Severability.</toc-entry></toc></section><section id="H13A06E25C585413CADFCA96B031E9C91"><enum>3.</enum><header>Prohibited diversity, equity or inclusion practice defined</header><text display-inline="no-display-inline">The Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000a">42 U.S.C. 2000a et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H24A845813CAB41C9AB686A9DB4D8DF66"><title id="H0E4BECB6FA1C40D089A659A81ABBD308" style="OLC"><enum>XII</enum><header>Prohibited diversity, equity or inclusion practice defined</header><section display-inline="no-display-inline" id="H157E833F46B9458BA8334F1D8FCA5F4A"><enum>1201.</enum><header>Prohibited diversity, equity, or inclusion practice</header><text display-inline="no-display-inline">For purposes of references to this section, the term <quote>prohibited diversity, equity, or inclusion practice</quote> means—</text><paragraph id="HE4E2A75FF489474288018BC9E5318168"><enum>(1)</enum><text>discriminating for or against any person on the basis of race, color, ethnicity, religion, biological sex, or national origin;</text></paragraph><paragraph commented="no" id="H55C2CBF6C019461193AC84053A4BC56C"><enum>(2)</enum><text display-inline="yes-display-inline">requiring as a condition of employment, as a condition for promotion or advancement, or as a condition for speaking, making a presentation, or submitting written materials, that an employee undergo training, education, or coursework, or other pedagogy, that asserts that a particular race, color, ethnicity, religion, biological sex, or national origin is inherently or systemically superior or inferior, oppressive or oppressed, or privileged or unprivileged; or</text></paragraph><paragraph id="H4C80A3C6C1184024A7F61CA2A678ECD6" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">requiring as a condition of employment, as a condition for promotion or advancement, or as a condition for speaking, making a presentation, or submitting written materials, the signing of or assent to a statement, code of conduct, work program, or plan, or similar device that requires assent by the employee that a particular race, color, ethnicity, religion, biological sex, or national origin is inherently or systemically superior or inferior, oppressive or oppressed, or privileged or unprivileged.</text></paragraph></section></title><after-quoted-block>.</after-quoted-block></quoted-block></section><title id="H010ED8896AAF416AB05ED6D6902D3225"><enum>I</enum><header>Federal Offices and Personnel</header><section id="H90B546C047D741B9988A6F1989880B4A"><enum>101.</enum><header>Executive orders and memoranda rescinded</header><subsection id="H44974A78AD2041AA80B44D0977848346"><enum>(a)</enum><header>Rescinded Executive Orders and memoranda</header><paragraph display-inline="no-display-inline" id="H073D8B222BF14D1B85030944373D3FD4"><enum>(1)</enum><header>In general</header><text>With respect to an Executive order or memoranda described in paragraph (2)—</text><subparagraph id="H6B7D73BF295045ABBDADB2951A4A8119"><enum>(A)</enum><text>the Executive order or memoranda—</text><clause commented="no" display-inline="no-display-inline" id="HC0A373373E1A4FC8ACFA5AC255442448"><enum>(i)</enum><text display-inline="yes-display-inline">shall not have any legal effect; and</text></clause><clause commented="no" display-inline="no-display-inline" id="HCEA8CF01CD28447E8557C684F770C0E1"><enum>(ii)</enum><text display-inline="yes-display-inline">is revoked in its entirety; and</text></clause></subparagraph><subparagraph id="H8A4FB595DFC6494285A70FC238D065DB"><enum>(B)</enum><text display-inline="yes-display-inline">no funds appropriated or otherwise made available by law shall be used to—</text><clause commented="no" display-inline="no-display-inline" id="HB0D2293B6D1141388A8B391E60ADDF20"><enum>(i)</enum><text display-inline="yes-display-inline">implement or comply with the Executive order or memoranda; or</text></clause><clause commented="no" display-inline="no-display-inline" id="HA8B71610D0F24381988987481E2EC90D"><enum>(ii)</enum><text display-inline="yes-display-inline">further any of the provisions or purposes of the Executive order or memoranda.</text></clause></subparagraph></paragraph><paragraph id="H4966FBCDC28240159BA75375C9F6CFC0"><enum>(2)</enum><header>Executive orders and memoranda described</header><text display-inline="yes-display-inline">The Executive orders and memoranda described in this paragraph are the following:</text><subparagraph id="HB050F14E28584CE1BA8AB26B0D0BBF47"><enum>(A)</enum><text>Executive Order 13985 (<external-xref legal-doc="usc" parsable-cite="usc/5/601">5 U.S.C. 601</external-xref> note; relating to advancing racial equity and support for underserved communities through the Federal Government).</text></subparagraph><subparagraph id="H947483A9F1F94D18B2F8AB152ECFA2E5"><enum>(B)</enum><text>Executive Order 13988 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e">42 U.S.C. 2000e</external-xref> note; relating to preventing and combating discrimination on the basis of gender identity or sexual orientation). </text></subparagraph><subparagraph id="HBBB10219CBE24480B62C039229909A61"><enum>(C)</enum><text>Executive Order 14020, (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e">42 U.S.C. 2000e</external-xref> note; relating to the establishment of the White House Gender Policy Council).</text></subparagraph><subparagraph id="H658E057114CB49D49DEBA5E24E6C413E"><enum>(D)</enum><text>Executive Order 14031 (<external-xref legal-doc="usc" parsable-cite="usc/42/3501">42 U.S.C. 3501</external-xref> note; relating to advancing equity, justice, and opportunity for Asian Americans, Native Hawaiians, and Pacific Islanders).</text></subparagraph><subparagraph id="H615AEAAFD42C467897D9CD1B31D17A05"><enum>(E)</enum><text>Executive Order 14035 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e">42 U.S.C. 2000e</external-xref> note; relating to diversity, equity, inclusion, and accessibility in the Federal workforce).</text></subparagraph><subparagraph id="H943E6D9C8DC44D83A29D5E534B5543C7"><enum>(F)</enum><text>Executive Order 14091 (<external-xref legal-doc="usc" parsable-cite="usc/5/601">5 U.S.C. 601</external-xref> note; relating to further advancing racial equity and support for underserved communities through the Federal Government).</text></subparagraph><subparagraph id="H18D5BB72C9A94C05B17615B4D3995B8C"><enum>(G)</enum><text>The National Security Memorandum on <quote>Revitalizing America’s Foreign Policy and National Security Workforce, Institutions, and Partnerships (NSM–03)</quote>, dated February 4, 2021.</text></subparagraph><subparagraph id="H33015F509BB4433588ED48ABCBB5767F"><enum>(H)</enum><text>The National Security Memorandum on Advancing the <quote>Human Rights of Lesbian, Gay, Bisexual, Transgender, Queer, and Intersex Persons Around the World (NSM–04)</quote>, dated February 4, 2021.