<section id="HE7475095D7A145F890A75331D718B265" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Improving Access to Long-Term Care Insurance Act</short-title></quote>. </text></section> <section id="HE25107A8F92C46268C1019F93D808E82"><enum>2.</enum><header>Deduction for long-term care insurance premiums</header> <subsection id="H3756AFABA57645BAA8307E9D10CF72F6"><enum>(a)</enum><header>Deduction not subject to minimum amount of expenses</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/213">Section 213</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new subsection:</text> 
<quoted-block style="OLC" id="H84EF3C5AE1D2488EA9C52AB0CB276485" display-inline="no-display-inline"> 
<subsection id="HE01552D502D54103867E5185037B8607"><enum>(f)</enum><header>Long-Term care insurance premiums not subject to minimum amount of expenses</header><text display-inline="yes-display-inline">In the case of any eligible long-term care premiums taken into account under subsection (a), such subsection shall be applied—</text> <paragraph id="HA04CE38B79A94DCCABEEEB68B1CC84DF"><enum>(1)</enum><text>without regard to the phase <quote>to the extent that such expenses exceed 7.5 percent of adjusted gross income</quote> for purposes of determining the deduction allowed under such subsection for such premiums, and</text></paragraph> 
<paragraph id="HFA7BC2BC1A0D461787CC12A69635043E"><enum>(2)</enum><text>by taking such premiums into account for purposes of determining whether a deduction is allowed under such subsection with respect to any other expenses paid for medical care.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="HF0560ED3CDD74FCBBD044DE01E9AC112"><enum>(b)</enum><header>Deduction allowed whether or not taxpayer itemizes deductions</header><text>Section 62(a) of such Code is amended by inserting after paragraph (21) the following new paragraph:</text>

<paragraph id="HF296D6E26FFF4C52B0DCE039953038B8"><enum>(22)</enum><header>Deduction for long-term care insurance premiums</header><text display-inline="yes-display-inline">The deduction allowed under section 213 for eligible long-term care premiums (as defined in section 213(d)(10)).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H3C0BD34FEB964DD1B6FC355090A0D853"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to taxable years beginning after the date of the enactment of this Act.</text></subsection></section> 
<section id="H3BE4F08968FD4B0B9149A4285F6C8E02"><enum>3.</enum><header>Reduction of certain tax credits</header> 
<subsection id="H436FC6DC8B644B05B83F6BD445D3A768"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Part IV of subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new subpart:</text> <quoted-block style="OLC" id="HBEE87495BB0543B6A023BFC1FB671F70" display-inline="no-display-inline"> <subpart id="H6A629ED9117A4C35B824FEF0533AF34A"><enum>H</enum><header>Reduction of certain credits</header> <toc container-level="subpart-container" quoted-block="no-quoted-block" lowest-level="section" idref="H6A629ED9117A4C35B824FEF0533AF34A" regeneration="yes-regeneration" lowest-bolded-level="division-lowest-bolded"> <toc-entry idref="H3C8C45B3A7C04382A0C0589BE1BB308A" level="section">Sec. 54. Reduction of certain credits.</toc-entry> </toc> <section id="H3C8C45B3A7C04382A0C0589BE1BB308A"><enum>54.</enum><header>Reduction of certain credits</header> <subsection id="HE5850FAA699F4D81A57427BAB3FA8880"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">In the case of any specified credit, the amount of such credit for any taxable year shall be reduced by the applicable percentage (determined under paragraph (2) with respect to such taxable year) of such amount (determined without regard to this subsection).</text></subsection> 
<subsection id="H9FED22F13E5C4BA382E3977E21B37555"><enum>(b)</enum><header>Applicable percentage</header><text>For purposes of this section—</text> <paragraph id="HC715068026574B44A5E790CAA65FACED"><enum>(1)</enum><header>In general</header><text>The term <quote>applicable percentage</quote> means, with respect to any taxable year the due date (determined without regard to any extension) of the return of tax for which is during any fiscal year, the percentage which the Secretary estimates will result in an increase in revenue to the Treasury during such fiscal year which is equal to the net decrease in revenue to the Treasury during such fiscal year that the Secretary estimates will result from the amendments made by section 2 of the <short-title>Improving Access to Long-Term Care Insurance Act</short-title>. The applicable percentage determined under the preceding sentence with respect to any taxable year shall be made publicly available by the Secretary before the beginning of such taxable year.</text></paragraph> 
<paragraph id="HCD68B017C41F426697F2D68592095405"><enum>(2)</enum><header>Methodology</header><text>The increase and decrease in revenue referred to in paragraph (1) shall be determined, to the maximum extent practicable, using the same methodology as is used by the Joint Committee on Taxation to estimate the budgetary effects of legislative proposals.</text></paragraph></subsection> <subsection id="HF42BC3AF7D294992ADB3F2AB3BB0B708"><enum>(c)</enum><header>Specified credits</header><text>For purposes of this section, the term <quote>specified credits</quote> means the credits determined under sections 25C, 25D, 25E, 30B, 30C, 30D, 40A, 45, 45H, 45K, 45L, 45Q, 45Y, 48A, 48B, and 48E.</text></subsection></section></subpart><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H0CDF8FD9803F484ABB1F0CB9F9D90899"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of subparts for part IV of subchapter A of chapter 1 of such Code is amended by adding at the end the following new item:</text> <quoted-block style="OLC" id="H99C43EF59E82438782A1FD0F66F65108" display-inline="no-display-inline"> <toc container-level="quoted-block-container" quoted-block="no-quoted-block" lowest-level="section" idref="HBEE87495BB0543B6A023BFC1FB671F70" regeneration="yes-regeneration" lowest-bolded-level="division-lowest-bolded"> <toc-entry idref="H6A629ED9117A4C35B824FEF0533AF34A" level="subpart">Subpart H—Reduction of certain credits</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="HC5BD39422AB24EB985253A761D48FBEF"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to taxable years beginning after the date of the enactment of this Act.</text> </subsection></section>
