which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide grants to States to encourage the implementation and maintenance of firearms licensing requirements, and for other purposes.</official-title></form><legis-body id="HB2B2E1F8F3734560863F2E91AEE7F199" style="OLC"><section section-type="section-one" id="H00B10991EED84C38805D7F93D1DBAEBF"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Making America Safe and Secure Act of 2024</short-title></quote> or the <quote><short-title>MASS Act of 2024</short-title></quote>.</text></section><section id="H2DDC95DAC66B492797492ABFF1BD619E"><enum>2.</enum><header>Firearms licensing</header><subsection id="H46F71943A14B4787B38E7AFFEAF4CF8E"><enum>(a)</enum><header>In general</header><text>Title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10101">34 U.S.C. 10101 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H1E303527A87549858D4A5E97F40B91C7"><part id="H0674F2DA740B4E9398F4BA52D0A5EF11" style="OLC"><enum>PP</enum><header>Firearms licensing</header><section id="H2CC5589C168D4235A1F64A1574B021E7"><enum>3061.</enum><header>Definitions</header><subsection id="HED16F8F540C14D0E93ECF7DE967A874C"><enum>(a)</enum><header>In general</header><text>In this part—</text><paragraph id="H9054299B937E46749F5C2FFF4111E165"><enum>(1)</enum><text>the term <term>covered license</term> means a—</text><subparagraph id="H6E489A253A06469284EBEE153DA8E3E2"><enum>(A)</enum><text>firearms license; or</text></subparagraph><subparagraph id="H61016D35724944BABBAD814219883C22"><enum>(B)</enum><text>firearms dealer license;</text></subparagraph></paragraph><paragraph id="HBD44E09CAADF47D398ABE484E225EDC9"><enum>(2)</enum><text>the term <term>domestic violence protection order</term> means a protection order, as defined in section 2266 of title 18, United States Code;</text></paragraph><paragraph id="H6F8D1E3F47854D069A5BA2B00936C3F2"><enum>(3)</enum><text>the term <term>extreme risk protection order</term>—</text><subparagraph id="H9F617EC3B5F043A2A676D23DECB213E2"><enum>(A)</enum><text>means a written order, issued by a State court or signed by a magistrate that, for a period not to exceed a time frame established by the State—</text><clause id="HA4B2EA4A13E14D33A165C5AB139B7B3A"><enum>(i)</enum><text>prohibits the individual named in the order from having under the custody or control of the individual, purchasing, possessing, or receiving a firearm or ammunition; and</text></clause><clause id="HC947FE604B1641BCAC8FC641FEAAF31B"><enum>(ii)</enum><text>requires that any firearm or ammunition under the custody or control of the individual be removed; and</text></clause></subparagraph><subparagraph id="H0A949A6F85CD448285AD650948B69879"><enum>(B)</enum><text>does not include a domestic violence protection order;</text></subparagraph></paragraph><paragraph id="H02FEF32C0A2A4CF88FCAD4800603FE9A"><enum>(4)</enum><text>the term <term>prohibited individual</term> means an individual who is categorically ineligible to receive a covered license;</text></paragraph><paragraph id="HA3143E13DFCD4CBF8462B80F2D72E193"><enum>(5)</enum><text>the term <term>suitable</term> means that an individual does not create a risk to public safety; and</text></paragraph><paragraph id="H91300E82104C4CBF9520C764067BA4F4"><enum>(6)</enum><text>the term <term>thorough background check</term> means a Federal and State background check, which may include a fingerprint-based background check.</text></paragraph></subsection><subsection id="H91A5022B5331496A963074535E3D9E4E"><enum>(b)</enum><header>Prohibited individuals</header><text>For purposes of this part, a State—</text><paragraph id="H9F4B730BA87A4BF29BB5BCEB25B03295"><enum>(1)</enum><text>shall establish standards for categorizing an individual as a prohibited individual for purposes of receiving a covered license; and</text></paragraph><paragraph id="H2493497258C54AD6B81B65EC68F9A62C"><enum>(2)</enum><text>in establishing standards with respect to a covered license under paragraph (1), shall take into consideration whether limitations may be warranted based on—</text><subparagraph id="H9EBAB3F62322426B82B2C592CB836418"><enum>(A)</enum><text>criminal history;</text></subparagraph><subparagraph id="H78464641209D46CAB065E09A16694A50"><enum>(B)</enum><text>whether an individual has been—</text><clause id="H5F13CD90494041C684E53D1F0743D13E"><enum>(i)</enum><text>deemed a danger to himself or herself or other individuals