</text></subparagraph></paragraph></subsection><subsection id="HEA337B628B86428BAC2A87CE91327D66"><enum>(b)</enum><header>Carrying out rescinded executive orders and memoranda</header><text>The head of an executive agency, as defined in section 105 of title 5, United States Code, may not carry out an Executive order or memorandum described in subsection (a)(2).</text></subsection><subsection id="H50649E1EF60A400AAC4643FEEA2D51B5" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header>Programs and office</header><paragraph commented="no" display-inline="no-display-inline" id="H1611360F3AAE435E8CB1878B32482A23"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 90 days after the date of enactment of this Act, the head of a Federal agency under which any program or office carries out an Executive order or memorandum described in subsection (a)(2) between the date of enactment of this Act and 90 days after the date of enactment of this Act shall close, terminate, and wind up the program or office.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9ADBA493779041E9A1FAE23EADF46875"><enum>(2)</enum><header>No reassignment</header><text display-inline="yes-display-inline">The head of a Federal agency that closes, terminates, and winds up a program or office under paragraph (1)—</text><subparagraph commented="no" display-inline="no-display-inline" id="HA1AB536A50694D6E879A0D68102D9FAC"><enum>(A)</enum><text display-inline="yes-display-inline">shall undertake an appropriate reduction in force; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE3231FB06B4645059310CFB431456AB3"><enum>(B)</enum><text display-inline="yes-display-inline">may not transfer, reassign, or redesignate any employee or contractor with a position or function that is eliminated by operation of this subsection.</text></subparagraph></paragraph></subsection></section><section id="HBBECAE7031B24E3AA89E654ABC0EC786"><enum>102.</enum><header>Office of Personnel Management</header><subsection id="H2F8BF5737A5943B5861EE4239BD1EBE4"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Director of the Office of Personnel Management shall—</text><paragraph id="H598F2BF034984C4AB8CDB6A70EF8BD50"><enum>(1)</enum><text>revise all regulations, policies, procedures, manuals, circulars, courses, training, and guidance of the Office such that all such material is in compliance with and consistent with this Act and the amendments made by this Act;</text></paragraph><paragraph id="HAA97B4B31BA1478F970017EBE790C303"><enum>(2)</enum><text>revise so as to effectively rescind all regulations, policies, procedures, manuals, circulars, courses, training, and guidance of the Office that were promulgated, adopted, or implemented to comply with the Executive orders and memoranda described in section 101(a)(2);</text></paragraph><paragraph id="H49C7EAA8180046B197FC4B143781D5BF"><enum>(3)</enum><text display-inline="yes-display-inline">terminate, close, and wind up the Office of Diversity, Equity, Inclusion, and Accessibility of the Office of Personnel Management (referred to in this paragraph as <quote>ODEIA</quote>) and undertake an appropriate reduction in force with respect to, and not transfer, reassign, or redesignate any, employees or contractors of ODEIA, the positions or functions of whom are eliminated by operation of this Act or the amendments made by this Act; and</text></paragraph><paragraph id="H74D5187F019442C7978FD5911FE83F0B"><enum>(4)</enum><text>terminate, close, and wind up the Chief Diversity Officers Executive Council and undertake an appropriate reduction in force with respect to, and not transfer, reassign, or redesignate any, employees or contractors of that Council, the positions or functions of whom are eliminated by operation of this Act or the amendments made by this Act.</text></paragraph></subsection><subsection id="H38299D58E9EE4D0CA42B08AC8A5AFE4E"><enum>(b)</enum><header>Chief Diversity Officers Executive Council charter</header><text>Effective on the date of enactment of this Act, the charter of the Chief Diversity Officers Executive Council is revoked.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="H4B01DAD636BD474E9647D4EB022CF05A"><enum>(c)</enum><header display-inline="yes-display-inline">Prohibition on racism in Government</header><text display-inline="yes-display-inline">Section 1104 of title 5, United States Code, is amended by adding at the end the following:</text><quoted-block id="H0EC407CF676F43C7B652FE1A6BB34CF0" display-inline="no-display-inline" style="OLC"><subsection id="HB2E0F980DC154801AC460CC8812CAAC5"><enum>(d)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H9304148659B44D57A58AAAB1E8A1F9C6"><enum>(1)</enum><text>In this subsection, the term <term>prohibited diversity, equity, or inclusion practice</term> has the meaning given the term in section 1201 of the Civil Rights Act of 1964.</text></paragraph><paragraph id="H90752C27F7C44048A1770A5BB9E817CA" indent="up1"><enum>(2)</enum><text>Racist behavior and racist training in the Government are prohibited, including any of the following:</text><subparagraph id="H57E2B1F429374DEC9726C124F2A842D3"><enum>(A)</enum><text>Discriminating for or against any person on the basis of race, color, ethnicity, religion, biological sex, or national origin.</text></subparagraph><subparagraph id="H3B743EC267C74CA185DE26E7027FEE40"><enum>(B)</enum><text>Training, education, coursework, or use of other pedagogy, that asserts that a particular race, color, ethnicity, religion, biological sex, or national origin is inherently or systemically superior or inferior, oppressive or oppressed, or privileged or unprivileged.</text></subparagraph><subparagraph id="HEDC5D752FC5F4DA9B24C438D37930273"><enum>(C)</enum><text>Maintaining an office, bureau, division, or other organization to further promote or enforce a prohibited diversity, equity, or inclusion practice.</text></subparagraph><subparagraph id="H02DF07C72982423DA271F249C5B405A5"><enum>(D)</enum><text>Retaining or employing a consultant or advisor to further promote or enforce a prohibited diversity, equity, or inclusion practice.</text></subparagraph><subparagraph id="H0BAC48AE80F04AA0A2D3AF6CE4B873C6"><enum>(E)</enum><text>Maintaining a rule, a regulation, a policy, guidance, a guideline, management control, a practice, a requirement, training, education, coursework, or a similar device to further promote or enforce a prohibited diversity, equity, or inclusion practice.</text></subparagraph><subparagraph id="H379593C8C824455BA7D82B7A3782DE20"><enum>(F)</enum><text>Requiring as a condition of employment, as a condition for promotion or advancement, or as a condition for speaking, making a presentation, or submitting written materials, the signing of or assent to a statement, code of conduct, work program, or plan, or similar device that requires assent by the employee that a particular race, color, ethnicity, religion, biological sex, or national origin is inherently or systemically superior or inferior, oppressive or oppressed, or privileged or unprivileged.