R. 8631</legis-num><associated-doc role="report" display="yes">[Report No. 118–633]</associated-doc><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20240605">June 5, 2024</action-date><action-desc><sponsor name-id="G000593">Mr. Gimenez</sponsor> (for himself, <cosponsor name-id="G000590">Mr. Green of Tennessee</cosponsor>, <cosponsor name-id="M001194">Mr. Moolenaar</cosponsor>, and <cosponsor name-id="P000048">Mr. Pfluger</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HHM00">Committee on Homeland Security</committee-name></action-desc></action><action display="yes"><action-date date="20240823">August 23, 2024</action-date><action-desc>Additional sponsor: <cosponsor name-id="M001204">Mr. Meuser</cosponsor></action-desc></action><action display="yes"><action-date date="20240823">August 23, 2024</action-date><action-desc>Reported with an amendment, committed to the Committee of the Whole House on the State of the Union, and ordered to be printed</action-desc><action-instruction>Strike out all after the enacting clause and insert the part printed in italic</action-instruction><action-instruction>For text of introduced bill, see copy of bill as introduced on June 5, 2024</action-instruction></action><action><action-desc><pagebreak></pagebreak></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit the Secretary of Homeland Security from procuring certain foreign-made batteries, and for other purposes.<pagebreak></pagebreak></official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" changed="added" style="OLC" committee-id="HHM00" reported-display-style="italic" id="H312D033F8C6C4EEB8F5C3A0C09FAF492"><section id="H3564C60A8294441C9F40BD0D23E91B2D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Decoupling from Foreign Adversarial Battery Dependence Act</short-title></quote>. </text></section><section id="HD54F26EDD345419FB0B9A9C38A5352AC"><enum>2.</enum><header>Prohibition on availability of funds for procurement of certain batteries</header><subsection id="HE7017094464E4D6487118CFA1AB0B383"><enum>(a)</enum><header>In general</header><text>Beginning on October 1, 2027, none of the funds authorized to be appropriated or otherwise made available for the Department of Homeland Security may be obligated to procure a battery produced by an entity specified in subsection (b).</text></subsection><subsection id="H1B66D7538ED74614BDE27F9BFA9BD35B"><enum>(b)</enum><header>Entities specified</header><text>The entities specified in this subsection are the following:</text><paragraph id="H2EFBC86CB47E4C63B4A7B37BAAC1D38B"><enum>(1)</enum><text>Contemporary Amperex Technology Company, Limited (also known as <quote>CATL</quote>).</text></paragraph><paragraph id="HBAA85F43CCD74B0EB1AE1B37247F8C64"><enum>(2)</enum><text>BYD Company, Limited.</text></paragraph><paragraph id="H402A58B7FF124B22ADF7AB47EFCA7174"><enum>(3)</enum><text>Envision Energy, Limited.</text></paragraph><paragraph id="H8DED74D6574545E09FAA2FE10C44C8C0"><enum>(4)</enum><text>EVE Energy Company, Limited.</text></paragraph><paragraph id="H6800735F52B446D5BC32E3BE3068D2A1"><enum>(5)</enum><text>Gotion High tech Company, Limited.</text></paragraph><paragraph id="H0EA5FF00E669412B8A72CE589B134CDF"><enum>(6)</enum><text>Hithium Energy Storage Technology company, Limited.</text></paragraph><paragraph id="H406B3624F8C545F79049404C37898BF6"><enum>(7)</enum><text>Any entity on any list required under clauses (i), (ii), (iv), or (v) of section 2(d)(2)(B) of <external-xref legal-doc="public-law" parsable-cite="pl/117/78">Public Law 117–78</external-xref> (commonly referred to as the <quote>Uyghur Forced Labor Prevention Act</quote>).</text></paragraph><paragraph id="H5C34DF15E66D4C7BB9EC50D7F2E069AC"><enum>(8)</enum><text>Any entity identified by the Secretary of Defense as a Chinese military company pursuant to section 1260H of the William M. (Mac) Thornberry National Defense Authorization Act for Fiscal Year 2021 (<external-xref legal-doc="usc" parsable-cite="usc/10/113">10 U.S.C. 113</external-xref> note).</text></paragraph><paragraph id="H46B4AFC7ACBC4037A3A32D4C714A9E74"><enum>(9)</enum><text>Any entity included in Supplement No. 4 to part 744 of title 15, Code of Federal Regulations, or any successor regulation.</text></paragraph><paragraph id="HC23AE018B9B7474D9BE97105791E226E"><enum>(10)</enum><text>Any subsidiary or successor to an entity specified in paragraphs (1) through (9).