E"><enum>(A)</enum><text display-inline="yes-display-inline">publish a report on the effectiveness, as determined by the Administrator, of the labeling program in achieving objectives, including such effectiveness in—</text><clause id="HA74EE0F750794AFAADFFE7C6BEE07CA6"><enum>(i)</enum><text display-inline="yes-display-inline">providing consumers information that consumers find useful; and</text></clause><clause id="H26DA97682FCB4CF2916DFCB0FBD3BB5D"><enum>(ii)</enum><text>reducing the greenhouse gas emissions associated with apparel throughout the full life cycle as described in paragraph (6)(A);</text></clause></subparagraph><subparagraph id="H7E77172EBC3A44F4BBFD6206538D6C81"><enum>(B)</enum><text display-inline="yes-display-inline">review and revise the regulations under this section to increase such effectiveness, as determined by the Administrator, of the labeling program with respect to the two objectives listed in clauses (i) and (ii) of subparagraph (A); and</text></subparagraph><subparagraph id="HD7C4C51093114173A949852783479EF6"><enum>(C)</enum><text display-inline="yes-display-inline">report to the Congress any recommendations for amendments to this section that, in the determination of the Administrator, would improve such effectiveness; and</text></subparagraph></paragraph><paragraph id="H863791E42AAC4DD2829864F04763DD2C"><enum>(15)</enum><text display-inline="yes-display-inline">the Administrator shall provide technical assistance, including through consultants, in reporting information as required in accordance with the labeling program, otherwise participating in the labeling program, and reducing greenhouse gas emissions, to—</text><subparagraph id="H195F2E390A8D4E4F8C574716C914A9C1"><enum>(A)</enum><text>participants;</text></subparagraph><subparagraph id="HAA0E071E9C5441BEBC6A5C925BDB7E11"><enum>(B)</enum><text>entities seeking to become participants; and</text></subparagraph><subparagraph id="H1AA169C4033A4704985C46A797747811"><enum>(C)</enum><text>entities seeking to become certified under paragraph (13).</text></subparagraph></paragraph></subsection><subsection id="H73B9C818FA054214B1D919DC63C9F359"><enum>(c)</enum><header>Voluntary commitments</header><paragraph id="H9016A905D0C24FA6AD50A7B7FF6F5D8E"><enum>(1)</enum><header>In general</header><text>The Administrator shall carry out a program under which a participant may agree to—</text><subparagraph id="HDEB265C4DA7A4D34B4E4DD0E1478FB99"><enum>(A)</enum><text display-inline="yes-display-inline">a voluntary commitment to reduce the total greenhouse gas emissions released throughout the full life cycle of participating articles of apparel and their input materials, as described in subsection (b)(6)(A); and</text></subparagraph><subparagraph id="H221788652CF3433FAE693C944892AD8B" commented="no"><enum>(B)</enum><text>make publicly available, including on the participant’s website, sustainability information pertaining to the participant or the participating article of apparel that is determined by the Administrator to be based on the best available scientific information.</text></subparagraph></paragraph><paragraph id="HF29E5A417A534F5D8F56DBCD882AE92F"><enum>(2)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this Act, the Administrator shall establish the program required by paragraph (1).</text></paragraph><paragraph id="H045952B220B640F9ABE1695D8E3F9A76"><enum>(3)</enum><header>Encouragement; technical assistance</header><text display-inline="yes-display-inline">The Administrator shall encourage participants, and provide technical assistance to participants, to agree to voluntary commitments under this subsection.</text></paragraph><paragraph id="H3FD9CB455E9C4CD98FBC718DEE52E1AB"><enum>(4)</enum><header>No mandate</header><text> This subsection does not authorize the Administrator to impose any mandate.