</text></subparagraph></paragraph><paragraph id="H92EB80BBA9314A82860AF106CC443C97" indent="up1"><enum>(3)</enum><text>The Office shall establish standards that shall—</text><subparagraph id="HB7067525C1AF47298EAB8DE3BE658B35"><enum>(A)</enum><text>apply to the activities of the Office or any other agency under authority delegated under subsection (a);</text></subparagraph><subparagraph id="H7EB4AAFA706844D29662FE6919896929"><enum>(B)</enum><text>prohibit racist behavior and racist training in the Government, as described in paragraph (2) of this subsection;</text></subparagraph><subparagraph id="HAF007592D3B7407A9EB4DCB8F7C1B8B3"><enum>(C)</enum><text>ensure compliance with this subsection;</text></subparagraph><subparagraph id="H882356A7EF6244A89766F95ACC976E12"><enum>(D)</enum><text>ensure compliance with section 717 of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e-16">42 U.S.C. 2000e–16</external-xref>); and</text></subparagraph><subparagraph id="HC8713416B08F498D96D784567A504B72"><enum>(E)</enum><text>be in accordance with the merit system principles under section 2301.</text></subparagraph></paragraph><paragraph id="H6B8659A20B324746AAEC3F8FA61111AB" indent="up1"><enum>(4)</enum><text>The Office shall establish and maintain an oversight program to ensure that activities under any authority delegated under subsection (a)—</text><subparagraph id="H8AD564B832614AE2A34EA72EB9637870"><enum>(A)</enum><text>prohibit racist behavior and racist training in the Government, as described in paragraph (2) of this subsection;</text></subparagraph><subparagraph id="H338D44E04891464F80677BF77552C34D"><enum>(B)</enum><text>ensure compliance with this subsection;</text></subparagraph><subparagraph id="HDFB2CA453A7947EBB292212BE911BDB2"><enum>(C)</enum><text>ensure compliance with section 717 of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e-16">42 U.S.C. 2000e–16</external-xref>); and</text></subparagraph><subparagraph id="HC83655365CD249C6B526F66736009B26" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text>are in accordance with the merit system principles under section 2301.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="HD6330146055B40EDAD2B275EAE50460B"><enum>103.</enum><header>Office of Management and Budget</header><text display-inline="no-display-inline">Not later than 180 days after the date of enactment of this Act, the Director of the Office of Management and Budget shall—</text><paragraph id="HA8A3F2D37C114C22A80ABA35B3053014"><enum>(1)</enum><text>revise all regulations, policies, procedures, manuals, circulars, courses, training, and guidance of the Office of Management and Budget to ensure those regulations, policies, procedures, manuals, circulars, courses, training, and guidance are in compliance and consistent with this Act and the amendments made by this Act; </text></paragraph><paragraph id="H8963209C344E44D9AE1912FBE77D57CD"><enum>(2)</enum><text>rescind all regulations, policies, procedures, manuals, circulars, courses, training, and guidance of the Office of Management and Budget that were promulgated, adopted, or implemented to comply with the Executive orders and memoranda described in section 101(a)(2);</text></paragraph><paragraph id="H1945100210274194AE164D2DBC50DF32"><enum>(3)</enum><text display-inline="yes-display-inline">rescind the version of Circular A–4 of the Office of Management and Budget adopted on November 9, 2023; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HCF437E95F10B44B6A16683275A0B9752"><enum>(4)</enum><text display-inline="yes-display-inline">replace the circular described in paragraph (3) with a version of the circular that—</text><subparagraph id="H66F2C7981CA9496CAACACAD327366D5C"><enum>(A)</enum><text>is identical to or substantially similar to the version of the circular as in effect on November 8, 2023; or</text></subparagraph><subparagraph id="H13DC1854FE4445F489B464B4F5064802"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="H9E8D68DE11E14D6BAB5AAE5C473BB83B"><enum>(i)</enum><text>is—</text><subclause indent="up1" commented="no" display-inline="no-display-inline" id="H4EBB43A7939849588EED5D0E003F1758"><enum>(I)</enum><text>consistent in all respects with this Act;</text></subclause><subclause indent="up1" commented="no" display-inline="no-display-inline" id="HE7F7F632BC51477185FB17EDDBA75BF6"><enum>(II)</enum><text>eliminates all references to diversity, equity and inclusion, racial diversity, racial equity, or racial inclusion unless such references are clearly consistent with—</text><item commented="no" display-inline="no-display-inline" id="H7BD4466C8E944235B24A88728DDAD290"><enum>(aa)</enum><text display-inline="yes-display-inline">equal opportunity principles;</text></item><item commented="no" display-inline="no-display-inline" id="H5FCBB00B02DC4B3C8F4C25D8E0D2CAFD"><enum>(bb)</enum><text display-inline="yes-display-inline">the principles of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000a">42 U.S.C. 2000a et seq.</external-xref>); or</text></item><item commented="no" display-inline="no-display-inline" id="H1A74024989EC45FBB86E891D676680BD"><enum>(cc)</enum><text display-inline="yes-display-inline">equal protection of the law principles; and</text></item></subclause></clause><clause indent="up1" commented="no" display-inline="no-display-inline" id="H53966D6A7C0F4EA68AFB7B30EA1BC91B"><enum>(ii)</enum><text>does not engage in or permit prohibited diversity, equity, or inclusion practices. </text></clause></subparagraph></paragraph></section><section id="H3217DFB3AA6F458989ED5FE359EB5F1A"><enum>104.</enum><header>Prohibited use of funds</header><subsection id="H2080877DB2D64197A8F74D5C32A9DDD9"><enum>(a)</enum><header>Agency defined</header><text display-inline="yes-display-inline">In this chapter, the term <term>agency</term> has the meaning given the term in section 3502 of title 44.</text></subsection><subsection id="H87C3E7086872416D951C0082D380289F"><enum>(b)</enum><header>Stopping racism in the Federal Government</header><paragraph id="HB20E77897A6940B7A516C634BD389C56"><enum>(1)</enum><header>In general</header><text>No Federal funds appropriated or otherwise made available by law shall be used for the purpose of maintaining in any agency an—</text><subparagraph id="HE83AC8C254974C558B7E868CFCEF019B"><enum>(A)</enum><text>office relating to diversity, equity, inclusion, or accessibility; or</text></subparagraph><subparagraph id="H1281126F3191451FB3631A8B1228044A"><enum>(B)</enum><text>a substantially similar office.