<official-title display="yes">To amend section 439 of the Social Security Act to authorize the funding of demonstration projects to test approaches for supporting and improving relationships between incarcerated parents and children in foster care, and for other purposes.</official-title>

<section id="H39C2C720814A48E8930B3490E0CC9E08" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Promoting Active Relationships to Enable Nurturing Ties Act of 2024</short-title></quote> or the <quote><short-title>PARENT Act of 2024</short-title></quote>. </text></section> <section id="H7D5804680E6A41CEA6CB1FDFFD6D1FE6" display-inline="no-display-inline"><enum>2.</enum><header>Meaningful relationships between foster children and incarcerated parents</header><text display-inline="no-display-inline">Section 439 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/629i">42 U.S.C. 629i</external-xref>) is amended to read as follows:</text>

<section id="H10C9FCD365994F2ABBB8DA70ABEEA1CC"><enum>439.</enum><header>State partnership planning and demonstration grants to support meaningful relationships between foster children and the incarcerated parents of the children</header>
<subsection id="H16E0343A9B0C4AFBB4EBA3BBE97DAB4F"><enum>(a)</enum><header>Authority</header>
<paragraph id="H32F771FB98A64E2AB5AED0611E972648"><enum>(1)</enum><header>In general</header><text>The Secretary may make demonstration grants to eligible State partnerships to develop, implement, and provide support for programs that enable and sustain meaningful relationships between covered foster children and the incarcerated parents of the children.</text></paragraph> <paragraph id="H77C5EEF7E2D043E5AC39F99CCCC839DE"><enum>(2)</enum><header>Payment of annual installments</header><text>The Secretary shall pay each demonstration grant in 5 annual installments.</text></paragraph>
<paragraph id="H006547C8AF3F4166A80876592AB26D97"><enum>(3)</enum><header>1-year planning grants</header><text>The Secretary may make a planning grant to a recipient of a demonstration grant, to be paid to the recipient 1 year before payment of the 1st annual installment of the demonstration grant and in an amount not greater than any installment of the demonstration grant, if—</text> <subparagraph id="H8C6A13AFFA40403F91B50322367B36EE"><enum>(A)</enum><text>the recipient includes a request for a planning grant in the application under subsection (c); and</text></subparagraph>
<subparagraph id="HDCA017551D014984BAA0D8CC2395C3FD"><enum>(B)</enum><text>the Secretary determines that a planning grant would assist the recipient and improve the effectiveness of the demonstration grant.</text></subparagraph></paragraph></subsection> <subsection id="HD7227F52B577444B960CB6A6D91D0B98"><enum>(b)</enum><header>Eligible State partnership defined</header> <paragraph id="H4E6CFDE4E0224A6FB500EAF1BECCB903"><enum>(1)</enum><header>In general</header><text>In this section, the term <term>eligible State partnership</term> means an agreement entered into by, at a minimum, the following:</text>
<subparagraph id="H037DFCF2D88741B5ACB626365FC4F273"><enum>(A)</enum><text>The State child welfare agency responsible for the administration of the State plans under this part.</text></subparagraph> <subparagraph id="HE0B0D1B1F4CB49039614B65EC7F2B988"><enum>(B)</enum><text>The State agency responsible for adult corrections.</text></subparagraph></paragraph>
<paragraph id="H9C576E934E0645899B58DBC91E2239AA"><enum>(2)</enum><header>Additional partners</header><text>For purposes of this section, an eligible State partnership may include any entity with experience in serving incarcerated parents and their children.</text></paragraph> <paragraph id="H755EBBC3F3DE4DC69E21ED02A61EB8A2"><enum>(3)</enum><header>Partnerships entered into by Indian Tribes or tribal consortia</header><text>Notwithstanding paragraph (1), if an Indian tribe or tribal consortium enters into a partnership pursuant to this section that does not consist solely of tribal child welfare agencies (or a consortium of the agencies), the partnership shall be considered an eligible State partnership for purposes of this section.</text></paragraph></subsection>
<subsection id="H68BB7151F4694D0F90EADA612CF118DC"><enum>(c)</enum><header>Application requirements</header><text display-inline="yes-display-inline">An eligible State partnership seeking a demonstration grant under this section to carry out a program described in subsection (a)(1) shall submit an application to the Secretary at such time, in such manner, and containing such information as the Secretary may require. The application shall include the following:</text> <paragraph id="H9F1C1A5D6656465D85AC9C9C69C72C1C"><enum>(1)</enum><text display-inline="yes-display-inline">A summary of the program, including how the program will support a meaningful relationship between a covered foster child and an incarcerated parent of the child.</text></paragraph>
