R. 8621</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20240605">June 5, 2024</action-date><action-desc><sponsor name-id="B001298">Mr. Bacon</sponsor> (for himself, <cosponsor name-id="C001080">Ms. Chu</cosponsor>, <cosponsor name-id="K000380">Mr. Kildee</cosponsor>, <cosponsor name-id="C001053">Mr. Cole</cosponsor>, and <cosponsor name-id="D000629">Ms. Davids of Kansas</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend part B of title IV of the Social Security Act to support State implementation of Federal standards established under the Indian Child Welfare Act of 1978.</official-title></form><legis-body id="H8ED9B96711D54E2B9FDA7B46EAD7311A" style="OLC"><section id="HD14CEE992C2849BBA3CA13B9FD6A2748" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Strengthening Tribal Families Act of 2024</short-title></quote>.</text></section><section id="H0DA4A41E1020491BAD1FD1465BDAC3F0"><enum>2.</enum><header>Effective implementation of the Indian Child Welfare Act of <enum-in-header>1978</enum-in-header></header><text display-inline="no-display-inline">Subpart 1 of part B of title IV of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/621">42 U.S.C. 621 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block id="H532122E3B8F94472A77290E5BF26F63B" style="OLC"><section id="H8193339FFE9E4AB1B83096C3F3C555D6"><enum>429B.</enum><header>Effective implementation of the Indian Child Welfare Act of <enum-in-header>1978</enum-in-header></header><subsection id="H5B3097055D7B4EF0968608BCDBA0DCD9"><enum>(a)</enum><header>In general</header><text>Not later than January 1, 2025, the Secretary, in consultation with Indian tribal organizations and States, shall develop a plan and provide technical assistance supporting effective implementation of the Indian Child Welfare Act of 1978, including specific measures identified in State plans as required by section 422(b)(9) of this Act. The technical assistance plan shall be based upon data sufficient to assess State strengths and areas for improvement in implementing Federal standards established under the Indian Child Welfare Act of 1978, including, at a minimum, the following:</text><paragraph id="HE8B6FB2B51B94440B845E93E92EF8457"><enum>(1)</enum><text>Timely identification of Indian children and extended family members.</text></paragraph><paragraph id="H328E366CBCF745A599BE01F54D08B877"><enum>(2)</enum><text>Timely tribal notice of State child custody proceedings.</text></paragraph><paragraph id="H250B95C0C9F84671897CBBC5A53EB4E8"><enum>(3)</enum><text>Reports of cases in which a transfer of jurisdiction (as defined under the Indian Child Welfare Act of 1978) was granted or was not granted, and reasons specified for denial in cases where transfer was denied.</text></paragraph><paragraph id="HD083DFB42F314A6B80C2144C9E38DCA9"><enum>(4)</enum><text display-inline="yes-display-inline">In cases in which a State court orders a foster care placement, whether requirements for active efforts to prevent the breakup of the Indian family, testimony of a qualified expert witness, and evidentiary standards were met.</text></paragraph><paragraph id="H2F83A7165E9A48719F3FCA2AEE510E1A"><enum>(5)</enum><text display-inline="yes-display-inline">Whether an Indian child was placed in a placement that is required to be preferred under the Indian Child Welfare Act of 1978, and if not, the reasons specified.</text></paragraph><paragraph id="HA64A229079BB47238D0E863B1E15D949"><enum>(6)</enum><text display-inline="yes-display-inline">In cases in which a State court orders the termination of parental rights, whether requirements for active efforts to prevent the breakup of the Indian family, testimony of a qualified expert witness, and evidentiary standards were met.</text></paragraph></subsection><subsection id="H1A69F391958F4E99BEE9B875D62DF645"><enum>(b)</enum><header>Interagency coordination</header><text>On request of the Secretary, the Secretary of the Interior shall provide the Secretary with such guidance and assistance as may be necessary to facilitate informing States and public child welfare agencies on how to comply with the Indian Child Welfare Act of 1978, including specific measures identified in State plans as required by section 422(b)(9) of this Act.</text></subsection><subsection id="HC3022BACA15D41F992235EF253EAE539"><enum>(c)</enum><header>Biennial reports to Congress</header><text>The Secretary shall biennially submit to the Committee on Ways and Means of the House of Representatives and the Committee on Finance of the Senate a written report on how—</text><paragraph id="HFB8DBD431E8D4CDABA9DEFF71703EFE1"><enum>(1)</enum><text display-inline="yes-display-inline">the States are complying with the Indian Child Welfare Act of 1978, as required by section 422(b)(9) of this Act; and</text></paragraph><paragraph id="HE3D0C19FA95747E387658E6A74720D0D"><enum>(2)</enum><text>the Secretary is assisting States and Indian Tribes to improve implementation of Federal standards established under the Indian Child Welfare Act of 1978.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
