which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit the use of artificial intelligence to deprive or defraud individuals of the right to vote in elections for public office, and for other purposes.</official-title></form><legis-body id="HB7BDF08829514E75A6CB9D7D61675481" style="OLC"><section id="H56BE3B2E6EC440CA8AABDE406B52A24B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Securing Elections From AI Deception Act</short-title></quote>.</text></section><section id="H38706BAD5D034BF3B9E24DF78ECB4E17"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act, the following definitions apply:</text><paragraph id="HEF04F536986B42D5B201EDD7660EAA15"><enum>(1)</enum><header>Commission</header><text display-inline="yes-display-inline">The term <term>Commission</term> means the Federal Trade Commission.</text></paragraph><paragraph id="HD59386C8A30E4A6DA418E31516962FED"><enum>(2)</enum><header>Covered algorithm</header><subparagraph id="H98D56B7E3CCA41B4BCE2D5F7EB5ED315"><enum>(A)</enum><header>In general</header><text>The term <term>covered algorithm</term> means a computational process described in subparagraph (B) that—</text><clause id="H89ED99FE6AB3441C9D4017FF7B7C2B9E"><enum>(i)</enum><text display-inline="yes-display-inline">creates or facilitates the creation of a product or information;</text></clause><clause id="H11E37D565FC742328274E165FE063B52"><enum>(ii)</enum><text>promotes, recommends, ranks, or otherwise affects the display or delivery of material information;</text></clause><clause id="H05BF6E6A3C8B441EAE2ACF67310152B7"><enum>(iii)</enum><text>makes a decision; or</text></clause><clause id="HA9C496BBCF3D424F95D7CEA8CE424184"><enum>(iv)</enum><text>facilitates human decision making.</text></clause></subparagraph><subparagraph id="H8B7CA5B2D1364DABB7AD18928A484596"><enum>(B)</enum><header>Computational process described</header><text>In subparagraph (A), a computational process described in this subparagraph is—</text><clause id="HA97C9B25C2714FFC9E4855F6E9CC2AA3"><enum>(i)</enum><text display-inline="yes-display-inline">a computational process that uses machine learning, natural language processing, artificial intelligence techniques, or other computational processing techniques of similar or greater complexity; or</text></clause><clause id="HD6982A177C374D7C8E0135176CB33550"><enum>(ii)</enum><text>a deterministic computational process derived from a process described in clause (i).</text></clause></subparagraph></paragraph><paragraph id="HB21CA89A73134FD2BF952246C10B0F70"><enum>(3)</enum><header>Deployer</header><text display-inline="yes-display-inline">The term <term>deployer</term> means any person, other than an individual acting in a non-commercial context, that uses a covered algorithm. Nothing in this paragraph may be construed to prohibit a person who is a deployer under this paragraph from treatment as a developer under this Act.</text></paragraph><paragraph id="HE4F731CFE3C1435498196FC5CC28F059"><enum>(4)</enum><header>Developer</header><text display-inline="yes-display-inline">The term <term>developer</term> means any person that designs, codes, customizes, or produces a covered algorithm, or substantially modifies a covered algorithm, whether for its own use or for use by a third party. Nothing in this paragraph may be construed to prohibit a person who is a developer under this paragraph from treatment as a deployer under this Act.</text></paragraph><paragraph id="H584C8FC53EF5422894274E0772289E8F"><enum>(5)</enum><header>Election worker</header><text display-inline="yes-display-inline">The term <term>election worker</term> an individual who is an election official, poll worker, or an election volunteer in connection with the administration of an election for a Federal, state, or local office.</text></paragraph></section><section id="HB4AC1C21E628442BA28A46ECDF55D74E"><enum>3.