<section id="H188FD6B6FE41461EADAD5C1F3B095580" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Destruction of Hazardous Imports Act</short-title></quote>.</text></section> <section id="HCA627B774C804784B2FEB4AF0CA19140"><enum>2.</enum><header>Destruction of certain refused articles</header> <subsection id="H307D1958056C4C069BB3983E7BC1868D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 801(a) of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/381">21 U.S.C. 381(a)</external-xref>) is amended—</text> 
<paragraph id="H8A9D8AB437E0490E82C09B0D847BD24B"><enum>(1)</enum><text>in the seventh sentence, by striking <quote>as described under subsection (b).</quote> and inserting <quote>as described under subsection (b), or any article refused admission under this section, if the Secretary of Health and Human Services determines that such article presents a significant public health concern.</quote>; and</text></paragraph> <paragraph id="H4044E413CC2046769D80949D60707DB9"><enum>(2)</enum><text>in the eighth, ninth, and tenth sentences, by striking <quote>drug or device</quote> each place it appears and inserting <quote>drug, device, or other article</quote>. </text> 
<quoted-block style="OLC" id="HA5326B0CF92C436C9D0DF7F6B0CD0AE5" display-inline="no-display-inline"> <after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HD86EDD037CF5499281B887E48927B8AB"><enum>(b)</enum><header>Prohibited acts</header><text>Section 301 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/331">21 U.S.C. 331</external-xref>) is amended by adding at the end the following:</text> <quoted-block style="OLC" id="HEC0ADE7558B14A93A83E3122874FFA4E" display-inline="no-display-inline"> <subsection id="HC9BE9A1931B0428CBDF4B3E0D644A0E5" commented="no"><enum>(jjj)</enum><text display-inline="yes-display-inline">The unauthorized movement, or introduction or delivery for introduction into interstate commerce, including export, of an article that the Secretary has decided to destroy under the seventh sentence of section 801(a).</text></subsection> <after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H60AB2C39C212491EA9F3F878AC3C634E" commented="no"><enum>(c)</enum><header>Applicability</header><text display-inline="yes-display-inline">The amendments made by subsections (a) and (b) shall apply to articles beginning on the date that is 180 days after the date of enactment of this Act.</text></subsection> <subsection id="HCA10EDE4FBAB4DB4AF2CF08AD1D54FB5" commented="no"><enum>(d)</enum><header>Regulations</header><text>The Secretary of Health and Human Services, acting through the Commissioner of Food and Drugs, shall—</text> 
<paragraph id="H6ACDBC52BE464BA1A5BD3A4770504E79" commented="no"><enum>(1)</enum><text>not later than 90 days after the date of enactment of this Act, finalize such revisions to regulations as may be necessary to implement the amendments made by subsections (a) and (b); and</text></paragraph> <paragraph id="H312114F2E707405082200546C7910738" commented="no"><enum>(2)</enum><text>ensure that such regulations are consistent with any applicable international agreements.</text> </paragraph></subsection></section>
