which was referred to the <committee-name committee-id="HFA00">Committee on Foreign Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the International Religious Freedom Act of 1998 and the Foreign Assistance Act of 1961 to prohibit preferential Federal grant treatment for atheist groups, and for other purposes.</official-title></form><legis-body id="HBA5E25FDAD4847C4ACEF4A8B4C469D69" style="OLC"><section id="H871C2CCF85B94B4B9D6B09344BC84A72" section-type="section-one" commented="no"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Religious Freedom and Fairness Act</short-title></quote>.</text></section><section id="H9449976CC56440EC840D5CB611C64F45"><enum>2.</enum><header>Amendments to the International Religious Freedom Act of 1998</header><subsection id="HA70FB4AB7EB2449C9E6429A6BEE46BDF"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Section 2(a) of the International Religious Freedom Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/22/6401">22 U.S.C. 6401(a)</external-xref>) is amended—</text><paragraph id="HA6549A59EF96446CA39707911EBA8786"><enum>(1)</enum><text>by amending paragraph (6) to read as follows:</text><quoted-block style="OLC" id="HF87CAB8CE5134A66A7FF0EF8A5731ED4" display-inline="no-display-inline"><paragraph id="H1E6644ADF7DB46E9A8788028F0C5A53E"><enum>(6)</enum><text display-inline="yes-display-inline">Targeting of non-theists, humanists, and atheists because of their beliefs occurs around the world.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H619730958F8244A2ACE0DDC470865602"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H2E62812C68E84947A2A8A63EF2B1ACE6" display-inline="no-display-inline"><paragraph id="H60CFA6F9882D49FEA669AD52ED2108A8"><enum>(8)</enum><text display-inline="yes-display-inline">Decreasing religiosity and increasing secularization has, in some parts of the world, led to some practicing theists facing greater discrimination, harassment, and threats.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H00C074B4F56247C3B5D2C98C043F7DDF"><enum>(b)</enum><header>High-Level contacts with nongovernmental organizations</header><text>Section 105 of the International Religious Freedom Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/22/6414">22 U.S.C. 6414</external-xref>) is amended—</text><paragraph id="HF9269C5AEB5A4E7C9372F4F765BBD006"><enum>(1)</enum><text>by striking <quote>United States chiefs of mission shall</quote> and inserting <quote>(a) <header-in-text level="subsection" style="OLC">In general</header-in-text>.—United States chiefs of mission shall</quote>;</text></paragraph><paragraph id="HC4153F7870DF4D189C7719BB60C871D2"><enum>(2)</enum><text display-inline="yes-display-inline">by striking <quote>United States chiefs of mission and Foreign Service officers abroad shall</quote> and inserting the following:</text><quoted-block style="OLC" id="H308C6D94E5424F13B7EFE1E38A304B87" display-inline="no-display-inline"><subsection id="HEAB9715D15D243CFBE155894A477BE1C"><enum>(b)</enum><header>Other meetings</header><text display-inline="yes-display-inline">United States chiefs of mission and Foreign Services officers abroad shall</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H5D8F627103654B5B8255C846D8A8C957"><enum>(3)</enum><text>in subsection (a) (as so designated)—</text><subparagraph id="H180D0DDBD9E744D8BA2C3321502B2A14"><enum>(A)</enum><text>by striking <quote>to provide</quote> and inserting </text><quoted-block style="OLC" id="HA0620641AB0043BA99FCA51282DE7FC8" display-inline="yes-display-inline"><text>to—</text><paragraph id="H8DA72CB25DF2425084591E1D213D2239"><enum>(1)</enum><text display-inline="yes-display-inline">provide</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="HE3C871E333CD411CB2A9BE8F3A64DB5A"><enum>(B)</enum><text>by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="HCD0F87CD507649759B0845DE23C81B10"><enum>(C)</enum><text>by adding at the end the following: </text><quoted-block style="OLC" id="HF1F597CB95F0411D811E35F8ABD39624" display-inline="no-display-inline"><paragraph id="H7FF25258E7214FD8955A39BF056C47CB"><enum>(2)</enum><text display-inline="yes-display-inline">organize, participate in, and attend high-level meetings to understand, document, and report to the Department of State’s Office of International Religious Freedom any perceived or actual anti-religious or anti-theist funding concerns, in the Department of State’s programs and grant awards.