which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name>, and in addition to the Committee on <committee-name committee-id="HII00">Natural Resources</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require the Secretary of Commerce to establish a grant program to foster enhanced coexistence between ocean users and North Atlantic right whales and other large cetacean species.</official-title></form><legis-body id="HA65C0009F7B6416691BAB40ABC43434D" style="OLC"><section id="H3658B90B22CB423689B81FAC1FA3D520" section-type="section-one"><enum>1.</enum><header>North Atlantic right whales and regulations</header><text display-inline="no-display-inline">For the period beginning on the date of the enactment of this section and ending on December 31, 2030, the North Atlantic right whale vessel strike reduction rule contained in section 224.105 of title 50, Code of Federal Regulations, in effect during the fiscal year ending on September 30, 2022, may not be amended, updated, modified, or replaced.</text></section><section id="HF149903E01734AF08BE98E389C78EFAE"><enum>2.</enum><header>North Atlantic right whale and other large cetacean species grant program</header><subsection id="HD107E9279404487296CDF94ECEEEC3EE"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this section, the Secretary shall establish a competitive grant program to award amounts, on an annual basis, to eligible entities for the eligible uses described in subsection (e).</text></subsection><subsection id="HAFA6D0BA57B3473282E164210AB6E823"><enum>(b)</enum><header>Administration</header><text display-inline="yes-display-inline">The Secretary shall enter into a cooperative agreement with the Foundation pursuant to the National Fish and Wildlife Foundation Establishment Act (<external-xref legal-doc="usc" parsable-cite="usc/16/3701">16 U.S.C. 3701 et seq.</external-xref>) for the Foundation to manage and administer the Program.</text></subsection><subsection id="H193130640E164852B4AE5B20C6D2AB16"><enum>(c)</enum><header>Applications</header><text>To be eligible for a grant under the Program, an eligible entity shall submit to the Foundation an application in such form, at such time, and containing such information as the Foundation determines appropriate.</text></subsection><subsection id="HBB4FD122D20B4E1BB812B360134BDD92" commented="no"><enum>(d)</enum><header>Funding</header><paragraph id="H1786C20377AC4B6BB9AF333C2D8BBED6"><enum>(1)</enum><header>In general</header><text>After the Secretary enters into a cooperative agreement with the Foundation under subsection (b)—</text><subparagraph id="H665A4C90A5824795AE35AD406BEA55D0" commented="no"><enum>(A)</enum><text>for each fiscal year, the Secretary shall provide to the Foundation the amounts made available under this section to carry out the Program in an advance payment of the entire amount on October 1, or as soon as practicable thereafter, of each such fiscal year; and</text></subparagraph><subparagraph id="H12BA4799F6B3462396EC0E0598DBFB51" commented="no"><enum>(B)</enum><text>the Foundation shall invest and reinvest excess such amounts for the benefit of the Program.</text></subparagraph></paragraph><paragraph id="H7EFA237E292D466B9215EB959330EDF4"><enum>(2)</enum><header>Application of National Fish and Wildlife Foundation Establishment Act</header><text>Amounts received by the Foundation under this section to carry out the Program shall be subject to the National Fish and Wildlife Foundation Establishment Act (<external-xref legal-doc="usc" parsable-cite="usc/16/3701">16 U.S.C. 3701 et seq.</external-xref>), except for section 10(a) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/16/3709">16 U.S.C. 3709(a)</external-xref>).</text></paragraph></subsection><subsection id="HEC1033E3D7214684A3B3E82721D18FF6"><enum>(e)</enum><header>Eligible uses</header><text>An eligible entity that is awarded a grant under the Program may use such grant to develop, assess, and carry out activities that reduce lethal and sub-lethal interactions between ocean users and North Atlantic right whales and other large cetacean species, including—</text><paragraph id="H65C3B8BE55424425A608BE4A0970CB55"><enum>(1)</enum><text display-inline="yes-display-inline">funding research to identify, deploy, or test innovative avoidance technologies that reduce or eliminate harmful interactions between ocean users and North Atlantic right whales and other large cetacean species;</text></paragraph><paragraph id="H65EF75C992A349788B4175AA94DF2D05"><enum>(2)</enum><text>efforts to enhance awareness of existing North Atlantic right whale management measures and rules;</text></paragraph><paragraph id="H8D6423260CA443F8A6815DCDB5D93CCC"><enum>(3)</enum><text display-inline="yes-display-inline">developing on-the-water approaches to support the coexistence of ocean users and North Atlantic right whales and other large cetacean species;</text></paragraph><paragraph id="H02F8CE2033E8447B8A0C2F73AC50FADF"><enum>(4)</enum><text>funding the expansion of infrastructure and capacity to disseminate management and other relevant information that reduces harmful interactions between ocean users and North Atlantic right whales and other large cetacean species, especially such interactions that can lead to lethal or sub-lethal injury; and</text></paragraph><paragraph id="H550A5F5F6D884C01BD0CF27B6035260C"><enum>(5)</enum><text>other uses the Foundation, in consultation with the Secretary and relevant eligible entities, determines appropriate.