<paragraph id="H557C8BA254CF4938AB5D4249C4CC627D"><enum>(2)</enum><text display-inline="yes-display-inline">A description of the activities to be carried out by the program, which must include all of the activities described in subsection (d) that are in the best interest of the covered foster child.</text></paragraph> <paragraph id="H2FE89598BFDF4E7783DA4E44855C9903"><enum>(3)</enum><text>A framework for identifying—</text>
<subparagraph id="H94E45E2DC6894712A37030F885A7A62A"><enum>(A)</enum><text display-inline="yes-display-inline">each covered foster child eligible for services under the program, including, to the extent practicable, coordination of data between relevant State child welfare agencies and court systems; and</text></subparagraph> <subparagraph id="H8957C6E85782470E9CD09FCC66534D97"><enum>(B)</enum><text display-inline="yes-display-inline">the roles and responsibilities of the entities in the partnership.</text></subparagraph></paragraph>
<paragraph id="H4E7E906C38014FEBB0594611275F4AB5"><enum>(4)</enum><text>Documentation that the applicant is an eligible State partnership.<italic></italic></text></paragraph> <paragraph id="H9445AB8FB46849849992CA5869DFD50F"><enum>(5)</enum><text display-inline="yes-display-inline">Assurances that the applicant will participate fully in the evaluation described in subsection (f)(2) and shall maintain records for the program, including demographic information disaggregated by relevant characteristics with respect to covered foster children and incarcerated parents who participate in the program.</text></paragraph></subsection>
<subsection id="HAA035194FDE348B9B41BA67D97438BBF"><enum>(d)</enum><header>Program activities</header><text display-inline="yes-display-inline">To the extent that the activities are in the best interest of the covered foster child, the activities referred to in subsection (c)(2) shall include the following:</text> <paragraph id="HF4E4CEC718E546FABB8D95E700AA8436"><enum>(1)</enum><header>Revision of policies</header><text>Through consultation with incarcerated parents and their families, grantees shall promote organizational policies of participating child welfare entities and collaborating correctional facilities to promote meaningful relationships through regular and developmentally appropriate communication and visitation between covered foster children and the incarcerated parents, including, when appropriate, the following:</text>
<subparagraph id="H8319C06870DD45C68BC2880CBD5BDF23"><enum>(A)</enum><text>For child welfare entities—</text> <clause id="H21803F85F778482E9CA048540BA1F771"><enum>(i)</enum><text>inclusion of parents in case planning and decision making for children;</text></clause>
<clause id="H6BF7068B527B40EB9A98B48337D1C44B"><enum>(ii)</enum><text>regular sharing of information and responses to requests for information between caseworkers and incarcerated parents with respect to the case information of a child, any changes to a case, permanency plans, requirements to maintain parental rights, and any efforts to terminate parental rights;</text></clause> <clause id="H886C804808CE4034BD1A43734DF35445"><enum>(iii)</enum><text>appropriate opportunities for incarcerated parents to demonstrate their relationship with a covered foster child given their incarceration, including training and courses required for a service plan; and</text></clause>
<clause id="HB4BCFFC382AE4A9996161D8F1614815B"><enum>(iv)</enum><text>the enhanced visitation described in paragraph (2).</text></clause></subparagraph> <subparagraph id="HF81E01FAA0AB40FB9DB21F0B9DA9AC5B"><enum>(B)</enum><text>For correctional facilities, fostering visitation and communication that is developmentally appropriate in terms of—</text>
<clause id="H66FC70112FA04D8DB485661F326C89FD"><enum>(i)</enum><text>the nature of communication and visitation, including—</text> <subclause id="H3DDBECEE07814C91811938C57CFE2981"><enum>(I)</enum><text>the ability to physically touch parents;</text></subclause>
<subclause id="H60727C15B2274F449DFF8C52BF86EAE6"><enum>(II)</enum><text>engaging with parents in locations that are appropriate for the age and development of the child;</text></subclause> <subclause id="H66C2EE00BB6F45A298C61EBB13EEDC89"><enum>(III)</enum><text>exchanging items that are appropriate to the age and development of the child, include expectations that are appropriate for the age and development of the child related to behavior, attire, and wait times; and</text></subclause>
<subclause id="H42CB3FC1E889417DABE587D6F312B1FC"><enum>(IV)</enum><text>allowing appropriate adults to bring children if legal guardians are not available to promote regular contact;</text></subclause></clause> <clause id="H645B33D12B6E437B88F244DBB2721053"><enum>(ii)</enum><text>reasonable inclusion of all children of the parent;</text></clause>
