which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To appropriate funds for the Federal Communications Commission’s <quote>rip and replace</quote> program and Affordable Connectivity Program, to improve the Affordable Connectivity Program, to require a spectrum auction, and for other purposes.</official-title></form><legis-body id="H6363012A402E4C4E97EF0418C82C61DE" style="OLC"><section id="HED3F89F6FD7F46CB8480EA6E66E30E3F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Saving Americans’ Valuable Earnings on the National ACP Act</short-title></quote> or the <quote>SAVE On ACP Act</quote>.</text></section><section id="H7E0DA3CB09A143A88AE4A644AF9C2A76"><enum>2.</enum><header>Additional <quote>rip and replace</quote> funding</header><subsection id="H0668BDA4BFA4460EB7A16910A8AFDEF3"><enum>(a)</enum><header>Increase in expenditure limit</header><text display-inline="yes-display-inline">Section 4(k) of the Secure and Trusted Communications Networks Act of 2019 (<external-xref legal-doc="usc" parsable-cite="usc/47/1603">47 U.S.C. 1603(k)</external-xref>) is amended by striking <quote>$1,900,000,000</quote> and inserting <quote>$4,980,000,000</quote>.</text></subsection><subsection id="H62F62C86E376494A95E17D9960EA443E"><enum>(b)</enum><header>Appropriation of funds</header><text display-inline="yes-display-inline">There is appropriated to the Federal Communications Commission for fiscal year 2024, out of amounts in the Treasury not otherwise appropriated, $3,080,000,000, to remain available until expended, to carry out section 4 of the Secure and Trusted Communications Networks Act of 2019 (<external-xref legal-doc="usc" parsable-cite="usc/47/1603">47 U.S.C. 1603</external-xref>).</text></subsection></section><section id="H87B2B84A2F614150B20FF689997B2CD9"><enum>3.</enum><header>Improving the Affordable Connectivity Program</header><subsection id="H8A8D72D53C6B4104B2218A9715B9C08D"><enum>(a)</enum><header>Improving verification of eligibility</header><paragraph id="H2DDC95DA378248D099D35F6FD76075C5"><enum>(1)</enum><header>Required use of National Verifier to determine eligibility</header><text>Section 904 of division N of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="usc" parsable-cite="usc/47/1752">47 U.S.C. 1752</external-xref>) is amended—</text><subparagraph id="HD4FCE2139A2D4477B1CB7A427704EF24"><enum>(A)</enum><text>in subsection (a)(6)(C), by striking <quote>or the participating provider verifies eligibility under subsection (a)(2)(B)</quote>; and</text></subparagraph><subparagraph id="H662D3B76ABC44F89A9188D5965FEBCAB"><enum>(B)</enum><text>in subsection (b)(2), by striking <quote>shall</quote> and all that follows and inserting the following: <quote>shall use the National Verifier or National Lifeline Accountability Database.</quote>.</text></subparagraph></paragraph><paragraph id="HA2D823221D514ECEA986E77A9907A120"><enum>(2)</enum><header>Repeal of eligibility through a provider’s existing low-income program</header><text>Section 904(a)(6) of division N of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="usc" parsable-cite="usc/47/1752">47 U.S.C. 1752(a)(6)</external-xref>) is amended—</text><subparagraph id="H91FF6572C99947A8ADAC003461A64A3B"><enum>(A)</enum><text>in subparagraph (C), by adding <quote>or</quote> at the end;</text></subparagraph><subparagraph id="HD04D90EFB1E54C23BCD991BDC9072357"><enum>(B)</enum><text>by striking subparagraph (D); and</text></subparagraph><subparagraph id="H94A03E45E50A43819C828508BEDD7A07"><enum>(C)</enum><text>by redesignating subparagraph (E) as subparagraph (D).</text></subparagraph></paragraph><paragraph id="HD8F00639C8914083A8C680DDDE9CB884"><enum>(3)</enum><header>Limitation on eligibility through the community eligibility provision of the free lunch program and the free school breakfast program</header><text>Section 904(a)(6) of division N of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="usc" parsable-cite="usc/47/1752">47 U.S.C. 1752(a)(6)</external-xref>) is amended by striking subparagraph (B) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HFEDDB1922AB048A59A5F1A07FA3FAA79"><subparagraph id="HB65F4358EEA54CC79E860A95A1C42B88"><enum>(B)</enum><text>at least 1 member of the household—</text><clause id="HF45BEFC12A2A41B9BFDF7119F889124D"><enum>(i)</enum><text>is eligible for and receives—</text><subclause id="H469FEC4CB26A4A06ADAB216AD7064595"><enum>(I)</enum><text>free or reduced price lunch under the school lunch program established under the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1751">42 U.S.C. 1751 et seq.