R. 8697</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20240611">June 11, 2024</action-date><action-desc><sponsor name-id="S001150">Mr. Schiff</sponsor> (for himself, <cosponsor name-id="W000822">Mrs. Watson Coleman</cosponsor>, <cosponsor name-id="N000147">Ms. Norton</cosponsor>, <cosponsor name-id="M001225">Mr. Mullin</cosponsor>, and <cosponsor name-id="G000598">Mr. Robert Garcia of California</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of Health and Human Services to conduct a demonstration project to test the impact of a guaranteed monthly income on the health of individuals enrolled for medical assistance under the Medicaid program.</official-title></form><legis-body id="HB9E1CCDB2F064663B6DDFF6DBA897846" style="OLC"><section id="H0E56EA183BE5426CBBE350D50AC8E592" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Guaranteed Additional Income for families in Need Act of 2024</short-title></quote> or the <quote><short-title>GAIN Act of 2024</short-title></quote>.</text></section><section id="H37BC0DB1BF064A22856B03C1844FD09C"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following findings:</text><paragraph id="HB9B495C70FE94171909097E1C3AEB730"><enum>(1)</enum><text display-inline="yes-display-inline">Medical research in recent decades has demonstrated the significant impact of income volatility on individuals’ health.</text></paragraph><paragraph id="H69DDD39721734C6DB010F5949294DB93"><enum>(2)</enum><text>Research has found that income volatility can lead to increased incidence of cardiovascular disease, depression and anxiety, and cognitive decline.</text></paragraph><paragraph id="H93879BA36592498891BD88394609C675"><enum>(3)</enum><text>From February 2019 to January 2021, the city of Stockton, California implemented a universal basic income pilot program. Participants reported improved physical, mental, and emotional health as a result of increased financial assistance, according to the final program evaluation published in the Journal of Urban Health.</text></paragraph></section><section id="H66CDF1C5EB244F47AE30DFBF825FE72F"><enum>3.</enum><header>Guaranteed monthly income demonstration project</header><subsection id="HB45D3F55256248ACA6E5EC3ACC6416A4"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary of Health and Human Services (in this section referred to as the <quote>Secretary</quote>) shall conduct a 5-year demonstration project (in this section referred to as the <quote>Project</quote>) under which a participating eligible entity shall provide a guaranteed monthly income to individuals enrolled for medical assistance under the Medicaid program under title XIX of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396">42 U.S.C. 1396 et seq.</external-xref>), and measure the impact of such guaranteed monthly income on the health of such participants.</text></subsection><subsection id="H8629E79161CF4466907E4BBFF114FDDD"><enum>(b)</enum><header>Application</header><text>An eligible entity seeking to participate in the Project under this section shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require, including information with respect to the manner in which such entity will distribute the guaranteed monthly income.</text></subsection><subsection id="H4A73484B6A1847CD8F47EF50DBE3639F"><enum>(c)</enum><header>Project design</header><paragraph id="HA01F1AE854D64EC68A99D03760800594"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall award not less than 10 grants to eligible entities on a competitive basis to provide participants in the Project with a guaranteed monthly income.</text></paragraph><paragraph id="H9D6B2DCF4A964B5792B9EE0EAEFDB7EA"><enum>(2)</enum><header>Option to target subpopulation</header><text>An eligible entity participating in the Project may choose to focus on a particular subpopulation of individuals enrolled for medical assistance under title XIX of the Social Security Act.</text></paragraph><paragraph id="HEE09B0AAB0E943E2B7FB035C736D2F53"><enum>(3)</enum><header>Guaranteed monthly income</header><subparagraph id="H63276476043A4D5E9DFBC182B6249940"><enum>(A)</enum><header>Participant requirements</header><text>To participate in the Project, a participant shall be enrolled for medical assistance under title XIX at the time such participant is selected for participation.