by a court or authorized administrative body; or</text></clause><clause id="HF5CC06DFA7E24CB997C25E02A2F3E8F0"><enum>(ii)</enum><text>committed to a hospital or institution as a danger to himself or herself or other individuals;</text></clause></subparagraph><subparagraph id="H62550BA25C0B4BF99822229F509A57D5"><enum>(C)</enum><text>age;</text></subparagraph><subparagraph id="H704C0EA743C246F8AD24AEC22818B3F8"><enum>(D)</enum><text>legal residency;</text></subparagraph><subparagraph id="HB2779A3A2ADB4802A93EDB2BFCDE17C5"><enum>(E)</enum><text>military dishonorable discharges;</text></subparagraph><subparagraph id="HADA369F1324347F0AE011EA10D99D8F2"><enum>(F)</enum><text>whether an individual—</text><clause id="HD782AA380026403482E336BC148F0136"><enum>(i)</enum><text>is subject to a permanent or temporary protection order; or</text></clause><clause id="H74695FA4D70D4B47B7A9857D0FC2F4A6"><enum>(ii)</enum><text>has been convicted of a misdemeanor crime of domestic violence (as defined in section 921 of title 18, United States Code);</text></clause></subparagraph><subparagraph id="H8E4EDB6381804D65A81E3855540B4DAC"><enum>(G)</enum><text>outstanding arrest warrants;</text></subparagraph><subparagraph id="HF03220806236437F90182FFCC4311F68"><enum>(H)</enum><text>status as a fugitive;</text></subparagraph><subparagraph id="H809A26CB75F4409AB2C1FC6B2A0B5BCA"><enum>(I)</enum><text>renunciation of United States citizenship; and</text></subparagraph><subparagraph id="HCA6E3BAA0A984FC6AF48963A835787E9"><enum>(J)</enum><text>other factors relevant to the suitability of a license holder.</text></subparagraph></paragraph></subsection></section><section id="HB7D95CB2223D4F2DA80D9354D45B0FA8"><enum>3062.</enum><header>Grants and conditions</header><subsection id="H7DDD0637137F44AD871A62C17146F0A3"><enum>(a)</enum><header>Grants authorized</header><text>The Assistant Attorney General may make grants to States to implement or maintain firearms and firearms dealer licensing requirements.</text></subsection><subsection id="H9D2B5CE1DAC04632BA3C550E038E9608"><enum>(b)</enum><header>Duration of grants</header><text>A grant under subsection (a) shall be for a period of 3 fiscal years.</text></subsection><subsection id="H9481676C54B9481482E685FDA6566AF1"><enum>(c)</enum><header>Use of funds for firearms and firearms dealer licensing</header><paragraph id="HA63CC609B64E424B95EF4E200C4C6E50"><enum>(1)</enum><header>Activities</header><text>Amounts received under a grant under subsection (a) shall be used for the implementation or maintenance of firearms and firearms dealer licensing requirements, which shall incorporate and implement the elements described in paragraph (2) of this subsection.</text></paragraph><paragraph id="H572B0FF7BA0544F8A2753BB21D47A10B"><enum>(2)</enum><header>Elements</header><text>The elements described in this paragraph are those providing that—</text><subparagraph id="HC61FB5305E934B33BA929D76319C565C"><enum>(A)</enum><text>an individual shall have a firearms license—</text><clause id="HFA2B6545E82C42E3B7178A26BD960E9C"><enum>(i)</enum><text>at the time of the purchase, rental, or lease of a firearm or purchase of ammunition; and</text></clause><clause id="HFAE91B38EB0C45D2A9D28D45590F63EA"><enum>(ii)</enum><text>during the entire period of ownership or possession of a firearm or ammunition;</text></clause></subparagraph><subparagraph id="H4343041956054A9E876F6B54F2BDA1A9"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="H25B9E4116C3F46AA81FFE2FFE09DDF8C"><enum>(i)</enum><text>an individual who (including the owner or operator of a business that) sells, rents, or leases a minimum number of firearms, or sells ammunition, during a calendar year shall obtain a firearms dealer license; and</text></clause><clause id="H4863C4D5905E41D494D84040E8247689" indent="up1"><enum>(ii)</enum><text>the State shall establish the minimum number of firearms for purposes of clause (i), which may not be higher than 10 per calendar year;</text></clause></subparagraph><subparagraph id="H7F71CFCF391C44F79E4DADDD176C4D89"><enum>(C)</enum><text>the chief of police or the board or officer having control of the police department of a local government, or a designee within the same department, shall function as the licensing authority;</text></subparagraph><subparagraph id="H43F816CB6AD1439AA088A505C5E0739C"><enum>(D)</enum><text>for an application for issuance or renewal of a