which was referred to the <committee-name committee-id="HED00">Committee on Education and the Workforce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of Labor to award grants to States for the purpose of providing subgrants to eligible entities for education and technical training on how to perform cosmetology services on textured hair.</official-title></form><legis-body id="H2D4BE526696146CF96F4B072EA54AEB3" style="OLC"><section id="H3A9DE42D26CA4C09937259532E5AE89A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Texture Positive Act of 2024</short-title></quote>.</text></section><section id="H1CD0802AF62E4F30AD4919915BEE77BB"><enum>2.</enum><header>Grants for education and technical training on textured hair</header><subsection id="H06D5CE87F5814C60B684E9CEAD418467"><enum>(a)</enum><header>Grants authorized</header><text display-inline="yes-display-inline">The Secretary shall award, on a competitive basis, grants to States for the purpose of awarding subgrants in accordance with this section.</text></subsection><subsection id="HC104E014E9E245948825494A8B3F4C11"><enum>(b)</enum><header>Application</header><text display-inline="yes-display-inline">A State seeking a grant under this section shall submit an application to the Secretary at such time, in such manner, and containing such information as the Secretary may reasonably require, including a summary of the information submitted under subsection (c)(2) by each eligible entity that the State plans to award a subgrant to under such subsection. </text></subsection><subsection id="H152951D737CA444C997A26C1EE7350D2"><enum>(c)</enum><header>Subgrants</header><paragraph id="H01F1A9FDE6DD49C2907C3D7BE3395A7B"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A State that receives a grant under this section shall use such grant to award, on a competitive basis, subgrants to eligible entities for the purpose of carrying out the activities described in paragraph (3).</text></paragraph><paragraph id="H8DD15AC9D427411DADFB301E9912DB5F"><enum>(2)</enum><header>Application</header><text display-inline="yes-display-inline">An eligible entity seeking a subgrant under this subsection shall submit an application to the State at such time, in such manner, and containing such information as the State may reasonably require, including—</text><subparagraph id="H6938D8BA5F164EE3827311BEF5E2185F" display-inline="no-display-inline"><enum>(A)</enum><text>a description of how the eligible entity plans to carry out the activities described in paragraph (3);</text></subparagraph><subparagraph id="HE0E2BBC438984515A428DD6CAF237FBF" commented="no"><enum>(B)</enum><text>an estimate of—</text><clause id="H9629864CE75045F99BBD70F861DC8492"><enum>(i)</enum><text>the cost of conducting the activities described in paragraph (3), including the cost per student of providing the education and technical training required under subparagraph (A) of such paragraph; and</text></clause><clause id="H671E903DD4E94E78B9B9ACFF94C66866"><enum>(ii)</enum><text>the number of students the eligible entity plans to instruct; and</text></clause></subparagraph><subparagraph id="HD9E3EA18724243549B22B523D29B66A2"><enum>(C)</enum><text display-inline="yes-display-inline">a description of how the eligible entity plans to increase access to the education and technical training required under paragraph (3)(A).</text></subparagraph></paragraph><paragraph id="H7CC618307FAF4FC8B332ED344B08870A" commented="no"><enum>(3)</enum><header>Use of funds</header><text display-inline="yes-display-inline">An eligible entity that receives a subgrant under this subsection—</text><subparagraph id="H525D2925F26047919B9EE7EF45AF0240"><enum>(A)</enum><text display-inline="yes-display-inline">shall use such subgrant funds to provide, as part of the curriculum of cosmetology schools, education and technical training to students of such cosmetology schools on how to shampoo, deep condition, braid, twist, and style textured hair; and</text></subparagraph><subparagraph id="HE78D1F560EAC4510A6A11407F2D2A29B" commented="no"><enum>(B)</enum><text>may use such subgrant funds to, in order to better provide such education and technical training—</text><clause id="HC98ADF55D8264A4E9FC1C9ED98812F6D" commented="no"><enum>(i)</enum><text>develop such education and technical training;</text></clause><clause id="H5BCCBC0AE029430B9216F74AD33CFFD6"><enum>(ii)</enum><text>hire and train instructors; and</text></clause><clause id="H64C7AB9051BB4E378BDE8140AA93B62C" commented="no"><enum>(iii)</enum><text>provide digital training, including through prerecorded videos.</text></clause></subparagraph></paragraph><paragraph id="HED0037F42A3443DBA5D7AEFE05461628" commented="no"><enum>(4)</enum><header>Determination of amount of award</header><text>A State shall award a subgrant under this subsection in an amount that the State determines appropriate based on the estimate submitted under paragraph (2)(B).</text></paragraph></subsection><subsection id="H781874600C7F4919A75E0C9B072E1877" commented="no"><enum>(d)</enum><header>Duration; renewal</header><paragraph id="H9FE4B70B206743289E18C042C8B390A3" commented="no"><enum>(1)</enum><header>Grants</header><text display-inline="yes-display-inline">A grant awarded under this section shall be for a term of 4 years and may be renewed by the Secretary.