</enum><header>Prohibiting use of artificial intelligence to deprive or defraud individuals of the right to vote in elections for public office</header><subsection id="H2C7CEA98C9B74570B4108C61277F8D2B"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">A developer or deployer shall not use a covered algorithm in a manner that intentionally deprives or defrauds, or intentionally attempts to deprive or defraud, an individual of the right to vote in an election for Federal, State, or local office, including the following:</text><paragraph id="HEE83F8762C724A92AB2F66C152DF6362"><enum>(1)</enum><text>Providing deceptive information regarding—</text><subparagraph id="H1B85157CB00A4E46B0A7C35A97B8E678"><enum>(A)</enum><text display-inline="yes-display-inline">the time, place, or method of voting or registering to vote;</text></subparagraph><subparagraph id="H01C306A7341E4776AB05560B479DD533"><enum>(B)</enum><text>the eligibility requirements to vote or register to vote;</text></subparagraph><subparagraph id="H852BE807563C4D5F9463BAEDF58D5D9E"><enum>(C)</enum><text>the counting and canvassing of ballots;</text></subparagraph><subparagraph id="HDB89CB1417DD4AC482E8217E35A53DE8"><enum>(D)</enum><text>the adjudication of elections;</text></subparagraph><subparagraph id="HD9B19BD2125F489DB1EB8B4F28543D07"><enum>(E)</enum><text>endorsements by any person or candidate; or</text></subparagraph><subparagraph id="H32CE616171B8416784E1697633E81BCF"><enum>(F)</enum><text>any other material information pertaining to the procedures or requirements for voting or registering to vote in an election for Federal, State, or local office.</text></subparagraph></paragraph><paragraph id="HFDFF10F5708F460A8B80F5A1AA4E3AB7"><enum>(2)</enum><text display-inline="yes-display-inline">Using deception, threats, intimidation, fraud, or coercion to prevent, interfere with, retaliate against, or deter, or to attempt to prevent, interfere with, retaliate against, or deter, an individual from—</text><subparagraph id="H90B4FFA8C8764F4A86B7DDB091D893E7"><enum>(A)</enum><text>registering to vote;</text></subparagraph><subparagraph id="HB2BBE046B3A44632AF67AFACE5D16DB0"><enum>(B)</enum><text>voting;</text></subparagraph><subparagraph id="H0B91430AC99443F1B2A7B4E514E7C581"><enum>(C)</enum><text>supporting or advocating for a candidate in the election; or</text></subparagraph><subparagraph id="H12B1E6B3D75C40E5A5932D54810DAFE6"><enum>(D)</enum><text>serving as, executing the responsibilities of, or assisting an election worker, including processing or scanning ballots, or tabulating, canvassing, or certifying voting results.</text></subparagraph></paragraph></subsection><subsection id="H8E7C404F95FE41429AFB2A6A96FA5C4B"><enum>(b)</enum><header>Penalty</header><text display-inline="yes-display-inline">Whoever commits a violation of subsection (a) shall be fined under title 18, United States Code, imprisoned for not more than 1 year, or both.</text></subsection><subsection id="H2ACA9D3665574F1D9E22E7BDC608963B"><enum>(c)</enum><header>Effective date</header><text>This section shall take effect upon the expiration of the 60-day period which begins on the date of the enactment of this Act.</text></subsection></section><section id="H6ABAC0CBF0234101B390342D4DF982C4"><enum>4.</enum><header>Requiring disclaimers on election-related content generated by artificial intelligence</header><subsection id="H5E19A0BB45544E20B80CBE8DB9A67C6C"><enum>(a)</enum><header>Requirement for persons deploying content</header><paragraph id="HE6C1A456FF044E9ABA599BC6B8DD03D2"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A deployer who uses a covered algorithm to generate, in whole or in part, an image, text, video, audio, or other media, and intentionally publishes such content, shall include the disclaimer described in paragraph (2) if—</text><subparagraph id="H162D9BB325AC4DBBB4F764290E223C25"><enum>(A)</enum><text>the content includes a simulation, alteration, or distortion of an image or video of a candidate for Federal, State, or local office;</text></subparagraph><subparagraph id="H18F67B6EEFD948B69A50F848209B0083"><enum>(B)</enum><text>the content includes audio simulating, altering, or distorting the voice of a candidate for Federal, State, or local office; or</text></subparagraph><subparagraph id="H43F546B084FB4C06BC2F352A829EF413"><enum>(C)</enum><text>the content depicts information about the time, place, manner, or requirements for voting or registering to vote in election for Federal, State, or local office.</text></subparagraph></paragraph><paragraph id="H914FD3621FE34F758FB8C0748EAA4E02"><enum>(2)</enum><header>Disclaimer described</header><text>The disclaimer described in this paragraph is either of the following:</text><subparagraph id="H2205017B86414A168CBF5ED6077CBE0D"><enum>(A)</enum><text>The following statement: <quote>AI Disclaimer: This output was generated by artificial intelligence</quote>.