firearms license, the licensing authority shall—</text><clause id="HDA9143EF9A314EA29846F1F35615DEB3"><enum>(i)</enum><text>conduct a thorough background check, which may include—</text><subclause id="HC5BD20C10BA8429BA5430D7B18FB8253"><enum>(I)</enum><text>conducting an interview with the applicant;</text></subclause><subclause id="H335BFAB194FF496E9A713DA6152E09D4"><enum>(II)</enum><text>requiring the submission of letters of reference stating that the applicant is of sound mind and character; and</text></subclause><subclause id="H962B9F4CEE82421DAB5326324BC3EDA0"><enum>(III)</enum><text>any other requirements the State determines relevant; and</text></subclause></clause><clause id="H34A5FD7A2ABA4577BCA0D253406309FB"><enum>(ii)</enum><text>make a determination of suitability;</text></clause></subparagraph><subparagraph id="H4F21D5AEA7A84BC6A5F49E9DCEB8EC03"><enum>(E)</enum><text>a first-time firearms license applicant shall complete safety training;</text></subparagraph><subparagraph id="HD1A935E415D74467A016AD6742872FFF"><enum>(F)</enum><text>for an application for issuance or renewal of a firearms dealer license, the licensing authority shall conduct an investigation into the criminal history of the applicant, which may include—</text><clause id="H3E012BF610654AB68795176F1A01528A"><enum>(i)</enum><text>an interview with the applicant;</text></clause><clause id="HF4CDD85303F3471E8A9E5402327E3BAC"><enum>(ii)</enum><text>a thorough background check; and</text></clause><clause id="HF046689A675D4A509978CCFCD0F36EAD"><enum>(iii)</enum><text>any other requirements the State determines relevant;</text></clause></subparagraph><subparagraph id="HF5EC1F88F61B4E70A984AA669FE70F09"><enum>(G)</enum><text>the State shall establish appropriate application processes for covered licenses consistent with Federal, State, and local law;</text></subparagraph><subparagraph id="H625FEC2C99E64E119B277318B7B3B721"><enum>(H)</enum><text>the State shall establish standards and processes by which licensing authorities can revoke, suspend, or deny the issuance or renewal of a covered license;</text></subparagraph><subparagraph id="H59EBEA733D404AA181ABBE7B1B47030F"><enum>(I)</enum><text>the State shall ensure that a revocation, suspension, or denial cannot be based on race, color, ethnicity, religion, sex, sexual orientation, or gender identity;</text></subparagraph><subparagraph id="HACE2A37A73B04F7181D339D7565CFFA1"><enum>(J)</enum><text>the State shall establish judicial review processes by which any applicant for or holder of a covered license may, within a reasonable time period, petition to obtain judicial review of a revocation, suspension, or denial of the issuance or renewal of a covered license;</text></subparagraph><subparagraph id="H8E474947823B4BBE9624400A789C1203"><enum>(K)</enum><text>the State shall establish—</text><clause id="H3093673EEE9E4EE6950B3C59F2B6E49E"><enum>(i)</enum><text>standards and a process under which a family member of an individual who the family member fears is a danger to himself, herself, or others may petition for an extreme risk protection order; and</text></clause><clause id="HFBF5604A2AFA4A4C93303FD52858EE1D"><enum>(ii)</enum><text>standards for the termination or extension of an order described in clause (i);</text></clause></subparagraph><subparagraph id="H077E4D9721F74DD1ABDBA00B5E5D4A9B"><enum>(L)</enum><text>the State shall establish processes under which—</text><clause id="HEFBC032B406B4E78BEA1D6BF3F91F188"><enum>(i)</enum><text>an individual whose covered license is revoked or suspended, or whose application for issuance or renewal of a covered license is denied, shall surrender or transfer all firearms and ammunition that are or would have been covered by the license; and</text></clause><clause id="H374B0CB5A74B4905A9D795FE5F8B7C44"><enum>(ii)</enum><text>an individual who is subject to an extreme risk protection order or domestic violence protection order shall surrender or transfer all firearms and ammunition in the possession of the individual;</text></clause></subparagraph><subparagraph id="HBC1AF132A4E34EC2A48D83E56754259B"><enum>(M)</enum><text>the State shall establish requirements with which a firearms dealer licensee must comply, which—</text><clause id="HAF6082CBEF4A4F35B8030BEE1C7F796F"><enum>(i)</enum><text>shall include requirements relating to—</text><subclause id="H9003FE32D34243F4961E428AE38FA072"><enum>(I)</enum><text>the