</external-xref>); or</text></subclause><subclause id="HEFF1A0F17F704F878320D6E53F0AD29C"><enum>(II)</enum><text>free or reduced price breakfast under the school breakfast program established under section 4 of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1773">42 U.S.C. 1773</external-xref>); and</text></subclause></clause><clause id="HDE2A46AA1FFB4F5995250114C72335F0"><enum>(ii)</enum><text>attends a school the local educational agency of which does not elect to receive special assistance payments under section 11(a)(1)(F) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1759a">42 U.S.C. 1759a(a)(1)(F)</external-xref>).</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H2EF24D7662964326AED5904070F5008B" commented="no"><enum>(4)</enum><header>Reduction of eligible households</header><text>Section 904(a)(6)(A) of division N of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="usc" parsable-cite="usc/47/1752">47 U.S.C. 1752(a)(6)(A)</external-xref>) is amended by striking <quote>except that</quote> and all that follows and inserting a semicolon.</text></paragraph><paragraph id="H38039F54C6B1444AB52B0C367F2CDC7C"><enum>(5)</enum><header>Effective date; rules</header><subparagraph commented="no" display-inline="no-display-inline" id="HB56E63B2ED7A4B2C81F4484E91523818"><enum>(A)</enum><header display-inline="yes-display-inline">Definitions</header><text>In this paragraph—</text><clause commented="no" display-inline="no-display-inline" id="H682A90F16763419AB729DCAC3F667461"><enum>(i)</enum><text display-inline="yes-display-inline">the terms <term>affordable connectivity benefit</term>, <term>Commission</term>, <term>eligible household</term>, and <term>participating provider</term> have the meanings given those terms in section 904(a) of division N of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="usc" parsable-cite="usc/47/1752">47 U.S.C. 1752(a)</external-xref>), as amended by this subsection; and</text></clause><clause commented="no" display-inline="no-display-inline" id="H3BE8C927F5134E38A69E5BB8E9233356"><enum>(ii)</enum><text>the term <term>Affordable Connectivity Program</term> means the program established under section 904(b)(1) of division N of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="usc" parsable-cite="usc/47/1752">47 U.S.C. 1752(b)(1)</external-xref>).</text></clause></subparagraph><subparagraph id="H990A58DC98A74E6296528AD459E75DED"><enum>(B)</enum><header>Effective date</header><text>Except as provided in subparagraph (C), the amendments made by this subsection shall take effect on the date of enactment of this Act.</text></subparagraph><subparagraph id="H0BFEF363F0924A4A9EEEDBD16C3CB305"><enum>(C)</enum><header>Enrolled households</header><text>A household that received the affordable connectivity benefit as of April 30, 2024, but is no longer an eligible household by reason of the amendments made by this subsection shall nonetheless be treated an eligible household until the date that is 180 days after the date of enactment of this Act.</text></subparagraph><subparagraph id="H2C7C7E04D2EC4485BB41FAE1632907D2"><enum>(D)</enum><header>Updating rules</header><text>Not later than 180 days after the date of enactment of this Act, the Commission shall update the rules of the Commission relating to the Affordable Connectivity Program to implement the amendments made by this subsection.</text></subparagraph><subparagraph id="HD3000A42BAA642C08D411CC4461C4949"><enum>(E)</enum><header>Re-certification</header><text>During the period beginning on the date on which the Commission updates the rules under subparagraph (D) and ending on the date that is 240 days after the date of enactment of this Act, a participating provider or the Administrator of the Universal Service Administrative Company, as applicable, shall re-certify the eligibility of a household for the Affordable Connectivity Program in accordance with section 54.1806(f) of title 47, Code of Federal Regulations, or any successor regulation, based on the amendments made by this subsection.