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="H7A7CCA212D9548D1BE1E46D8F7151BB7" display-inline="no-display-inline"><enum>(c)</enum><header>Programs and allocations of funds by United States missions abroad</header><text>Section 106 of the International Religious Freedom Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/22/6415">22 U.S.C. 6415</external-xref>) is amended—</text><paragraph id="HF35EDC45F87C4E3F99732C9AAFF8003C"><enum>(1)</enum><text>by striking <quote>It is the sense of Congress</quote> and inserting <quote>(a) <header-in-text level="subsection" style="OLC">Sense of congress</header-in-text>.—It is the sense of Congress</quote>; </text></paragraph><paragraph id="H8E494602C505481892B3782180786C69"><enum>(2)</enum><text>in subsection (a) (as so designated)—</text><subparagraph id="H260D2CBCEB374D5DB3622D6619EBEE94"><enum>(A)</enum><text>in paragraph (1), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="H13568D2154DB44A1B2A55A530A9160D4"><enum>(B)</enum><text>in paragraph (2), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="H197D21D340004D2BB896C0B29B1BBC8C"><enum>(C)</enum><text>by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="H4298A4C8F7644BAAB46D9D9E5F142AF3"><paragraph id="H2E15165713A44B92957750009359000F"><enum>(3)</enum><text display-inline="yes-display-inline">in allocating or recommending the allocation of funds for programs and grants funded by the United States Government, the Department of State and United States diplomatic missions shall ensure that the programs and grants do not—</text><subparagraph id="H4B52665D05EF46338855AB812B3AA510"><enum>(A)</enum><text display-inline="yes-display-inline">promote or advance non-theist or humanist ideologies or beliefs; or</text></subparagraph><subparagraph id="H6DA86C572C02442EBF1F4800DC8A932C"><enum>(B)</enum><text>aim to expand the membership of non-theist groups.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H6A7873C6AD9F4C67A73B19415AB17D35" commented="no"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H165446CE3B574FDFAE6AFBA4B1FE5CB3"><subsection id="HEAA442744AAD43588DF5939F52D471F7" commented="no"><enum>(b)</enum><header>Limitations on funds</header><paragraph id="H2CA13459218F4AB9890BE7634457E48B" commented="no"><enum>(1)</enum><header>Other limitations</header><text display-inline="yes-display-inline">No funds allocated for programs or grants funded by the United States Government as described in subsection (a) may be used to provide funding to—</text><subparagraph id="HB0F527BF789A4D7780021001D8C9AFF4"><enum>(A)</enum><text display-inline="yes-display-inline">any entity or close affiliate of such entity that has made public statements disparaging, infringing upon, or otherwise denigrating theistic belief; or </text></subparagraph><subparagraph id="HCD26B7102735479682557031B98ADA2F" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">any atheist, agnostic, humanist, or other non-theist group in a foreign country unless the Department of State and United States diplomatic mission to that country also provide proportional funding to other religious groups in that country over the same time period, taking into account the severity and number of violations of religious freedom of the various religious groups and the population and financial capacity of the various religious groups.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="H068BA830E39D4AB2A710891EE68A2EFF"><enum>3.