</text></subparagraph></paragraph><paragraph id="H6BC982A7B14E4B27A074A2D785545744"><enum>(2)</enum><header>Prohibition</header><text>No Federal funds appropriated or otherwise made available by law shall be used for the purposes of—</text><subparagraph id="HEFA03BB098894ABB9D5FB07D82FB3CAC"><enum>(A)</enum><text>maintaining in any agency the Chief Diversity Officers Executive Council or a substantially similar council;</text></subparagraph><subparagraph id="H8683ADCD7CCD435E89320016EC547E5E"><enum>(B)</enum><text>maintaining or employing in any agency a chief diversity officer or a substantially similar officer;</text></subparagraph><subparagraph id="H4E5904E1FE69455A8D29D02900D7707D"><enum>(C)</enum><text>subject to paragraph (3), developing, implementing, distributing, or publishing in any agency—</text><clause commented="no" display-inline="no-display-inline" id="H82F732FFC89B45E29593161EFB9A2AE7"><enum>(i)</enum><text display-inline="yes-display-inline">plans, strategic plan, reports, or surveys relating to diversity, equity, inclusion, and accessibility;</text></clause><clause commented="no" display-inline="no-display-inline" id="H3CC863E0055B4FDA8C02011377F03026"><enum>(ii)</enum><text display-inline="yes-display-inline">action plans, reports, or surveys relating to equity or substantially similar plans, reports, or surveys;</text></clause></subparagraph><subparagraph id="H848C4DAFB13745B0B7964CA3B8BE1A82"><enum>(D)</enum><text>developing, implementing, or maintaining in any agency an employee resource group or an affinity group based on race, color, ethnicity, religion, national origin, sexual orientation, or gender identity;</text></subparagraph><subparagraph id="H020E7EE34876442B9DB27666B48E00D7"><enum>(E)</enum><text>developing, implementing, or maintaining in any agency an agency equity team or a substantially similar team;</text></subparagraph><subparagraph id="H40F15BEFE007451C9C5E3E6637B375FF"><enum>(F)</enum><text>maintaining the White House Environmental Justice Interagency Council or a substantially similar Council;</text></subparagraph><subparagraph id="H9AC5F8D157044A00A3B3DB5114BB72C8"><enum>(G)</enum><text>maintaining the Equitable Data Working Group or substantially similar group;</text></subparagraph><subparagraph id="H8BA2DE4766A04C70ACE3D333DE3DAFAD"><enum>(H)</enum><text>developing, implementing, distributing, publishing, establishing, or purchasing in any agency—</text><clause commented="no" display-inline="no-display-inline" id="H01DCA738A56340FCB0EE10D7973438B9"><enum>(i)</enum><text display-inline="yes-display-inline">a training course relating to—</text><subclause commented="no" display-inline="no-display-inline" id="H977599E2E32044908480C7828D705D5F"><enum>(I)</enum><text display-inline="yes-display-inline">diversity;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="HE213E2C948614EF793BAA06B030BE76C"><enum>(II)</enum><text display-inline="yes-display-inline">equity;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H1FD06DD2FF2E409FA5F29AD451A492F0"><enum>(III)</enum><text display-inline="yes-display-inline">inclusion;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H0DBDDA79127C4462B7BA09DA967F6234"><enum>(IV)</enum><text display-inline="yes-display-inline">a critical theory relating to race, gender, or otherwise; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H09F4A337D6FA4F0C82E88C9ECAE3626C"><enum>(V)</enum><text display-inline="yes-display-inline">intersectionality; or</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="HB89BE93D0AD24376A41F0039258ACD58"><enum>(ii)</enum><text>a training course substantiality similar to a training course described in clause (i);</text></clause></subparagraph><subparagraph id="H28DC3FF0F67B49A9BA1646DB96453012"><enum>(I)</enum><text>developing, implementing, or maintaining in any agency a diversity, equity, inclusion, and accessibility data dashboard or a substantially similar data dashboard;</text></subparagraph><subparagraph id="HF95651C3559E4E699E5099EF65F9DA5B"><enum>(J)</enum><text>maintaining within the Office of Personnel Management a council relating to diversity, equity, inclusion, or accessibility; or</text></subparagraph><subparagraph id="HA4107299AB2648E2A4492F4194DBF0EF"><enum>(K)</enum><text>maintaining or employing in any agency a position relating to diversity, equity, inclusion, or accessibility.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H071343CB38DA4506AB4FD66E15E830D9"><enum>(3)</enum><header>Exception</header><text>The prohibition under paragraph (2)(C) shall not apply to a plan, report, or survey required by law.</text></paragraph><paragraph id="H16D595B139CC4583AC9E0A8F496E48C7"><enum>(4)</enum><header>Rule of construction</header><text>Nothing in this section shall be construed to prevent the maintenance and funding of—</text><subparagraph id="HD473BD5F57DF4208A4592ACEDC6E4148"><enum>(A)</enum><text>Equal Employment Opportunity offices as historically organized and operated; or</text></subparagraph><subparagraph id="H17B5BEF967A74D6590C7CF19911E5EE9"><enum>(B)</enum><text>an office enforcing the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12101">42 U.S.C. 12101 et seq.</external-xref>) or similar programs or offices as historically organized and operated.</text></subparagraph></paragraph></subsection></section><section id="HB2CF7F289D8044EEB2268EF998AC4165"><enum>105.</enum><header>DEI offices closed</header><subsection commented="no" id="H10C2D24A8CC74383AAC8BE6780739B5A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 90 days after date of enactment of this Act, the head of any Federal agency that has an office relating to diversity, equity, inclusion, or accessibility—</text><paragraph commented="no" display-inline="no-display-inline" id="H81289F8D1F3C4E26B85A35FE3175C1E0"><enum>(1)</enum><text display-inline="yes-display-inline">shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="HEF7F8D98FD424B3B88DC7C24DFF1CD7C"><enum>(A)</enum><text display-inline="yes-display-inline">terminate, close, and wind up that office; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H8539B254E4814E0181A20710C997A456"><enum>(B)</enum><text display-inline="yes-display-inline">undertake an appropriate reduction in force; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE9BAEE04102242478B2B59E12FA9B8B5"><enum>(2)</enum><text display-inline="yes-display-inline">may not transfer, reassign, or redesignate any employee or contractor with a position or function that is eliminated by operation of this subsection.</text></paragraph></subsection><subsection id="HFEE8E58E3C3D4C62B6EF5495380895DC"><enum>(b)</enum><header>Application</header><text>Nothing in this section shall be construed to prevent the maintenance and funding of—</text><paragraph id="H6820C2C22796477D8DCB4DFED04A9A2F"><enum>(1)</enum><text>Equal Employment Opportunity offices as historically organized and operated; or</text></paragraph><paragraph id="H365A535653C540EEAF627DA41401BD7B" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>an office enforcing the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12101">42 U.S.C. 12101 et seq.</external-xref>) or similar programs or offices as historically organized and operated.</text></paragraph></subsection></section><section id="H3A9B56800EA6441C83B206192319910F"><enum>106.