</text></subparagraph><subparagraph id="HB24669940941401FB434E88C7D8E16F9"><enum>(B)</enum><header>Distribution of monthly income</header><clause id="H14EDD8B9E0CD4E299BC1A6BFE9EB09A0"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Each participant shall receive a monthly payment, in an amount of not less than $500, as determined by the eligible entity through which such participant is enrolled for participation in the Project.</text></clause><clause id="HF759C297B0AF409FA3731786F04DF424"><enum>(ii)</enum><header>Method of distribution</header><text>Monthly payments made under the Project shall be made by direct deposit or paper check.</text></clause><clause id="H04E4860DF4C14F73B5ADFCFCCE1686AF"><enum>(iii)</enum><header>No tax liability</header><text>Any payments made to a participant under clause (i) shall not be considered income for purposes of the Internal Revenue Code of 1986.</text></clause><clause id="HACDF7686AD3C4EDF8AC386D3DA5E4FC0"><enum>(iv)</enum><header>No conditions on use of payments</header><text display-inline="yes-display-inline">An eligible entity may not put any conditions on how participants spend the monthly payments made under the Project, and the manner in which a participant spends such payments shall not impact the eligibility of such participant to participate in the Project.</text></clause></subparagraph></paragraph><paragraph id="H03D7D845F8C6471B8F9DA54B9069491B"><enum>(4)</enum><header>Limitation on use of funds</header><text>Not more than 20 percent of the total funds awarded to an eligible entity under this section may used for administrative costs incurred by such eligible entity in implementing the Project, or for outreach and education efforts made by such entity with respect to such Project.</text></paragraph></subsection><subsection id="HF8D7416D917941F8BC04034DBBE2D945"><enum>(d)</enum><header>Eligible entity</header><text display-inline="yes-display-inline">For purposes of this subsection, an eligible entity means one of the following entities:</text><paragraph id="H0812A84BEC3A4DB2928043A73E885737"><enum>(1)</enum><text>Any of the following units of local government:</text><subparagraph id="H65A1FC59C973495F9CBCD32D829500B8"><enum>(A)</enum><text display-inline="yes-display-inline">A county.</text></subparagraph><subparagraph id="H0B50ED7A9C7441CABCF83ED30B8F9FB9"><enum>(B)</enum><text>A borough.</text></subparagraph><subparagraph id="H3DF4CFDBF278445EAE5B13C8B661F1D6"><enum>(C)</enum><text>A municipality.</text></subparagraph><subparagraph id="H8EE82304BB3847159F3B353568D10A3A"><enum>(D)</enum><text>A city.</text></subparagraph><subparagraph id="HA513F6E15F8745BEBEDE4BE1D084D8A4"><enum>(E)</enum><text>A town.</text></subparagraph><subparagraph id="HEF2AC7C15C0C48E78E7B4B0DDD62D7C8"><enum>(F)</enum><text>A township.</text></subparagraph><subparagraph id="HA74B89AED4FF40D0A051E4FBF2643AC7"><enum>(G)</enum><text>A parish.</text></subparagraph><subparagraph id="HF2DFC776CC574A2F9FE5BA13E4940F93"><enum>(H)</enum><text>A local public authority, including any public housing agency (as defined in section 3(b) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437">42 U.S.C. 1437(b)</external-xref>).</text></subparagraph><subparagraph id="HE92B683A1445463F91D36A6D1EB8C66F"><enum>(I)</enum><text>A special district.</text></subparagraph><subparagraph id="H5FFCD1FAAF5B430FB8579231104D1E65"><enum>(J)</enum><text>A school district.</text></subparagraph><subparagraph id="H2BBFB839CD2E4892AD6724D416106202"><enum>(K)</enum><text>An intrastate district.</text></subparagraph><subparagraph id="H047F972F9869446DA1472E379E24E85B"><enum>(L)</enum><text>A council of governments, without regard to whether such council is incorporated as a nonprofit corporation under State law.</text></subparagraph><subparagraph id="H8B7FCCA94A9C4B508B2D4675BB761605"><enum>(M)</enum><text>Any other agency or instrumentality of a multi-State, regional, or intra-State or local government.</text></subparagraph></paragraph><paragraph id="HB5F388AC47EC490490448C594AE29795"><enum>(2)</enum><text>An Indian Tribe or Tribal organization (as such terms are defined in section 4 of the Indian Self-Determination and Education Assistance Act).