R. 8687</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20240611">June 11, 2024</action-date><action-desc><sponsor name-id="L000596">Mrs. Luna</sponsor> (for herself and <cosponsor name-id="M001219">Mr. Moylan</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Federal Food, Drug, and Cosmetic Act to deem adulterated food containing certain color additives, and for other purposes.</official-title></form><legis-body id="H495197D6EA93444EBE585050858AD503" style="OLC"><section id="H6E3F3A6AA39345BF93815BE321773BD6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Do or Dye Act</short-title></quote>. </text></section><section id="H1413319EDE8F402A90084438F292B126"><enum>2.</enum><header>Food containing certain color additives deemed adulterated</header><subsection id="HEF7BB91243F44B21A54723BF90BAA92E"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding the listing and certification (or exemption in effect with respect to such certification) of any covered color additive pursuant to section 721 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/379e">21 U.S.C. 379e</external-xref>), effective beginning on the date of this Act—</text><paragraph id="HFE8B10FA2F0948B88B63562538311089"><enum>(1)</enum><text display-inline="yes-display-inline">a covered color additive is deemed unsafe for use in or on food within the meaning of subsection (a) of such section; and</text></paragraph><paragraph id="HAAC3958AC8694753A25F81FD58EFE9B5"><enum>(2)</enum><text display-inline="yes-display-inline">a food that is, or it bears or contains, such a color additive is adulterated within the meaning of section 402(c) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/21/342">21 U.S.C. 342(c)</external-xref>). </text></paragraph></subsection><subsection id="HC0FB384D52E441F8AB3AFCD701616238"><enum>(b)</enum><header>Covered color additive</header><text display-inline="yes-display-inline">In this Act, the term <term>covered color additive</term> means the following color additives (as such term is defined in section 201 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/321">21 U.S.C. 321</external-xref>)):</text><paragraph id="HE1A0B2F1F92E4C77851563553F6662D7"><enum>(1)</enum><text>Red No. 40.</text></paragraph><paragraph id="H5BD9CDBAB7D243C5A2FC55967500627B"><enum>(2)</enum><text>Yellow No. 5.</text></paragraph><paragraph id="H94BD25CAEBC54D4D9653CFB627F78FD2"><enum>(3)</enum><text>Yellow No. 6.</text></paragraph><paragraph id="H28EF43A3E3174F568D821B1D61303264"><enum>(4)</enum><text>Any additive that is substantially similar to the additives specified in paragraphs (1) through (4). </text></paragraph></subsection></section></legis-body></bill>
