<section id="H8BF45BAA594D4A1BBB2BA8F971895DF8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Humane Transport of Farmed Animals Act</short-title></quote>.</text></section> <section id="HC0ADFD2CE19F4B9FB749F3A892D918EE" section-type="subsequent-section"><enum>2.</enum><header>Transport of animals</header><text display-inline="no-display-inline">Section 80502 of title 49, United States Code, is amended—</text> 
<paragraph id="H87D5B1B009374AF1B6912A74C55B6957"><enum>(1)</enum><text>by redesignating subsection (d) as subsection (f); and</text></paragraph> <paragraph id="H3E95A4053A85479A9FB58CB56BCD58FA"><enum>(2)</enum><text>by inserting after subsection (c) the following: </text> 
<quoted-block style="USC" id="H2247BC51EBCC429FA2C935E5122410E7" display-inline="no-display-inline"> 
<subsection id="H9449972F20EC4B5988EFC1B9DF10B428"><enum>(d)</enum><header>Enforcement</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this subsection, the Secretary of Transportation, in consultation with the Secretary of Agriculture, shall develop a mechanism for conducting investigations or inspections, including the inspection of any vehicle or vessel transporting animals or any written or electronic records associated with such transport of animals, to determine whether any rail carrier, express carrier, or common carrier, a receiver, trustee, or lessee of one of such carriers, or an owner or master of a vessel transporting animals has violated or is violating this section. </text></subsection> <subsection id="H42321168C01B4FDEB0E354E31CED157D"><enum>(e)</enum><header>Additional authority</header><text>To carry out subsection (d), the Secretary of Transportation and the Secretary of Agriculture may promulgate such rules and regulations, and issue such orders or guidance, as are necessary.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H83725FD4AA1C43DDBCDD35D4D6E883AD"><enum>3.</enum><header>Prohibition on interstate movement of certain animals</header><text display-inline="no-display-inline">Section 10406 of the Animal Health Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/7/8305">7 U.S.C. 8305</external-xref>) is amended—</text> <paragraph id="HE1D150A3FA9F4653BC140FD6554E2870"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>The Secretary may prohibit</quote> and inserting the following: </text> 
<quoted-block style="OLC" id="HBD4A2BBA4BA942C7BB0C13D1F275C4D9" display-inline="no-display-inline"> 
<subsection id="HD724ADD3923C4656B54A8FA356611197"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary may prohibit</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> <paragraph id="H6AF8C250E5334D78B3D89C186A930DB7"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>

<subsection id="H681872FE0E7248828793CA58682F064A"><enum>(b)</enum><header>Prohibition</header> 
<paragraph id="H898C20DE85A84F3CA4FF02D91C4F317D"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">No person shall move in interstate commerce livestock that are unfit to travel. </text></paragraph> <paragraph id="HA07C997827974E34A7FB80394EC8CC5F"><enum>(2)</enum><header>Unfit defined</header> <subparagraph id="H3D3F0DDB3CBA405D89A20A8F8AD90D8B"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">For purposes of paragraph (1), the term <term>unfit to travel</term> means, with respect to the movement of livestock, that such livestock are deemed unfit to travel pursuant to Article 7.3.7(3), Chapter 7.3 of the World Organisation for Animal Health’s Terrestrial Animal Health Code, including successive changes.</text></subparagraph> 
<subparagraph id="HBF18AA38EF634E8FA9F9D3B4526407A9"><enum>(B)</enum><header>Inclusions</header><text><italic></italic>Such term includes livestock that—</text> <clause id="H9D782B222D1047FB992A3C502D75BF5D"><enum>(i)</enum><text>are sick, injured, weak, disabled, or fatigued;</text></clause> 
<clause id="H606D82006FB4479DAD2AA378E4542DE3"><enum>(ii)</enum><text>are unable to stand unaided or bear weight on each leg;</text></clause> <clause id="H20ABEFCF0A0C48C7B41DB7DB8FA23187"><enum>(iii)</enum><text>are blind in both eyes;</text></clause> 
<clause id="H1894CE7FCEE24B17BA894B274FC3F6F4"><enum>(iv)</enum><text>cannot be moved without causing additional suffering;</text></clause> <clause id="H7F29DC3C38AD444D829AFDEDB2E6BC85"><enum>(v)</enum><text>are newborn with a navel that has not been fully healed;</text></clause> 
<clause id="HBBF217A9C7D549B7B7E86483DE398EEA"><enum>(vi)</enum><text>are pregnant and that would be in the final 10 percent of their gestation period at the planned time of unloading;</text></clause> <clause id="H3C6F232A8EF24C37AE7A0090D573BBA1"><enum>(vii)</enum><text>have given birth within the previous 48 hours and are traveling without their offspring; or</text></clause> 
<clause id="HEA27847BB807420FA5354A51839BED86"><enum>(viii)</enum><text>have a body condition that would result in poor welfare because of the expected climatic conditions.</text></clause></subparagraph></paragraph> <paragraph id="HC7A79425A0E2478BA31E7A9525A42049"><enum>(3)</enum><header>Exception</header><text display-inline="yes-display-inline">Nothing in this subsection shall be construed to limit the movement in interstate commerce of any livestock for purposes of providing veterinary care to such livestock.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