</text></paragraph><paragraph id="HC79A66677AB04E53BFD838154D176F45" commented="no"><enum>(2)</enum><header>Subgrants</header><text>A subgrant awarded under subsection (c) shall be for a term of 6 months and may be renewed by the State that awarded the subgrant. In determining whether to renew such subgrant, the State shall take into consideration the information submitted under subsection (e).</text></paragraph></subsection><subsection id="HAE3F02AA62CA40D0AA19D1F755F7EC2C"><enum>(e)</enum><header>Reporting requirements</header><paragraph id="HB715E4A6AC6A40BE930969FA3CC866B7"><enum>(1)</enum><header>Eligible entities</header><text>Not later than 60 days before each date that is the final date of the term described in subsection (d)(2), a recipient of a subgrant under subsection (c) shall submit to the State that awarded the subgrant a report including—</text><subparagraph id="HEAFAFF515EB24576B4F7B9EFD631710F" display-inline="no-display-inline"><enum>(A)</enum><text>a description of how the subgrant was used;</text></subparagraph><subparagraph id="H809AD60BEEB84C0DB21DF9CD934E4DC6" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">an identification of the cosmetology schools that the eligible entity worked with to provide the education and technical training required under subsection (c)(3)(A);</text></subparagraph><subparagraph id="H84D7CAB455694BB18E91563BAFAAE22A"><enum>(C)</enum><text display-inline="yes-display-inline">the number of instructors that the eligible entity trained to provide the education and technical training required under subsection (c)(3)(A); and</text></subparagraph><subparagraph id="HF1BE3C9D985C402BA66F2F146902402B"><enum>(D)</enum><text>the number of students that received the education and technical training required under subsection (c)(3)(A).</text></subparagraph></paragraph><paragraph id="HF9C4CB593DAA44EC9D18A7B663823B8E" commented="no"><enum>(2)</enum><header>States</header><text display-inline="yes-display-inline">Not later than 60 days after each date that is the final date of the term described in subsection (d)(1), a State that receives a grant under this section shall submit to the Secretary a report including—</text><subparagraph id="HBBE0DEAED9A8477AA8FE4C732CEBC32E" commented="no"><enum>(A)</enum><text>an identification of the State agency that awards subgrants under this section; and</text></subparagraph><subparagraph id="HB19187E5BE7741BBAF74B75F623835AE" commented="no"><enum>(B)</enum><text>a summary of the information submitted under paragraph (1).</text></subparagraph></paragraph></subsection><subsection id="HF0916C3D2ABE45DABCCE50104CA97A61"><enum>(f)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H001BB0B8A2EC493FBA081583361C7F9C"><enum>(1)</enum><header>Cosmetology school</header><text display-inline="yes-display-inline">The term <term>cosmetology school</term> means a school that provides training to prepare students for gainful employment in an occupation related to cosmetology. </text></paragraph><paragraph id="HBAB5D442D6B348E8BDCCFFB45BB83F97"><enum>(2)</enum><header>Eligible entity</header><text display-inline="yes-display-inline">The term <term>eligible entity</term>—</text><subparagraph id="H9E62DBCB3C014AABA772F587D1E7C770"><enum>(A)</enum><text>means a corporation, limited liability company, association, or company that—</text><clause id="H727E20E041284BC08E7B42CEF6109426" commented="no"><enum>(i)</enum><text>was established not less than 5 years before the date of enactment of this Act;</text></clause><clause id="HA70F10D5807F4FAC829FA2A033154719"><enum>(ii)</enum><text>has experience in providing the education and technical training required under subsection (c)(3)(A);</text></clause><clause id="HD1DDA7FF62F14DB69FAA0386454B2F59"><enum>(iii)</enum><text>has an employer identification number issued by the Internal Revenue Service; and</text></clause><clause id="HBB7C26C867284EE2B138308867775D30"><enum>(iv)</enum><text>has a Minority- or Women-owned Business Enterprise certificate; and</text></clause></subparagraph><subparagraph id="HC484B358FE4A4060B0F3A6982C11F62C"><enum>(B)</enum><text>does not include—</text><clause id="HE605C47E48DA4C3FAC71702559C2FE36"><enum>(i)</enum><text>a consortium of cosmetology schools, including an association of such schools;</text></clause><clause id="H3CC432B01FA84A94AB0DA45E401A7455"><enum>(ii)</enum><text>an individual; or</text></clause><clause id="HE3116BF1BDE44D19B1C520E5249312E4"><enum>(iii)</enum><text>a cosmetology school that has received, at any point, Federal funds other than through a subgrant under subsection (c). </text></clause></subparagraph></paragraph><paragraph id="HDFFA16DD35F94DBC8E90D6E0F26755DB"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Labor.</text></paragraph><paragraph id="H1DBC39C9C70D49CE82A3CD55EF1DF0B0" commented="no"><enum>(4)</enum><header>State</header><text>The term <term>State</term> means each of the several States, the District of Columbia, and any commonwealth, territory, or possession of the United States.</text></paragraph><paragraph id="H85F8F6531DEC456EB32277873DFB087C"><enum>(5)</enum><header>Textured hair</header><text>The term <term>textured hair</term> means hair that is coiled, curly, or wavy in its natural state.</text></paragraph></subsection></section></legis-body></bill>