</enum><header>Prohibited personnel practices</header><subsection id="H49D0FBD178964BDEA828AFE8E3EB070C"><enum>(a)</enum><header>In general</header><text>Section 2302(b) of title 5, United States Code, is amended—</text><paragraph id="H96CF7B6C37924993A4DDBA61CA06439C"><enum>(1)</enum><text>in paragraph (13)(B), by striking <quote>or</quote> at the end;</text></paragraph><paragraph id="H509FFB1217704DA7B1265AD2AE7AAEED"><enum>(2)</enum><text>in paragraph (14), by striking the period at the end and inserting <quote>; or </quote> and</text></paragraph><paragraph id="HF527CEC7FEE745E791B731DC3C7B953E"><enum>(3)</enum><text>by inserting after paragraph (14) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HF1E77BFBFB494C149CC932E2BED10FB5"><paragraph id="HF4A26896C7DB4CDEBC8267C05C5279DA"><enum>(15)</enum><text>take or fail to take, or threaten to take or fail to take, any personnel action against any employee or applicant for employment because of the failure of the employee or applicant to—</text><subparagraph id="H4AAB1FE70C534244B753CB1A92D08603"><enum>(A)</enum><text>complete training with respect to diversity, equity, or inclusion, critical theory (relating to race, gender, or otherwise), intersectionality, sexual orientation or gender identity, or any substantially similar theory or policy;</text></subparagraph><subparagraph id="H504DCFE335C64858A64476DB22D2BAA8"><enum>(B)</enum><text>complete training that asserts or requires trainees to assert that a particular race, color, ethnicity, religion, biological sex, or national origin is inherently or systemically superior or inferior, oppressive or oppressed, or privileged or unprivileged;</text></subparagraph><subparagraph id="H73477A7E36D04D38BF6EC6E5D0D3A01D"><enum>(C)</enum><text>sign or assent to (which may be by executing or acknowledging) a statement, code of conduct, work program, plan, or similar device with respect to diversity, equity, and inclusion, critical theory (relating to race, gender, or otherwise), intersectionality, sexual orientation or gender identity, or any substantially similar theory or policy;</text></subparagraph><subparagraph id="H68C3DDB1A3AC402B8943AB703D22A943"><enum>(D)</enum><text>sign or assent to (which may be by executing or acknowledging) a statement, code of conduct, work program, plan, or similar device that asserts or requires assent by the employee or applicant that a particular race, color, ethnicity, religion, biological sex, or national origin is inherently or systemically superior or inferior, oppressive or oppressed, or privileged or unprivileged;</text></subparagraph><subparagraph id="H407364D74C654EDCA2ACB17AAD1D63C2"><enum>(E)</enum><text>take any other action that would require the treatment of any individual advantageously or disadvantageously on the basis of that individual’s race, color, ethnicity, religion, biological sex, or national origin; or</text></subparagraph><subparagraph id="H54F1A88D425A44E79C9A31210D5F7FB3"><enum>(F)</enum><text>limit, segregate, or classify employees or applicants for employment in any way that would deprive or tend to deprive any individual of an employment opportunity, or otherwise adversely affect the status of the individual as an employee, because of the race, color, ethnicity, religion, biological sex, or national origin of the individual.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H35E7CD2B923E4380A96F027F45556C73"><enum>(b)</enum><header>Performance appraisal systems</header><text>Section 4302 of title 5, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H8CE622DADF744D14A00F53294ACB5F0D"><subsection id="H513DBEE8E1604C7796641BD0B81FA816"><enum>(e)</enum><text>A performance appraisal system may not adversely evaluate an employee for the failure of the employee to—</text><paragraph id="HC72AE5C50BE94A469F9C7D5925386EC9"><enum>(1)</enum><text>complete training with respect to diversity, equity, or inclusion, critical theory (relating to race, gender, or otherwise), intersectionality, sexual orientation or gender identity, or any substantially similar theory or policy;</text></paragraph><paragraph id="H571837C61AC1496EB81532AB43186311"><enum>(2)</enum><text>complete training that asserts or requires trainees to assert that a particular race, color, ethnicity, religion, biological sex, or national origin is inherently or systemically superior or inferior, oppressive or oppressed, or privileged or unprivileged;</text></paragraph><paragraph id="H33E4EBEAADF746B9A97D0127AFFB216A"><enum>(3)</enum><text>sign or assent to (which may be by executing or acknowledging) a statement, code of conduct, work program, plan, or similar device with respect to diversity, equity, and inclusion, critical theory (relating to race, gender, or otherwise), intersectionality, sexual orientation or gender identity, or any substantially similar theory or policy;</text></paragraph><paragraph id="H355F2492296C4CE3A6824B7265443244"><enum>(4)</enum><text>sign or assent to (which may be by executing or acknowledging) a statement, code of conduct, work program, plan, or similar device that asserts or requires assent by the employee that a particular race, color, ethnicity, religion, biological sex, or national origin is inherently or systemically superior or inferior, oppressive or oppressed, or privileged or unprivileged;</text></paragraph><paragraph id="HD628EE797F2B4D6E95C97261884BC05C"><enum>(5)</enum><text>take any other action that would require the treatment of any individual advantageously or disadvantageously on the basis of that individual’s race, color, ethnicity, religion, biological sex, or national origin; or</text></paragraph><paragraph id="HDE5BDD5F86454ADFADE6A3DDAD3F4674"><enum>(6)</enum><text>limit, segregate, or classify employees or applicants for employment in any way that would deprive or tend to deprive any individual of an employment opportunity, or otherwise adversely affect the status of the individual as an employee, because of the race, color, ethnicity, religion, biological sex, or national origin of the individual.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H63C92006AB8A4EB8A6B2D396399F8296"><enum>(c)</enum><header>SES performance appraisal systems</header><text>Section 4312 of title 5, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HB2F1EDCD2B9A449AB38A98827D924800"><subsection id="HB6271B28CC4341F58B092DEE57DFD97B"><enum>(e)</enum><text>A performance appraisal system may not adversely evaluate a senior executive for the failure of the senior executive to—</text><paragraph id="H32B2EF7E54D1410B9108A44459AB2262"><enum>(1)</enum><text>complete training with respect to diversity, equity, or inclusion, critical theory (relating to race, gender, or otherwise), intersectionality, sexual orientation or gender identity, or any substantially similar theory or policy;</text></paragraph><paragraph id="HE2EDBAE1BC72400A81F2BAEF3AD398E3"><enum>(2)</enum><text>complete training that asserts or requires trainees to assert that a particular race, color, ethnicity, religion, biological sex, or national origin is inherently or systemically superior or inferior, oppressive or oppressed, or privileged or unprivileged;</text></paragraph><paragraph