R. 8689</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20240611">June 11, 2024</action-date><action-desc><sponsor name-id="M001221">Mr. Molinaro</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require Amtrak to publicly disclose certain bonus compensation paid to Amtrak executives, and for other purposes.</official-title></form><legis-body id="HE0A527F0A0DA44809B722FBE42BB16A5" style="OLC"><section id="HDF6B0C68B1284CF890F2D0AEB9B5CBF7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Amtrak Executive Bonus Disclosure Act</short-title></quote>.</text></section><section id="H68C8D432F8B740BF96342379AE0F7882"><enum>2.</enum><header>Public disclosure of taxpayer-assisted executive compensation</header><subsection id="H6270224B84FB4F77BF1BECAA08ED9C11"><enum>(a)</enum><header>Briefing</header><text display-inline="yes-display-inline">Not later than 30 days before Amtrak awards performance-based bonus compensation to an Amtrak executive, Amtrak shall brief the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate on the proposed bonus and the criteria and metrics used to calculate such a bonus.</text></subsection><subsection id="HCF0410C2B7644BF08E661B8959682A0D"><enum>(b)</enum><header>Public disclosure</header><text display-inline="yes-display-inline">Amtrak shall publish in the Federal Register—</text><paragraph id="H8B257DBD90C448A3B685ADE182BA0ADB"><enum>(1)</enum><text>notice of any bonus compensation awarded to an Amtrak executive not later than 30 days after awarding such bonus; and</text></paragraph><paragraph id="H889EC4E142F34C2D883BEB96F4F34A0B"><enum>(2)</enum><text>an explanation of the criteria and metrics used to calculate such bonus.</text></paragraph></subsection><subsection id="H1A4462904A684109B4A73BC8FCFEF5D2"><enum>(c)</enum><header>Amtrak executive defined</header><text display-inline="yes-display-inline">In this section, the term <quote>Amtrak executive</quote> means a full-time employee of Amtrak in a management position, including the following positions:</text><paragraph id="H39F138D8476D498C8E97D44857AFC3CE"><enum>(1)</enum><text>Chief Executive Officer.</text></paragraph><paragraph id="HEDD0B2FE04914F9C82EFE00020355E15"><enum>(2)</enum><text>Executive Vice President and General Counsel and Corporate Secretary.</text></paragraph><paragraph id="HA5EE97BC543F4FA2866A5B27A5A31090"><enum>(3)</enum><text>President.</text></paragraph><paragraph id="H960A504A659C43F99ECC3B9F4218A7CB"><enum>(4)</enum><text>Vice President, Government Affairs, and Corporate Communications.</text></paragraph><paragraph id="HAF1AD9A1332043CB8F7E1DB9881A0232"><enum>(5)</enum><text>Executive Vice President, Capital Delivery.</text></paragraph><paragraph id="HEC2AB0D50B1D4D9E8614062DEC1CD811"><enum>(6)</enum><text>Executive Vice President, Strategy, Planning and Accessibility.</text></paragraph><paragraph id="H9EEFC02EB16C4585814219CEA92AF81B"><enum>(7)</enum><text>Executive Vice President and Chief Safety Officer.</text></paragraph><paragraph id="HB8D07A0CEAD344899231A8815E584D35"><enum>(8)</enum><text>Executive Vice President and Chief Human Resource Officer.</text></paragraph><paragraph id="HB14A9E3F6C3140AB964D0768DD240A87"><enum>(9)</enum><text>Executive Vice President, Service Delivery and Operations.</text></paragraph><paragraph id="HA38B4AA60C454A579BD7E306985AC042"><enum>(10)</enum><text>Executive Vice President and Chief Financial Officer.</text></paragraph><paragraph id="H01C09D117C7C4E81993C7B1E5E0933B2"><enum>(11)</enum><text>Executive Vice President, Digital Technology and Innovation.</text></paragraph><paragraph id="HB9410B7F46284A688F3F48854D3AA613"><enum>(12)</enum><text display-inline="yes-display-inline">Any individual whose duties and responsibilities are substantially similar the personnel listed in paragraphs (1) through (11), or as defined in section 700.2(b) of title 49, Code of Federal Regulations. </text></paragraph></subsection></section></legis-body></bill>