location at which the licensee conducts firearm or ammunition transactions;</text></subclause><subclause id="H919A66AFA2F6485592CA19692EB6DF6B"><enum>(II)</enum><text>the manner in which the licensee records firearm or ammunition transactions;</text></subclause><subclause id="H62CE00D82D1D472BB0D8140A2E400FA7"><enum>(III)</enum><text>background checks for employees of the licensee; and</text></subclause><subclause id="HBA736237A46C43EC9D574FA308966081"><enum>(IV)</enum><text>any other matter that the State determines appropriate; and</text></subclause></clause><clause id="HD41E6FC490F945578996DB73186C45C0"><enum>(ii)</enum><text>may include requirements that a licensee—</text><subclause id="HE7FAB8732F2947C092748E419BB656C0"><enum>(I)</enum><text>maintain a permanent place of business—</text><item id="HCD9EE497285A45649EF3C0EBA777F85E"><enum>(aa)</enum><text>that is not a residence; and</text></item><item id="H4E421A6F0F784A54B191EF2D864F085B"><enum>(bb)</enum><text>at which the licensee conducts all firearms or ammunition transactions;</text></item></subclause><subclause id="HAF63FDBFD04244D4B9370A2241DD8B3C"><enum>(II)</enum><text>submit to mandatory record and inventory inspections by a licensing authority;</text></subclause><subclause id="HABD8C4E5AB474697A6567CBCE8058BEA"><enum>(III)</enum><text>maintain a sales record book at the permanent place of business described in subclause (I) in accordance with standards established by the State;</text></subclause><subclause id="HC3C36CEBC38945BC8A16A5849025D101"><enum>(IV)</enum><text>conduct a pre-employment background check on each potential employee to determine the suitability of any potential employee who may have direct and unmonitored contact with a firearm or ammunition; and</text></subclause><subclause id="H910F41FCD35345E39788ECBEF97AA3D3"><enum>(V)</enum><text>take any other action that the State determines appropriate;</text></subclause></clause></subparagraph><subparagraph id="HCD78D9094B2544FA9AD2C454733D1883"><enum>(N)</enum><text>the State shall promulgate rules and regulations to ensure the prompt collection, exchange, dissemination, and distribution of information pertaining to the issuance, renewal, expiration, suspension, or revocation of a covered license;</text></subparagraph><subparagraph id="HF6D517CB64004FF5AC518898DC07C575"><enum>(O)</enum><text>the State shall establish standards that are consistent with Federal and State law—</text><clause id="HCD9650A0C2C04BC7A837074B224992D4"><enum>(i)</enum><text>governing the transfer of a firearm or ammunition; and</text></clause><clause id="H349E7C8C02E84EBDA4ADFAEC5B781B87"><enum>(ii)</enum><text>for identifying a prohibited individual, in accordance with section 3061(b);</text></clause></subparagraph><subparagraph id="H3A62614FAA534547BC62BFB528A7EBFD"><enum>(P)</enum><text>the State shall promulgate rules and regulations that require a dealer or private seller of firearms or ammunition to verify the validity of a firearms license before the sale, rental, or lease of any firearm or the sale of any ammunition;</text></subparagraph><subparagraph id="H910D473C9D5641C88EF2C64834246FDB"><enum>(Q)</enum><text>a dealer or private seller of firearms or ammunition shall report all sales, rentals, and leases of firearms, and sales of ammunition, to State authorities;</text></subparagraph><subparagraph id="H412F8350A7E94A8A93B3A2C7FD1B238E"><enum>(R)</enum><text>a dealer of firearms or ammunition shall notify the licensing authority when presented with an invalid or expired firearms license;</text></subparagraph><subparagraph id="HF9AA2D86FEF74C7B8A46B452549FB135"><enum>(S)</enum><text>any firearms licensee whose firearm or ammunition is lost or stolen shall report the loss or theft to the licensing authority and State authorities within a reasonable time frame and in a manner established by the State;</text></subparagraph><subparagraph id="HBAAFCC0727EF4983BB0E35E6153F2C10"><enum>(T)</enum><text>an individual holding a firearms license or firearms dealer license shall renew the license on a time frame established by the State;</text></subparagraph><subparagraph id="H5DE7F2167E284106899DB6DF48D90296"><enum>(U)</enum><text>an individual may not use the firearms license of the individual to purchase a firearm or ammunition for—</text><clause id="H1078464C210A45A78C953062EF6ACE44"><enum>(i)</enum><text>the unlawful use of the firearm or ammunition by another