<clause id="H35EA309EC8634B2FA74AE799F73BDC13"><enum>(iii)</enum><text>communication and visitation at times when the children are available;</text></clause> <clause id="H2F06AFE12EED40C9B560047546295096"><enum>(iv)</enum><text>security procedures to comfort children and be minimally invasive; and</text></clause>
<clause id="HEE654F0A080A4391B70344035AB8B501"><enum>(v)</enum><text>promoting parent-child relationships regardless of the sentence imposed on the parent.</text></clause></subparagraph></paragraph> <paragraph id="H0A379FDDAEE0493E82116AB5A41AAA2C"><enum>(2)</enum><header>Enhanced visitation</header> <subparagraph id="H54CD2B0AB27B4C1986FE91CE1D30CEF0"><enum>(A)</enum><text>Grantees shall facilitate weekly communication and, for at least 9 days each year, in-person visitation between a covered foster child and any incarcerated parent of the child.</text></subparagraph>
<subparagraph id="H301077384E444193B6928A17C45CDD5C"><enum>(B)</enum><text>Electronic visitation (such as live video visits, phone calls, and recorded books) may be used but shall not be the sole method to promote a meaningful relationship for purposes of the grant.</text></subparagraph> <subparagraph id="HF1D34C76463B4D06B8A0325B21D622E6"><enum>(C)</enum><text>Enhanced visitation programs shall—</text>
<clause id="H716972ECD73443C988CDE50EE1E258ED"><enum>(i)</enum><text>integrate best practices for visitation programs with incarcerated parents and their children;</text></clause> <clause id="H5A841E7193114F5D84E3EBA0D6CC3A2F"><enum>(ii)</enum><text>adopt developmentally appropriate visitation policies and procedures such as those described in paragraph (1)(B);</text></clause>
<clause id="H623B21D460904962A2C9FE0A06BE05D1"><enum>(iii)</enum><text>reduce or eliminate the cost of developmentally appropriate communication and visitation for the covered foster child, which may include the purchase of communication technology, covering transportation, insurance, and lodging costs, costs related to providing appropriate visitation spaces and activities, and other relevant costs;</text></clause> <clause id="HE0C2304D39AA4C32852C7CAD4EDC53AD"><enum>(iv)</enum><text>to the extent practicable, integrate appropriate parenting education to help prepare and process visits; and</text></clause>
<clause id="HFBDD293600B04353B5E03E5FE6C335E3"><enum>(v)</enum><text>avoid restricting visitation and communication as a punishment for the incarcerated parents.</text></clause></subparagraph></paragraph> <paragraph id="H04EBC4C2579D4B2B8852EDB4664100E1"><enum>(3)</enum><header>Training</header><text>Grantees shall incorporate ongoing training for child welfare, correctional facility staff, and other program providers to understand the importance of promoting meaningful relationships between children and incarcerated parents.</text></paragraph>
<paragraph id="HA4997D8D28EE44D68B9170517929C489"><enum>(4)</enum><header>Case management</header><text>Grantees shall provide case management services for the incarcerated parents of a covered foster child to promote the relationship, access to services, and coordination with the caseworkers of the covered foster child to strengthen the relationship.</text></paragraph> <paragraph id="H545D46E5259D442D8E9468B42B9F2FBE"><enum>(5)</enum><header>Legal assistance</header><text>Grantees shall facilitate access to necessary legal services and may use grant funds for services that are not reimbursable under other Federal programs.</text></paragraph></subsection>
<subsection id="H4CF2E5C32BB34E719CD528818BAB2911"><enum>(e)</enum><header>Federal share</header><text display-inline="yes-display-inline">The Federal share of the cost of any activity carried out using a grant made under this section shall be not greater than 75 percent.</text></subsection> <subsection id="H328AC6F5D22C4BBFBFE3E487F1EDF931"><enum>(f)</enum><header>Technical assistance, evaluations, and reports</header> <paragraph id="H3F04BABCCDF3426A810620909FA329FA"><enum>(1)</enum><header>Technical assistance</header><text>The Secretary shall provide technical assistance with respect to grants under this section, including by—</text>
<subparagraph id="HE0F15A3910424DFCACA2D4EF3B487D48"><enum>(A)</enum><text>assisting grantees in understanding best practices in promoting meaningful relationships between incarcerated parents and their children as well as consulting with appropriate stakeholders when developing their programs;</text></subparagraph> <subparagraph id="H87FE921B1B314CC5B9ADE9F916DD25F4"><enum>(B)</enum><text>assisting grantees with establishing and analyzing implementation and performance indicators; and</text></subparagraph>
