R. 8692</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20241211">December 11, 2024</action-date><action-desc>Received; read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>AN ACT</legis-type><official-title display="yes">To require that the Amtrak Board of Directors comply with the open meetings requirements of section 552b of title 5, United States Code, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC" id="HF572748B1C6240FF8F21577CCF6C72E7"><pagebreak></pagebreak><section id="H17314A57395E4848AD67F496B8B1B1C4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Amtrak Transparency and Accountability for Passengers and Taxpayers Act</short-title></quote>.</text></section><section id="HD41D43236F64411BB6F4D150DB7B8311"><enum>2.</enum><header>Open meetings</header><text display-inline="no-display-inline">Section 24301(e) of title 49, United States Code, is amended—</text><paragraph id="HCC63D9E9C1224834BBA8F3CF72AE0606"><enum>(1)</enum><text>by striking <quote>Section 552 of title 5, this part</quote> and inserting the following: </text><quoted-block style="USC" id="H5CE87CEA90F14E51BA75234450397589" display-inline="no-display-inline"><paragraph id="HFCA6A20E90864F349322A75389CC8E85"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (3), sections 552 and 552b of title 5, this part</text></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></paragraph><paragraph id="HA2307461ACD54EF6B2002879DDBA53E9"><enum>(2)</enum><text>in the second sentence by striking <quote>Section 552 of title 5, United States Code, applies</quote> and inserting the following: </text><quoted-block style="USC" id="HEA9947813B0941C5BEDFC2FED984853E" display-inline="no-display-inline"><paragraph id="H6A3BE12E66E94BCFA6EFED8E250046ED"><enum>(2)</enum><header>Timing of application</header><text display-inline="yes-display-inline">Except as provided in paragraph (3), sections 552 and 552b of title 5 apply</text></paragraph><after-quoted-block>; and </after-quoted-block></quoted-block></paragraph><paragraph id="H48695A16CE8C4AE2AE8508F5A19CCECC"><enum>(3)</enum><text>by adding at the end the following: </text><quoted-block style="USC" id="H433B0A0E73F8409D932E8889D7DD5431" display-inline="no-display-inline"><paragraph id="H39D1242A9EE34A5A8F7132AF54C9B326"><enum>(3)</enum><header>Scope of application</header><subparagraph id="H989E6A1FD1824E1D8818E766245C969D"><enum>(A)</enum><header>Information</header><text display-inline="yes-display-inline">The requirements of the second sentence of section 552b(b) of title 5 shall not apply to any portion of an Amtrak meeting and subsections (d) and (e) of section 552b of title 5 shall not apply to any information pertaining to any portion of an Amtrak meeting otherwise required by section 552b of title 5 to be disclosed to the public in any case in which Amtrak properly determines that such portion or portions of the meeting or the disclosure of such information is likely to involve—</text><clause id="H7C997890B11143548C32B234D15CC6A7"><enum>(i)</enum><text display-inline="yes-display-inline">contract negotiations, including negotiations for contract procurements and agreements, the disclosure of which would imperil or compromise the competitive position of Amtrak;</text></clause><clause id="H22D4495CDED945CEADE395F264882B32"><enum>(ii)</enum><text display-inline="yes-display-inline">collective bargaining agreements or any terms and conditions that are proposed for inclusion in any collective bargaining agreement, including the negotiation of terms and conditions with employees or representatives of employees of Amtrak; and </text></clause><clause id="HB3C495A754ED40299BEB30C1122FC0F9"><enum>(iii)</enum><text display-inline="yes-display-inline">with respect to any individual who is a prospective officer, employee, or contractor or an officer, employee, or contractor employed or appointed by Amtrak, matters involving the employment, appointment, termination of employment, terms and conditions of employment, evaluation of the performance of, promotion or disciplining of any such individual, unless all such individuals whose rights could be adversely affected request in writing that the matter or matters be discussed at a public meeting.</text></clause></subparagraph><subparagraph id="HC0D28164A5EC4021B84962F61D30479A"><enum>(B)</enum><header>Additional application</header><text display-inline="yes-display-inline">In addition to the information described in subparagraph (B), the information described in section 552b(c) shall apply to Amtrak meetings.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body><attestation><attestation-group><attestation-date date="20241210" chamber="House">Passed the House of Representatives December 10, 2024.</attestation-date><attestor display="yes">Kevin F.