individual; or</text></clause><clause id="HCF3377BCBADA4046A3AB6C56D5CC7DD5"><enum>(ii)</enum><text>the resale or other transfer of the firearm or ammunition to an unlicensed individual; and</text></clause></subparagraph><subparagraph id="H44E59E35DD794D18A9D5E4DBB68FF361"><enum>(V)</enum><clause commented="no" display-inline="yes-display-inline" id="H59E3EAE00F5942F989D56935C3B2F8C2"><enum>(i)</enum><text>it shall be unlawful to store or keep a firearm in any place unless the firearm is secured in a locked container or equipped with a tamper-resistant mechanical lock or other safety device, properly engaged so as to render the firearm inoperable by any individual other than the owner or other lawfully authorized user; and</text></clause><clause id="HCDADD26045124EA98E3513FF544381D2" indent="up1"><enum>(ii)</enum><text>for purposes of clause (i), a firearm shall not be considered to be stored or kept if carried by or under the control of the owner or other lawfully authorized user.</text></clause></subparagraph></paragraph><paragraph id="H943DD1DE70704E308250051FC929DC67" indent="up1"><enum>(3)</enum><header>Separate ammunition dealer license permitted</header><text>A State that requires a license for dealing ammunition that is separate from a license for dealing firearms shall be deemed to have satisfied the requirements under paragraph (2) relating to a firearms dealer license, as that license relates to the dealing of ammunition, if the State imposes the same requirements for an ammunition dealer license as are mandated under paragraph (2) for a firearms dealer license, as that license relates to the dealing of ammunition.</text></paragraph></subsection><subsection id="H7E171C1EBC0E48959B11D0F4630FEC2C"><enum>(d)</enum><header>Application</header><text>To be eligible to receive a grant under subsection (a), a State shall submit to the Assistant Attorney General an application at such time, in such manner, and containing such information as the Assistant Attorney General may require, including a description of how the State will use the grant to implement or maintain firearms and firearms dealer licensing requirements that include the elements described in subsection (c)(2).</text></subsection><subsection id="HAAAD23CDBA0D4D4CBD271399DBB5382D"><enum>(e)</enum><header>Annual report</header><text>Each State receiving a grant under subsection (a) shall submit to the Assistant Attorney General, for each fiscal year during which the State expends amounts received under the grant, a report, at such time and in such manner as the Assistant Attorney General may reasonably require, that contains—</text><paragraph id="HB856AD339FAC4C94B5E5DBF7AE9AE457"><enum>(1)</enum><text>a summary of the activities carried out using amounts made available under the grant;</text></paragraph><paragraph id="HD147A1610668435C92C4EE5F6AD8BFFE"><enum>(2)</enum><text>an assessment of whether the activities are achieving the elements described in subsection (c)(2); and</text></paragraph><paragraph id="HA0F900E944D640EE8715368C0A335AC1"><enum>(3)</enum><text>such other information as the Assistant Attorney General may require.</text></paragraph></subsection><subsection id="H17F0893309E9462A848079767B353B94"><enum>(f)</enum><header>Limitations on the allocation of funds</header><text>Not more than 2 percent of the amount made available to carry out this section in any fiscal year may be used by the Assistant Attorney General for salaries and administrative expenses.</text></subsection><subsection id="H058376A14C234853ACF9FDB09FF73EBD"><enum>(g)</enum><header>Reallocation of appropriations</header><text>A recipient of a grant under subsection (a) shall return to the Assistant Attorney General any amounts received under the grant that are not expended for a purpose described in this section.</text></subsection></section></part><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H8A178F72F58F477789455DDE37D8D513"><enum>(b)</enum><header>Authorization of appropriations</header><text>Section 1001(a) of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10261">34 U.S.C. 10261(a)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H3E180B52DD9A4AC08ADED6541349AC27"><paragraph id="H29DAAA00F1F14E80B6D809E87881B225" indent="up1"><enum>(29)</enum><text>There are authorized to be appropriated such sums as may be necessary to carry out part PP.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