</text></paragraph></subsection><subsection id="HB4A29CB37F3A4E6BB110D306D05E1742"><enum>(f)</enum><header>Priority</header><text>In awarding grants under the Program, the Foundation shall give priority to applications—</text><paragraph id="HA9A674D220164599B987A91495C48EB8"><enum>(1)</enum><text display-inline="yes-display-inline">with a substantial likelihood of reducing lethal and sub-lethal interactions between ocean users and North Atlantic right whales and other large cetacean species;</text></paragraph><paragraph id="H0952611A96B64DC59863AB4D354C3ECF"><enum>(2)</enum><text>that include cooperation among ocean users; and</text></paragraph><paragraph id="H0F571A4D25094305AC0129A2D7499F80"><enum>(3)</enum><text>that demonstrate, or have the potential to provide, economic benefits to small businesses reliant upon fishing, tourism, and maritime-related activities based in the United States.</text></paragraph></subsection><subsection id="HBCD93F2D38104A7CB0759059141012D7"><enum>(g)</enum><header>Prohibited uses</header><paragraph id="H3A0A237D85304EAC91A3D5C02646E797"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), an eligible entity that is awarded a grant under the Program may not use such grant to distribute resources to an entity or individual that is not a United States person.</text></paragraph><paragraph id="H1CE1C42D3D1B403D9B2545789D90351C"><enum>(2)</enum><header>Exception</header><text display-inline="yes-display-inline">An eligible entity that is awarded a grant under the Program may use such grant to distribute resources to a partnership that includes an entity or individual that is not a United States person if the resources are distributed directly to a partner in the partnership that is a United States person.</text></paragraph></subsection><subsection id="HD3FA09390A114A059B6C711F55A30B03"><enum>(h)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 2 years after the date of the enactment of this section, and every 2 years thereafter, the Secretary shall submit to the Committee on Natural Resources and the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report regarding the results and effectiveness of projects carried out with a grant awarded under the Program and work carried out pursuant to section 201 of division JJ of the Consolidated Appropriations Act, 2023 (<external-xref legal-doc="usc" parsable-cite="usc/16/1393">16 U.S.C. 1393</external-xref>) and section 11303 of the James M. Inhofe National Defense Authorization Act for Fiscal Year 2023 (<external-xref legal-doc="usc" parsable-cite="usc/16/1391">16 U.S.C. 1391</external-xref>).</text></subsection><subsection id="HDF799A2F2ACA4AD9BDB30E9CAD04CA5A"><enum>(i)</enum><header>Authorization of appropriations</header><paragraph id="H518AAE9F704C4771A9E8CC9D15AC92B7"><enum>(1)</enum><header>In general</header><text>There is authorized to be appropriated to the Secretary to carry out this section $10,000,000, to remain available until expended.</text></paragraph><paragraph id="H28ABF1C89575426BAC8EE29863D30C2D"><enum>(2)</enum><header>Administrative expenses</header><text>Each fiscal year, of the amounts made available to carry out this section under paragraph (1), the Foundation may use not more than 5 percent or $80,000, whichever is greater, of such amounts for the administrative expenses of the Program.</text></paragraph></subsection><subsection id="HC48607AD69944808B2D796C5DAFC8BF6"><enum>(j)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H2D27098FF28B49339DDA04FE9E1B4D1A"><enum>(1)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text><subparagraph id="H79F59F79F8CF44C1AEABC6D5E6FF9E1D"><enum>(A)</enum><text>a State, regional, local, or Tribal government;</text></subparagraph><subparagraph id="H6B92DE0778624DDFB543EE0B308504BF"><enum>(B)</enum><text>a nonprofit organization or research institution with expertise in on-the-water technology for the monitoring or detection of North Atlantic right whales and other large cetacean species;</text></subparagraph><subparagraph id="H7A26BE8177E14268BE1D2CE3B9AF2849"><enum>(C)</enum><text>any individual or entity the Secretary and the Foundation jointly determine appropriate, including ocean users in the fishing, tourism, fishing tackle manufacturing, boating, shipping, marine electronics, ship piloting, vessel towing, and other maritime sectors; and</text></subparagraph><subparagraph id="H75445B70AF454ABAA06EB3BFB590BF53"><enum>(D)</enum><text>a consortium of 2 or more entities described in any of subparagraphs (A) through (C).</text></subparagraph></paragraph><paragraph id="H9522D82DEA3A4EA6AAA75D133D77803C"><enum>(2)</enum><header>Foundation</header><text>The term <term>Foundation</term> means the National Fish and Wildlife Foundation.</text></paragraph><paragraph id="H8A33A73A3E0D42A7A814960E137C6455"><enum>(3)</enum><header>Program</header><text>The term <term>Program</term> means the program established under subsection (a).</text></paragraph><paragraph id="HBE1513A94BCD408290513ABD30ACA215"><enum>(4)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the Secretary of Commerce, acting through the Under Secretary of Commerce for Oceans and Atmosphere.</text></paragraph><paragraph id="HFB784432A82A499086B6244026DD851C"><enum>(5)</enum><header>United States person</header><text>The term <term>United States person</term> has the meaning given the term in <external-xref legal-doc="usc" parsable-cite="usc/26/7701">section 7701(a)(3)</external-xref> of the Internal Revenue Code of 1986.</text></paragraph></subsection></section></legis-body></bill>
