R. 8822</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20240625">June 25, 2024</action-date><action-desc><sponsor name-id="G000578">Mr. Gaetz</sponsor> (for himself, <cosponsor name-id="L000596">Mrs. Luna</cosponsor>, and <cosponsor name-id="D000032">Mr. Donalds</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Internal Revenue Code of 1986 to allow the payment of certain Federal taxes with bitcoin.</official-title></form><legis-body id="H8BC4327041A143DDAC64971357BC6876" style="OLC"><section id="HDEC3A8598773452E8EC99D1B3D58B7A6" section-type="section-one" commented="no"><enum>1.</enum><header>Payment of certain taxes by bitcoin</header><subsection id="HA168D98177A24BE3B0F8DE6FF1E3B10C" commented="no"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subchapter B of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/64">chapter 64</external-xref> of the Internal Revenue Code of 1986 is amended by inserting after section 6316 the following new section:</text><quoted-block style="OLC" id="HF0034799F2574A5687FBD56CD8B43305" display-inline="no-display-inline"><section id="H96A837E66DDE492BA0165661839640B5" commented="no"><enum>6316A.</enum><header>Payment of certain taxes by bitcoin</header><subsection id="H9BD9A2F4DDF94FD8822932E239D2B84F" commented="no"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall develop and implement a method to allow for the payment with bitcoin of any tax imposed on an individual under this title.</text></subsection><subsection id="HBD185072153344D5AAD12D78F3B2EA69" commented="no"><enum>(b)</enum><header>Regulations</header><text display-inline="yes-display-inline">The Secretary shall prescribe such regulations as the Secretary deems necessary to receive payment by bitcoin, including regulations that—</text><paragraph id="H13C166980D6041B197525EAA052EAEF2" commented="no"><enum>(1)</enum><text>specify when payment by such means will be considered received,</text></paragraph><paragraph id="HF782AE4C5B29493CAD5DD8D9B130C62D" commented="no"><enum>(2)</enum><text>require the immediate conversion of any bitcoin amount received to its dollar equivalent at the conclusion of any transaction, </text></paragraph><paragraph id="HAF036F6077C2427A93C37BEDAF34ECB7" commented="no"><enum>(3)</enum><text>identify types of nontax matters related to payment by such means that are to be resolved by persons ultimately liable for payment and financial intermediaries, without the involvement of the Secretary, and </text></paragraph><paragraph id="H0F90B829BD254D0BA2E9D86F43DEC516" commented="no"><enum>(4)</enum><text>ensure that tax matters will be resolved by the Secretary, without the involvement of financial intermediaries.</text></paragraph></subsection><subsection id="H9E24F225771443F49DCF5E63332FD925" commented="no"><enum>(c)</enum><header>Authority To enter into contracts</header><paragraph id="HB333AF31A19340B6A345413DD65E8AA7" commented="no"><enum>(1)</enum><header>In general</header><text>The Secretary is authorized to enter into contracts to obtain services related to receiving payment by bitcoin.</text></paragraph><paragraph id="HA497F3B9758A4D358EDAD1C7EA247826" commented="no"><enum>(2)</enum><header>Fees</header><text>Rules similar to the rules of paragraph (2) of section 6311(d) shall apply, determined without regard to the first sentence of such paragraph. </text></paragraph></subsection><subsection id="HB26912F190FA4C67B081BB8D82808408" commented="no"><enum>(d)</enum><header>Ultimate liability; liability of banks; confidentiality</header><text>Rules similar to the rules of subsections (b), (c), and (e) of section 6311 shall apply.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H5C1000C223B8418F9F8B5898FAC03881"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections for subchapter B of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/64">chapter 64</external-xref> of the Internal Revenue Code of 1986 is amended by inserting after the item relating to section 6316 the following new item:</text><toc regeneration="no-regeneration"><toc-entry level="section"><quote>Sec. 6316A. Payment of certain taxes by bitcoin.</quote>.</toc-entry></toc></subsection><subsection id="HF0474D20BE0E4855AE1C5ABDE6AAED2E" commented="no"><enum>(c)</enum><header>Effective date</header><text>The amendment made by this section shall apply to payments made after the date which is one year after the date of the enactment of this Act. </text></subsection></section></legis-body></bill>
