which was referred to the <committee-name committee-id="HHM00">Committee on Homeland Security</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit the Secretary of Homeland Security from procuring certain foreign-made batteries, and for other purposes.</official-title></form><legis-body id="HABEDE380AEEB4BC090B095605966789C" style="OLC"><section id="H952D0768A423491882993C4DD99C13DD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Decoupling from Foreign Adversarial Battery Dependence Act of 2024</short-title></quote>. </text></section><section id="HA0734C28302940CE9BEFDA44B047A44F"><enum>2.</enum><header>Prohibition on availability of funds for procurement of certain batteries</header><subsection id="H06AD21FA262A401C88E444713FAC26F1"><enum>(a)</enum><header>In general</header><text>Beginning on October 1, 2027, none of the funds authorized to be appropriated or otherwise made available for the Department of Homeland Security may be obligated to procure a battery produced by an entity specified in subsection (b).</text></subsection><subsection id="HEAE4A5561194446C82C96303A9CB3BB2"><enum>(b)</enum><header>Entities specified</header><text>The entities specified in this subsection are the following:</text><paragraph id="H36DB0E74C9094516AA9BE98A4B2CBF6D"><enum>(1)</enum><text>Contemporary Amperex Technology Company, Limited (also known as <quote>CATL</quote>).</text></paragraph><paragraph id="H964CC42AA83E415F8F9CAE1AC8BD180B"><enum>(2)</enum><text>BYD Company, Limited.</text></paragraph><paragraph id="H912C3143C9044DFCA9EB574BCED4DB7E"><enum>(3)</enum><text>Envision Energy, Limited.</text></paragraph><paragraph id="H8A41DBCABD2F430DB1691CFD2CB3567E"><enum>(4)</enum><text>EVE Energy Company, Limited.</text></paragraph><paragraph id="H71A38E165BB7443297D2784B865C2557"><enum>(5)</enum><text>Gotion High tech Company, Limited.</text></paragraph><paragraph id="H761BDBF95422401FADC3E800F8460740"><enum>(6)</enum><text>Hithium Energy Storage Technology company, Limited.</text></paragraph><paragraph id="HADD620C584F84812854F6E57209839EC"><enum>(7)</enum><text>Any successor to an entity specified in paragraphs (1) through (6).</text></paragraph></subsection><subsection id="H5892B8D66CAE4F1FBD0B63D8588CA2A8"><enum>(c)</enum><header>Treatment of production</header><text>For purposes of this section, a battery shall be treated as produced by an entity specified in subsection (b) if such entity—</text><paragraph id="HAEA9E492D5C8498B93EFC681B73D4C0F" commented="no"><enum>(1)</enum><text>assembles or manufactures the final product that uses such battery; or</text></paragraph><paragraph id="H1046E4AE0F3542C39E08D89AEAD331D8"><enum>(2)</enum><text display-inline="yes-display-inline">creates or otherwise provides a majority of the components used in such battery.</text></paragraph></subsection><subsection id="H9D66955DB8C44E7A92AACC88074B4007"><enum>(d)</enum><header>Waivers</header><paragraph id="H73FEC2F3130B4DDE9DFCC322E0F95D8F" commented="no"><enum>(1)</enum><header>Relating to assessment</header><text>The Secretary of Homeland Security may waive the limitation under subsection (a) if the Secretary assesses in the affirmative all of the following:</text><subparagraph id="H4027F1021A9A4870BF526D7C5BB619FE" commented="no"><enum>(A)</enum><text>The batteries to be procured do not pose a national security, data, or infrastructure risk to the United States.</text></subparagraph><subparagraph id="HB096F5249B68497F96738114B28EBEB1" commented="no"><enum>(B)</enum><text>The entity that produced such batteries does not satisfy the criteria for listing under—</text><clause id="HF083054BF8DC4EC9A7AD8F466BCABDE8" commented="no"><enum>(i)</enum><text>section 1260H of the National Defense Authorization Act for Fiscal Year 2021 (<external-xref legal-doc="usc" parsable-cite="usc/10/113">10 U.S.C. 113</external-xref> note); or</text></clause><clause id="HEE3851FBC25E43108B2CCDF12D370940" commented="no"><enum>(ii)</enum><text>Public Law 117–78 (commonly referred to as the <quote>Uyghur Forced Labor Prevention Act</quote>).</text></clause></subparagraph><subparagraph id="HC65FD1C4C1F0426B8F65234FD06C935F" commented="no"><enum>(C)</enum><text>There is no available alternative to procure batteries that are—</text><clause id="H7C2A91FBAE0B4AF4A236C1EC885DBC65" commented="no"><enum>(i)</enum><text>of similar or better cost and quality; and</text></clause><clause id="H66AC05BD258F451C94D318C3A2D30FA5" commented="no"><enum>(ii)</enum><text>produced by an entity not specified in subsection (b).</text></clause></subparagraph></paragraph><paragraph id="H3FC3CD2381A54A2EBCAA3053643B4EAF"><enum>(2)</enum><header>Relating to research</header><text display-inline="yes-display-inline">The Secretary of Homeland Security may waive the limitation under subsection (a) if the Secretary determines that the batteries to be procured are for the sole purpose of research, evaluation, training, testing, or analysis</text></paragraph><paragraph id="H5550FA1E0D1B4A1E8F826BA9F80242C2" commented="no"><enum>(3)</enum><header>Congressional notification</header><text display-inline="yes-display-inline">Not later than 15 days after granting a waiver under this subsection, the Secretary of Homeland Security shall submit to the Committee on Homeland Security of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate a notification relating thereto.</text></paragraph></subsection></section></legis-body></bill>
