R. 8832</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20240625">June 25, 2024</action-date><action-desc><sponsor name-id="S001183">Mr. Schweikert</sponsor> (for himself and <cosponsor name-id="H001082">Mr. Hern</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HWM00">Ways and Means</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of Health and Human Services to issue guidance on payment under the Medicare program for certain items involving artificial intelligence.</official-title></form><legis-body id="H12C639677B6E44B994FE5F38FF57611F" style="OLC"><section id="H70958D04DBE248D49933823351916AB2" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Maintaining Innovation and Safe Technologies Act</short-title></quote>.</text></section><section id="H2D15EB17284245F69466C289643E5BCC" display-inline="no-display-inline" section-type="subsequent-section"><enum>2.</enum><header>Guidance on Medicare payment for certain items involving artificial intelligence</header><text display-inline="no-display-inline">Not later than January 1, 2026, the Secretary of Health and Human Services shall use existing communications mechanisms to issue guidance on requirements for payment under part B of title XVIII of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395j">42 U.S.C. 1395j et seq.</external-xref>) for remote monitoring devices, such as continuous glucose monitors, that—</text><paragraph id="H7BF4ABB972C943CF8C577F068AC5801F"><enum>(1)</enum><text>use an artificial intelligence component (such as a continuous adjustment component); and</text></paragraph><paragraph id="HB724C7CED71345098F51DC04A4F6677B"><enum>(2)</enum><text>transmit information to a health care provider for purposes of management and treatment of an individual.</text></paragraph></section></legis-body></bill>