id="H290F8F80656D4840AF54BD794D413383"><enum>(3)</enum><text>sign or assent to (which may be by executing or acknowledging) a statement, code of conduct, work program, plan, or similar device with respect to diversity, equity, and inclusion, critical theory (relating to race, gender, or otherwise), intersectionality, sexual orientation or gender identity, or any substantially similar theory or policy;</text></paragraph><paragraph id="H71F352EB3A6840EFA43FAF702D540118"><enum>(4)</enum><text>sign or assent to (which may be by executing or acknowledging) a statement, code of conduct, work program, plan, or similar device that asserts or requires assent by the senior executive that a particular race, color, ethnicity, religion, biological sex, or national origin is inherently or systemically superior or inferior, oppressive or oppressed, or privileged or unprivileged;</text></paragraph><paragraph id="H5CEAC56DF9F046D0A125108F58BC016D"><enum>(5)</enum><text>take any other action that would require the treatment of any individual advantageously or disadvantageously on the basis of that individual’s race, color, ethnicity, religion, biological sex, or national origin; or</text></paragraph><paragraph id="H056B18EA3F4C4202AAF8ABE0A10B3708"><enum>(6)</enum><text>limit, segregate, or classify employees or applicants for employment in any way that would deprive or tend to deprive any individual of an employment opportunity, or otherwise adversely affect the status of the individual as an employee, because of the race, color, ethnicity, religion, biological sex, or national origin of the individual.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></title><title id="HD5346C8407CA458C8E04311B14A3DF8C"><enum>II</enum><header>Federal Training</header><section id="HC69B3F09DB1748B197787BF109465F7C"><enum>201.</enum><header>Government-wide training</header><subsection id="H12F9B5683D0F408CAF22B38DF6816979"><enum>(a)</enum><header>In general</header><text>Section 4103 of title 5, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H679F512C1B204A2FA9858BAD59E28EB6"><subsection id="HBB9246E709AE4678883D46B681E974EC"><enum>(d)</enum><text>No training program or plan may be developed, implemented, distributed, published, established, or purchased under this section—</text><paragraph id="H96A0101230AB4B619274462F7876B784"><enum>(1)</enum><text>with respect to diversity, equity, and inclusion, critical theory (relating to race, gender, or otherwise), intersectionality, sexual orientation or gender identity, or any substantially similar theory or policy; or</text></paragraph><paragraph id="HA9515AF7381F4A5F9782902AB28E99AC"><enum>(2)</enum><text>that asserts or requires the trainees to assert that a particular race, color, ethnicity, religion, biological sex, or national origin is inherently or systemically superior or inferior, oppressive or oppressed, or privileged or unprivileged.</text></paragraph></subsection><subsection id="H87A514304EF748A4B82DB5A4F32DC33B"><enum>(e)</enum><text>No employee may be required to complete training under a program or plan established under this section—</text><paragraph id="HFBAC9ADCC8704E54849788EF81ABAC0E"><enum>(1)</enum><text>with respect to diversity, equity, and inclusion, critical theory (relating to race, gender, or otherwise), intersectionality, sexual orientation or gender identity, or any substantially similar theory or policy; or</text></paragraph><paragraph id="H503CCB2DA9EC4E218726F6F44730B51E"><enum>(2)</enum><text>that asserts or requires the trainees to assert that a particular race, color, ethnicity, religion, biological sex, or national origin is inherently or systemically superior or inferior, oppressive or oppressed, or privileged or unprivileged.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H9BF62CE443AA4F9DB392E0E78DCD2DCD"><enum>(b)</enum><header>Regulations</header><text>Section 4118 of title 5, United States Code, is amended—</text><paragraph id="HFBBFEC848C1B4D6A890DD96B7659F9F5"><enum>(1)</enum><text>in subsection (c), by striking <quote>This section</quote> and inserting <quote>Except as provided in subsection (d), this section</quote>; or</text></paragraph><paragraph id="H8E70A47479A74F208A92FB63CDEC2EDA" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>that asserts or requires the trainees to assert that a particular race, color, ethnicity, religion, biological sex, or national origin is inherently or systemically superior or inferior, oppressive or oppressed, or privileged or unprivileged.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="H5AEBD98EEDCD4C2FA599723218400B7F"><enum>202.</enum><header>Use of funds</header><text display-inline="no-display-inline">No funds appropriated or otherwise made available by law shall be used for the purpose of developing, implementing, distributing, publishing or purchasing in any Federal agency a training course—</text><paragraph commented="no" display-inline="no-display-inline" id="H014C20504F6842728F1A2135AA5DD0AD"><enum>(1)</enum><text display-inline="yes-display-inline">relating to—</text><subparagraph commented="no" display-inline="no-display-inline" id="H21D079E4F5D24758A562A6D688AB1EB9"><enum>(A)</enum><text display-inline="yes-display-inline">diversity, equity, inclusion, and accessibility;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HFFA36DAAEA4B49EEA2AB6E82F7C39E7E"><enum>(B)</enum><text display-inline="yes-display-inline">a critical theory relating to race, gender, or otherwise; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H063A13338A9749DAADDAD8583283BE98"><enum>(C)</enum><text display-inline="yes-display-inline">intersectionality, sexual orientation, or gender identity; id="HFCC5A07B57854CE99542C63D7BCD18C9"><enum>(c)</enum><header>Termination of committee</header><paragraph id="H611FB521965945909CC8A53CE7799F40"><enum>(1)</enum><header>Finding by Administrator</header><text display-inline="yes-display-inline">With respect to an advisory committee, if the Administrator finds that the applicable agency head, chair of the advisory committee, or the advisory committee authorized, permitted, or implemented a prohibited diversity, equity, or inclusion practice, then the advisory committee shall terminate not later than 30 days after the Administrator makes such finding.</text></paragraph><paragraph id="H932CAB0B5D854D2DBEE98533C3E091DD"><enum>(2)</enum><header>Finding by Inspector General</header><text display-inline="yes-display-inline">With respect to an advisory committee, if the Inspector General for the agency that established the advisory committee finds that the applicable agency head, chair of the advisory committee, or the advisory committee authorized, permitted, or implemented a prohibited diversity, equity, or inclusion practice, then the advisory committee shall terminate not later than 30 days after the Inspector General makes such finding.