</text></paragraph><paragraph id="H68886D7D3FCB42C48499EA56845FE34C"><enum>(3)</enum><text>A nonprofit organization.</text></paragraph></subsection><subsection id="H05E3B047CAC548198C1BB329BAF51BB4"><enum>(e)</enum><header>Surveys</header><paragraph id="H3DA9CF1E67BC4A34A62378B3CA4050AB"><enum>(1)</enum><header>Baseline survey</header><text>Prior to the first distribution of guaranteed monthly income payment under the Project, each eligible entity shall conduct a baseline survey of the participants receiving such income from such entity that includes—</text><subparagraph id="H39668BE22D4F4B898E175733CFB16262"><enum>(A)</enum><text>the demographic data of each participant, including the age, race, ethnicity, employment status, marital status, income (including individual income and total household income) and number of dependents with respect to such participant; and</text></subparagraph><subparagraph id="H5B3302B35C984497852FCB05459EB873"><enum>(B)</enum><text>the financial circumstances of each participant and the impact of those circumstances on such participant’s mental health and physical health.</text></subparagraph></paragraph><paragraph id="HA83D4F700A1F402990B2D6313B69FAA4"><enum>(2)</enum><header>Ongoing survey</header><text>Not less than 3 times during each calendar year in which an entity is participating in the project under this subsection, each such entity shall survey each participant receiving monthly payments from such entity to determine—</text><subparagraph id="HDA2BF609501540FEAD573228EDDAAE6F"><enum>(A)</enum><text>how the monthly payments are spent, including groceries, rent, utility bills, or other expenses; and</text></subparagraph><subparagraph id="HF780592A676D4B4A86C1BF1E40E5B66C"><enum>(B)</enum><text>the impact, if any, on—</text><clause id="H7E4E293F542B436CAC92A4C176C4846C"><enum>(i)</enum><text>the employment status of each participant;</text></clause><clause id="H780A2450689242A683732037F59F8166"><enum>(ii)</enum><text>the mental health and physical health of each participant;</text></clause><clause id="HC635EE096E654D819AE5CCD5CEF2A0FF"><enum>(iii)</enum><text>the mental health and physical health of the members of each participant’s household; and</text></clause><clause id="HB87F7421701842BA9F75E14E04B948DE"><enum>(iv)</enum><text>the status of each participant’s financial circumstances, including any impact to such participant’s credit score, ability to grow savings, or ability to make financial investments.</text></clause></subparagraph></paragraph><paragraph id="H20B40A28E0634D9CB23E4E70E8F571DB" commented="no"><enum>(3)</enum><header>Guidance</header><text display-inline="yes-display-inline">Prior to the first distribution of guaranteed monthly income payment under the Project, the Secretary shall issue guidance to each eligible entity participating in the Project on conducting the surveys required under this subsection. Such guidance shall include recommendations for how to determine the financial circumstances, mental health, and physical health of a participant for purposes of such surveys.</text></paragraph></subsection><subsection id="H73063FDE2B6E4356A4EE23D0DF82C2AB"><enum>(f)</enum><header>Reports</header><paragraph id="H2266B9A65893431897CBBE28B85F4517"><enum>(1)</enum><header>Reports to Secretary</header><text>Not later than 1 year after the date on which the first guaranteed monthly income funds are distributed in accordance with subsection (c)(3)(B), and annually thereafter, each eligible entity shall submit to the Secretary a report on the Project, including the information collected from the surveys described in subsection (e).</text></paragraph><paragraph id="H78CC7392B1D64380B6B05083DAE47BAD"><enum>(2)</enum><header>Reports to Congress</header><text>Not later than 2 years after the first report is submitted under paragraph (1), and every 2 years thereafter, the Secretary shall submit to Congress a report on the Project, including a year-over-year analysis of the survey data submitted to the Secretary under paragraph (1), and any recommendations with respect to potential legislative action.</text></paragraph></subsection></section></legis-body></bill>
