R. 8867</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20240627">June 27, 2024</action-date><action-desc><sponsor name-id="N000147">Ms. Norton</sponsor> (for herself and <cosponsor name-id="F000476">Mr. Frost</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HGO00">Committee on Oversight and Accountability</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the REAL ID Act of 2005 to allow States to determine whether to require licenses and other identification to list a gender or sex, and for other purposes.</official-title></form><legis-body id="H3B4438F7B341481688B94666E05B77AF" style="OLC"><section id="HE0E0C920730F4C299FCD71A5E4904F7C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>REAL ID Gender Requirement Reform Act</short-title></quote>.</text></section><section id="H6D2AB1236B674CBE9C2F464A8F7DD142"><enum>2.</enum><header>Identification requirements</header><subsection id="H11BCC2ABA0444266B4E09B8555794C84"><enum>(a)</enum><header>Amendment</header><text display-inline="yes-display-inline">Section 202(b) of the REAL ID Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/49/30301">49 U.S.C. 30301</external-xref> note) is amended—</text><paragraph id="HE36D59C8B0CF49028A34EAF6DA00E5CA"><enum>(1)</enum><text display-inline="yes-display-inline">by striking paragraph (3);</text></paragraph><paragraph id="H2287DA143A4B4F7A8ADDDA1F72D89351"><enum>(2)</enum><text>by redesignating paragraphs (4) through (9) as paragraphs (3) through (8), respectively; and</text></paragraph><paragraph id="H712F850605B1440285AAF9A8D8C97697"><enum>(3)</enum><text>by adding at the end the following new subsection:</text><quoted-block style="OLC" id="H301BAA48D31E4F288707E233956613A1" display-inline="no-display-inline"><subsection id="H1A04F8A3C1B041C79CEFED5286884FE0"><enum>(e)</enum><header>State determination of listing gender</header><text display-inline="yes-display-inline">A State may determine whether to include a gender or sex field required for a driver’s license and identification card issued to a person by the State. If a State includes any such gender or sex identification, a person shall indicate the appropriate designation without any additional documentation requirement (such as a doctor’s note) and the State shall include an unspecified or other designation in the gender or sex field in addition to male or female. </text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H6C374280EF8246099CBB41D347E3D53F"><enum>(b)</enum><header>Technical and conforming amendment</header><text display-inline="yes-display-inline">Section 508(a)(1) of the Court Security Improvement Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/49/30301">49 U.S.C. 30301</external-xref> note) is amended by striking <quote>section 202(b)(6)</quote> and inserting <quote>section 202(b)(5)</quote>.</text></subsection></section></legis-body></bill>
