R. 8815</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20240625">June 25, 2024</action-date><action-desc><sponsor name-id="S001172">Mr. Smith of Nebraska</sponsor> (for himself and <cosponsor name-id="M001160">Ms. Moore of Wisconsin</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend subpart 2 of part B of title IV of the Social Security Act to ensure that youth and parents with lived experience in the child welfare system are consulted on policies, ensuring representation and inclusion of their perspectives in State child welfare program planning.</official-title></form><legis-body id="H7992D28490D0462F907050C958016B91" style="OLC"><section id="HF9D67066B04E4DBE9922DA3A9A472D43" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Youth and Family Engagement in Child Welfare Act</short-title></quote>.</text></section><section id="H41A986E2E45A49498FDB50DFEA1408D7"><enum>2.</enum><header>Youth and family engagement in child welfare program planning</header><text display-inline="no-display-inline">Section 432(b)(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/629b">42 U.S.C. 629b(b)(1)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" id="H37FE4E87772C46899BA9EE75BE9DBF6D" display-inline="no-display-inline"><paragraph id="H9C930EA21B1C413AB8148185907223DD"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall approve a plan that meets the requirements of subsection (a) only if—</text><subparagraph id="H1734FB30B190400FBDBABD554391F273"><enum>(A)</enum><text>the plan was developed jointly by the Secretary and the State, and the State, in developing the plan, consulted with—</text><clause id="H1F5A166E42C34D7584A759CFF3CD7542"><enum>(i)</enum><text>appropriate public and nonprofit private agencies;</text></clause><clause id="HAD03D921AD114564962942AF0F0365DC"><enum>(ii)</enum><text>community-based organizations involved in providing services for children and families in the areas of family preservation, family support, family reunification, foster care, kinship, and adoption promotion and support;</text></clause><clause id="H59936285F36A481B86F588DDD30CD2FE"><enum>(iii)</enum><text>parents with child welfare experience, foster parents, adoptive parents, and kinship caregivers; and</text></clause><clause id="H7F3D7E9A1C72490E9C919B49D1F99184"><enum>(iv)</enum><text>children, youth, and young adults with experience in the child welfare system, including State boards and councils comprised of youth with the experience who represent the diversity of children in the State to whom the plan would apply; and</text></clause></subparagraph><subparagraph id="H92E0FE39F3CA46C19DCE4585E70B5E4D"><enum>(B)</enum><text display-inline="yes-display-inline">the State has made publicly accessible on a website of the State agency a report that outlines how the State has implemented the suggestions of the children and youth referred to in subparagraph (A)(iv);</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H5A536CD415954C48979492DA6462382F"><enum>3.</enum><header>Effective date</header><text display-inline="no-display-inline">The amendment made by this Act shall take effect on October 1, 2026.</text></section></legis-body></bill>
