which was referred to the <committee-name committee-id="HED00">Committee on Education and the Workforce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Occupational Safety and Health Act of 1970 to ensure labels or other appropriate forms of warning are provided in English and in the language indicated by each employee exposed to the hazard as the primary language of such employee, and for other purposes.</official-title></form><legis-body id="HA4FF0CD81166455381A7C66CD04373A2" style="OLC"><section id="H5D47D3745C744ACB9345C87594E74265" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Language Access for Workers Act</short-title></quote>.</text></section><section id="H9481DF592C2B4FB9800860B71458EF2E"><enum>2.</enum><header>Amendment to OSHA</header><text display-inline="no-display-inline">Section 6(b)(7) of the Occupational Safety and Health Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/29/655">29 U.S.C. 655(b)(7)</external-xref>) is amended in the first sentence by inserting before the period the following: <quote>, including by requiring that such labels or other appropriate forms of warning be provided in English and a language understood by employees reasonably expected to be exposed to the hazard and prepared appropriately for the vocabulary, educational level, and literacy of such employees</quote>.</text></section><section id="H11A0C4EBA537464DB0955559D8052626"><enum>3.</enum><header>Rulemaking</header><text display-inline="no-display-inline">Not later than 180 days after the date of enactment of this Act, the Secretary shall amend any standards promulgated pursuant to section 6 of the Occupational Safety and Health Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/29/655">29 U.S.C. 655</external-xref>) as necessary to comply with the amendment made by section 2.</text></section><section id="H2A1AFA5023334E3C96BE0CE15DF2B670"><enum>4.</enum><header>Grants authorized for translation services</header><subsection id="H1422803BC72D486A85D06478A99B3B66"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">From the amounts appropriated under subsection (e), the Secretary of Labor shall award grants, on a competitive basis, to eligible entities to provide translation or related services to covered individuals to ensure that such individuals receive any contracts, manuals, or training or other instruction related to the employment of such individuals in a language and manner that is understandable to such individuals, including translating any labels or other appropriate forms of warning required by the first sentence of section 6(b)(7).</text></subsection><subsection id="H04B4BB43E0254CF4838D8AA6179D5C40"><enum>(b)</enum><header>Priority</header><text>In awarding grants under this section, the Secretary shall give priority to eligible entities that—</text><paragraph id="H79643566A6A743ADAF6E4BB2D1FD4398"><enum>(1)</enum><text>serve or employ covered individuals in a geographic area with a high population of migrant employees; or</text></paragraph><paragraph id="H3BB2BC807DD44F30BC37804AD62FCB51"><enum>(2)</enum><text display-inline="yes-display-inline">serve or employ covered individuals in the agricultural or service industry. </text></paragraph></subsection><subsection id="H3BA570EDD02F4E1DB0423D372E4B17BB"><enum>(c)</enum><header>Application</header><text>To be eligible to receive a grant under this section, an eligible entity shall prepare and submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require, which shall include a description of how the eligible entity proposes to use the grant to assist covered individuals. </text></subsection><subsection id="H059A6CAFA9474714B1E5E63191517EAB"><enum>(d)</enum><header>Reports</header><paragraph id="H89F636411E1C4BC18CDF495D0CF286B7"><enum>(1)</enum><header>Report to the Secretary</header><text>An eligible entity that receives a grant under this section shall submit to the Secretary, and the Bureau of the Census, a report, on a annual basis, on the number of covered individuals assisted with such grant, disaggregated by the occupation or industry sector, and the type of assistance provided to such individuals with such grant.</text></paragraph><paragraph id="HBE331C2099964E6186755BE402C918AA"><enum>(2)</enum><header>Report to Congress</header><text display-inline="yes-display-inline">The Secretary shall submit to Congress each report received under paragraph (1).</text></paragraph></subsection><subsection id="H4B54D4DC8C8844F88ECFD71E8E7933F5"><enum>(e)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this Act:</text><paragraph id="HA4FD462D2D404F2EA271A8EC166F73CD"><enum>(1)</enum><header>Eligible entity</header><text display-inline="yes-display-inline">The term <term>eligible entity</term> means an employer, nonprofit organization, an employment provider, an employer association, or a labor organization, for which covered individuals comprise at least 40 percent of the individuals who are employed or served by such employer or other entity.</text></paragraph><paragraph id="HA3D0313EF43C4420A5DA20D37BCC6256"><enum>(2)</enum><header>Covered individual</header><text>The term <term>covered individual</term> means an individual—</text><subparagraph id="HE1AD17A2B598448299E2E084746266A9"><enum>(A)</enum><text>who is employed or is seeking employment;</text></subparagraph><subparagraph id="HABBBFEA8E29E4D4EAB956FC72DF1DE8E" commented="no"><enum>(B)</enum><text>who has limited ability in reading, writing, speaking, or comprehending the English language; and</text></subparagraph><subparagraph id="HE43B035A17E1458089C0053D3C4986D0" commented="no"><enum>(C)</enum><clause commented="no" display-inline="yes-display-inline" id="H33244EA55DB1451985FC19A8DF09D165"><enum>(i)</enum><text>whose native language is a language other than English; or</text></clause><clause id="H1EEC69D96E954C38BB928709B7424CFC" indent="up1" commented="no"><enum>(ii)</enum><text>who lives in a family or community environment where a language other than English is the dominant language. </text></clause></subparagraph></paragraph><paragraph id="H7667E247B0CB4B79A274E964CAA6041A"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Labor.</text></paragraph></subsection></section></legis-body></bill>