</text></subparagraph></paragraph></subsection><subsection id="H49722D4B880B47A3BA2F1DE3851B779B"><enum>(b)</enum><header>Repeal of Affordable Connectivity Program device subsidy</header><text>Section 904 of division N of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="usc" parsable-cite="usc/47/1752">47 U.S.C. 1752</external-xref>) is amended—</text><paragraph id="H4410897AF8D542158C9B788030914D3C"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="H37CFE5F739F34DF1977CF01AE641E3A9"><enum>(A)</enum><text>by striking paragraph (4); and</text></subparagraph><subparagraph id="H153A916663914C1EBF372351AE71848F"><enum>(B)</enum><text>by redesignating paragraphs (5) through (11) as paragraphs (4) through (10), respectively; and</text></subparagraph></paragraph><paragraph id="HCFD620FC12ED41048703FA93CD9F2661"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph id="HC582B4986831443899AAFF7AED34F05D"><enum>(A)</enum><text>in paragraph (1), by striking <quote>, or an affordable connectivity benefit and a connected device,</quote>;</text></subparagraph><subparagraph id="H83CE4DC6B2794F729C9C0ED7F717B211"><enum>(B)</enum><text>in paragraph (2), by striking <quote>subsection (b)(6)(C)</quote> and inserting <quote>subsection (b)(5)(C)</quote>;</text></subparagraph><subparagraph id="H1152502F2B9049148B19F851DA66774C"><enum>(C)</enum><text>by striking paragraph (5);</text></subparagraph><subparagraph id="H14842FB71F7E4EC19C10F809DEB6775E"><enum>(D)</enum><text>by redesignating paragraphs (6) through (15) as paragraphs (5) through (14), respectively;</text></subparagraph><subparagraph id="H4AF1FBD4225842D5A61749286B03B413"><enum>(E)</enum><text>by amending paragraph (5), as so redesignated, to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HCEC4452612AA4A829D2BA3EDDB29E259"><paragraph id="H1A386AE176E14402958229EC384E8244"><enum>(5)</enum><header>Certification required</header><text>To receive a reimbursement under paragraph (4), a participating provider shall certify to the Commission that each eligible household for which the participating provider is seeking reimbursement for providing an internet service offering discounted by the affordable connectivity benefit—</text><subparagraph id="HF40BCCF388F8404492B108E8C6AA81BA"><enum>(A)</enum><text>will not be required to pay an early termination fee if such eligible household elects to enter into a contract to receive such internet service offering if such household later terminates such contract;</text></subparagraph><subparagraph id="H6C91095EC80849BC8E3A27C99D3A63BE"><enum>(B)</enum><text>was not, after December 27, 2020, subject to a mandatory waiting period for such internet service offering based on having previously received broadband internet access service from such participating provider; and</text></subparagraph><subparagraph id="HC21E263C1D2E40D8976FC798B6307C36"><enum>(C)</enum><text>will otherwise be subject to the participating provider’s generally applicable terms and conditions as applied to other customers.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="H1822DCA48C234664B2437E1D261377A3"><enum>(F)</enum><text>in paragraph (11), as so redesignated—</text><clause id="H5172F45B8103452FAD4DFBBB28988E09"><enum>(i)</enum><text>in subparagraph (D), by striking <quote>a connected device or a reimbursement for</quote>;</text></clause><clause id="H73BF0661AB874DF8A44D08F874EB6B07"><enum>(ii)</enum><text>by striking subparagraph (E);</text></clause><clause id="H0DB0EBDF1F3E4D03BCDB06A5135FBAC8"><enum>(iii)</enum><text>by redesignating subparagraphs (F) and (G) as subparagraphs (E) and (F), respectively; and</text></clause><clause id="H01E702EFBADE4B7A85B91DD4DE638EAD"><enum>(iv)</enum><text>in subparagraph (F), as so redesignated, by striking <quote>subsection (a)(6)</quote> and inserting <quote>subsection (a)(5)</quote>; and</text></clause></subparagraph><subparagraph id="H44AB4C0BDFD64E4BB95C5A7CD32F6F18"><enum>(G)</enum><text>in paragraph (13), as so redesignated, by striking <quote>paragraph (12)</quote> and inserting <quote>paragraph (11)</quote>.</text></subparagraph></paragraph></subsection><subsection id="H362ADBEDFF6347B5927F97798F4E49B5"><enum>(c)</enum><header>Antifraud controls, performance goals, and measures</header><text>Section 904 of division N of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="usc" parsable-cite="usc/47/1752">47 U.S.C. 1752</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H69F772E54EE741ECA8706FC335630662"><subsection id="H8E8D875873C54D68A1CD092727BDDC34"><enum>(k)</enum><header>Antifraud controls, performance goals, and measures</header><paragraph id="HCE3928E9B9EC423CA9B45E25752E92C6"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this subsection, the Commission shall develop and implement antifraud controls, performance goals, and performance measures for the Affordable Connectivity Program, and in doing so, shall consider the recommendations submitted by the Comptroller General of the United States to the Commission in the report entitled <quote>Affordable Broadband: FCC Could Improve Performance Goals and Measures, Consumer Outreach, and Fraud Risk Management</quote>, publicly released January 25, 2023 (GAO–23–105399).