</text></paragraph></subsection><subsection id="H1F3379D6424640A8ACBC110186CAACC6"><enum>(d)</enum><header>Action</header><paragraph id="HECA1156209094137BE8598A295AB669B"><enum>(1)</enum><header>In general</header><text>Any person may bring an action in any United States district court seeking a determination that the Administrator, any agency head, any chair of an advisory committee, or any advisory committee authorized, permitted, or implemented a prohibited diversity, equity, or inclusion practice with respect to an advisory committee.</text></paragraph><paragraph id="HAB8EDDC0D7B3418D8D67485EEC081E61"><enum>(2)</enum><header>Order directing termination of advisory committee</header><text>If after an evidentiary hearing, a court determines that the defendant authorized, permitted, or implemented a prohibited diversity, equity, or inclusion practice, the court shall issue an order directing the Administrator to immediately terminate that advisory committee.</text></paragraph><paragraph id="H502DD350220A4FCE81B30FE33A4D470B"><enum>(3)</enum><header>Additional awards</header><text>In an action brought under this subsection in which the plaintiff prevails, the court may award—</text><subparagraph id="HD912A478FE9245F2A633A0C019C10651"><enum>(A)</enum><text>a Writ of Mandamus or other equitable or declaratory relief;</text></subparagraph><subparagraph id="H4AB0B040CC5944719AE036D6B4DA4DBE"><enum>(B)</enum><text>a minimum of $1,000 per violation per day;</text></subparagraph><subparagraph id="HE3DDA3E4D88247B590D08DAE4E6A6876"><enum>(C)</enum><text>reasonable attorney’s fees and litigation costs;</text></subparagraph><subparagraph id="H5400F99896E34B8DA226BE89488D3BC5"><enum>(D)</enum><text>compensatory damages; and</text></subparagraph><subparagraph id="H4FFAEEBF3C8E474F8774BE4B562E872B"><enum>(E)</enum><text>all other and</text></paragraph><paragraph id="H0D40B9F2174D4BF0B56F4573FA84E7F8"><enum>(2)</enum><text>ensure that the Committee Management Secretariat complies with and enforces the requirements of the <short-title>Dismantle DEI Act of 2024</short-title>.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H77209286A29E49248059EA1D3EBF2484"><enum>(c)</enum><header>Revised rules, regulations and guidance</header><text>Not later than 180 days after the date of enactment of this Act, the Administrator shall ensure that all rules, regulations, policies, guidance, guidelines, management controls, governing documents, practices, requirements, training, education, coursework, or similar devices are revised to the extent that they are inconsistent with this Act.</text></subsection></section><section id="H3520474E4548478FAD63CD599A9E259E"><enum>503.</enum><header>Agency head responsibilities</header><subsection id="HAB62C00BEAF74AECADBA937EAB9F81F3"><enum>(a)</enum><header>Agency head responsibilities</header><text display-inline="yes-display-inline">Subsection (a) of section 1007 of title 5, United States Code, is amended by adding at the end the following: <quote>Each agency head shall establish uniform administrative guidelines and management controls to ensure compliance with the <short-title>Dismantle DEI Act of 2024</short-title>.</quote>. </text></subsection><subsection id="H1F9F7B33A36E4753B7EF9F0F3F927563"><enum>(b)</enum><header>Compliance</header><text display-inline="yes-display-inline">Subsection (b) of section 1007 of title 5, United States Code, is amended—</text><paragraph id="H74C0174938FA4E628E2B6CB590582C54"><enum>(1)</enum><text>in paragraph (2), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="H62E4DFDB9CC14E838770C8ED2224F7F7"><enum>(2)</enum><text>in paragraph (3), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="H8756653DCEE3436FA18468AA0486173C"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="HFB08C638FF10442ABD5C696E114963F4"><paragraph id="H3F6E321DDF494B1F9684D4D4BD9E2CFB"><enum>(10)</enum><text>confirms that the standards for accreditation of the agency or association do not—</text><subparagraph id="HA314EDB0DF92458D94B4EC9CD2AA03E2"><enum>(A)</enum><text>require, encourage, or coerce any institution of higher education to engage in prohibited diversity, equity, and inclusion practices (as defined in section 1201 of the Civil Rights Act of 1964);</text></subparagraph><subparagraph id="H1AAC067582D142EF97CF47DD531C94FE"><enum>(B)</enum><text>assess the commitment of an institution of higher education to any ideology, belief, or viewpoint;</text></subparagraph><subparagraph id="H59000B2F74464E3DA1AA9C83B5FDBECE"><enum>(C)</enum><text>prohibit or discourage an institution of higher education from engaging in activity protected by the Constitution, including having a religious mission, operating as a religious institution, or being controlled by or associated with a religious organization; or</text></subparagraph><subparagraph id="HEBAA1820A1FC4379B5E73EE8C02DC963"><enum>(D)</enum><text>discriminate against an institution of higher education for engaging in religious speech, religious practice, or religious exercise.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H232D70EA0D1F4114B4E284BBB4471136"><enum>602.</enum><header>Prohibited use of funds by the Secretary of Education</header><text display-inline="no-display-inline">Section 8527 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7907">20 U.S.C. 7907</external-xref>) is amended by adding at the end the following:</text><quoted-block id="HE080C936BED245ECA5ED2BA699531CCE" display-inline="no-display-inline" style="OLC"><subsection id="H49C87FDFE89F4624A2C5BB3891FDF283"><enum>(e)</enum><header>Prohibition; Rules of Construction</header><paragraph id="H0C45109BA70E4D8B98269BED57FD9CFC"><enum>(1)</enum><header>Prohibition</header><text display-inline="yes-display-inline">None of the funds provided to the Secretary of Education under this Act may be used by the Secretary, including through a grant, contract, or cooperative agreement, to—</text><subparagraph id="HA7B229B627464D68AC4550C54DFF0033"><enum>(A)</enum><text>maintain an Office of Diversity, Equity, Inclusion, and Accessibility, an Office of Diversity, Equity, and Inclusion, an Office of Diversity and Inclusion, a Diversity Office or a substantially similar office;</text></subparagraph><subparagraph id="HD7FF916FC31741F6B38CADC2D3C5E47B"><enum>(B)</enum><text>maintain or employ a Chief Diversity Officer or substantially similar officer;</text></subparagraph><subparagraph id="H3FA123FA9AEC42D69D133358387B373C"><enum>(C)</enum><text>develop, implement, distribute, publish, or purchase a training course or substantially similar course relating to any of the following—</text><clause display-inline="no-display-inline" id="H6007A3763BD44ED193572D02AE094D74"><enum>(i)</enum><text>diversity, equity, inclusion, and accessibility (DEIA); </text></clause><clause commented="no" id="HDD6CFD0623BC4873B0BE96958441910D"><enum>(ii)</enum><text>diversity, equity, and inclusion;</text></clause><clause commented="no" id="H9A108EEDC73A4C3CB6D2E3340B35F784"><enum>(iii)</enum><text>diversity and inclusion; </text></clause><clause commented="no" id="H622D55552221436C8821E4A8CB8D046D"><enum>(iv)</enum><text>diversity; </text></clause><clause id="HB1A22B7F7593499AB6C137F8236206B3"><enum>(v)</enum><text>critical theory (race, gender, or otherwise);</text></clause><clause id="H47986B87914F4F66B3E7D638F1B23001"><enum>(vi)</enum><text>intersectionality; or</text></clause><clause id="H065A8135E48E49D584E56EDBC65AC6FA"><enum>(vii)</enum><text>sexual orientation or gender identity; or</text></clause></subparagraph><subparagraph id="HB07776ED3EE04CEA904CB156948D8A4C"><enum>(D)</enum><text>develop, implement, distribute, publish, or purchase a training course or substantially similar course that asserts or requires trainees to assert that a particular race, color ethnicity, religion, biological sex, or national origin is inherently or systemically superior, inferior, oppressive or oppressed, privileged or unprivileged.