</text></subparagraph><subparagraph id="H7D0D748A6E8B40E191E8426ACE5CF343"><enum>(B)</enum><text>A symbol, similar in size and design to the copyright symbol, consisting of the letters <quote>AI</quote> in a circle.</text></subparagraph></paragraph></subsection><subsection id="H4AC29D49CE724255A960FA76ADC94D40"><enum>(b)</enum><header>Requirements for developers</header><text display-inline="yes-display-inline">A developer who offers the ability to use a covered algorithm to generate or publish any content described in subparagraphs (A), (B), or (C) of subsection (a)(1) shall—</text><paragraph id="H8B91BD6796814A549A27E24A52FC22A7"><enum>(1)</enum><text display-inline="yes-display-inline">provide deployers of the covered algorithm a mechanism to comply with subsection (a); and</text></paragraph><paragraph id="H427CCC7E6E164AC4A22D7B81D539BC86"><enum>(2)</enum><text display-inline="yes-display-inline">to the extent technically feasible, make the disclaimers required to be included by the deployer under subsection (a) permanent or unable to be easily removed.</text></paragraph></subsection><subsection id="HBA89DB298098464BB8A94137A970CF34"><enum>(c)</enum><header>Administration and enforcement by Federal Trade Commission</header><paragraph id="HF1E3982B5AF54EC6BE667158EE7DFF2E"><enum>(1)</enum><header>Regulations required</header><text>Not later than 2 years after the date of the enactment of this Act, the Commission shall issue regulations under section 553 of title 5, United States Code, that detail the time, place, manner, and other appropriate requirements for the use of the disclaimer required by subsection (a), including accessibility for persons with disabilities and measures to ensure that the disclaimer is appropriate to the medium in which it is published.</text></paragraph><paragraph id="H0AA3E70B2F1045DA91A90E1FB7E64E69"><enum>(2)</enum><header>Additional authority</header><text display-inline="yes-display-inline">The Commission may issue regulations under section 553 of title 5, United States Code, that provide exceptions to subsection (a) in specific circumstances in which it would be obvious to a reasonable person that the media is a synthetic depiction of an actual item, place, person, or event.</text></paragraph><paragraph id="H3F86A9E0589541EBBFBADC3BE5F14DD4"><enum>(3)</enum><header>Enforcement</header><subparagraph id="H9F04B6E1ACCE453B9C833CE17E4C0A7D"><enum>(A)</enum><header>Unfair or deceptive acts or practices</header><text display-inline="yes-display-inline">A violation of this section or a regulation issued under this section shall be treated as a violation of a regulation under section 18(a)(1)(B) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/57a">15 U.S.C. 57a(a)(1)(B)</external-xref>) regarding unfair or deceptive acts or practices.</text></subparagraph><subparagraph id="HD155655EE02A4534A9221D856CC568D7"><enum>(B)</enum><header>Powers of Commission</header><text display-inline="yes-display-inline">The Commission shall enforce this section and any regulation issued under this section in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though all applicable terms and provisions of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>) were incorporated into and made a part of this section, and any person who violates this section or a regulation issued under this section shall be subject to the penalties and entitled to the privileges and immunities provided in the Federal Trade Commission Act.</text></subparagraph></paragraph><paragraph id="HC4390FD9008D4B8D8DF47EEA5B8D61A5"><enum>(4)</enum><header>Reporting requirement</header><subparagraph id="HFC70D408F68D49F59DDC63CFD0610D6B"><enum>(A)</enum><header>Public education</header><text>During the 5-year period which begins on the date of the enactment of this Act, the Commission shall undertake reasonable efforts to educate the public about the meaning and use of the disclaimer required by subsection (a).</text></subparagraph><subparagraph id="H2009FAE815DC4EFFA5B2F993B748023B"><enum>(B)</enum><header>Report</header><text>At the conclusion of the period described in subparagraph (A), the Commission shall submit a report to Congress on the adoption and effectiveness of the disclaimer required by subsection (a).