<subparagraph id="HB0470118446B4BB6A2F99FE488831974"><enum>(C)</enum><text>conducting an annual technical assistance and training meeting and an annual grantee meeting so that grantees can learn from the experiences of other grantees.</text></subparagraph></paragraph> <paragraph id="H1C493DC00BF3431781B32BB5F4F2A660"><enum>(2)</enum><header>Evaluations</header><text display-inline="yes-display-inline">The Secretary shall conduct an evaluation of program outcomes, including with respect to parent and child well-being, parent-child interactions, parental involvement, awareness of child development and parenting practices, placement stability, and termination of parental rights with respect to covered foster children and incarcerated parents, to measure program effectiveness, as determined by the Secretary, and identify opportunities for improved program practices and implementation.</text></paragraph>
<paragraph id="HF6551D3A04A84958972B9826DF91334E"><enum>(3)</enum><header>Reports to the Congress</header>
<subparagraph id="H90CE509433CD49599FBB259E72EB8ACF"><enum>(A)</enum><header>Initial report</header><text>Not later than 3 years after the date of the enactment of this section, the Secretary shall submit to the Committee on Ways and Means of the House of Representatives and the Committee on Finance of the Senate a report that includes—</text> <clause id="HD0CE7A47077648AABD7C95904F9DF83E"><enum>(i)</enum><text>the number of applications for grants under this section;</text></clause>
<clause id="H8850E13029EB48C1949B970507DF48D8"><enum>(ii)</enum><text>the number of grants awarded, and the amounts for each grant; and</text></clause> <clause id="H01851C54C5284711B229FDE76A8298E1"><enum>(iii)</enum><text>information on the grants, including—</text>
<subclause id="H25B7F7560BC142D9AAF4819374C509F1"><enum>(I)</enum><text>interim results of the evaluation described in paragraph (2);</text></subclause> <subclause id="HD168060BCEE446FEA1AE1CF77AFF56C7"><enum>(II)</enum><text>disaggregated data on covered foster children and incarcerated parents;</text></subclause>
<subclause id="HE7CB111E7E384E9EB6BAC5B400470AD4"><enum>(III)</enum><text>information on the composition of eligible State partnerships;</text></subclause> <subclause id="H22390BF487E14AC8946B9DAB8BA24ACC"><enum>(IV)</enum><text>best practices for facilitating meaningful relationships between covered foster children and incarcerated parents; and</text></subclause>
<subclause id="H061406B6B9FE4F759ACBAEF5F9DF6704"><enum>(V)</enum><text>barriers to implementation or expansion of programs funded under this section.</text></subclause></clause></subparagraph> <subparagraph id="H0780F4B07D264295B972CB0BDA3C52AB"><enum>(B)</enum><header>Final report</header><text>Not later than 6 years after the date of the enactment of this section, the Secretary shall submit to the Committee on Ways and Means of the House of Representatives and the Committee on Finance of the Senate a report that includes—</text>
<clause id="H76F27F39F91248BDA24FDEE7E1BB9FF0"><enum>(i)</enum><text>the final results of the evaluation described in paragraph (2); and</text></clause> <clause id="HCE765B68EE244F52BA0CA2A96E828477"><enum>(ii)</enum><text>recommendations for refinements to grant requirements to improve program outcomes.</text></clause></subparagraph></paragraph></subsection>
<subsection id="HFDE5AF487D72424B95910C72F4C9AB1E"><enum>(g)</enum><header>Authority of Secretary with respect to Indian tribes and tribal organizations</header>
<paragraph id="H5A74036B6BBB484D9D4AB4D002093704"><enum>(1)</enum><header>Waiver or modification of requirements</header><text>In making a grant to an Indian tribe or tribal organization under this section, the Secretary may waive the matching requirement of subsection (e) or modify an application requirement imposed by or under subsection (c) if the Secretary determines that the waiver or modification is appropriate to the needs, culture, and circumstances of the Indian tribe or tribal organization.</text></paragraph> <paragraph id="H2E4D55E100874CE285B33DA9CBF2319B"><enum>(2)</enum><header>Evaluation</header><text>The Secretary shall use tribally relevant data in carrying out the evaluation under subsection (f)(2) with respect to an Indian tribe or tribal organization.</text></paragraph></subsection>
<subsection id="H9F31582C892C4046A3ED781A275BD5AE"><enum>(h)</enum><header>Limitations on authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to the Secretary not more than $35,000,000 for each of fiscal years 2026 through 2029 to carry out this section.</text></subsection> <subsection id="H82BDA492766E4C1C97C692D75D26462D"><enum>(i)</enum><header>Definition of covered foster child</header><text display-inline="yes-display-inline">In this section, the term <term>covered foster child</term> means a child that—</text>
<paragraph id="H18BFFE17A29E4F2F85D349B3D2A09C16"><enum>(1)</enum><text display-inline="yes-display-inline">is in foster care; and</text></paragraph> <paragraph id="HD8D66111E4954CEABA0D1EB58DA63A3D"><enum>(2)</enum><text>has at least 1 parent incarcerated in a Federal, State, or local correctional facility.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section>