</enum><header>Amendments to the Foreign Assistance Act of 1961</header><text display-inline="no-display-inline">Section 116(e) of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2151n">22 U.S.C. 2151n(e)</external-xref>) is amended—</text><paragraph id="H9FF0496062564BD6A46ED917FF02CE9C"><enum>(1)</enum><text>by striking <quote>(e)</quote> and inserting <quote>(e)(1)</quote>;</text></paragraph><paragraph id="H7634CAED64424A95A0F75321E54E36E3"><enum>(2)</enum><text>by striking <quote>None of these funds</quote> and inserting the following:</text><quoted-block style="OLC" id="H35ACAEBA4A6C4975B3CA16232279789F" display-inline="no-display-inline"><paragraph id="H3DF7344664F84296AC3A048DA66BDD0D" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HD2C5B53C6EDD4E538C445DC5250E7F9A"><enum>(A)</enum><text>None of these funds</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="HCB429F9179474233B417F4AEEE418FB2"><enum>(3)</enum><text>in paragraph (2) (as so designated), by adding at the end the following: </text><quoted-block style="OLC" id="HADE0C65DC8B5477CB83C02E4A0E2D142" display-inline="no-display-inline"><subparagraph id="HBBF547B5616342A8BB19AF0FD8863E98" indent="up2"><enum>(B)</enum><text display-inline="yes-display-inline">None of these funds may be used, directly or indirectly, to—</text><clause id="H9C6B22CAFA8B437AB453795311A5B1DC"><enum>(i)</enum><text display-inline="yes-display-inline">promote or advance non-theist or humanist ideologies or beliefs; or</text></clause><clause id="H5A60BF2FDB6C4EDD8041582CF6B820F1"><enum>(ii)</enum><text>directly aim to expand the membership of non-theist groups.</text></clause></subparagraph><subparagraph id="H1A6592C372BE43DAAABAC5D4B1B72CDC" indent="up2"><enum>(C)</enum><text display-inline="yes-display-inline">None of these funds may be provided to—</text><clause id="HE856E5DB9F754595B935A841AE9EF970"><enum>(i)</enum><text display-inline="yes-display-inline">any entity or close affiliate of such entity that has made public statements disparaging, infringing upon, or otherwise denigrating theistic belief; or</text></clause><clause id="HCA61F984D84B4382BFFD5A64FAA7DAD7"><enum>(ii)</enum><text display-inline="yes-display-inline">any atheist, agnostic, humanist, or other non-theist group in a foreign country unless the Department of State and United States diplomatic mission to that country also provide proportional funding to other religious groups in that country over the same time period, taking into account the severity and number of violations of religious freedom of the various religious groups and the population and financial capacity of the various religious groups.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="HE358F280EC684151AEAF397ABC5FF67A" commented="no"><enum>4.</enum><header>Report</header><subsection id="H04B76361B03C4531AAC3DE7D65EF49A7"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, and annually thereafter, the Office of International Religious Freedom, in coordination with the Department of State’s Bureau of Democracy, Human Rights, and Labor, shall submit to the appropriate congressional committees a report that includes a list of all grants, cooperative agreements, and programs funded by the Department in the previous fiscal year that have been provided to religious, atheist, agnostic, and humanist groups worldwide.</text></subsection><subsection id="H8991EF7E83444174852D680D876D233C"><enum>(b)</enum><header>Matters To be included</header><text>The list include in the report required by subsection (a)—</text><paragraph id="HC3DEDC1C86324DF2B05B370E3AB8DF73"><enum>(1)</enum><text>shall be disaggregated by country, dollar amount, name of implementing partner;</text></paragraph><paragraph id="H1906DE9F652841B58C78CD48D77205CC"><enum>(2)</enum><text display-inline="yes-display-inline">shall include a brief description of what objectives the grant was intended to achieve, what metrics suggest those objectives were met, and what national interests were advanced; and</text></paragraph><paragraph id="HD95D08BE6FA14399818431CDE22CFA24"><enum>(3)</enum><text display-inline="yes-display-inline">how programming comports with both the Free Exercise Clause and the Establishment Clause of the United States Constitution. </text></paragraph></subsection><subsection id="HD3EF2F0F8DC8497A984E5902F9EB3230"><enum>(c)</enum><header>Form</header><text display-inline="yes-display-inline">The report required by subsection (a) may be submitted in classified form if necessary.</text></subsection></section></legis-body></bill>