</text></paragraph></subsection><subsection id="HA5D9A42B51BA462EA25017E4C4019BAF"><enum>(c)</enum><header>Treatment of production</header><text>For purposes of this section, a battery shall be treated as produced by an entity specified in subsection (b) if such entity—</text><paragraph id="H53D4C3507C814DD4B6C6BAD67089041D" commented="no"><enum>(1)</enum><text>assembles or manufactures the final product that uses such battery; or</text></paragraph><paragraph id="H009E76A2C5AE4533B9998BEF16B91227"><enum>(2)</enum><text display-inline="yes-display-inline">creates or otherwise provides a majority of the components used in such battery.</text></paragraph></subsection><subsection id="HF5A3CE02A8E94333A5EF6ABC4DE91578"><enum>(d)</enum><header>Waivers</header><paragraph id="H5F09DFBDC7454F96A6D0A8C34181ECC6" commented="no"><enum>(1)</enum><header>Relating to assessment</header><text>The Secretary of Homeland Security may waive the limitation under subsection (a) if the Secretary assesses in the affirmative all of the following:</text><subparagraph id="H5CBEB81D0D8A4F85BA62B83FAC8B3964" commented="no"><enum>(A)</enum><text>The batteries to be procured do not pose a national security, data, or infrastructure risk to the United States.</text></subparagraph><subparagraph id="H62DAFDCDA6204561B1C7F95811E7FCF8" commented="no"><enum>(B)</enum><text>There is no available alternative to procure batteries that are—</text><clause id="HA8F21394877B4824912D5C1F9C9058B0" commented="no"><enum>(i)</enum><text>of similar or better cost and quality; and</text></clause><clause id="H6CF63EAF913847D6B95BF20E6FA2C7C6" commented="no"><enum>(ii)</enum><text>produced by an entity not specified in subsection (b).</text></clause></subparagraph></paragraph><paragraph id="H4EFA58B8CC564FF4A4D6ABC65C7D302F"><enum>(2)</enum><header>Relating to research</header><text display-inline="yes-display-inline">The Secretary of Homeland Security may waive the limitation under subsection (a) if the Secretary determines that the batteries to be procured are for the sole purpose of research, evaluation, training, testing, or analysis</text></paragraph><paragraph id="HD1AB2D6046AE43F5A8F2CDA155819701" commented="no"><enum>(3)</enum><header>Congressional notification</header><text display-inline="yes-display-inline">Not later than 15 days after granting a waiver under this subsection, the Secretary of Homeland Security shall submit to the Committee on Homeland Security of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate a notification relating thereto.</text></paragraph></subsection><subsection id="H4F8D218528CF4E7A931E807CB73D663A"><enum>(e)</enum><header>Report</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary of Homeland Security shall submit to the Committee on Homeland Security of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate a report on the anticipated impacts on mission and costs on the Department of Homeland Security associated with carrying out this section, including with respect to following components of the Department:</text><paragraph id="H277EAB664BC2406987C2B263A5DFF841"><enum>(1)</enum><text>U.S. Customs and Border Protection, including the U.S. Border Patrol.</text></paragraph><paragraph id="HAF568C87CE094C5F81A5E08A73E53354"><enum>(2)</enum><text>U.S. Immigration and Customs Enforcement, including Homeland Security Investigations.</text></paragraph><paragraph id="H29D9664E4C5242DF879C595D7FC9DCF9"><enum>(3)</enum><text>The United States Secret Service.</text></paragraph><paragraph id="H6B1051CEB75B456486359CCB94C9B670"><enum>(4)</enum><text>The Transportation Security Administration.</text></paragraph><paragraph id="H7B027231FA384D36B5EF86284F034DE8"><enum>(5)</enum><text>The United States Coast Guard.</text></paragraph><paragraph id="HF766E4E5E6094E67810112D76E04AC76"><enum>(6)</enum><text>The Federal Protective Service.</text></paragraph><paragraph id="H143D9FADA1B0498998DA70187DAC6B0C"><enum>(7)</enum><text>The Federal Emergency Management Agency.</text></paragraph><paragraph id="H8D2F53F7A7D94310A7655F81C081F3FC"><enum>(8)</enum><text>The Federal Law Enforcement Training Centers.</text></paragraph><paragraph id="H72B0C44ADFA64B21A95F6C351A5D42E3"><enum>(9)</enum><text>The Cybersecurity and Infrastructure Security Agency.</text></paragraph></subsection></section></legis-body><endorsement display="yes"><action-date date="20240823">August 23, 2024</action-date><action-desc>Reported with an amendment, committed to the Committee of the Whole House on the State of the Union, and ordered to be printed</action-desc></endorsement></bill>
