which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 28, United States Code, to clarify that protection for jurors on the basis of sex includes sexual orientation and gender identity.</official-title></form><legis-body id="H88E62D7343BF4689AD6B2D20F66891FF" style="OLC"><section id="HF2DFCD558E08480FAC9F55D22A30345E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Juror Non-Discrimination Act of 2024</short-title></quote>.</text></section><section id="HB8646E08FF3748EC9A27F6DBFEBF4964"><enum>2.</enum><header>Juries</header><text display-inline="no-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/121">Chapter 121</external-xref> of title 28, United States Code, is amended—</text><paragraph id="H3EBD3C4902ED4311B4B05849AF5034C6"><enum>(1)</enum><text>in section 1862, by inserting <quote>(including sexual orientation and gender identity)</quote> after <quote>sex</quote>;</text></paragraph><paragraph id="H76E1914EF3EF414B8B3A8897E0B1AB76"><enum>(2)</enum><text>in section 1867(e), in the second sentence, by inserting <quote>(including sexual orientation and gender identity)</quote> after <quote>sex</quote>; and</text></paragraph><paragraph id="H47D7C012AEBD42249F9590F87417C1D7"><enum>(3)</enum><text>in section 1869—</text><subparagraph id="H1610FDF2046C4AFDAB5073CAEF7112F7"><enum>(A)</enum><text>in subsection (j), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="H083C59502E5246EF8BE7FA2312D6834E"><enum>(B)</enum><text>in subsection (k), by striking the period at the end and inserting a semicolon; and</text></subparagraph><subparagraph id="H0B4BCBC7793B4956831ECBD16D9DE508"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block id="HE4184B8C2DC64DDFBDACAA937838C721" style="USC"><subsection id="HD143ACB170E14A53A16B91A2E531E7A7"><enum>(l)</enum><text><quote>gender identity</quote> shall mean the gender-related identity, appearance, mannerisms, or other gender-related characteristics of an individual, regardless of the individual’s designated sex at birth;</text></subsection><subsection id="HBACE74B71B58460C8F5D0D834EF9CE37"><enum>(m)</enum><text><quote>sex</quote> shall include—</text><paragraph id="HAB3C1F523CF344A7A6E4A7F51207709D"><enum>(1)</enum><text>a sex stereotype;</text></paragraph><paragraph id="HB7153D6CB0764263A5D1727306915773"><enum>(2)</enum><text>pregnancy, childbirth, or a related medical condition;</text></paragraph><paragraph id="H0D4D742011864A778CD42EEAFC59F859"><enum>(3)</enum><text>sexual orientation or gender identity; and </text></paragraph><paragraph id="HA9614642654A4B1E942814111E9713B0"><enum>(4)</enum><text>sex characteristics, including intersex traits;</text></paragraph></subsection><subsection id="H970D457BB395406DBF9A678027A5DF47"><enum>(n)</enum><text><quote>sexual orientation</quote> shall mean homosexuality, heterosexuality, or bisexuality; and</text></subsection><subsection id="H34AD006007504BC48471FB8FD725F0A5"><enum>(o)</enum><text><quote>race</quote>, <quote>color</quote>, <quote>religion</quote>, <quote>sex</quote> (including <quote>sexual orientation</quote> and <quote>gender identity</quote>), <quote>economic status</quote>, or <quote>national origin</quote>, used with respect to an individual, includes—</text><paragraph id="H46365594204C40DEBD7BECA7B02EF1C6"><enum>(1)</enum><text>the race, color, religion, sex (including sexual orientation and gender identity), economic status, or national origin, respectively, of another person with whom the individual is associated or has been associated; and</text></paragraph><paragraph id="HD1F8C5D0F28A4F2F9A2950925D1F7DE0"><enum>(2)</enum><text>a perception or belief, even if inaccurate, concerning the race, color, religion, sex (including sexual orientation and gender identity), economic status, or national origin, respectively, of the individual.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section></legis-body></bill>