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H81D59C3BD1374091AC2617DAD8EA9741"><enum>(d)</enum><header>Report on effectiveness</header><text>Not later than 1 year after the date of enactment of this Act, the Inspector General of the Federal Communications Commission shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Energy and Commerce of the House of Representatives a report analyzing the effects of this section, including the amendments made by this section, with respect to improving the efficiency and quality of the Affordable Connectivity Program established under section 904 of division N of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="usc" parsable-cite="usc/47/1752">47 U.S.C. 1752</external-xref>).</text></subsection><subsection id="H7741A0345E464F4E9A06678BB03A489A"><enum>(e)</enum><header>Appropriation of funds</header><text display-inline="yes-display-inline">Section 904(i)(2) of division N of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="usc" parsable-cite="usc/47/1752">47 U.S.C. 1752(i)(2)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="H2F6CF6223EC444019E030DACA01BBFB6"><enum>(1)</enum><text>in the paragraph heading, by striking <quote><header-in-text style="OLC" level="paragraph">Appropriation</header-in-text></quote> and inserting <quote><header-in-text style="OLC" level="paragraph">Appropriations</header-in-text></quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HAB3E3E86C9E447488C61A8793D3B8766"><enum>(2)</enum><text>by striking <quote>There is</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HA892A4B93A3A457C8D598D60C8E0A985"><subparagraph id="HEBA60457F3894AD9BAAE1CC2B3F9B2C2"><enum>(A)</enum><header>Fiscal year 2021</header><text>There is</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5D56D188FF154EAEB93164C099F4B5B4"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H63EE7E578F7A4355A148293CDE3743E9"><subparagraph id="HF6CC9507C58B4219AB29C6E548835F83"><enum>(B)</enum><header>Fiscal year 2024</header><text>There is appropriated to the Affordable Connectivity Fund, out of any money in the Treasury not otherwise appropriated, $6,000,000,000 for fiscal year 2024, to remain available until expended.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="HDD8F1094A85E418EB04A0B74A4020B94"><enum>4.</enum><header>Reauction of certain licenses</header><subsection id="H85649C369D93478F8189F03D1DF5E0D2"><enum>(a)</enum><header>FCC reauction authority</header><text>Not later than 2 years after the date of enactment of this Act, the Federal Communications Commission, without regard to whether the authority of the Commission under paragraph (11) of section 309(j) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/309">47 U.S.C. 309(j)</external-xref>) has expired—</text><paragraph id="HB4971AE867C843A38856A094D5E5079E"><enum>(1)</enum><text>shall initiate 1 or more systems of competitive bidding under that section to grant licenses for—</text><subparagraph commented="no" display-inline="no-display-inline" id="H8CBE922A917F44C884D79A7C5BE4856D"><enum>(A)</enum><text display-inline="yes-display-inline">the bands referred to by the Commission as the <quote>AWS–3 bands</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB618BAB3B4A64133BD22E3D9849B86DF"><enum>(B)</enum><text display-inline="yes-display-inline">any other unassigned spectrum bands with respect to which the Commission previously offered licenses in competitive bidding, as determined appropriate by the Commission; and</text></subparagraph></paragraph><paragraph id="H0148B36FFD2144B188323FA3C5EB0AAA"><enum>(2)</enum><text>shall initiate 1 or more systems of competitive bidding under that section to grant licenses for any unassigned spectrum bands, other than the bands auctioned under paragraph (1), with respect to which the Commission—</text><subparagraph commented="no" display-inline="no-display-inline" id="H801140BCB22D454F9740B5ACCCF6B78A"><enum>(A)</enum><text display-inline="yes-display-inline">previously offered licenses in competitive bidding; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H81D4600CD5024F6D8EDB4D6485E05165"><enum>(B)</enum><text>determines there is sufficient current demand.</text></subparagraph></paragraph></subsection><subsection id="HF9E742381437401DB708C47F5E1A1120"><enum>(b)</enum><header>Completion of reauction</header><text>The Federal Communications Commission shall complete each system of competitive bidding described in subsection (a), including receiving payments, processing applications, and granting licenses, without regard to whether the authority of the Commission under paragraph (11) of section 309(j) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/309">47 U.S.C. 309(j)</external-xref>) has expired.</text></subsection></section></legis-body></bill>