</text></paragraph></subsection><subsection id="HF716726EC8DE4AFE8B8CED55B378BA02"><enum>(d)</enum><header>Database</header><text>Not later than 2 years after the date of enactment of this Act, the Administrator shall establish a database to provide easy access to consumers and apparel industry stakeholders to information pertaining to the labeling program, including—</text><paragraph id="HAAB26F50336045E4987272B953353123"><enum>(1)</enum><text display-inline="yes-display-inline">explanations of the objectives and the methodologies of the Administrator in establishing the requirements described in subsection (b);</text></paragraph><paragraph id="H9609BC9C29E7422D8772AB6FFDC8B0A3"><enum>(2)</enum><text>the information described in subsection (b)(6) with respect to each participating article of apparel;</text></paragraph><paragraph id="H7F8C8342DBC4431386ADB6D6751C7F18"><enum>(3)</enum><text>the voluntary commitments of each participant as reported under subsection (c); and</text></paragraph><paragraph id="HAEDCC49EA18D4C048C5BC1D1424D86B1"><enum>(4)</enum><text>any additional available information on the sustainability of apparel that the Administrator determines to be—</text><subparagraph id="H1EBC3DD6DDB94D738B94271148E11511"><enum>(A)</enum><text>useful to the consumer and apparel industry stakeholders; and</text></subparagraph><subparagraph id="HC8DB92E2C70447EABE5A5AC05638783E"><enum>(B)</enum><text>based on the best scientifically available information.</text></subparagraph></paragraph></subsection><subsection id="HD182066C4F4F4001A61C3E31642FC635"><enum>(e)</enum><header>Consumer outreach</header><paragraph id="HE5701DE5D22D40A389F137E0FD58E816"><enum>(1)</enum><header>Program</header><text>Not later than 3 years after the date of enactment of this Act, the Administrator shall establish a program to inform consumers about the labeling program.</text></paragraph><paragraph id="H14E349104C884DFA9B85D8C0D4308983"><enum>(2)</enum><header>Requirements</header><text>The consumer outreach program established under paragraph (1) shall—</text><subparagraph id="H963E70B3CB6F40EE833C81E95067FC2A"><enum>(A)</enum><text>provide retail apparel establishments educational materials and other information to be conveyed to consumers regarding the labeling program;</text></subparagraph><subparagraph id="H1ECD19A7843144FBB3227AC63B16353A"><enum>(B)</enum><text display-inline="yes-display-inline">provide technical assistance to retail apparel establishments regarding the labeling program and the materials and information described in subparagraph (A); and</text></subparagraph><subparagraph id="HC57C00DFE84A4EA9B11B9C0A41FAB532"><enum>(C)</enum><text display-inline="yes-display-inline">reach the public through a wide range of means, including public service announcements and advertising.</text></subparagraph></paragraph></subsection><subsection id="H11C5BFBC039845D88D216CACAB69FDBC"><enum>(f)</enum><header>Penalties for fraudulent use of label</header><paragraph id="HFCFA1641DF2A4097B62144B698709223"><enum>(1)</enum><header>In general</header><text>Any person that violates a requirement of this section shall forfeit and pay to the United States a civil penalty of not more than $10,000 for each such violation.</text></paragraph><paragraph id="H76A9B99A424A48D892709B94F846E567"><enum>(2)</enum><header>Separate violations</header><text>Each separate violation of a requirement of this section shall be a separate offense, except that in a case of a violation through continuing failure to obey or neglect to obey an order by the Administrator under this section, each day of continuance of such failure or neglect shall be deemed a separate offense.</text></paragraph><paragraph id="H1BDEA317E2644B55810CA990C0571CCB"><enum>(3)</enum><header>Equitable relief</header><text>In a civil action brought under this section, the United States district courts are empowered to grant mandatory injunctions and such other equitable relief as such courts deem appropriate.</text></paragraph></subsection><subsection id="H72160E171D594FDFB51020BBF17DC2A5"><enum>(g)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H18FDD2FD7FF249F9957F3FA47C7F6703"><enum>(1)</enum><header>Apparel industry stakeholders</header><text>The term <term>apparel industry stakeholders</term> means—</text><subparagraph id="H56A6F07AE4AD403DBE87BD610ADAA6CA"><enum>(A)</enum><text>suppliers and vendors of apparel manufacturers;</text></subparagraph><subparagraph id="H5CAD5685ABF5488CB0685F8888D19254"><enum>(B)</enum><text>apparel manufacturers;</text></subparagraph><subparagraph id="H18DFACDB82274977B5BF2C75594F0463"><enum>(C)</enum><text>retail apparel establishments;</text></subparagraph><subparagraph id="HEAD99941F9F8436A83D6B4F4F9D80CDD"><enum>(D)</enum><text>entities that measure, monitor, verify, and report information described under subsection (b)(6);</text></subparagraph><subparagraph id="H0018811F23AF403492338E312C8B7863"><enum>(E)</enum><text>institutions of higher education;</text></subparagraph><subparagraph id="HF6CE624924294A7A940A3CBDEB05C67F"><enum>(F)</enum><text>consumer organizations;