</text></subparagraph></paragraph><paragraph id="H4F9C839EE3634374B0EE679BE99A44FC"><enum>(2)</enum><header>Rules of construction</header><text>Nothing in this section shall be construed to—</text><subparagraph id="HC205E44A760B4A8FA3D2D5C153CBB5C5"><enum>(A)</enum><text>prohibit the maintenance and funding of Equal Employment Opportunity offices or officers, as historically organized and operated;</text></subparagraph><subparagraph id="H9C429D8C1D2148D697C58F55F9DF0790"><enum>(B)</enum><text>prohibit the maintenance and funding of offices enforcing the Americans with Disabilities Act of 1990 or similar programs or offices, as historically organized and operated; or</text></subparagraph><subparagraph id="HEA16F956A6DA4EB58A5079A05FAECAB9" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">impact the use of non-Federal funds by a contractor of the Department of Education or by a grant recipient of funds from the Secretary of Education.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></title><title id="H06C3A1E5C28343ECA72937A8565B17BD"><enum>VII</enum><header>Other Matters</header><section id="H223FB05A5298469B8B3C85A6B3925C87"><enum>701.</enum><header>Fannie Mae, Freddie Mac, Federal Home Loan Banks, and Federal Housing Finance Agency</header><text display-inline="no-display-inline">Section 1319A of the Federal Housing Enterprises Financial Safety and Soundness Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/12/4520">12 U.S.C. 4520</external-xref>) is repealed.</text></section><section id="H50DA74F4639643C1B4B9D2FDE65298E0"><enum>702.</enum><header>Capital markets regulation; and</quote> and inserting a period; and</text></clause><clause id="H2A49536F63184E13A2772527A5D09AF1" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text>by striking paragraph (9). </text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H57F3A9F972F440A386E930B8DE18AB02"><enum>(B)</enum><text display-inline="yes-display-inline">The table of contents for the Dodd-Frank Wall Street Reform and Consumer Protection Act is amended by striking the item relating to section 342.</text></subparagraph></paragraph></subsection><subsection id="H35960EA6C88741C3889D312EAACCAA63" commented="no"><enum>(b)</enum><header>Boards of public companies subject to civil rights act</header><text display-inline="yes-display-inline">Section 701 of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e">42 U.S.C. 2000e</external-xref>) is amended by adding at the end of subsection (f) the following: <quote>The term <quote>employee</quote> includes any person who serves on a board of directors of an issuer that has a registration statement in effect as to a security under the Securities Act of 1933 and is compensated by the issuer.</quote>. </text></subsection><subsection id="H5DBB0B9E0E6442119E3A32938D132F43"><enum>(c)</enum><header>Prohibition on racism</header><text display-inline="yes-display-inline">The Gramm-Leach-Bliley Act (<external-xref legal-doc="usc" parsable-cite="usc/15/6701">15 U.S.C. 6701 et seq.</external-xref>) is amended by inserting after section 503 (<external-xref legal-doc="usc" parsable-cite="usc/15/6803">15 U.S.C. 6803</external-xref>) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H81F423B1ACDC4001AE994A00644D779B"><section commented="no" id="H8392F466AC424167975B3D19AB7A530A"><enum>503A.</enum><header>Prohibited diversity, equity and inclusion practices</header><text display-inline="no-display-inline">No Federal functional regulator shall engage in a prohibited diversity, equity, and inclusion practice (as defined in section 1201 of the Civil Rights Act of 1964) or require (whether by regulation, enforcement action, guidance, examination or otherwise) that any person regulated by the Federal functional regulator engage in a prohibited diversity, equity, and inclusion practice.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H12357CB2CCDB42A7B2C6637D76374A02"><enum>(d)</enum><header>National securities associations</header><text display-inline="yes-display-inline">Section 15A of the Securities Exchange Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/15/78o-3">15 U.S.C. 78o–3</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H33613E2EAC084EF7B0700A0C2E2ADD24"><subsection id="H1622DED7072A434F9F9F2B7A2DEDF5CD"><enum>(o)</enum><header>Prohibited diversity, equity and inclusion practices</header><text display-inline="yes-display-inline">No national securities association shall engage in a prohibited diversity, equity, and inclusion practice (as defined in section 1201 of the Civil Rights Act of 1964) or require (whether by rule, enforcement action, guidance, examination, or otherwise) that any member of the national securities association engage in a prohibited diversity, equity, and inclusion practice.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H3B49B76D28D444D995330A8D9CA09AF3"><enum>(e)</enum><header>Community Development Advisory Board member requirements</header><text>Section 104(d)(2)(G) of the Community Development Banking and Financial Institutions Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/12/4703">12 U.S.C. 4703(d)(2)(G)</external-xref>) is amended, in the matter preceding clause (i), by striking <quote>and racial, ethnic, and gender diversity</quote>. </text></subsection></section><section commented="no" id="H5CC55B0F93534226BA72C2489A65CAB5"><enum>703.</enum><header>Health and Human Services</header><text display-inline="no-display-inline">Section 821 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/296m">42 U.S.C. 296m</external-xref>) is repealed.</text></section><section id="HEBB9A22AD409490EBEF5C1FFBEF59718"><enum>704.</enum><header>Repeal of diversity, equity, and inclusion programs of Department of Defense</header><subsection id="HB797993077DE453A965F6EA700CE72B0"><enum>(a)</enum><header>Repeal of reporting requirements on diversity and inclusion</header><text display-inline="yes-display-inline">Section 113 of title 10, United States Code, is amended—</text><paragraph id="H19B59B99DE7148BD949F454C1608F5F8"><enum>(1)</enum><text>in subsection (c)—</text><subparagraph id="HDE4AC923D343456FA6CB3C81AD41D0E5"><enum>(A)</enum><text>by striking paragraph (2);