</text></subparagraph></paragraph></subsection><subsection id="H0435D218AAF1401B9C646DBE5CDE58C8"><enum>(d)</enum><header>Effective date</header><text display-inline="yes-display-inline">This section shall take effect upon the expiration of the 60-day period which begins on the date on which the Commission issues the regulations required under subsection (c)(1).</text></subsection></section><section id="H78604269FF154219960F87BB1B3B203F"><enum>5.</enum><header>Duty of care</header><subsection id="HE85E09A029D4498FBCD8F8B836CED147"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">A developer or deployer shall not offer, license, or use a covered algorithm in a manner that is not safe and effective. </text></subsection><subsection id="H6BD059DFE7124CA6BCECE95596A54966"><enum>(b)</enum><header>Safe</header><text display-inline="yes-display-inline">For purposes of subsection (a), a covered algorithm is safe if—</text><paragraph id="H3155802B56534853AB7C034D3E67D857"><enum>(1)</enum><text>the developer or deployer has taken reasonable measures to prevent or mitigate harms identified by a pre-deployment evaluation or impact assessment;</text></paragraph><paragraph id="H96D86E5AC53144FB887F30BE7A1DF288"><enum>(2)</enum><text>use of the covered algorithm as intended is not likely to result in a violation of this Act; and </text></paragraph><paragraph id="HD91D191A7B7B47558F3945FA5E71065E"><enum>(3)</enum><text>the developer or deployer evaluates the possibility of not offering, licensing, or using the covered algorithm, or removing a covered algorithm from use, and reasonably concludes that—</text><subparagraph id="HF555DEF664C5474D879D89A685B25437"><enum>(A)</enum><text>use of the covered algorithm is not likely to result in substantial harm to individuals; </text></subparagraph><subparagraph id="HB93BB24FC4C445818D24EF4F3B950D04"><enum>(B)</enum><text>the benefits to individuals affected by the covered algorithm likely outweigh the costs to such individuals; </text></subparagraph><subparagraph id="HA7C028DC202641F89D8A312D0F53E90D"><enum>(C)</enum><text>individuals can reasonably avoid being affected by the covered algorithm; and </text></subparagraph><subparagraph id="HE499915547BE435DB224AF8256CA0539"><enum>(D)</enum><text>use of the covered algorithm is not likely to result in deceptive practices.</text></subparagraph></paragraph></subsection><subsection id="HFDB09F908907413899989B866FCBF4F7"><enum>(c)</enum><header>Effective</header><text display-inline="yes-display-inline">For purposes of subsection (a), a covered algorithm is effective if the developer or deployer has taken reasonable steps to ensure that—</text><paragraph id="H5D2F21B90EE94DEEB29A5FDE5078B2C4"><enum>(1)</enum><text>the covered algorithm functions at a level that would be considered reasonable performance by a person with ordinary skill in the art; </text></paragraph><paragraph id="HD3F91C870C4843BAA1A3CC79AED05692"><enum>(2)</enum><text>the covered algorithm functions in a manner that is consistent with the expected performance and publicly advertised performance of the covered algorithm; </text></paragraph><paragraph id="H14C205DD19BA400491188DEE4F15F52C"><enum>(3)</enum><text>the covered algorithm functions in a manner that is consistent with any publicly advertised purpose or use; and </text></paragraph><paragraph id="H06BC09E2CE4042219826A9ECDE76AFB5"><enum>(4)</enum><text>any data used in the design, development, deployment, or use of the covered algorithm is relevant and appropriate to the deployment context and the publicly advertised purpose.</text></paragraph></subsection><subsection id="HBA996951CBEF4192BDAAACEC96FF0E68"><enum>(d)</enum><header>Enforcement by Federal Trade Commission</header><paragraph id="H3C374E49D5E7445AB9A91738319C170A"><enum>(1)</enum><header>Unfair or deceptive acts or practices</header><text display-inline="yes-display-inline">A violation of this section shall be treated as a violation of a regulation under section 18(a)(1)(B) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/57a">15 U.S.C. 57a(a)(1)(B)</external-xref>) regarding unfair or deceptive acts or practices.</text></paragraph><paragraph id="H427CE7208E1448D49C956DA2D317B084"><enum>(2)</enum><header>Powers of Commission</header><text>The Commission shall enforce this section in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though all applicable terms and provisions of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et
