which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name>, and in addition to the Committees on <committee-name committee-id="HFA00">Foreign Affairs</committee-name>, and <committee-name committee-id="HIF00">Energy and Commerce</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Defense Production Act of 1950 to provide a process for a member agency of the Committee on Foreign Investment in the United States to request the Committee initiate a unilateral review of a transaction and to require congressional notice when such request is denied, and for other purposes.</official-title></form><legis-body id="HA933155908914D84882761FA1E66927B" style="OLC"><section id="HD9A0959D01A04AD1A8C5AEA2A9D63348" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Foreign Investment Transparency and Accountability Act</short-title></quote>. </text></section><section id="H5D12A3BBF5304921B5CAD657A47D0DFB"><enum>2.</enum><header>Member agency request for review and report on transactions not reviewed</header><text display-inline="no-display-inline">Section 721(b)(1) of the Defense Production Act of 1950 (<external-xref legal-doc="usc" parsable-cite="usc/50/4565">50 U.S.C. 4565(b)(1)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H4A1BD572782F4064A1733B403EF8A563" display-inline="no-display-inline"><subparagraph id="H96C04EFA7A4A4A1F8594DE8AF54D2B6C"><enum>(I)</enum><header>Member agency request for review</header><text display-inline="yes-display-inline">If a member agency of the Committee wishes the Committee to initiate a review of a transaction pursuant to subparagraph (D), the head of the agency shall notify the Committee of such request and certify to the Committee that the transaction is a covered transaction described under subparagraph (D).</text></subparagraph><subparagraph id="H63F50CE2E9B542C58DEC255FEF83EA7F"><enum>(J)</enum><header>Notification if no review is initiated</header><clause id="H55932A60879E4F68A653B5ECB61BF9C6"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">If the Committee considers a transaction (including a transaction described in a notice received under subparagraph (I)) and does not initiate a review of the transaction, the Committee shall issue a public notice to the appropriate congressional committees containing—</text><subclause id="HE0D6AFE67E2A4C0B8818BF401BC7C263"><enum>(I)</enum><text display-inline="yes-display-inline">a description of the transaction, including whether the transaction was described in a notice received under subparagraph (I);</text></subclause><subclause id="H566F25321EB549DB9F924E93040BC777"><enum>(II)</enum><text>a statement that the Committee does not plan to initiate a review of the transaction; and</text></subclause><subclause id="HA86330DC7CCE461EBA8D7FAC9A10117D"><enum>(III)</enum><text>a statement of whether or not the Committee determined the transaction was a covered transaction described under subparagraph (D) and, if not, any legislative recommendations of the Committee to make the transaction a covered transaction, if the Committee determines such a change would improve national security.</text></subclause></clause><clause id="H6CA35DAF8A9C42DBB6F0E92E2DA70E15"><enum>(ii)</enum><header>Classified annex</header><text display-inline="yes-display-inline">The notice described under clause (i) shall contain a classified annex, which shall contain the names of the parties to the transaction, as well as any other classified or business confidential information related to the transaction. </text></clause><clause id="H1EC18B8E62F147BCBC1439F28B5320A8"><enum>(iii)</enum><header>Appropriate congressional committees</header><text display-inline="yes-display-inline">In this subparagraph, the term <quote>appropriate congressional committees</quote> means the Committee on Financial Services and the Subcommittee on Financial Services and General Government of the Committee on Appropriations of the House of Representatives and the Committee on Banking, Housing, and Urban Affairs and the Subcommittee on Financial Services and General Government of the Committee on Appropriations of the Senate.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
