which was referred to the <committee-name committee-id="HVR00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 38, United States Code, to modify certain requirements relating to the recovery by the Department of Veterans Affairs of overpayments made to eligible persons or veterans relating to educational assistance under the laws administered by the Secretary of Veterans Affairs, and for other purposes.</official-title></form><legis-body id="H8FE3EF0D569443E4919103D3B803F584" style="OLC"><section id="H3F955C243E784B9B8C143A28405903AB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Student Veteran Debt Relief Act of 2024</short-title></quote>.</text></section><section id="H1BA08D87C50D435D99A886FB1B3E75C5"><enum>2.</enum><header>Overpayments to eligible persons or veterans</header><text display-inline="no-display-inline">Section 3685 of title 38, United States Code, is amended by adding at the end the following new subsections:</text><quoted-block style="USC" id="H3741C5F0B22B453996C1FACC8A7495EA" display-inline="no-display-inline"><subsection id="H9752C37ED6B24CA8807286876C5BFBE9"><enum>(f)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H0D1B0502CC3040268F0C469837A07EFA"><enum>(1)</enum><text display-inline="yes-display-inline">If the Secretary finds that an overpayment has been made to a veteran or eligible person relating to educational assistance under a law administered by the Secretary, the overpayment shall not constitute a liability for the veteran, eligible person, or educational institution if the veteran, eligible person, or educational institution demonstrates to the Secretary that—</text><subparagraph id="H451E7FB2E5E1448290BF088464A0B833" indent="up1"><enum>(A)</enum><text>the Department made an error with respect to the eligibility of the veteran or eligible person for educational assistance under the laws administered by the Secretary; or</text></subparagraph><subparagraph id="H3726C21F589C4C93B12EF94B4663A1DF" indent="up1"><enum>(B)</enum><text>the Department of Defense provided incorrect information to the Department of Veterans Affairs with respect to the eligibility of the veteran or eligible person for educational assistance under such laws.</text></subparagraph></paragraph><paragraph id="H39A0D343258740D98F37E7728F067719" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HD6F2D4347C3940D8B538DEC952A6B1C7"><enum>(A)</enum><text>If the Secretary finds that an overpayment has been made to a veteran or eligible person relating to educational assistance under a law administered by the Secretary and determines, in consultation with an educational institution where the veteran or eligible person is pursuing a course or program of education using such assistance, that liability for the overpayment would be likely to result in the inability of the veteran or eligible person to continue pursuit of the course or program, the Secretary shall—</text><clause id="H0F3FA70DD3934E61B6C7931A3A5338D0" indent="up1"><enum>(i)</enum><text>review the liability to determine if the liability is eligible for a hardship waiver; and</text></clause><clause id="H2EDD12B5B78E4AD2B33B733EA5E7D63B" indent="up1"><enum>(ii)</enum><text>if the liability is not eligible, make an attempt to recover the overpayment from the veteran or eligible person.</text></clause></subparagraph><subparagraph id="H91B5D96EEA8D4E5983D1B71DE1913F93" indent="up1"><enum>(B)</enum><text>If the Secretary is unable to recover an overpayment from a veteran or eligible person under subparagraph (A)(ii), the Secretary shall—</text><clause id="H7D5095C6BA9D4478931D9ABB9D4C4AA1"><enum>(i)</enum><text>provide to the Under Secretary for Benefits evidence of the attempt to recover the overpayment; and</text></clause><clause id="H76CD5ED4102D42D3ADCE7AD30AE4E145"><enum>(ii)</enum><text>establish with the veteran or eligible person a payment plan under which the veteran or eligible person agrees to repay the amount of the overpayment to the Secretary.</text></clause></subparagraph></paragraph></subsection><subsection id="HEAD10790A6A44A26BF95B5A02A4D1134"><enum>(g)</enum><text>The Secretary may not recover an overpayment under this section unless—</text><paragraph id="HB9FBF345F6B841C68DDAB5876399A1E2"><enum>(1)</enum><text>the overpayment occurs and is identified on or after January 5, 2021; and</text></paragraph><paragraph id="HDBFBCB88244F4EE39B22FE945E1900BC"><enum>(2)</enum><text>the overpayment is identified, and the educational institution is notified of the overpayment, not more than ten years after the overpayment occurs.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
